- The plaintiff took her children to the defendant’s day care. The plaintiff claims one of the defendant’s employees lost her 3-year-old daughter, and she was found on the street. The plaintiff had to pull her children out, and she’s suing for emotional distress. The defendant insists she is not responsible for what happened because it didn’t occur during day care hours.

Her story made no sense because it makes no sense to take children away from the daycare premises to a BBQ.

Perhaps (and evident to me) the object was to arrange a convenient meeting place for drop off and pick up of the children. If the owner had knowledge of the arrangement, there would have been no issue with registering the children for daycare services like every other normal day. I would think the daycare owner wouldn't mind getting paid for services. Concerning alleviation from wrongdoing on the owner's part, what did the owner do wrong? Why would a daycare owner with a place of business arrange for her business to be conducted off the business premises? Why would a daycare owner (with a license and reputation to protect) agree to provide services off designated premises at somebody's house during a family barbecue? Questions, questions, questions. Biggest question of all for you. Do you actually believe the plaintiff's story?

The math is not mathing here. Check these questions:
1. Why would two fired employees write to support their former employer?
2. If said employer knows that the plaintiff carried on arrangements outside with her employees why were the employees not re-instated?
3. Also, if this is being done outside the daycare center, one expects the child to go into the center that day.

You are missing a key point Swansetta admitted that her children weren’t suppose to be at the daycare until later, which is why she did not swipe in, otherwise she would have been charged. The employee she allowed to take her children to the BBQ was also not on the clock. Whether the exchange took place in the lot or in the inside, they were not signed in. Also if Swansetta did not know this employee outside of the daycare or even where she lived, why would she have felt so comfortable allowing a “stranger employee” to take her children to a BBQ to be around other random strangers just because said employee had a relative the same age as her child? I do however suspect the owner made an agreement with the fired employees to possibly rehire if they gave statements, but that doesn’t mean they lied. Were bribed… yes
Also the arrangement seemed to be take my children to the BBQ and then bring them with you when you clock in for work, which was probably the time Swansetta was suppose to drop the children off. I also suspect Swansetta paid this employee a fee to take and watch her children at this BBQ or she in fact did know the employee and they were doing her a favor either way lies were told.
@@vibesista19well said. I can see the possible shadiness of the defendant offering them their jobs back by testifying or writing a statement. However, many may think JM wasn’t being fair, he has to go by the facts that are being presented and based on that make a ruling. Also, this is TV, so there’s an element of drama to be considered. Either way, the plaintiff was caught in several lies which helped the defendant win their case.

This case reminded me of a similar case from that same 2011/12 season where the defendant nearly attacked the husband and wife plaintiffs and Doyle put her in handcuffs.
