- Imagine if one of your children wanted to wear a Gadsden Flag shirt, or a Washington Gun Law hat to school? What would the school district do? Washington Gun Law President, William Kirk, discusses that exact scenario in the matter of C.S. v. McCrumb, a case now before the 6th Circuit Court of Appeals. The challenge here is to a schoold district's determination that a "come and take it" hat was inappropriate for school attire. Problem is that this issue is pretty well-settled case law and this now opens a whole new can of worms of litigation. So, learn more today and arm yourself with education.

The school board has no constitutional right to be offended in proxy.
School Board = gov (municipal) entity. It has no rights under fed constitution, not even powers (it only describes federal/state powers)...the only place that municipal power is derived from is each State's Constitution: yes they have wide, largely unregulated power...but it can NEVER trump even fed/state law, let alone fed constitutional rights.
When I went to elementary school it was in the 90s. My friend and I got called in to the principal's office for reading military history books and talking about guns during breaks. One of the teacher's aides said it was, "concerning" and got that "zero tolerance" ball rolling. Our parents got called in. My friend's dad arrived before mine did, and he was completely on our side. It was one of those defining moments where I learned that it was okay not to trust adults in power, and to stick up for yourself against adults in power.
I was in grade school in the 1960s (I'm 65 now). TV shows that I watched in the mid-60s included Combat, with Vic Morrow, and Twelve O'Clock High (a series about American B-17 bombers in WW-II). I thought nothing of drawing pictures in school of B-17s dropping the bomb loads with nazi fighters swarming around them. Funny - no teacher ever reported me for being a war monger. I just thought the TV show was interesting, and I've always been a history buff since. Btw - I also loved Lost in Space, Voyage to the Bottom of the Sea, and The Outer Limits.
@@KevinSchwinkendorf pretty much what we were studying. We didn't think about it at the time, because why would reading books from the school library translate to that? We're still history buffs in spite of it happening. The teacher's aide use to tell students they didn't have to do pledge of allegiance due to the 1st Amendment, but forgot the memo about reading our material also being under the 1st Amendment.
Great to know! Glad the Courts did the right thing!
Just because someone is offended doesn't mean anyone has committed a crime. If some people are too soft, that is entirely their problem
Some people deserve to be offended.
Would you be offended if you came to understand that "the right to keep and bear Arms" never existed in English as an overall context from day one? It was intended to be a constitutional legacy and originally authored by Benjamin Franklin according to these 1000+ letters.
“History may distort truth, and will distort it for a time, by the superior efforts at justification of those who are conscious of needing it most. Nor will the opening scenes of our present government be seen in their true aspect, until the letters of the day, now held in private hoards, shall be broken up and laid open to public view. What a treasure will be found in General Washington’s cabinet, when it shall pass into the hands of as candid a friend to truth as he was himself!”

Its explicit. Just clever. A constitutional right to peace that demands common sense arms laws AND NOTHING ELSE. The only arms any american will be allowed to have are not the ones currently found in gun violence incidents from sea to shining sea. No more handguns or AR15s. Think only hunting with limited clip hunting rifles. They will also be well regulated of course but should be fine in the public domain.
Just don't elect a tyrant. In a democracy the PEOPLE are goverment. This is much different than having a king.

