Yeah I agree. UA-cam needs to take some of the blame for this. It keeps happening under their watch and they are not doing anything about.. ya know why? It's probably because they are gonna have to hire actual people to work in the copyright department which means less revenue for investors. So they rely on algorithms cuz it's cheap. Obviously.

It always becomes an unusually sad and heavy court case when the victims are somehow complicit in facilitating their own theft. You can not get away with doing nothing to stop the thieves when they are not even armed to hurt you!
UA-cam is the primary profiteer as they get a percentage regardless of who wins the claim. This is clear selective enforcement. If the DA hasnt prosecuted anyone else (namely youtube), they are selectively choosing who and when to prosecute which is unenforceable. This guy needs to appeal. The entire judicial system is illegitimate.
Also, if you contest the copyright claim, the "company" who claimed it gets to decide whether or not it was a false claim, which they never do of course. Can't believe youtube still doesn't recognize this as a major oversight in their platform.
It’s insane. We had an old song get claimed by someone because 2 seconds of it sounded like a couple notes from their own song _that was uploaded several years after ours_ 😂 Fortunately it was one we hadn’t cared about for years & it’s not like we ever got big views, so it didn’t matter much. We did try to contest it at the time for the hell of it though, and exactly what you said happens...is what happened. “Oh well whatever” & all, but when it happens to a relatively popular artist/band/creator I can only imagine how frustrating it is
This really high-lights how batshit inane UA-cams approach to copyright is. “Hey that’s mine” seems to be all it takes. Their only concern seems to be removing themselves from any liability at the expense of their own content creators.
As a musician I cannot tell you how frustrating it is how easily some random person can just claim your music. There are processes you have to go through to get the copy right back to it's original owner, but it's so much hassle when the original person that stole it basically just said "yeah that's mine."
I'm in a similar boat. Are there any prophylactic measures small artists can take to stop their music from being claimed by others? Does having everything on Spotify or registered with ASCAP
@derekalexandersmith definitely with your P.R.O. it might be a slow process to get your rights back. But at least with registering your tracks with ASCAP, BMI, etc. You already have the intial rights. So ultimately youll have a strong case.
Look here, Jay z was going to buy his child a new 120 inch plasma screen television, now thanks to these pirates he can only afford the 100 inch plasma screen. Still think piracy is cool?
@@derekalexandersmith You can create another account and copyright strike your own songs so you still get all the revenue, youtube doesn't care about the copyright system enough to stop you, they don't even stop others from copyright striking other people's videos unrighteously.
UA-cam needs to add an option where you can fight a claim due to lack of standing or fraud. It is so archaic that the CLAIMER gets to decided whether to drop the claim, which they absolutely never do. I talked to a UA-cam rep about this once and the only real advice they gave was "seek legal counsel". So for small creators like me, we are basically screwed.
These dumb rules are probs older than some of youtubes reps at this point lmao. Data analysis has come so far since the days of ray william johnson and =3, when these rules were necessary. They just don’t care because they think these rules don’t hurt youtube, just creators
Well, if you are a smaller creator then you could always take UA-cam to small claims court. It doesn't cost much and usually lawyers aren't allowed. It's basically like Judge Judy. If UA-cam doesn't send someone to show up then you automatically win.
Soooo true ishowspeeed copystrikes any video that just says his name doing pretty much the same thing I guess that why his name wasn’t brought up in the video cuz ishowspeed and his team probably will copystrike me for saying his name in the comments smh
I still do not encourage or endorse committing any sort of grand larceny or theft on the internet just because you know there is a light sentence for stealing music money from other users. 5 years and 10 months in prison will feel even longer when you actually experience that prison time for yourself. I wish I knew enough about UA-cam to know how false copyright strikes will eventually harm the bottom line of the higher-ups, and not just the bottom line of individual users.
@@Adamkalb1 They don't actually. UA-cam themselves take a portion of advertising revenue from each video. The part you steal with false copyright is the creators portion, completely separate from UA-cam's portion, so it cost them nothing so they aren't in a rush to fix it.
Same the only thing is the restitution if they make him pay a certain amount and that's the only thing that could suck cuz if u don't pay u go to jail again and again like child support but out of 23 million I know he still has alot somewhere and they probably only charged him less than 3 or 4 million restitution when he gets out unless he made a deal and gave them a couple million when he got prosecuted
@@FireGodSpeed Wrong. "Teran personally obtained more than $6 million in personal profit, which he used to sustain a lavish lifestyle. " "The government requests that the Court set a restitution hearing to determine an appropriate restitution amount. The PSR set restitution in the amount of $1,464,717.90. (PSR at 24-25). The government is actively working to obtain information from other victims, which is a substantial undertaking because the majority of victims reside outside of the United States. The government has recently expanded its notification efforts to include Spanish-language notifications and is further widening its public outreach. A future restitution hearing would afford sufficient time for additional victims involved in this case to come forward. "
The important question is whether the $20 million were seized from the scammers or not. 5 years is getting off easy and last thing you'd want is for them to still have even a cent of that money when they return.
If other comments are to be believed, he was ordered to retun $1.4M of it. So basically nothing. I'd spend 5 years in prison for $20M every single day. It's basically like having a job that pays $4M a year.
@Lightn0x the date for the restitution hearing hasn’t been set yet. They mentioned $1.4 million in the article but they are still looking for other victims. The final amount won’t be decided until the restitution hearing is complete. That article also said that the $23 million that was scammed was split between at least 5 other co conspirators
@@Lightn0xll his money was seized. Only 1.4 million of it was returned to the victims because of logistics. It would be dumb if he was allowed to keep all that money when they knew how much was stolen
All you have to do as scammer is to gift that money to family or invest it outside of country you live, preferably in country with no extradition laws like Argentina and you will never have to return anything. I don't think there was single person in history of USA to actually pay what court ordered. It's almost always settled outside courtroom at much much lower sum as most scammers will have very little if any money that can be connected to them. I worked in European IRS for years then as accountant, trust me they will not pay anything, they will return to same scam in matter of days, we even got some people continue to do scamms from within prisons by proxies... It's YT that needs to change it's policy or nothing will change
The law should consider crimes like these as Grand Larceny. It is the same thing as stealing 23 million dollars from a bank. Give him a life sentence please
Wow. That is very sad and pathetic how UA-cam's community guidelines and rules against false copyright claims and false copyright strikes, do not value the security of their users like a real bank. They do not take cheaters of the copyright system seriously enough to de-incentivize these offenses from happening again simply because they think they are big enough to recover from this. UA-cam wrongfully assumes that no grand larceny will be grand enough to shut them down forever, not even shut them down for a short week.

