    This woman should have been prepared before coming to the court. The man was smart enough to get a backup from a lawyer, who not only came to court with him but apparently prepared him on how to present his case. However, I still think it is of high necessity to invite the children for a one-on-one discussion to ascertain the truth about the molestation allegation. Judge Fumi couldn't bear with the woman😢

      That's because judges don't judge base on emotions. Judge Fumi has heard such untrue accusations from women through her years of doing the job. The court has told her what to do, take it to the criminal court. There are so many NGOs that will help her. But which mother wouldn't cry out for such a thing not until now

      Some mother's keep quiet because of cultural beliefs and fears of being labelled a bad woman who wants to destroy "their son"; especially, as in this type of case, where there are no evidence to prove the case apart from verbal narrations. This is why paedophiles get away with their nonsense. It's so sad Judge Funmi couldn't talk on this, with a little patience, with the lady; to advise her on how to protect her kids, if she is sure of her allegations on the man, though there are no evidences she could show right there! I feel really disturbed!

    Why is it that the lady is not given the opportunity to express herself completely, I actually feel for this woman, she might not be completely correct but there is an iota of truth in her words, how can she prove this type of stuff? This is why many rape victims die in silence, the ppl in the court are not really seeing through her pain

      The audience was annoying, but this is a lesson to everyone out there if a man does not love you enough to marry you, he should not be given access to what married men are entitled to, the woman was so careless and brainwashed to have allowed such a man impregnated thrice if the first one was a mistake the 2 issues that followed were not, in fact, the woman was not really SMART ENOUGH

      Seems people are hardly aware that court room is no place for emotional perspectives. She couldn’t proof anything. How I wish she could provide evidence. He would have been reprimanded to jail straight. She didn’t come prepared so one can’t blame the Judge.

      Again I hear a lot of am not interested in your marriage, whatever happened or you do is your business, men should be asked to compensate women after separation or divorce otherwise they will take it out on the kids. The court should investigate and allow the lady to speak.

    Child molestation is a very terrible offense. I expected the honorable judge to refer the alleged kid for professional counseling to ascertain the allegation. Or even asking to speak with the child. Also instead of asking the lady to take d kids to his father's house, why not meet at a neutral location? This judgment really worried me, what if mum is telling the truth? Scary 😢

      My take, too, on this matter. I feel sad about this outcome. The said child may be in for further abuse and won't be sure if she could open up to mum about it again, now she must be a little older, if it is true their Dad have a problem comporting himself!

      @@bolanlesekoni8856 I agree with you. Even if someone is malicious, child molestation allegation MUST be investigated. I didn't see this here, the mother was dismissed and even scolded. I shudder to imagine it's true. As for the mum, I'm surprised she is asking for funds . Most alleged victims of child molestation from father, the mother RUNS away with the kids especially if there is a diabolical element to it. But here she was suing and asking for funds from the alleged abuser, the whole story is sad and crazy

      I can see that the Man was so smart in presenting his case. It's quite unfortunate that the lady doesn't have any evidence to proof & no one to back her up. And l think the Judge was only concerns & rules about the rights on the children which is okay.

    The judge ruled well.
    The lady in question should have proof when coming to Court. I don't support the idea of rubbishing your partner to your kids, it's so immature. Don't drag your children to anything that they are not old enough to handle.

      @@jeniferjohnson3448 I had a cousin who took a second wife because of the first wife's malicious and heinous characters. She used her children especially the daughter against him as in this case. But when the daughter got married she realised the damage her mother had caused her after discovering those things her mother used to tell her about the father were lies and fictions. Now she is not in good terms with the mother. I was there when the daughter arranged people to beg her father for forgiveness.
      The problem of the woman in the justice court is because the man didn't marry her officially after 3 kids. I blame her for having children out of wedlock. Wedding should come first.She was allowed to be led on!

I must say that this is a very sick conclusion. Are you suggesting that because it happened that way in your fabricated story, the same applies to this woman? This is a very sick conclusion.
      So, because men rape women and it is the norm, if any man comes forward to say otherwise, your type will say he is lying because in your case every situation always happen one-way and cannot happen differently.
      The fact of this matter can only be revealed if further investigation is carried out. No one knows the truth of this matter. Anyone who carefully listened to this man's defense on the matter will ask for further investigation.