The opinions of Heller versus Columbia will be rendered null and void. That ruling in no way had anything to do with the second amendent.
You also cannot have a right taken away from you that never existed.
Well LGBTQ shirts are offensive and my children don't believe in such ways it is against our morals, values, and beliefs. So making my child wear a LGBTQ clothing is a violation of my child's rights.
A valid point. Seems to be some "disparate treatment" in the school system. Isn't that illegal?
Just exposing our children to others wearing alphabet mafia propaganda is harmful to other students under that school's policy...
Valid
WHO is making your child wear such bullshit clothing?
first: what parent would give his or her child that?
second: just ignore it.
They’re not teaching kids how to live in a free country. quite the opposite in fact.
The Public school system devised by John Dewey was specifically designed to train mass conformity as part of his Marxist and socialist ideology. Through a means of repetitive behavioral compliance iterated via physical activities, the child is conditioned to respond with obedience to continual orders from the teachers. There is no real instruction other than this, as you can’t get 30 students to focus on a subject for any meaningful amount of time in most classes. Class time is broken up into 45 minute blocks for this purpose of behavioral reenforcement and conformity. John Dewey was always anti-American, but couldn’t come out in the open with it.
School should be canceled then.
@@MichaelC76x - or at least the NEA.
Ideally, all public schools should be turned into private schools.
@@johnh.tuomala4379 Labs, gyms, recreation, sports, shops, and multi-use facilities. You can still have all the football you want, but there's no need to pack kids into classes all-day, 5 days a week in the information age.
Need more academic and scientific competitions, agricultural studies, local energy management, construction sciences, engineering, where companies work with students and attendees to find what disciplines everyone gravitates to in prep for their services and employment tracks.
Reminds me of when a school said that a kid couldnt wear a "dont tread on me" patch on his backpack because it somehow was related to slavery
Or the kid with the pop tart gun.
"don't tread on me" speaks for freedom ,marxist masters don't recognize freedom for enslaved citizens.
they must be teaching that slaves want to be treaded on.

In highschool I wore a T shirt that said " Guns dont kill people, abortions kill people"
We need those now.
I have a shirt that says
I'm pro choice... Has multiple styles of pew pews 😂😂🤣
I'm pro guns but it's just a fact that guns, while capable of doing other things and being used safely, do in fact excel at killing people, there's a reason our soldiers have them, why cops without judicial authority get to skip the legal system I don't know

SECOND AMENDMENT and all!
The substantial disruption seemed to be caused by the school administration.
Let's get some "Don't Tread on Me" and 2nd Amendment hats and shirts for the kids. We need to change the culture in the US to be one of familiarity, safety, and commonality of firearms and their appropriate uses. Both of my kids are well-trained and safe with firearms. We must train and familiarize our families and friends with firearms to build the base and change the baselines.
I don't like just advancing any amendment on its own as if they aren't all intertwined. I mean, that's the point of the Bill of Rights. Personally, I want ALL of them protected and revered.
Get the kids 'Bill of Rights' Tshirts and I'll send you some dough.
IMO, if children knew more about firearms including safety rules and by the time they are in junior high knew how to determine if a firearm is unloaded and if it is not; know how to clear it, we'd have a lot fewer firearm incidents.
How about a shirt that says "MY DADDY IS A CIVIL RIGHTS LAWYER AND WILL SUE YOU IF YOU DO ME WRONG"
@@charlesnash2748 If law enforcement and prosecutors did their job and put gang members behind bars instead of trying to use their crimes as an excuse to disarm law-abiding citizens, we'd have even fewer firearm incidents.
We are fighting the entirety of the public education system, which vehemently stands against everything you said. They would rather convince a boy that he is a girl and should mutilate himself than teach him about safety with firearms.
How insane is it to realize that? They would rather encourage and enable a severe mental illness than teach kids how to be safe when dealing with a loaded gun.
Schools have been for decades now, the single largest violators of first amendment rights, among other things, and so few people even notice, much less care. Even when I was still a student, the schools in my area were bound and determined to control what we wore, what we said, and what information we had access to. It's sickening.
@@koveras225 Look at the similarities between students and prisoners. Both are transported on buses. Both eat in a cafeteria. Both are subject to strict schedules. Both are marched in formation to activities. Both have no constitutional rights. Although, non of us do. Both are rewarded for good behavior. I can go on and on. We are slaves. Nothing more!!
Exactly, schools are by designed to subscribe the population to group control by how they schedule, the curriculum chosen, etc. There have been banned books, dress codes, honor codes, and zero tolerance policies. When I went to elementary school in the 90s, "zero tolerance" got me in trouble for reading military history books from the school library with my friend during breaks because one of the teacher's aides thought it was "concerning" which got the zero tolerance policy ball rolling. Thankfully, my friend's dad didn't agree with it.
I totally agree, I just have to point out that the 13th amendment makes prisoners actually slaves but kids still have their rights
It's the result of the long march through the institutions. The majority of teachers are Far Left activists now, and take full advantage of their access to your children to indoctrinate new members into their cult.
Blessed my kids are homeschooled and exempt from this BS.
We did that too. They graduated from U. of WA at age 20, with honors. If more families would boycott the schools, the schools (for financial reasons) would fall in line with what should be their mission. Education, not indoctrination. Parents need to either take back the schools or find other alternatives (home-schooling, co-ops, group tutoring, etc.). There's a lot of support and material our there to help those parents who really care about their children and are not just looking for a convenient warehouse for them.

