I was in jail (Salt Lake City, Utah) with this guy that violated his pre-trial protective order 33 times because, he couldn't stay off the phone. He was charged with DV (Domestic Violence) of his GF. They instantly "flag" calls made to certain numbers. Doesn't matter the context. If you ever find yourself innocent and in a position, make sure they mail you with a pseudonym from the post office telling you to call that burner. No particular stuff. Keep it extremely vague and have CODE. i.e. "So which chess piece is your favorite?"
one of my friends had a client like that. dude got taken in for violating a DV protective order with calls and texts, then got himself another 10 violation charges for jail calls to the ex. it’s wild how often people are that dumb or just don’t care/get it.
Hey Bruce, I work for a company that monitors jail calls in NYS. Any call placed to a lawyer is considered privileged and cannot be monitored even if it's done through a 3 way. However, if a call is placed to a lawyer's office, but it goes to voicemail or they only talk to the secretary the call is not privileged. A lawyer must actually be present on the line for the call to become privileged, and many times inmates will leave detailed messages for lawyers. Also inmates have a limited list of phone numbers that are curated by their counselor. 3 way calls are technically not permitted, but the technology to stop them is really inconsistent and 3 ways happen all the time without being terminated.
I live in New York state so in case I run into future legal issues in the future I know not to leave my lawyer a detailed message or talk to the secretary.
Tate is not in American prison though so their rules are likely different . Also, while the calls themselves may be privileged prosecution or investigators can use that knowledge as a springboard to find other things and you'd have to prove the calls were monitored. Which without hard evidence you would be admitting to knowing of criminal activity your client was taking part in.
@@benf6822 yeah, I assume the rules would be different. Especially since New York State is SpEcIaL and needs to do everything with such needless restrictions and guidelines that I'm sure most other states will have different rules, let alone other countries. I am not sure what you're trying to say about the prosecution using the privileged calls as a springboard. I think you mean they could still listen to them and just act like they didn't. I have no idea how it would work in Romania, but at least where I am a prosecutor isn't entitled to any calls that come out of a prison. Those calls are property of the company that supplies the telephones for the prison. There are not only company policies to ensure a person's rights to privacy in the legal system, but laws stating those calls cannot be listened to. The company who owns those calls would get in serious trouble and probably be heavily fined and lose their contracts if it ever came out that privileged calls were being provided to or used by prosecutors to gain an understanding of potential crimes. Again, I have no idea how Romania works, but I'd assume they wouldn't be able to listen in on privileged calls either.

I was a Corrections Officer. We had a inmate that came in sick and he got real sick then even sicker. One night as I help the nurse I asked "Has anyone check his blood sugar"? SO The nurse gets the blood sugar test and low and behold it was so high the test device could not even to begin to measure his blood sugar. The nurse gets another one thinking it was broken, but it errors out. At that point we Don't have the means to care for him and transport him to the hospital were he dies 4 hour later of complications from diabetes sugar level. The sad part was not one Doctor or nurse took the time to check his sugar level in 2 days 18 hours. The doctor at the hospital said he should have died 2 days ago it that high. If the medical staff at the prison would have read his chart coming from county and did their job by given him a full check over He would still be alive.
@Desolate Survival Gaming damn, it’s almost like when you break the laws, society deems you less than. Because you are. Crazy how a prisoner dying isn’t a major loss to the world. Insanity
I remember when I was in jail and I can’t count how many times (especially in domestic cases) these people had called their girlfriend or whatever and then it’s time for court and they go “judge we have new evidence” and each time it’s always a recorded call from jail lol. I would tell people they do listen to those and they didn’t believe me
They wouldn't even have to monitor each call either. In a domestic case the prosecutor could just ask the girlfriend "Have you had any contact with him since incarceration?" "Yeah he called me a week ago" or they might even hate them enough to call and tell without being asked. It also wouldn't be hard to look at a list of numbers called by each inmate and match them with numbers they shouldn't be calling and then go back and get the recording.
Same. Did something stupid and spent 18 days in jail. The conversations other guys had on the phone were mind blowing to me. And each call says tgg he at you are being recorded when you place it. And in the dorm style block they discussed their cases at length with random strangers. My calls were limited to “I’m fine. Back in - days.”
My dad got done in for that because he was talking to his daughter (my sister) Nothing was wrong with that however he had to call his ex wife to talk her which his ex wife had a restraining order on him All those phone calls were brought up as evidence of my dad breaching the restraining order

They are still gathering evidence to charge. From what I have gathered, they have enough to meet the threshold for human trafficking. But new details are recently being discovered, for example it only came to light a couple of weeks ago they tried to get inside information out of the police (a new charge), only a few days ago they froze his crypto currency as I imagine new information came to light about that. organised crime is complicated and takes months to paint the full picture. They could hsve sentenced him based on the immediate info they had, but it wouldn't have been an accurate reflection on the full body of crime. Preventative arrest on someone with ties to mafia, and lots of money who Is involved in organised crime is necessary. He would be a significant flight risk and his ability to manipulate the press and victims with his connections on the outside world is too high.
Yeah it seems clear the human trafficking charges have weight but tax evasion and running a criminal enterprise are more sophisticated crimes and require detailed financial evidence. That takes time to gather and I'm sure that's what's causing the delays in going to trial.

