      There is relation of land lord and tenant in old rent act. There is difference between land lord and owner in case of leave and licence agreement. Licensor and licensee.

    भारत में कोई न्याय व्यवस्था है ही नहीँ। सिर्फ अपराधियों को न्याय मिलता है क्यों कि अधिकांश वकील जज अपराधी हैँ क्यों कि इनकी नियुक्ति अपराधियों द्वारा ही की जाती है।

    सरकारें नियम कानून तो अच्छा बनाती है लेकिन उसको लागू करने वाले अपनी मनमर्जी से चलाते हैं,60 दिन में समस्या का समाधान छलावा साबित होगा, न्याय व्यवस्था पूरी तरह से ध्वस्त हो चुकी है, इसमें वकीलों का योगदान सबसे ज्यादा है, भगवान इनको सद्बुद्धि दें।

    धन्यवाद, बहुत अच्छी जानकारी प्राप्त हो गई।
    हमारा एक बंगला है जो हमारे दादाजी ने खरीदा था। और वो second owner थे। बंगला खरीदी किए तभी उसी बंगले के २ रूम्स मे एक किरायदार रेहेता था। पहले owner ने उस किरायदार से कोई एग्रीमेंट नही किया था, बाद मे उस किरायदार से दादाजी ने और दादाजी के बाद दादी के नाम पर बंगला दादाजी के will से दादी के नाम हो गया । तभी हम उस किरायदार से भाड़ा लेते थे । अब दादीजी ने will कर के भाई के नाम बंगला कर दिया। दादी का देहांत २०१० मै हो गया। भाई ने अपना नाम दर्ज किया नहीं । किरायदार ने दुसरा मकान आपने बेटी के नाम खरीदा , और इस बंगले वाले मकान को ताला लगाके ६_ ७ वर्ष से निकल गया। अब हमारी फैमिली बढ़ गई है। और मकान की आवश्यकता है। तो हमे ये २ रूम्स वापस चाहिए । किरायदार अब रूम देने से इंकार कर है । या बहोत ज्यादा पैसों कि मांग है । कोर्ट केस के लिए कृपा हमेशा ही देर लगती है । कृपया advise दे ।

    Their is one point that does not get favour for Landlord and Tennant. Tennant do minor changes on wall such as Nail instead of screw by drilling. Nails destroy the walls. Tennant do some changes without letting landlord permission which later becomes a headache for landlord to make such fixes that costs above the total rent as received from Tennant.

      True, i cleverly evicted one tenant who did changes to my property without consulting me.. anyway old building.. i will not rent out anymore!!!

    There should be some restrictions on the rent increase part, owners think it's their property so they can increase the rent 100% on next year...this is happening everywhere....and there should be a law for Agents too..who takes brokerage of two months in some cases just to show the flat and repeats that again after completion of 11 months contract with owner.
    This is definitely a harassment of tenants by brokers and some cases brokers(locals) threaten tenants...there should be
    Some guidelines on how much rent can be increased each year...owners increase rent by 50-100% and companies give appraisals on average 2-8% yearly.
    This needs to stop...

    It is not desired to submit rent agreement copy to rent authority. Agreement copies should be kept with landlord and tenant and submitted to rent authority to only resolve disputes or for eviction.

      In case of any dispute on the rent of properties either commercial or residential if fail the resolve the dispute of any reason, tenent should vacate the rented permieses without ifs and buts at once in order to safeguard the fundamental and legal right of landlord.

    What will be the criminal liability in case the tenant does not vacate nor pays the rent. Without criminal liability act is toothless as all previous Acts. For this reasons landlord still does not want to give his property on rent. Another issue is all security deposit where two months or six months deposit is too meagre for your property is valued in lakhs and when dispute arises it is of no use. Security deposit should be higher so as to compensate the landlord in case of damages to his property.

      6 months security deposit is too high . Max 1 month of rent as deposit is sufficient . What about those landlords who upsurp the deposit citing damages which do not even happen. Landlords are greedy and demand unrealistic rents.