Private school! Pick one that doesn't do DEI hires or diversity funding BS. The best education I've seen, they say the pledge of allegiance to the great USA and pledge of allegiance to the Christian flag. Produces great members to society and ensures they understand what the standard is. They will raise their kids correctly. BTW, I'm a lower middle class service member, I cut my teeth and budget to ensure my child is raised correctly.
Home school. I attended a lot of private schools, which were not much better than public school other than maybe being 1-2 years ahead in the same subjects and incorrect modalities for teaching.
This opens Up A whole can of worms. I don't care one way or another bout The Lbgt movement. But I am very offended by the in Your Face attitude
During my sophomore high school speech class we were required to present a demonstration of how to perform a task of our choosing in front of the speech class. On the morning of my presentation, I walked through the front door of the school carrying a .22 caliber bolt action rifle and a gun cleaning kit so I would have the necessary items to demonstrate the proper way to clean a rifle. No one paid any attention to me and my rifle other than a few comments or questions about how well I liked that particular make and model of rifle. The rifle stayed in my locker until speech class when I did my best to instruct my classmates on the correct cleaning of such a rifle. The class was attentive and the teacher gave me an "A" for my efforts. After school, I walked home about a mile through town with the rifle on my shoulder which attracted not a whit of attention by anyone. It was 1963 and, oh yeah I nearly forgot to mention, the school also taught the United States Constitution openly in class. My, how things have changed.
I thought the courts proved their claim the kids seeing a gun always causes panic, fear and disruption. Huh, I thought they needed clear and reasonable evidence of likely or imminent harm to restrict rights. Weird.
What in Sam Hill was your generation doing in 1968 during the Gun Control Act and 1993 during the Assault Weapons Ban? How did you folk let it get this bad?

Tried but couldn't find a link to a news article from mid 2000s. Military bases/posts are huge communities with homes, shopping, churches and schools. Around 2005, a student in the on-post school of Fort Campbell, KY was suspended for wearing a Wounded Warrior T-Shirt. Most would recognize their trademarked silhouette image of a soldier carrying another, and there is a rifle being carried along with the wounded soldier. Keep in mind, that period of time was awful with causalities in Iraq and Afghanistan. All students in that school had parents who were serving in the military. Many students who had parents who'd been seriously wounded or killed. At the time Wounded Warrior Project was one of the only charities serving soldiers who had been wounded. And they suspended the student because there was a silhouetted image of a rifle on a T-Shirt. Because it was a DoD school, and parent careers significantly affected by what happens on base/post by their dependents, it isn't like the parents could make a huge stink or sue.

