Sir, mera Adverse Possession ka court case chal rha hai mere Nanaji aur unke chote bhai k beech. Ye ek nazul ki zameen hai. Mere Nanaji k bhai ( ex military man the sirf 10 saal job kiya & early retirement le liya) . Ye jo nazul ki zameen hai usey ek X Military man ne mere Nanaji k chote bhai ko Transfer kiya tha. Us waqt document pe unka hi naam tha, but kharidi k waqt mere nanaji ne funds diya aur 1000q feet me se 500sq feet pe construction kiya. 1989 se mere nanaji waha reh rahe hai. 2008 se mai aur meri family mere nanaji k yaha shift hue. Aur hum mere nanaji aur nani ka dekh bhal krte hai. Hamare paas Electric bill, house tax 1989 se to 2023 tak hai. Aur 2010 me boring bhi krwayi thi. Jab humne 2023 construction krna chaha to mere nanaji k chote bhai ne notice diya, aur ab court case shuru hai. Please tell me sir, kitna chances hai hamare favour me result lagne ka. Hamara to 30 yr se adverse possession hai. Mere nanaji ko to 30 yrs jayda hua aur hame 20 saal hue yaha rehte hue. Please do reply.

I have GPA in my mother's name who has expired , but we have the possession of the property since last more than 13 years. GPA clearly states that owner has granted the unopposed right to take any action like rent out or sell over this property.
Property ID is also in my name and we have been paying electricity bill in my mother's name since then.

Sir 40 साल पहले मैने 30 dimsmil जमीन केवला करवाया था, जिससे केवला करवाया था, उसके नाम पर 15 डिसमिल जमीन था, बाकी 15 डिसमिल उसके पत्नी के नाम था, उसने मुझे पूरा 30 डिसमिल केवला कर दिया था, अब 40 साल बाद उनकी पत्नी ने 15 डिसमिल जमीन दूसरे को रजिस्ट्री कर दिया, मुझे जो रजिस्ट्री किए थे उनका देहांत हो चुका है, अब उनकी पत्नी ने जो 40 साल बाद फिर से दूसरे को रजिस्ट्री है कि है वो कैंसिल हो सकती है क्या ? जमीन पर मेरा जब से रजिस्ट्री कराए हैं 40 साल पहले तब से शांतिपूर्ण ढंग से खेती कर रहे हैं, और 30 डिसमिल का रसीद भी कट रहा है,
If we assume there Six persons involved in that matter.

3. E(origin of plot of land)(D's maternal uncle)(expired person)
4. D(some portion of land buyer from me)(E's nephew)
5. B(owner of private road)
6. A( is the owner of front side land of public road)
*All are alive except E and my father
*E died before my father death
*My father died at the end of 2015
Overall calculation before death and after death:-
{*Hints:-If we consider a rectangular size plot having lenght and width a and b respectively then we take their ratio between a and b and their area assuming a*b. I mean if I consider a is the arm facing east west and b is facing north south. (If East west side a times stepping and north south b times stepping then total plot can be counted.)*} I suggest you keep drawing paper. As I measure a portion of a plot alongwith the same plot, you'll keep drawing a map accordingly
If we assume there is a plot having dimensions 7*4.
In the east side of same plot having 1*4 from 7*4 then west side will be 6*4(7*4-1*4=6*4) and further in the same plot in the east side the same 1*4 parts of the land divide into two equal part then 1*2(north side of the same towards east ) and 1*2(south side of the same plot towards east.
If we denote north side of 1*2 portion 1*2 as 1*2n(n for north) and south side of 1*2 portion as 1*2s(s for south). So calculation should be {1*4(total east portion of the plot)-1*2n=1*2s) and my father bought that 1*2s which khas land portion of the plot. So in 2001, our property size should be {6*4 patta(demarcated)+1*2s khas(south east of same plot)} (complately new land my father bought from directly E) another 1*2n in the same plot is given to the nephew of E (I mean D) by E. (*Remember all calculation is done in same plot havin rectangular size*) But in 2016(by now my father expired but E, the maternal uncle of D is been already expired few year ago) after selling some portion of property from the west side of same plot having 1*4 from 6*4 then remaining 5*4(6*4-1*4=5*4)
Now proposed land should be 5*4+1*2s
NOW COMING TO THE POINT
My father bought a land patta(6*4) west side alongwith khas(1*2s)on south east side in 2001 from E and E is the maternal uncle of D . {remaing part(1*2) on north east side is given the person named D by his maternal uncle and demarcated in earlier. since to maintain total plot 7*4-1*4+1*2={(6*4+1*2)this is portion of my land according to 2001}our newly land} .Suddenly due to financial crises in 2016(I mean my father dies from cancer which cause financial crises and that time both my mom and I don't have knowledge about land and record. we sold 1*4 part all the way west from (6*4) so the proposed that land should be 6*4-1*4+1*2={(5*4+1*2)}. Now I have 5*4 alongwith 1*2 khas land.Till now we haven't demarcated that land.But after 2016 he played a game with us. He occupied that khas land by planting some betel nut trees. And most probably 2023 they sanctioned that land for har Ghar jal jeevan mission without taking my NOC.Now I don't have to access that patta land. Few days ago, I got to know from public health department that khas land registered owner is E who is maternal uncle of D{but after checking on online myself,I can't find that E's name is registered on online} but he(E) died before my father death. If r is the private road of B which differentiate all the plot from South side owner and road is oriented in east west direction.B's house is south west direction of that private road. A is the person who owned a house on south east side beyond private road owned by B. So I don't have access my land
In summary
If we tell about all four side of our property then-our property is surrounded by private land on three sides and government-owned land (khas land) on the fourth side. To the south, there's a private road having orientation east- west direction followed by residential homes, (road is adjacent to my land) which are out of the plot. while to the west, there's a betel nut garden of D owner. To the north, there are rubber garden of someone which is out of the plot. Towards the north east of the same plot there's house owned by D and towards north south of the same plot government-owned land where a water tank is being constructed without taking my NOC, and both khas and D's land is almost same size if you consider lenght to lenght and width to width and further east, there's a north-south oriented road. The nearest feature to your property on the east side is the water tank.

for government properties Adverse possession is 30 years if the British government has given on lease land to a trust for 99 years and later Indian government comes in the picture and claims the land to belong to them on this land there is a building in which trust tenants are staying who have No connection to the government body they pay pugree to the trust rent to the trust can such tenants claim Adverse possession on the land.
Can The ground floor tenant of the trust the land of the government the government knows about the tenant but says they do not recognise the tenant and Sat they only recognise the trust if the trust dissolves and tenants living more than 30 years can they claim Adverse possession.
Government is aware of the possession of the tenant never raised any objection possession over 30 years.