Idk man. People all over the video are commenting on the "weak" sentence that he got. But he got 2 years. 2 years is probably enough for rehabilitation. The guy didn't commit any murder. And I am quite sure all his stolen money will be seized. Getting even 2 years of jail time will also hinder the guy's ability to get employment, so yes, there is a permanent punishment he will be facing for the rest of his life

5:58 wow it's almost like it's UA-cam's fault for allowing this type of shit to have even occurred. Maybe every single person who approved his royalties or whatever should get 5 years in jail too.
Between the copyright claim scammers, the copyright claim abuses by legit publishers, and the outright wrong copyright claims being asserted by UA-cam, I hope that there is eventually a class action lawsuit against UA-cam for their accommodation and facilitation of all of it. In an age where AI can identify and discern and analyze and report, it is ridiculous how all of these scams and abuses are possible at all, which has gotta make you wonder how much YT profits from allowing it all.
@YouCouldBeHere yeah literally any idiot reporting you, or if you write *swear word* YOU, or YOU *swear word* it will auto delete comment if you post and then likely give a 24 hour mute, it's fucking pathetic and if you just swear too much in general. i swear alot and it's CONSTANTLY giving me the "R U SURE U WANNA POST THIS ITS SOOOO MEAN!!!!!!:(" bullshit popups, where if you click anyways it INSTA auto deletes/doesn't even post, and after a few times in a single day it triggers a mute... it's a joke now
UA-cam needs to be banned from using AI and automation for copyright stuff. Like straight up And be forced to hire the appropriate HUMAN manpower to compensate. Let's see how much this shit dies overnight after that happens.
UA-cam is complicit in an astronomical amount of illegal activity, and they tacitly encourage it. The problem is they have essentially unlimited money from Google which means huge law teams that no one wants to go up against.
Legally speaking what youtube does is the safest route. They involve themselves as little as possible so in case something goes wrong the 2 parties are supposed to duke it out in court and not be able to involve youtube. On the other hand if youtube reviewed the claims then they would be an active participant, meaning every time a fake claim comes up they would be included in the lawsuits.
@Select2Play at this point there has been so many false claims there is no possible way that youtube hasn't reviewed at least 1 of them they should be held accountable for their blatant complacency to what is very obviously happening and has been happening under their noses for over a decade now. They cannot hide behind the bs "We didn't see it happen" argument at this point especially when so many prominent youtubers have either called them out for allowing it or flamed them on Twitter about it
@@ProfSplendorFactionespcially when youtubes team is more than aware of false copyrights in the music industry. They should be held accountable for being bad at their jobs