My son was sent home, rather than be allowed to turn a shirt inside out, because his shirt was supposedly violent. It was a Rob Zombie movie shirt. There was no violence in the artwork. The same teacher that complained never said a word about it. The day after that my son's friend wore the shirt and saw the same teacher to say hello and the teacher never said a word. The next week our two neighbors wore the shirt to school, saw the teacher, in fact one of them had him for a class, and the teacher never said a word. We went to school the next day with the shirt, had the all the kids come with us to the office before school and filed a complaint against the teacher and all of them told the principal what they did at our request and with their parents approval. The principal suspended my son for two days. We tried to get a lawyer to represent him against the school but nobody wanted to go up against the teachers' union. We pulled all 3 kids out of that school and put them into a Catholic school. They did get a much better education.
Just sent my son to school with a gadsden flag t shirt.. now we wait and see
Im still hacked off about school sending our kid, kindergartner at time, to principals office for making a gun shape out of hand during recess.
There's a reason I spend 10 grand a year to send my kids to private school. Sounds like a school district is about to get an education in the first and second amendment.
I wish I would have known that in high school. The Sedro Woolley high school administration wouldn’t let us put the silhouette of a shotgun on our schools trap shooting team shirts and sweatshirts.
From now on I'm wearing gun t-shirts everyday everywhere I go !!!
Keep your eye on Massachusetts regarding the referendum petition to suspend H.4885
I believe a pride flag is a vulgar sexual innuendo. It offends and upsets me, so where is my right not to be offended.
Next time that I have to go inside my sons school, I'm going to wear an NRA hat and T-shirt.
They already heavily restrict the 1st amendment. Saying certain things or wearing certain things are against the rules and are punished.
Join , Alliance Defending Freedom , it’s worth every penny.
I just said it about another post… we either get government out of the school systems or we homeschool our children!
I am a sophomore in high school I have a key chain that is a bottle opener in the shape of a 1911 and my teacher got mad and the dean said it was fine but she is mad now
I wish I could remember all these court challenges and laws.
I keep notes on ones I want to pass on as Kirt talks.
This video should be shared with all public school administrators.
Listen up, pay close attention, I'm not gonna repeat it, the Republic is lost
Looking forward to seeing the state getting clapped in court.
Wonderful segment. Thank you
Gretchen Whitler.
The irony regarding how the 2nd protects the 1st is not lost on me

Always was.
*_ABOLISH PUBLIC EDUCATION!_*
💪😎🇺🇸
I am a middle school teacher, but I am speaking as a private individual and I believe this to be a topic of broad public interest (it appears that I have to meet those two tests whenever I mention being a teacher).
Frankly, the Tinker decision is one that I have not heard of. Coming from another field, I am familiar with the Turner case, it is well-known that "Turnerize" is used as a verb; such as "You need to Turnerize this because the parent is not going to understand what you are saying." I am also aware of some random cases that I heard of in teacher training, and in our annual teacher training, but I just do not recall Tinker, so it may not be as well known as you think it is.
All that said, I might have expressed that the hat was in poor taste if worn on any day other than "wear your silly hat" day, there is no way I can see prohibiting it.
On a broader point, the school teachers are not monolithically opposed to the rights of gun owners . . . and I think we need to start saying "gun owners rights" instead of "gun rights," but that is a digression. . . nor is the teachers union. On a day that a bunch of teachers went and got our CCW training the running joke at lunch was "you out me, you out yourself."
The reason a mass of us went to the class was that we are in a "right to carry" state, but the point was made that unless we had CCW permits, a gun in our car was still a federal crime, So, off we went to class. Our regional union rep was one of the people taking the class. I happen to know he is a bit of a gun nut. I know this because I have gone shooting with him.
I can easily go on, but the point remains, teachers are not an anti-gun owner's right monolith.
Here in Virginia, our state motto is sic semper tyrannis.
Last year my senior in high school son put a glock logo amongst other logos on a pottery project. the teacher didn't like it and told him he couldn't put it on there. Son went to principal, who is not a gun guy, but apparently is familiar with Constitution. The principal told her to knock it off, and he finished his project with logo.
Im sorry but I really do not care about this. 75% of the gun law videos I see nowadays are about these pettily little cases from the middle of nowhere that have zero bearing on the rest of the country. I am not saying its not important, but we have much, much bigger fish to fry, like getting ALL AWBs overturned, and overturning the GCA and NFA. Lets spend resources there. Have you seen the requirements for buying ammo in NY now? They ask you how much you WEIGH, in addition to a whole host of other info, they are required to write down the lot number on each box you buy, and if you buy more than the state likes at once, your background check gets delayed. Oh, did I mention you need a background check to buy ammo in NY? Can we focus some videos there?
Thanks
