I have sen this officer before he appeared on one of DJ Audit's vid he comes across as an expert on drones. This was still a stop and account officers have no power to detain. It is not like driving a car. In my opinion ( b) must be in place before he can asked for it. What made it suspect that you did not have the correct documentation. Now he know that you were an Auditor.(1)A constable may exercise the power conferred by this paragraph in relation to a person (P) if the constable-
(a)has reasonable grounds for believing that-
(i)a flight by an unmanned aircraft is taking place or has taken place, and
(ii)P is or was the remote pilot of the unmanned aircraft, and
(b)has reasonable grounds for suspecting that a relevant registration requirement is or was applicable as respects the UAS operator for the unmanned aircraft and the flight.

Real crime would possibly be getting dealt with if he just showed him his operators ID, it's not a big issue really is it, acting like you don't have one or refusing to show it clearly suggests you're hiding something. If the operators I.D is legit, then what's the issue, he clearly either doesn't have one or it's a fake I.D.
Criminal justice courts act 2015 section 26 abuse of power in public office is an offence. He has no power to demand your operator ID or your details unless you have committed a crime. If it’s on a drone he still has no authority to check it. By detaining you without an offence it’s an assault sue the crap outta them

I just had a go at the operator test, only knowledge gained from yourself and DJ Audits and managed to get 37 out of 40.
So I am now the proud owner of an operators license and flyer ID, I just need to buy a drone now 🤣

They know there is absolutely no consequence to their actions despite the fact that they should be held to a higher standard. Complaints will be rare as they make it very difficult and will obstruct at every opportunity. Those complaints that are made generally won't be upheld, and those that are will have little to no effect on the individual Constables. There is therefore zero accountability which should really concern the public, especially as they seem to specialise in recruitng unstable people who are looking for power or to be able hide their own crimes.

How do you know for certain that the officer abused his powers or wether or not it was a lawful detainment? I highly doubt you do.

The Air Traffic Management Act only applies to OTHERS WHO CONTROL airspace, it has nothing to do with drone operators, COPSPLAIN = Deceitful speech police use to cover for their unlawful act against you.
This Schedule 11 Part 1 of the Air Traffic Management and Unmanned Aircraft Act 2021 includes direct operators and others: 'For the purposes of sub-paragraph (4)(c) each of the following police powers “corresponds to a power conferred by Schedule 9 as enacted”- (a)a power to require a person who the constable has reasonable grounds for believing is or was the remote pilot of an unmanned aircraft for a flight (“A”)- (i)to provide information, documentation or other evidence relating to A's compliance with any requirement relating to A's competency to be the remote pilot of the unmanned aircraft for the flight; (ii)to provide information relating to the identity of a person who is or was the UAS operator of the unmanned aircraft, or made the unmanned aircraft available to A, for the flight;' (Clearly if they believe they have reasonable suspicion, then you are required to co-operate and give Operator ID including Full Name). Schedule 9 provides all the relevant authority required - Air Traffic Management and Unmanned Aircraft Act 202.
Don't think they can ask for it if he hasn't flown it. I think they can ask him for it if they've seen him flying it.

Make sure you take a civil claim against him, or the lesson will never be learnt! He has no Legal Authority to ask for the operators ID unless he has reasonable Articlable suspicious of a crime! Flying a drone is not an offence he needs retraining. Has he breached GDPR by searching your detail with a false detainment? Keep us updated on the outcome of this, I'm soo angry. Should have asked for his supervisor and asked him to bring a stop/search record. Get on to the solicitor ASAP

You can actually fly over a prison of you fly high enough. The restricted zone only stretches from the ground level up to 164' (50m). Although DJI have their app set just at the boundary and vertically upward to the moon. If you get an Autel drone you can fly over. The Prison Service should have been more specific when they requested the FRZ. There's already legislation in place to stop the introduction of "contraband" into a prison. So, it doesn't matter whether someone uses a drone or a catapult etc.

the Air Traffic Management and Unmanned Aircraft Bill had its second reading in Parliament on the 27 January 2020. The bill also gives the police new stop and search powers around airports, prisons and other restricted areas. You were stood beside a prison. They had legal authority to see your Operator ID. Had you been flying anywhere else such as just a residential area away from a restricted area then they would NOT have the power to see your Operator ID. This is separate from any powers they may have if they genuinely believe an offence has been committed.
That is only if a crime has been committed
I've come to the conclusion after watching many many different auditors, that it all boils down to the power struggle of obtaining personal details.. & if you comply with them they are happy, but if you don't comply they abuse there powers to get them, & the more time passes with the officers not holding power they cross the line of no return, where now their ego is in control & desperation sinks in...
i should put this is file i say it so often, people put themselves into a position where they make a claim and then even if they know they are wrong they feel they've "lost" if they back down, there's another thing like auditing called street epistemology where people have conversations about beliefs, usually a god belief, but the point is when you're challenging someone always leave yourself an out, a place where you can say "oh, i thought i was right, but obviously i am wrong, sorry, thanks for updating me" but 99 / 100 it becomes a pissing contest especially where someone _thinks_ they know the rules without actually checking.
To answer your question. The drone users and prisoners have communication via secret phones ect. They agree on a time and a spot that works. So somebody will land the drone with drugs attached and leave it there until the prisoner (who arranged the time and spot) collects it and then the drone user can fly back out. This is why you can fly above 164ft. I'm not sure why 164ft is significant but that's why
Hi A Y, this conversation with the first young policeman is much better and more sensible than many but he also does not know what the drone laws actually are, at least he is willing to admit that.
The way you explain what you intend to do and how that you can film the inside of the prison compound from that position quite lawfully, he appears to understand and accept what you say.
He does want to know what your full name is, it seems for no particular reason apart from just habit.
A bit later after your flight he comes back with another of his colleagues who gets off to a very good start!. Then just when it was going so well he asks to see your operator ID, this you perfectly correctly refuse to do because you do not have to. He then start a whole lot of ridiculous copwaffle about this refusal being 'evidence' that gives him cause for suspicion.
You quite properly assure him that you do have that I D, he does not accept that assurance, this implies that he thinks you are lying!, from this point on you are entitled to dismiss m=him for lack of respect and good manners.
His insistence that he is entitled to this information in the same way that he is if you are in a car, absolute nonsense, the operator ID on the drone is there purely tom identify the owner if you have lost it somewhere.
They have now dug themselves into a hole they cannot find their way out of, he then says that you are detained be cause he believes something about you, I suspect that belief is not admissible evidence, this is getting worse and worse by the second, I think at this point you could offer further resistance thus creating a significantly larger claim against them, the fact that you submit leaves me much impressed by your consideration for them, it is a lot more than they deserve.