      In delhi my land lord give me a room kn rent no advance no security Great
      I pay rent on 1st very nice
      And after 4 year againn to delhi same land lord no empty room constructed a room set and provide us super land lord i salute
      Here bengluru no facility both security and rent high
      Land lord not returning security money back saying bring another tenets to give your s money
      So i stopped paying rent to adjust s money.

    It is to proposed that any kind of dispute between land lord and tenent if not soloved with mutual understanding due to any reason tenant must be vacated the permisies without any ifs and buts otherwise it would be deemed to diprived the legal and fundamental rights of landlord. If tenent do not vacated the rented permisies is liable to be penalised by competent authorities to safeguard the interest of landlord as his fundamental and legal right. Moreover, the maximum period of time limit for rent agreement must be decided by law. After expiry of time limit, it can be extended by making new rent agreement by mutual understanding between landlord and tenent. If there is no such provision in the law, question would be arised in the court for unnecessary latigation for killing the fundamental legal interest and right of landlord. The landlord can be considered before the tenent as begger for natural justice at any circumstances. Otherwise all is null and void for solving the problem of landlord.

    गुड मॉर्निंग डियर रिस्पेक्टेड सर मैं आपसे जानना चाहता हूं जैसे कि एक किराए के अलावा भी सिक्योरिटी पर मकान दिया जाता है जिसमें कि मकान मालिक 3 लाख या 2लाख रुपए लेकर के मकान रहने के लिए देता है जिसमें किराएदार को किराया नहीं देना होता एग्रीमेंट का समय 1 साल या 2 साल के बाद जब भी एग्रीमेंट पूरा होता है तो वह रुपए वापस मिल जाते हैं किराएदार को लेकिन इस दौरान अगर मकान गिर जाए तो क्या मकान मालिक किराएदार को वह सिक्योरिटी अमाउंट वापस करेगा

    I had my house in rent after signing written agreement. The agreement expired in oct 22. The tenant is not vaccating my house in spite of written and verbal noticed. He has filed a civil case and the police says that we can not it vaccated as the case is pending in court. The tenant has filed the case just to avoid eviction of my home. He knows that the case will be in court for a long time and he need not vaccate house. He is not paying rent as electricity bills. He is simply taking advantage of loop holes in law. When agreement hax expired he gas no right to remain in house till court decides the case. What I should do in this situation to get the house vaccated? Should I get itvaccated using muscle powrt?

    I own a property that i rented out, also i myself live in a rented flat. I've experienced both being owner and tenant. The problem is that- indian law is subjective and not objective in nature, law has a bias. The law needs to be objective and clear. In my view laws are unfair towards tenant, due to following 1. There needs to be a law on rent control, because inflation hits tenant the most and tenant has to pay everyone and everything (broker, packer and movers, deposit, lawyer and government, interior, house repairs, maintenance and charges) land lord has unrealistic expectations from tenant 2. Deposit-It should only be one month deposit OR no deposit, that shoud be permissible and tenant should be protected by a guarantee, because in most cases deposit is not returned back to the tenant. Owner just makes false claim and accusations to do soo. 3. Whimsical and egotistical behaviour of landlord and property administration and neighbours-should be penalised under law. for harrassing and creating nuisance for tenant, it should stop restrictions, exploitation and abuse of the tenant. In many cases society and apartments administration make rules for tenant specifically and restrict access to amenities (terrace, gym, swimming pool, entry to premise within specific hours, guests, parking, lift etc) and extracts money from tenant for the same amenities 4. Legal scrutiny and expenditure-generally tenant has to go through it and has to pay cost involved. 5. Dignity & Integrity of tenant is questioned and compromised at every point. Indian law has to accept tenant as part of society and citizen of indian. Tenant needs to be empowered in the right way.

