You can't divert it by drains or in this case, extending a roofline on his shed, so that the water from their roof flows over to the neighbor's property. This is why you're supposed to pull permits for building structures, submit plans and have inspections so that your structure meets codes.

Was the 5ft ordinance in effect that many years ago when the sheds were erected??? Were they ever grandfathered??? I can see where the water could damage the shed wall at that height after seeing the pictures... the overhang would've diverted the water... it's not clear how long the overhang had been there vs. just the gutters... either way, it seems like both sheds need to be moved... The sheds were built 35 years ago. The law up till 4 years before was the clearance had to the property line was 3 feet. 35 yrs ago they probably did not need permits to build the sheds.

The top of that wall isnt damaged just the bottom. The defendant was wrong for that. He purposely put a slanted roof to divert water to her property. That is WRONG.
The defendant added an eve that allows water run off to drain onto his neighbor, yet they think she is the problem? They call her the trouble maker, not hardly.

My county is pretty crap being timely with permits. I'm still waiting to receive one for a fence that was installed 3 months ago. I gave them over a month to respond.
Living that long next to each other, barely any problems for most of that time until the sheds were falling apart, and with that, the sudden realization that they were both not built on the right spots for many years, THEN these neighbors had bones to pick, that is amazing. There are neighbors today, who can't stand each other within weeks of becoming neighbors and will brutally fight about petty drama and clog up the court system with frivolous lawsuits about it. These litigants, had decades of being alive, and decades of peace between them, both sides existing during times in History, where life was not easy for everyone in the world, and you just had to make the best of things, not sweat over little stupid things, and being helpful and neighborly with each other, people today need to learn to have the patience for that again, learn from those who had it a lot harder and still wanted to make an effort to get along with others. Both sides in this case, were smart to have this quickly resolved in court, hopefully now things are peaceful between them again and they can continue to enjoy the rest of their lives.