How did he reasonably suspect you had no operators ID, just because you refused to give it? He can only have it if he reasonably suspects you don't have one.
It's a requirement by law to provide your operator ID. So, if you say you don't want to give it, it's reasonable for the officer to suspect you don't have one.
Hanging around with drone near prison, wearing mask, not giving details, unwilling to show drone has operators ID ... reasonable grounds to suspect he has not got one.

I think this is the first audit for years where i can understand the police , they very polite and just want to see you’ve got a valid license ,they aren’t gaining any extra information that the general public can’t receive . Anyone can say ‘yeah ive got a license ‘
The police officer can certainly request the operator id under the act he quoted (think if it as a vehicle registration number) but not demand your name. Unfortunately (or fortunately depending upon your perspective) the current beta CAA website for validating operator IDs requires both name and ID to work. This needs to be fixed to work in the same way vat numbers are validated. You give the number and it just tells you whether it is valid or not without any other information being given out. I am sure this will be addressed in a future update to the database. In the mean time the officer is not going to have much joy contacting the CAA directly if he wanted your info as they will simply say whether it is valid or not and that is it.

HNK Solicitors, a lot of the top auditors use them, you can fill an initial online form for them to consider your case. If they take your case on it will be on a no-win-no-fee basis.
A lot of auditors call them.
Most get told they haven't got a claim.

Just take notice of the cop's patch on his chest says it all.
Operators ID is only for if the craft crashes on to private property so as the CAA can enforce legislation for recourse recovery of losses and damages caused by the craft.
And not to justify legitimacy to Po Lice (no tex error).
Plus the flyer doesn't have to have operators ID for that class of drone.

The less you say to the police the better, you being overly friendly in this situation gave them a sense of power as they knew they had a chance to walk all over you with how polite and cooperative you were being, in future just tell them you're not breaking any laws and exercise your right to remain silent.
They can still stop and search and demand ID in this case.

With regards to his grounds... It's intricate. He says he suspects you don't have an operator's ID which would contravene Section 265a of the ANO, allowing him power of stop and search under schedule 8 of the air traffic management and unmanned aircraft act 2021. HOWEVER, suspicion of not having an operators ID just because you don't want to give it because you're not obliged to is akin to searching you under any legislation because you don't want to give your details. I think this is a precedent that needs to be set and I think you should contact HNK and take a civil action against them mate.
I'd be questioning exactly what section they're detaining and searching you under and what offence they believe to have been committed. I'd then be asking what would happen if you refuse, if they say they'll seize it then I'd agree under duress. Easier said than done in the heat of the moment believe me I know 😂

When the other copper said you'd not done anything wrong you should have been free to go. If they want to relate it to a vehicle, it's like getting pulled over for absolutely no reason at all. "Hi, I've observed you driving completely within the law but I've pulled you anyway".
You do realise they do that constantly under the road traffic act just to check if you have a driving license and other documentation.

Not 'commit a(n) offence', but 'suspected' of committing an offence, or probably 'resonable suspicion' of committing. I saw no reasonable suspicion, unless just the ability to breath constitutes reasonable suspicion.

The government has given police new powers the 'Air traffic Management and Unmanned Aircraft Bill' has had it's second reading in parliament as recent as January 2020. Included in this are:- 'Drone users could face an on the spot fine for certain offences such as failing to provide evidence that they have the correct permissions and exemptions if found to be flying their device too high or too close to buildings, or failing to provide evidence of competency or registration'.
'The Bill will also give the police new stop and search powers around airports, prisons and other restricted areas'. 🛸🚔👮♂️

If your drone or model aircraft is below 250g or C0 class, the person flying it does not need a flyer ID. However an operator ID is required.
Thats only true if the person flying it is the actual operator (ie the person that owns/maintains it). If you let someone else fly your drone (even a mini 2) then that person needs a flier ID before they can fly your drone that has your operator ID on.

"Operator ID
The operator is the person responsible for managing a drone or model aircraft. This means they’re responsible for things like maintaining it and making sure that anyone who flies it has a flyer ID."