Right? I see so many scams and scam ads, and yet they put more time into fucking over honest content creators than protecting users from actual villains.
Bruh. They don't even bother trying to fix the bot problem on here, you think they give enough of a shit to deal with something actually legally dubious?
The real issue here is that there are almost always no repercussions for issuing fake claims or takedowns, from youtube or the law, unless they are really brazen about it.
Imagine if he stole that money from a bank, he would have way longer sentence. But justice system seems to think its not a big deal when it comes to this situation
Honestly it’s a shame how low brow some sentences are for financial crimes in the United States. It seems like even a grand larceny charge (stealing more than 10,000$ in stuff) often gets people more time than more white collar esque crimes like embezzlement etc.
grand larceny charges are NOT 10k, it's like a few hundred/thousand... i got hit with grand larceny over like $800 that i didn't even take(the fuckin kid blacked out drunk and put it in his glove box and literally was dropping 100s on the ground and lost soooo much money and then him and his mom were mad so called the cops and said we stole it, which is why it ended up getting dropped) so it's ABSOLUTELY not 10,000.
One of the things I find to be super irritating is when you pay to license sound packs in perpetuity and mix some audio for a video from it, and then some a**hole copyrights your video because they licensed the same audio pack and used it for some song they made. It’s just so irritating that UA-cam allows this to happen. I’m glad this guy got fried for it, but it need to happen more. There’s a ton of this bullsh!t going around. It’s infuriating.
UA-cam seriously needs to have a penalty system against content ID/copyright abusers. Like the community strike system, there needs to be consequences to remove abusers and make it harder for these people to profit off this abuse to this level.
I love how they say it's a hefty sentence but if if he stole the same amount from a bank or company he would have gone into the slammer for 10 to 15 years
My theory for why financial crimes get such light sentences is because then it sets a precident that benifits certain groups of people. Like politicians.
It baffles me to no end how a human being can do something so absolutely vile to ANOTHER human being without being remorseful enough to think twice. the world we currently live in is absurd

I remember when PewDiePie just mentioned Despacito in a video title, didn't even play the song (half attempted a couple chords on a guitar) and the video was claimed 27 times for a song _that wasn't played in the video._ So 27 people, individuals or parasitic legal firms, claimed the video saying they represented the copyright holder, and UA-cam said 'oh, yeah, seems legit'.
Jim Sterling had this problem for so long, they usually only take money from Patreon and leave all the youtube video completely ads free, people would false claim the videos and put ads on it, so they decided to copy right claim the videos first and deny all the ads to be placed on the videos
There have been copyright troll attorneys that have gotten 14+ year sentences & this guy only got 5? Plus it's not like they're gonna take away all of his money. Yeah, had the same at around 2011-2012 and it was kind of a big deal amongst music producers. There were topics about it on various forums. Fact that YT didn't look into it makes me wonder... Is it because they get a piece of the pie?

There's nothing more satisfying than watching these scumbags getting what they deserve! Scammers are some of the lowest of the low, especially the ones that prey on the vulnerable and weak.
Well the way the judicial system works, as far as I think this went is that he actually made a plea deal and had a pretty badass lawyer backing him up. Ive seen these things happen all the time. People who should be getting some serious time dont because of that. Now his initial charge probaby was like 20 years, but a plea bargain and his lawyer talking to the district attorney could have made an agreement to just 5
Or just the fact that non-violent offenses aren't punished as harshly as offenses where the person threatens murder to get what they want. Five years is a pretty long time, and it is funny how any sentiments of rehabilitation and not doing over-harsh sentences go away as soon as the presenter was the one wronged.