    Agar tenent makan na khli karee to agreement ke base per case hoga wo phir chalta rahega
    Ek provision hina chaiyee ki
    Six month ka notice makan malik dega nahi khalee kiya to court dakhl dekee khali karayee
    Ya six month special condition mee extend karee
    Uskee bad landlord police ki sahayta se bahar kar dega
    Court will not entertain the tenent case
    Esper bhi kuch batai ya suggest karee

    मकान या दुकान मालिक किराया कब बढ़ा सकता है?
    किराया बढ़ाने का क्या नियम है?
    कुछ मकान या दुकान मालिक बोलते हैं कि जिस किराये पर आपने दुकान ली है ,वो मूल किराया रहेगा और उसी पर 5% हर साल बढ़ेगा ,10 साल तक ।उसके बाद जो किराया राशि होगी वो मूल किराये में परिवर्तित हो जाएगी और अगले 10 साल जो नया मूल किराया हो गया है ,उसका 5% चलेगा ।
    जबकि कुछ दुकान या मकान मालिक बोलते हैं कि मैं तो हर साल बढ़े हुए किराये पर हर साल 5% बढ़ाऊंगा ,इस तरह से तो किराये दार पर अत्यधिक बोझ पड़ेगा ।

    This law is impracticable. If the landlord cannot enter the house, water leakage to other flats cannot be checked. If the rent holder makes structural changes, the landlord cannot restrict him, and the house can be damaged. In general, the increment of the rent is mentioned in the agreement. If the increment is based on the two-month's notice, it will give rise a number of disputes. Because after taking a house on lease, the talent makes a lot of expenses on furniture. He cannot vacate the house just in two months.

    Tenant ke liye deposite amount dena sabse badi dikkat hoti hai. Tenant agar more than 3years raha ho. Ghar khali karte samay jab deposite amount mangta hai to landlord agar koi structural changes aajae, ghar ka koi door, kitchen ota problem me aajay, colouring to landlord deposite amount se hi deduct karta hai.
    Minor issues to tenant bhi solve kar deta hai. Par what about major issues?

    अतिशय माहितीपूर्ण.
    मुझे भी एक समस्या है सर, हमने जिनसे घर खरीदा था, उन होने डाले हुए किरायेदार अभी भी मकान खाली नहीं कर रहे.
    अब जमीनदार हम है तो हम उनसे मकान खाली कैसे करवाये?
    वो लोग किराया भी नहीं देते, मकान भी खाली नहीं करते और हम जमीनदार होके अपंग कानून की वजह से उन लोगो के खिलाफ कुछ भी नहीं कर सकते.मेरे पापा ने ये घर खरीदा था, और इस बात को अब 20 साल से ज्यादा साल हो ज्यादा साल हो गये है | खरीदने के बादसे आज तक किसी ने भी किरया नही दिया, ना मकान खाली किया |

    The government has no intention to protect the rights of tenants. They are humiliated, encroached in private life, and treated like beggers even though the owner is getring his charge. These particular owners must be rated according to their behaviour on some non profit digital portal. So that a new tenant can be cautious of some greedy psycho land lord before putting in a hefty amount as deposit and putting in the effort shifting his /her life into that house.
    Like cibil score, there must be a portal to score the decency of a house owner.

    In Gujarat, Kolkata mostly tenants are chosen by solid reference who by rare probability would default. I had a house in Ahmedabad and I rented it for 10 years without any agreement or security deposit, but everyone paid rent on time and the last tenant bought my property at market price. No issues.
    I do have another house in Kolkata next to Bhowanipur metro station, the tenant working in a respectable position pays rent on time every month. Although agreements are made every year but I deliberately don't hike any rent as I need someone to take care of. A lot depends on tenants psyche. Next year my another Gujarat property will get vacated as my family will move to Kolkata, many prospective tenants are contacting me for rental making international calls just because of my straight cut deal and no hike policy. So, if houseowners are bit considerarate then tenants do behave responsibly. (Of course, background check is a must, if necessary police verification). Advocates are parasites in my opinion, they take money from both side and keep the dispute live. So deal directly, can get a broker with verified credentials and cap the brokerage. Use the broker for first lead, pay within limit then deal directly. Free webpages Magicbrick, 99 acre can get direct link with nominal fees. 😊

    Mere building ki secretary muje terrace use nhi karne de rahi , lock change kardi. Mujhe apne AC ka outdoor unit check krna hota h
    Kyuki muje building k logo pr trust nhi.