      The proof will come after the man has defiled the child and even at that his people will be covering it up. No mother will like her child to be exposed to such abuse.
      Note that at the end the judge was a bit cautious in spire of her aggressive reaction to the lady. She wanted school visits, visits at the parents house, visits with the father with the mother around then the child can spend over night with the father alone.
      Overnight with the father to do what? If the child does not want to spend overnight with the father no one should force her to do so. In fact she must not be encouraged to do so.

    If everyone writes her allegations off and one of the children gets molested or even falls pregnant from incest is that when she will be believed?
    I think Judge Funmi should have insisted on an investigation of the allegations, possibly by referring her to child protection services to look into it. In the meantime just allow SUPERVISED visits till the issue is settled

      The judge obviously was not interested in the allegation of molestation, how will the woman prove to the court that her child was molested, what evidence were they asking her to present, it will have been fair if the judge gave room for proper investigation

      Nigerians are funny people sha. So it's now the courts duty to conduct investigations? when she was asked who did she report the case to what did she say?
      The court knows when someone wants to waste their time. As a witness if she had taken the incident more seriously and reported to the authorities when it happened, then there could even be a basis for an investigation.

    The lady talks like she’s educated but unfortunately she isn’t. You can’t be complaining that he refused to marry you and be alleging molestation or abuse of your kids and also demanding upkeep while denying him access all in one breath. She has to press charges if she’s sure of her allegations. She needs to see a lawyer to get her acts together next time. Know what you want before bringing him to court asking for upkeep.

      Thank you @nelsonodigili6261. I'm surprised for people's reaction toward the man. How will she be angry that a man who molests his own daughter, refuses to marry her? If she is so sure the man is a child molester, then she needs to run far from such a man, not bringing him to court for refusing to marry you and child welfare. The court has a procedure. If you don't have evidence, you can't get judgment except the man own up to it. Crying crocodile tears in court will not give you what you want

I am intolerant to issues of rape and child molestation, but this case showed she just wanted to purnish the man for not finding her worthy for marriage. Maybe if she had patience and played her game well, she would have achieved that desire.
      Unfortunately, she cooked up tales of molestation, yet, she wanted the man to marry her. We need to listen to what she isn't emphazing. Great judgement.

    1. Only God knows who is telling the truth between both parents.
    2.The lady mentioning that he led her on without marrying her just shot herself in the leg.
    3. The Judge should consider that the man is married and the children may face maltreatment from their Dad's wife if they eventually start visiting him alone.

      Carrying out investigation is the Police Job. That is the reason criminal matters MUST be reported to the Police. Police is the one that will refer the matter to court of jurisdiction with appropriate charges. The Judge educated you all on this, but you all are emotional rather than following due process to get justice.

    The judge has to investigate abuse case of the father on his daughters first, before you can grant him custody, you are bullying that lady. Just because she can’t prove it doesn’t mean it didn’t happen, those children are at risk.

      The Judge doesn't have to do anything, this is a civil case, if she had presented evidence she would have referred them to DPP. A Judge can't rule on emotions

    Why is it very hard for some people to understand the fact that child's molestation issue is beyond this court jurisdiction. Judge Funmi can't make judgement on this matter and that is why she told her to go to the criminal court with evidence and the criminal court will do the needful to the man. There is nothing to be done in the court without evidence (s) . Therefore, stop bullying the judge for doing her job rightfully. I felt the woman pain as well and I will advise her to take the criminal aspect of the case to the criminal court with evidence (s) for further judgment

    I feel so bad for this lady, it's as if everyone is against her. She has her reasons for not granting this man access to her children, she alone knows what she saw but probably couldn't get the chance to get proper evidence, I believe she's trying to protect her girls based on their father's behaviour & I don't blame her for that. The judge has been sounding like she had taken sides already right from the beginning of the case & that's not fair. That woman should have been guided properly on how to get professional help for her girls. Unlike the previous cases, I'm not satisfied with this judgement.

      She was asked to prove, she couldn't, when the judge insisted she immediately went to: " He led me on and refused to marry me", that tells you her real train of thought, the accusations were a mask. A scorned woman should not use her children as a weapon against the father. This is the correct judgement, until she can prove her accusations. All she has done is defamation of the man's character which is an offence also.

