Hi, I've been in Thailand 28 years'. There's a real reason so many bars fail. I'll Explain. To own a bar you have to register your bar company with the DBD (Department of Business Development) You'll have to register your bar company with 2 Thai Nationals. You'll own 40% Thai national 1 40%, Thai national 2 20%. You'll also have to apply for a non B Business visa, as it illegal to own and run a bar on a retirement visa. You'll also have to employ 4 Thai staff on contract of salary 10,000 per month to support your work permit that you apply for after your business visa. you'll also have to pay social security every month about 700 bath, the amount escapes me, to your 4 Thai staff. And also when you rent a business unit you'll have to pay business tax to the landowner. In your situation, the best thing you can do is make up with your partner, enjoy life in Thailand without complaining too much. You seem like a nice guy, I hope everything works out for you my friend .

If what you explained is correct, the mentioned percentage of 40% + 40% + 20% tells me that the law was designed in a rigged way to ditch the foreigner easily and the money always stays in Thailand once invested, it will never leave the country. Amazing.
Keep an eye on the legal expenses. The lawyers could be milking you while achieving nothing so you get screwed twice. Have an endgame plan and a threshold where enough bs is enough. Keep a bug out bag handy so that you can skip town at short notice with your passport, ticket money, spending money, the shirt on your back, and your life intact. Unlike in your country of origin, the law in the rest of the world doesn't necessarily work on the basis of plain simple logic. There are many other factors involved. Best of luck.

The owner of the bar is the person who owns the building. My understanding is that his (at that time) significant other was going to sign a lease and he gave her the money. So legally that means she got a great gift and signed the lease with that money under her name. Then when things went south she had the lease in her name and he had nothing. If that is the truth no lawyer will be able to undo that and they will simply siphon more money out of his pocket.
The moment you said, "I could open up a really good profitable bar and something that could make me a good income. I had five people employed." proves you know nothing about Thai laws and legitimate business practices. You then go on to say, "I don't need a work permit because I don't do any work. I own the place." Say goodbye to your money and the bar, before you are kicked out and blacklisted from Thailand.

Greg you are thinking about Family (defacto) law in Australia. The law of splitting assets after the defacto relationship breaks down doesn't apply in Thailand. Thai family law only applies with a marriage certificate. Thai business law? What's that? Technically you are in the category of giving gifts 🎁 to your teelak. Have you ever heard of paying sinsod ($,gifts) to marry in Thailand? This also applies to Mia noi or minor wife (defacto relationship). In the eyes of Thai society " she take care of you and you give her Gifts (sinsod)in return " Thai courts will look at you and think you're a keenow/ indian giver. Keep on trucking brother Greg

You can learn a lot from your story. First of all, it`s possible to open a nice bar if you have the money, drive and discipline. But, NEVER try to save money on getting your papers right to protect your ownership. Use a lawyer.

Hey mate, sorry to hear about your situation, my friend in phuket went through the same thing, he's American thou, good news is you might be ok cause he got a letter from the owner of the bar that he leased 51% went to his Thai girl friend the owner wrote that he the American paid the full amount for the lease and the judge said yes she owns 51% of what she put in which is nothing so she had to leave with nothing and the American kept his bar and the owner (Thai) knows that the American will pay rent every month on time but the Thai lady will argue, haggle not pay on time so catch up with the owner and you should be sweet.....

I have made a couple of suggestions that might not be ethical, but you are not dealing with ethical people. I once said to a motorcycle renter whose motorcycle kept on stopping to either give me back my deposit and money for the extra days or I will leave this motorcycle out in the jungle and fly out. I got my money back.
Is that 150k the only income, you really need a form of continuous funds, if your single you'll also need around $35k kept in a Thai bank or $2500 a month income, or a combination of both

I first lived in Thailand 40 years ago in Phuket. I was just a kid of 22. I remember talking to a guy from Belgium who was an old hand. Hey mate, sorry to hear about your situation, my friend in phuket went through the same thing, he's American thou, good news is you might be ok cause he got a letter from the owner of the bar that he leased 51% went to his Thai girl friend the owner wrote that he the American paid the full amount for the lease and the judge said yes she owns 51% of what she put in which is nothing so she had to leave with nothing and the American kept his bar and the owner (Thai) knows that the American will pay rent every month on time but the Thai lady will argue, haggle not pay on time so catch up with the owner and you should be sweet.....