I work for a public defender’s office and SO many people call us from jail on 3-way and it makes no damn sense! If they give their attorney permission to talk with mom/dad/baby’s mama/another person they trust, the attorney will keep them updated too. But why subject yourself to recording/monitoring?? Our clients can make free, private calls to our office, but if they call any other # it’s expensive. please correct me if i'm wrong , but i think the reason why the prosecutor didn’t charge them yet is because they need more time to fully investigate this case , not because they don’t have evidence but maybe because they found more illegal stuff in this case , so they need to investigate more. they can charge them when they’re ready. if the prosecutor just charges them , they can’t continue the investigation. why? it is because charging them immediately would be bad because they would lose the ability to do more investigation , to dig up more information, and to dig deeper into this case. his fanboy keep on saying " they don't have any evidence otherwise they would have already charged him by now. romania's legal system is corrupt. " they have no understanding of how their legal system works and their opinion are solely their own. you absolutely do need evidence to extend the detention , plus the prosecutor was given 180 days for the criminal investigations. so just let them do their work and we just wait for the trial.
You have the gist of it: they probably have more than enough evidence to take the case to trial, but the preventative detention their system allows for means that they can continue to conduct their investigation and make that case *ironclad* and expand it to wherever the evidence they dig up takes them, while Tate is sidelined and unable to (mostly) interfere with it (he's still trying to interfere with it, via frivolous defamation lawsuits aimed at the accusers), and take the case to court in their own dang time, provided they can continue convincing the human rights judges of the merits of continuing to extend his detention each time (and then convincing the inevitable appeals court judges to uphold those rulings). The cope from the tater tots that "there's no evidence" and that's why they haven't filed charges yet is pure delusion on their part, Tate would already be a free man if that was actually the case.
There’s truth to that. I believe that whatever you charge someone with in court, you have to prove that specific charge. If new charges are brought up after the fact, you can’t simply just ‘add’ them to the same case and try to proof said added charges. An entirely new case has to be made. And that takes time.
There is so much evidence for them to go over, it’s not just the trafficking and SA it’s the money laundering too. They can’t let him out because he’s already said he will flea to Dubai and he’s a danger to women and the victims involved. I really hope they charge him soon though as it’s been going on for months
@@matthewyoho5422 taters statements is something that can be used to corroborate evidence even if it's taken out of context. I get that. However I'm surprised that there hasn't been an indictment handed down yet. He should be detained without bail because of the serious charge but where's the charges? I'm still waiting for the charges. It's been 90 days already.
@@conlawmeateater8792 You'll see those charges when they either run out the entire potential 180 detention period, or if the judge declines to extend that detention by the next requested 30 day increment (and then the court of appeal upholds that decision), whichever happens sooner: unless DIICOT thinks they've exhausted all their avenues of investigation, and there's nothing further to be found, then there's really no reason for them to rush things - it's only the (potential) halfway point.
I'm so sorry and hear you so much. It's not right. For profit rehabilitation never works. They Carr about what they get and how to treat whoever any kind of way more than anything and it's so detrimental. I hope things get nicer and easier. Never had to be like any of this 🍀🍀🍀

Indeed, the system listens and claims they “stop” once it’s determined it’s “attorney/ client” call but never believe them. Those calls can destroy your case, bcuz everything can be used, and abused, by taking it out of context. Do not talk or admit anything!!!
Well they can't use it as evidence if it's just between you and your attorney. Even if they put it forward the court should reject it. Also the conversation being privileged doesn't mean they can't listen it just means they can't use it as evidence in court.
@@jordanchen23 thats what i was gonna ask if you call your lawyer and they start the call stating their name and law office wouldnt that be inadmissible?
@@fetusthegreat9797 but attorney client privilege goes out the window if the communication takes place where others can listen in (i.e. Conference call or speaking on public venue).
Yikes
Damn! They prob gave him time served at court. 🤣
he was in love >.>
one of my friends had a client like that. dude got taken in for violating a DV protective order with calls and texts, then got himself another 10 violation charges for jail calls to the ex. it’s wild how often people are that dumb or just don’t care/get it.
Damm foreal!! They really be giving him multiple chances. It’s probably his tantrums.
He is in Romania where NO American laws apply!!!!!

The plan was for him to die.

My dad got done in for that because he was talking to his daughter (my sister)
Nothing was wrong with that however he had to call his ex wife to talk her which his ex wife had a restraining order on him
All those phone calls were brought up as evidence of my dad breaching the restraining order

He would be a significant flight risk and his ability to manipulate the press and victims with his connections on the outside world is too high.
fantastic info!

Plus the telecom co the jail here uses can sometimes detect the 3rd party on the line & will disconnect the call anyway.
Does the Telcom co have an automatic program that automatically disconnects you after a 3rd party call?

@@bbbbbbb-y3ugood to know. He may know a "guy" 🙌
please correct me if i'm wrong , but i think the reason why the prosecutor didn’t charge them yet is because they need more time to fully investigate this case , not because they don’t have evidence but maybe because they found more illegal stuff in this case , so they need to investigate more. they can charge them when they’re ready. if the prosecutor just charges them , they can’t continue the investigation. why? it is because charging them immediately would be bad because they would lose the ability to do more investigation , to dig up more information, and to dig deeper into this case. his fanboy keep on saying " they don't have any evidence otherwise they would have already charged him by now. romania's legal system is corrupt.
Great video as always but please take some time to get consistent audio levels across your videos.