    I honestly feel sorry for the lady, why is the Judge so concerned about the welfare of the children and not the well-being of the children🤦🏾‍♀️; she contradicted herself so much on this case, how can she care about the psychological impact of the children but not willing to let the children have a supervised visitation with the children, it’s very obvious the judge considered the woman a liar and made her judgment even before this hearing.
    The Judge lost it when she said “you can see people answering you”. It’s very obvious she was sentimental about the case and already aligned with the man.
    The judge was so concerned about the proof of the alleged molestation as tho she has the jurisdiction to even talk on it.
    Sidebar, what does the lawyer mean by the “man was afraid to go to court initially”……if he had nothing to fear why is he sacred of a civil court🧐🧐🧐

      Your observations are very valid. Judge Funmi did not judge this case well. You could see she antagonised the lady throughout her testimony. As an officer of the state, more is expected from her.

    Lawfully, the law cannot enforce claims that lack credibility, proof and evidence. When it comes to issue like this the whole world will raise eyebrows. I pitty for men who question this judgement.

    I think the way the judge shut down the woman continuously was wrong. Sure, the case of molestation could not be tried in Justice court but the judge could have addressed the later in a more reassuring manner. Molestation is something that is quite difficult to prove but is not enough reason to completely write off the woman’s concerns. As someone who watches a lot of court shows, paternity, couple, personal injury, divorce court etc. i can say there are some pointers as to whether someone may be honest or not and you can see from the mom’s body language that she was defiant and felt really helpless and kept emphasizing on her fears.
    Did anyone realize the father did not say anything about it after just debunking. I would expect that if you are completely innocent, that is the first and major thing you would address because it’s a disgusting claim that you molest your kids. Even the guy’s lawyer did not mention it.
    The judged shut the lady down over and over again and it would bruise her confidence.
    Imagine how difficult it was to mention this in public and the judge left angrily too. Normally they would agree on a monthly allowance and the school fee and all that, but she was too upset. I think the court could have handled it better and maybe help guide her to start an investigation through the proper channels instead of shut her down continuously.

      When you bug down the court with narratives that are not part of your original claim, it amounts to waste of court time. Her matter is for children upkeep which is a civil matter. The matter on child molestation (even though all her stories do not substantiate it. What everyone focuses on is the headline - Child Molestation) is criminal and the process for that is different. Judge educated her on how to approach that, but she kept on with it wanting to use that to keep baby daddy away from his children. I believe the Judge could read in between the lines. If the lady was sure of her criminal story, she would have reported to the Police for investigation. It is the Police that will charge the matter to court. That is the process. I believe the Judge was lenient, when you bring up a story and the judge told you how to approach the matter to get justice and rather than focusing on the main issue you brought to court you keep distracting the court with issue that the court does not have jurisdiction over, your case might be dismissed. People need to be educated and the Justice Court is doing a great job. Domestic Violence, Child Molestation and other criminal matters MUST be reported to the Police for Investigation before charging it to Court. That is the process in Nigeria.

      You can help her file her case. She's alleging something she can't proof, she is alleging that he was abusing her child and she didn't mention it to anyone, not like they're married officially during this period. Not even her family members.
      She's even a principal offender looking at her action and in lieu of S.7 of the criminal code because she aided the husband to escape the punishment of the law when he concealed the alleged act of child molestation.

      When you come to court any allegation you don't have evidence for, keep it to yourself. It dilutes your case. The court will only rule on issues with facts. She is doing her job in that regard. She shouldn't have come to court. Her advisers did her wrong. If you want child support, you must be willing to share access. At the moment she came to court, so issues have overtaken each other. The court will make a ruling.

    The lady didn't understand that the case she was trying to prove beside the actual case of child welfare can only be treated in a court that can treat criminal cases. She was just muddling up issues & wasn't ready to hear anything different from what she's made up her mind about. She's free to go to any court that can treat a criminal case & see if she can obtain retraining order. Anything other than that is chasing the shadow.

      The case of molestation just as said by the judge is a criminal case and should be handled by the criminal court. The Judge has advised her on what to do if she can prove her allegations. But untile she proves that, the father of the children has right to his children. It seems like we don't understand or didn't listen to all what Judge Funmi said.

