He told her off for shouting when all she did was speak a bit more rapidly. That's a control mechanism, accuse someone of breaking normal conversational rules to shut them up rather than address what they're saying. I had a boss that would do this all the time when she was trying to bully you into doing shifts you weren't obligated to do, so at one point I told her "I'm not shouting, YOU'LL KNOW WHEN I RAISE MY VOICE".

Many departments have been infiltrated at administrative level by hostile foes, and created rotatin 12-hour shifts for police. That can put one on edge. Fairfax county VA, for example was, and may yet be, on 3 shifts round the clock and officers had to do 2 weeks of 12-hour days on each shift in rotation.

Yeah trespassing is a crime. Schedule a tour instead and write down the address. Call the county clerk to find out who owns the property at the address and Google the firm. This old woman is probably not a thief (you can never be sure, this is the Meth Belt) but she isn't very smart either.
We are warned to be afraid, very afraid by some elements of our society. Some people become over sensitized by this. Or maybe they have had some adverse experience we are unaware of.
She had to be told to leave the property and then refused to leave before they could have detained her. She was unlawfully detained and then harassed her.

It's standard procedure to cuff an arrestee. She broke the law. Doesn't matter how tall you are, how much you weigh, or how old you are, if you break the law, you will get cuffed!

The lady’s explanation was reasonable, she left when asked (even though the actual homeowners didn’t…which should matter here but doesn’t for some reason) , and she gave her information. And the cops still handcuffed her and were rude to her. This could’ve been cleared in like 3 minutes. Mountain of a molehill.

I grew up in this area. The police force there is made up of all the kids that got bullied in middle school. And its VERY obvious. I've had plenty of encounters with Springfield and Joplin Mo PD. Both highly unqualified buffoons.

If that's the case, how do delivery persons, or anyone else get to the front door to contact the resident? Isn't it trespass if the owner or their representative ask you to leave and you refuse to do so? How do those officers feel when they go home and tell the family that they gave an old lady, like grandma, a hard time and exacerbated her PTSD, and then left her to walk home in that anxious condition? At least the lady learned that there is no way she'd live next to that neighbour.
Going into the backyard would be a little intrusive. But since the dwelling is unoccupied not a big deal to just look. Wasn't like she climbed over a fence or opened a gate to the backyard.

I love this channel and I think the legal analysis is sound (particularly for a non-attorney), but I think he needs a rubric that includes any time a clearly harmless civilian is harmed or detained/arrested for any real length of crime is a fail. I’ve seen more egregious conduct where the cops had no legal reason at all to detain/harm where they still got something higher than a D.
Being unprofessional (out of earshot of the public) is not equivalent to violating the law or someone's rights. An F should be reserved for such instances or similar.

everyone is "suspicious". that's why they require REASONABLE (That is, given the totality of circumstances, it's logical to presume) ARTICULABLE (that is, they can point to specific facts) SUSPICION (that is, a specific crime). Not just "Oh, you're wearing a black shirt. that's suspicious because a guy in a black shirt robbed a store half way around the world an hour ago!!"

It is, in both the video and the situation I described, considered abandoned property and thus in the public domain; if someone wanted to leave something after they move out then it needs to be stored out of public view (ie inside) or with clear signs of retention (ie fences, signs, covers, etc.), if the actual property owner would even let them. 2) Even if we assume just "not minding her business" was grounds for police involvement (it ABSOLUTELY IS NOT), why do you direct that at her alone, and not the neighbor who had no right to tell her to leave the adjacent, vacant, not fenced in or otherwise restricted to the public property that just happened to be next door? It is not against the law to walk onto private property if there is no sign that says no trespassing. If the owner asks you to leave you need to leave which she did even though the people next door are not the owners. She explained things very plainly why she was there and they still had to treat her like a criminal. These cops are trash.
Why did the cops even have to get involved with this? The lady thought the place was open, was told it wasn’t, and left and walked away. Had she stayed or refused to leave, it’d be one thing but she wasn’t even on the property when the cops came.
Legally they shouldn't have. Neighbors can't tell you you aren't allowed on a property and unless the property owner asked you to leave you committed no crime by being in the front yard or looking into the back. The neighbor can call in that suspicious behavior was happening but definitely not anything beyond that. The cops have a lot of discretion on how to handle a situation and this one should have been handled much differently.

@@Jolson17929 even if no one spoke to her at all she may have been committing trespass, because it seems that Missouri's 2nd degree trespass law is particularly strict, much more so than we usually see in audit videos in which in order for a crime to have been committed a person must refuse to leave upon being informed that they are trespassing the relevant language of the statute is "enters unlawfully" and "strict liability"; strict liability means that criminal intent isn't necessary to have committed the crime (not defending the cops here -- they acted terribly under the circumstances)

Year of our lord 2024 and the people have forgotten about fences and no trespassing signs… It’s not hard to secure a property, this one clearly wasn’t! I’ve seen a rise in neighbors calling police on landscapers and such doing free work on abandoned or overgrown properties… Really a sad state of affairs when you face persecution for trying to be an active member of the community.