    Hello Sir, please explain the agreement type. I mean can it be a Notarised Agreement or it has to be a Registered agreement only. If I prefer a Notarised Agreement of 11 months , would it be sufficient to favour both parties?
    Second, what is the meaning of Leave and License Agreement in which the word “Tenant” is never to be mentioned anywhere because putting the word tenant may go unfavourable to the Landlord in case of any dispute. Pls explain this considering Uttar Pradesh Law. Regards- K K Srivastava

    Light bill becomes a big problem. Landlords take rs 8/rs 10 per unit whereas government rate is. 4.41 per unit upto 100 units. My landlord constructed his half done property on 2nd floor, used light for tiles cutting work, fabrication & fitting doors. Now he's not ready to give share in the increased lightbill. Current month bill is of rs 3000 wheras my consumption of light is approximately rs 800.

    Very well explained the rent act for Leave & License, but what about those who are on Pagdi System? It still prevails in Mumbai and tenants are tortured by the landlords most of the time. All the tenants are not goons who are capable of facing such atrocities. Most of the time the landlords do not allow you to sell the apartment even by giving them their legal share or even more. The tenants are stuck to face the landlords' atrocities, Is there any protection under the law. Especially if the tenants have been living for more than 45 years and paying increased payment which they take under the pretext of maintenance and repairs etc. Is there any solution, please inform

    Kisi insan ke paas ek se zyda makan hon to wo apne chhote bachon ke baade hone tak kiraye per dega, kuch logon ko shauq hota hai ke apni halal/haram kamayi immovable property per invest karein future mein zyada percentage se return aaye.
    2.Tenant ko makan malik ka ahsamand hona chahiyye ke kirayadar apni sahulat ke liye makan rent per liya hai aur promise karta hai ke norms ko follow karunga. Jab aapas mein dispute hoga to hansi khushi ek dusre se dur hojana na ke ek dusre ko neecha dekhane ke liye lenghty procedure mein padhna, donon ka paisa aur auqat kharab. Mind peaceful naheen rahta. Dene walla, achha ya bura karne walla ooper baitha hai hamari har niyyat per uski nazar hai.

    Problems arose during covid when despite government orders landlord increased rent or threw tenants out with the help of police. So double rent as recovery fine should never be included. A 5%surcharge is good enough. Landlord has lot of money, lives in his own house but makes sure he doesn't have to pay for anything from security deposit. That's why it's important to reduce security to maximum one month as tenant had to bear transportation &agent commission TWICE a year.

    What if tenant is asbsconding... after locking the premises. And without paying rent is there any provision to recover the amount due with intrest and legal charges from tenant..
    Kyunki jo lock kar aur kiraya le kar bhag jata hai wo samman yo chod kar nahi jata... aur agar agreement nahi hai to kya kiryedaar per kiraya lekar bhagne ka adhikar hai..

    ऐग्रीमेन्ट किसके पैसौ से बनना चाहिते।वैसे तो फायदा मकान मालिक को ही होना है ।मगर मकान मालिक किरायेदारों से ही ऐबग्रीमेन्ट का पूरा पैसा लेते हैं।जबकि यह अनुचित है,,
    नये कानून में इसपर भी रोशनी डालना चाहिए।

    Agreement में लिखा होने के बावजूद किराएदार जाते समय आखरी महीने में किराया नहीं देते। वो security के पैसे को ही adjust करवाने की कोशिश करते हैं। न करने पर लड़ने को तैयार हो जाते हैं और बिजली पानी की बकाया payment करने में आना कानी करते हैं।

    2 months rent as security deposit for residential premises is impractical, there have been numerous instances of unpaid rent, utility bills, damage to structure, furniture & fixture, appliances in the premises, the value of which goes way beyond even 6 months rent as deposit, but this should be bare minimum amount of security deposit.

    But again, there is always the threat of arbitrary increase of rent of more than 10%. Sometimes the landlord demands 30% increase. The law should bring about a ceiling of rent increase and also a continuity clause. Changing houses every 11 months or changing business premise every 11 months is not practical.