    So sad that an elite would find herself in this kind of situation. I find it unbelievable for her to have 3 children for a man that didn't signify any interest in marrying her! The man wouldn't have bothered coming back to her if his marriage to his legal wife has produced children. She's feeling used quite alright, but the question is what's the attraction to a man that wasn't committed to you??? I pray she finds joy. As for her allegations, like Judge Funmi said, it is hard to establish except there is evidence.
    Lady, it is never too late to stand tall above your past mistakes, rise above it by first cooperating with the process outlined by the Judge, take responsibility for your action of bearing children for a man that wasn't committed to you!! Only then can you heal completely and ready to face life!!! Accept your errors of inflicting this emotional trauma upon yourself, then you are on your way to full healing and recovery. There's a man for you. Heal up and pick up the pieces of your life and become a better person.

    The judgment did not consider the safety of the children. The judge prioritized protecting the equal rights of the parents over the serious allegations against the Dad. These allegations are strong and concerning and shouldn’t have been ignored. At the very least, the children should have been asked to establish the facts.

    I'm disappointed with Judge Funmi for the first time. Those kids are witnesses, the lady should get a lawyer just like the girl and some human agency. Put those girls in different rooms and ask them questions if it truly happened because the girl could also been lying too. To the girl, you don't talk over a judge.

    Juustice Funmi was fair in her judgement. A parent cannot be granted sole custody of the children unless there is proof of that the other parent is unfit to care for the children.

    Truth is this judgment isn’t fair . The lady has enough evidence and proof. All the judge could have done is to call the child in private and asked more questions to see if the truth might come out from the child.     I have mixed emotions about this one. Many young girls molested and raped by close family members and there should be extra precautions taken. However if she lied about this she is not only hurting her daughters but many girls who may want to speak up now no one will believe them.

    Firstly, she said the guy only send 30 to them in Mina but the guy send more. The guy said he rented shop for her and she messed everything up under 3 months
    2)She never mentioned that she ran away with the guy's car (properties)
    3)During the first pregnancy, she actually lived with another man she denied she never dated but her child bearing his surname
    4) She denied her husband access to his children because she claimed their father molest them in which she has no prove.
    It is very clear that she is lying...she is pained because the guy didn't marry her.
    Who knows why the guy's wife has not be able to conceive? Some women are dangerous very dangerous.
    Going from one babalawo to another in other to ruin the life of any man in the name of marriage.
    Some of them can pretend till christ come.
    My advice for the guy is.....he should be very careful whenever he visit his children. The woman can set him up and make everything look real. With what is on ground, he won't be able to get out of the mess.

    Most Nigerians 😂, allow emotions to rule them, I read people's comments on this matter and I marvelled.
    Remember that this woman brought the case of wanting the father to be responsible to the children to court, she want the man to be paying the bills but not have access to the children.
    She brought up issues of molestation along the line.
    She wants to eat her cake and still have it.
    If she can establish a molestation case in the criminal court and send the man to jail, the first purpose will be defeated.
    I wonder how the man will be able to provide for the children inside the jail.
    The judgement even went in favour of her just that she was not satisfied with the condition of the father having access to the children.

    Evidence is 9th part of the law. The lady knew she was coming to the court and should have presented any evidence to prove her case rather than just talking. In this day and age, even video evidence or audio can suffice. The court is not for sentiments or hear say, Her allegation may well be true but she could have brought the elder daughter as witness too, and she still is hanged-up on her relationship with the defender instead of insisting on the court mandating him to do the needful. I hope a lot of ladies are learning.

    It is a difficult thing to prove child molestation and in as much as many don't have proof, it does not mean it is not happened. The children should in my opinion be safeguarded at all cost. Im glad judge Funmi is starting with school supervised visitations, definitely a good way to start and I'm glad he will have access to them gradually. There are parents unfortunately who molest their kids so being their dad doesn't mean he is not capable of such. That being said I wish the kids well and hope that they are safe.