Still think piracy is cool?
i think i saw someone say you can copyright yourself to avoid getting scammed is that possible or no
@@derekalexandersmith You can create another account and copyright strike your own songs so you still get all the revenue, youtube doesn't care about the copyright system enough to stop you, they don't even stop others from copyright striking other people's videos unrighteously.
Yeah all people want is literally a place where they can provide evidence when a claim is based on nothing lol is that so much to ask for

Well, if you are a smaller creator then you could always take UA-cam to small claims court. It doesn't cost much and usually lawyers aren't allowed. It's basically like Judge Judy. If UA-cam doesn't send someone to show up then you automatically win.

@@Arancil It's highly likely that it will be way much less than 23 million after the 5 year sentence.
It's basically like having a job that pays $4M a year.
now that the government knows he got that much they will want a huge piece of that. he probably paid the government so he only got 5 years
@Lightn0x the date for the restitution hearing hasn’t been set yet.

UA-cam should be sued for being complacent in royalty fraud and for allowing this to continue blatantly
Filling a false DMCA claim is Perjury and that carries a max sentence of 5 years.
Welcome to America where the rich get off easy and the poor are scrutinized for every little thing they do and eventually end up in jail as slaves.
He did it on 50 thousand songs though? Why only 5 years
grand larceny charges are NOT 10k, it's like a few hundred/thousand... i got hit with grand larceny over like $800 that i didn't even take(the fuckin kid blacked out drunk and put it in his glove box and literally was dropping 100s on the ground and lost soooo much money and then him and his mom were mad so called the cops and said we stole it, which is why it ended up getting dropped) so it's ABSOLUTELY not 10,000.
One of the things I find to be super irritating is when you pay to license sound packs in perpetuity and mix some audio for a video from it, and then some a**hole copyrights your video because they licensed the same audio pack and used it for some song they made. Raped and beaten for five years. Once the other inmates find out how much money you made you will be exploited.
@@elitedavidhorne8494 just wait till you learn the rich don't have to give that info up and low security prisions have tons of Safety nets for them. This is north america, what do think we are savages who give the same treatment for the rich?

I'm just amazed how he thought he would get away with it
he did for 5 years and only got caught because he made the IRS get suspicious
@@burp2019 it took that long for them to catch on?

The world could definitely use some more smile checkpoints. Thanks, Charles :)
An old con artist once said "it's more profitable to ask for forgiveness than permission for anything" but scammers gunna scam and stupid people gunna pay that's how it works
Only 5 years?🤦🏿♂️He definitely doesn't have regrets
I doubt UA-cam will do anything about this, this has been going on for more than a decade, to a lot of people. I had some of my music claimed back in 2012- 2013 by the same kind of fake society with "media" in the name. I don't even run adds on any of my stuff, but these assholes did. It stopped a few years later (they probably didn't make enough from it). But it shows that they're doing this on a large scale, and even on small creators, at least at the time, before the ad-pocalypse. I'm sure that they have programs that do it automatically.
Yeah, had the same at around 2011-2012 and it was kind of a big deal amongst music producers. There were topics about it on various forums.
Fact that YT didn't look into it makes me wonder... Is it because they get a piece of the pie?
@@kenn_foxx5563 It might be. I mean, from their point of view, any ad is better than no ad at all.
But OGs like us fondly remember the time when YT, and everything on the internet was free, and ad-free.
Thanks for the happy checkpoint, Charlie!

It’s nice to know that SOME people get their comeuppance for their actions
5 years sentenced to Federal Pound Me in the Ass Prison 👨⚖
Ill say the same thing I say about short sentencing for paedophilia.
If the justice system cracks down on these kind of people, they'll be damaging their employer.
It only makes sense to give minimal sentences to crimes which politicians and their buddies are expected to commit.
23 million for 5 years of my life? I've been doing this whole thing wrong apparently. Been working WAY longer than that for WAY- WAAAY less.
He definitely deserves it, he could literally be set up for life with the ten million but nah he was avaricious
He is still set for life bro. He spends 5 years in the slammer then he comes out a multi-millionaire. This sentence is nothing...

I would totally spend 5 years in prison for 23 million dollars, it's not even a punishment
If they don't take the money away it's so worth. Also would probably be in a lower security prison.
