This quest stumped me too at first. You have to tell him "ok, I will go back" and he will immediately disengage you and walk into the bathroom. At that point you have to pickpocket his key while he is at the urinal and proceed to his office using the now unguarded elevator. If your lockpick skill is high enough you can bypass the pickpocket option and proceed directly to his office using the elevator. Don't forget to grab the skill book on his desk after you retrieve the sensitive files.

Then use the Cottonlark Feather to tickle the man’s undercarriage when approaching from behind. You’ll be able to get the key even if you’re Level 1 Pickpocket.

there is no expectation of privacy in public. publicly funded and publicly accessible buildings indeed fall under first amendment proection. you are also constantly being recorded out in public by comercial and private security, traffic, private and public dashcams, teslas etc. i wonder when the last time you signed a release for any of those recordings?

It's America, not Australia, and "getting told no" is not going to mean anything in this context. Legally, the guy filming is the one in the right. He's not in a private building - he is in a pubic building and is therefore allowed under the First Amendment to film in a public space and hold the police accountable for whatever they're doing. Now, don't get me wrong, I am not a fan of these constitutional auditors because they tend to be purposely uncooperative by refusing to tell people who they are and why they are filming and provoking these altercations for UA-cam views, but technically, it's the bald guy who's ignorant of the law. He should have called a superior to clarify the situation instead of acting like a wannabe tough guy.