    God knows the truth but the court should be a safe place for justice. In matters as sensitive as this, there should be further investigation. I just feel there is more to just these accounts. Only God knows the truth but further investigation could reveal more.
    Judge Funmi really tried with the judgement and she operated from the point of view of the Law. This is a fair judgement and I think she considered the statement of the woman.

    This lady seemed paranoid about her own sexual abuse issue not necessarily what she ‘thought’ happened to her children from their dad. She’s being over protective of them because she has ‘solely’ raised them. Also, she’s had no relationship with the man’s family so that may be another reason since the children may have to visit that side of the family now. She needs counseling to be reassured that the children would be fine without her being present. However, if her allegations are true the man must be prosecuted to the full extent of the law just as the judge emphasized. Additionally, this lady seemed bitter because the man did not marry her and his marriage is ‘childless’, she wants to punish him for ‘abandoning’ her for the other woman. Forgetting that she had been deceptive from the beginning by taking the first pregnancy to another man.

      The molestation allegations should be further investigated though. However, she had previously accuse her first husband of same things prior to leaving him, so her account sounds fishy to me

I encourage everyone with genuie cause for action to report their matters to the Police for investigation and consequently charge the matter to court. That is the process to getting justice in Nigeria. This is not a matter of emotion or sentiment.

    Custody can’t be deny except she brings evidence she kept saying he led me on, how do u still want to marry a Man U said molested the kids she actually confused her case

    Hmmm... I have very mixed feelings as Judge Funmi already mentioned that there are cases where women do this to hurt their spouses in Part 1. However, I also feel the pain in the woman's eye, shes hurt and worried. Although this is not a criminal court, so Judge Funmi has systematically advised her on exactly what she needs to do to restrain him and persecute him. I hope she got it.

      I don't think the lady got the advise. Because she was just talking over the judge. Judge funmi was being nice today. The lady has already made up her mind on what she wanted to hear. If the lady is lying the guy should sue her. That's a big allegation. If she isn't lying, she should be able to prove it. Not just claim.

      The judge know best, again the man did not come with a lawyer, the lawyer is a case working from child welfare and they must have heard the allegations from the lady and discovered that is was a bundle of bushit from an angry ex, we all know that she is angry that the man did not married her, she mentioned it multiple times.
      If the man molested the child, she would not be concerned about not being married to the man.

    This woman is not being truthful. She should go to the criminal court with the "Child molestation issue ". She only brought the welfare of the children to court. You cannot deny him access to his children, expect him to pay for upkeep and come to court saying all sorts of things and accusing him because you were given a platform to talk.
    No access, no welfare.
    Thank God the Judge is a woman. If it were a man now we might say the judge was been biased.
    Nice judgement ma. Make person no go pour sand sand for your garri.

      "We've been talking, I tell him things he's supposed to do". He's correct. His sentence is present continuous.
      'Been talking' not "we talked"

    A wife acusing her husband of his biological children of molestation is a weighty one that should not be overlooked .Either true or not the man should be ashamed No smoke without fire

    This case is very unfair. I actually believe the woman. Judge Funmi didn't do well in this case. Even if he is given visitation rights, they should be supervised. The court should also have the children spoken to. She is in real pain, and as a good mother, she is protecting her children.

      The same man that she kept insisting used her and not marry her. Listen well to what she said, she was more upset that he did not marry her

      @dwinaj I would be upset if I gave him 3 children and he didn't marry me after promising for so long. But from she has made the allegations, we don't know, whether true or false, care should be taken for those little girls.

      Ok lets turn the table. The man could as well say that the woman is molesting the only son as he has witnessed it.
      He could stick to the story the way this woman did throughout the session. What then would you say?
      I guess your response would be that it's a lie because he wants to get back at the mother right?
      Let her provide evidence that's all. The judge asked her to go to a criminal court to give that a short. But trust me it would most likely not fly. It's not the court responsibility to investigate matters it's a place you come to prove matters with evidence to achieve a goal.

      Why are you so biased against the man just because the woman said he molested the children. Why hasn't the woman reported the case to the police? When asked she said she told her family. Is her family now the law.
      Let's learn to keep emotions aside and stick the facts. No Court in the world will convict this man without evidence. The judge told her to go to criminal Court where she can get a restraining order and where he can be prosecuted and jailed if found guilty. What else do you want the judge to do. What elseeeeeeee.