There is no trespassing without the owner complaint. I have told my neighbors that they are not authorized to trespass anyone because they tried to trespass my grandson one day. The deputies were pretty rude to him even though he said multiple times he was my grandson. I showed up the same time the sheriff did. The sheriff knew I was not going to be happy immediately because I was not the complainant and put an end to the situation.

I lived across the street from neighbors like that. Another neighbor said he breathed a sigh of relief when I bought the place because now he would be in second place as their object of wrath. They have all passed on and had to live from the other side, all the wrath they perpetrated.

I commend the officer for the restraint they used. The 60 year old citizen was handcuffed, for officer safety and didn’t scream “stop resisting” as they are trained. She wasn’t tased, slammed to the pavement, even though their lives were in danger, their guns weren’t drawn. Thank goodness they are safe, we all know how much danger they were in by a petit senior citizen who is handcuffed.
That neighbor seems annoying. God forbid a realtor show up or a utility worker stop by and try to do a job. The cop in this case was annoying too. She gave her name and bdate. “Freaking out” isn’t a crime, especially when she already said she has ptsd.
Not the best examples. A realtor would've already been in contact with the property owner and utility workers in general have easements for any equipment on private property.

I live in Springfield. Police there are too busy harassing homeless or perceived to be homeless to pursue actual crime. My ex had his motorcycle stolen and found it in a neighbor's yard and they refused to arrest the guy and he had to go get it back on his own. Once, we saw a guy falling down drunk get in his pick up truck and drive away. We followed him all over town as he swerved all over the road and into oncoming traffic for 45 minutes while we stayed connected to dispatch because they were too busy harassing elderly women "trespassing" to respond.

Fairfax county VA, for example was, and may yet be, on 3 shifts round the clock and officers had to do 2 weeks of 12-hour days on each shift in rotation.

2) Even if she WAS just there to see if there was stuff left behind, that is not a crime if the property was placed in public view and arranged such that nobody would reasonably assume it was left as decoration or fixtures by the current property owner/tenant. It is incredibly common for people to leave things in their yard or on the curb after they move out for passers-by to pick up for free. But, AGAIN, she was not there this time for that purpose

1) It absolutely is not a crime, and your insistence that it does shows either your ignorance or your maliciousness. It is, in both the video and the situation I described, considered abandoned property and thus in the public domain; if someone wanted to leave something after they move out then it needs to be stored out of public view (ie inside) or with clear signs of retention (ie fences, signs, covers, etc.), if the actual property owner would even let them.
2) Even if we assume just "not minding her business" was grounds for police involvement (it ABSOLUTELY IS NOT), why do you direct that at her alone, and not the neighbor who had no right to tell her to leave the adjacent, vacant, not fenced in or otherwise restricted to the public property that just happened to be next door? Why did the cops even have to get involved with this? The lady thought the place was open, was told it wasn’t, and left and walked away. Had she stayed or refused to leave, it’d be one thing but she wasn’t even on the property when the cops came.
Legally they shouldn't have. Neighbors can't tell you you aren't allowed on a property and unless the property owner asked you to leave you committed no crime by being in the front yard or looking into the back. The neighbor can call in that suspicious behavior was happening but definitely not anything beyond that. The cops have a lot of discretion on how to handle a situation and this one should have been handled much differently.

I was saying the same thing, what if someone wants to knock on your door and sell you some Girl Scout cookies or solar panels. Are you going to call the cops just cuz someone knocked on your door and say they trespassed? Of course not. The house was vacant and she had a legit reason to think about renting the place because she said she owns some dogs and she lives in a condo Tower which isn't really pet friendly. There is no trespassing without the owner complaint. I have told my neighbors that they are not authorized to trespass anyone because they tried to trespass my grandson one day. The deputies were pretty rude to him even though he said multiple times he was my grandson. I showed up the same time the sheriff did. The sheriff knew I was not going to be happy immediately because I was not the complainant and put an end to the situation.
You should have had your neighbor trespassed from your property and gotten a restraining order.

I commend the officer for the restraint they used. The 60 year old citizen was handcuffed, for officer safety and didn’t scream “stop resisting” as they are trained. She wasn’t tased, slammed to the pavement, even though their lives were in danger, their guns weren’t drawn. Thank goodness they are safe, we all know how much danger they were in by a petit senior citizen who is handcuffed.
That neighbor seems annoying. God forbid a realtor show up or a utility worker stop by and try to do a job. The cop in this case was annoying too. She gave her name and bdate. “Freaking out” isn’t a crime, especially when she already said she has ptsd.

I live in Springfield. Police there are too busy harassing homeless or perceived to be homeless to pursue actual crime. My ex had his motorcycle stolen and found it in a neighbor's yard and they refused to arrest the guy and he had to go get it back on his own. Once, we saw a guy falling down drunk get in his pick up truck and drive away. We followed him all over town as he swerved all over the road and into oncoming traffic for 45 minutes while we stayed connected to dispatch because they were too busy harassing elderly women "trespassing" to respond.
