    Section 50 of the police reform act is the go to legislation to abuse in order to obtain peoples details. It's far too easy for a constable to make up whatever they deem as being anti-social and the problem with this legislation is the fact that they made the offence the refusal to give details rather than the anti-social behaviour itself.

    According to police guidance, the use of handcuffs in that situation was assault and battery. The officer should be charged.

    She is certainly not wrong when she said that people hate them. Never ever help them with their enquiries no matter what it is, best thing to do is keep clear of them having zero interaction with them, especially women who value their safety.

    Translates as: I am dressed in a costume and have the freedom to decide what is naughty based on my personal standards a flagrantly abuse the public's rights. If you don't let me do what I want with you, I shall abuse your rights even further. You can claim compensation but it will only come out of 'Your' taxes and not my own pocket. So there.

    The law Police use to gain details for no reason. You can still refuse if they don't have a lawful reason to gain them. You don't even need to provide details at the Police Station if you're arrested, only when you appear in Court 👍👍

      Yes I know from first hand experience. The police tried prosecuting me under the name... Mr NO NAME NO NAME after refusing to answer all their questions in custody as well as engage in any fingerprints or biometrics.

    If a copper broke the law enough to abuse Section 50 to extract my details, I would refuse and enjoy my time in court. I would then bring a case against the police farce, and if I could, the individual cop.

    People should just be letting them arrest. Let them do it, and you'll be immediately de-arrested at the station. Then sue them.

    Magistrates, untrained in law, have also issued CBOs (in place of the now unused ASBOs) for the so called anti-social behaviour of recording in public or recording the police, which apparently caused harassment, alarm or distress. That ridiculous law does need repealing.

      Not a straight cop in the British force it seems. What with 'the rapist' and 'dave the b*****d' and those are just two examples off the top of my head. I'm sure there would be more if I looked into it nevermind the ones that the public are entirely unaware of. It should have been obvious when you started to see police wearing punisher(skull) patches and such.

    50 is insidious. Spurious claim of disorderly and ordered to ID ,triggering a way around only ID ing, when arrested or when driving .
    That's "back door", to 'you do not have to say anything' ( inclusive of ID)

      Yes and even goes against case law of Rice v Connolly 1966 whereas you are not required to assist a constable with their inquiries prior to any arrest or caution.

    In a situation like this: call their bluff. Get arrested. Still refuse to give your details. Then sue them for compensation.
    Section 50 is a rotten piece of legislation. Introduced by the Labour Government in 2002 as a response to low level type gangster behaviour in housing estates reported by the press.
    Section 2 of the Anti-social Behaviour, Crime and Policing Act 2014 defines anti-social behaviour as:
    "conduct that has caused, or is likely to cause, harassment, alarm or distress to any person"
    That's a shockingly vague definition. Or if applied as written, the police should be taking action against themselves on a daily basis because their "investigations" cause people alarm and distress.

    Maybe let the goon arrest you so you can have it out with the custody Sergeant who will be reticent to enable the unlawful arrest. If the Sergeant does enable it the liability transfers to him/her which strengthens the complaint made post release. Bottom line is the arrest is unlawful and conceding to the unlawful demands made by the goon to avoid arrest gives the goon confidence to continue abusing his powers. Tough call, I know. The right path is always the hardest and is the path we need to follow to deliver the changes we demand 👍🏻

    You never have to give your name and address, you can just shut your mouth, when that copper kidnap you and takes you to the station, without your name, he will need a charge to say to his staff sergeant and the grounds.       The charge is not giving your name and address when requested by a constable using section 50 police reform act. That is the actual offence which is nothing to do with the perceived anti social behaviour in the first place. It's ridiculous and can lead to a magistrate giving you a £1000 fine.

    EASY.....hit the Chief Constable with a Private Prosecution under Section 26 Criminal Justice and Courts Act amended 2016 " Any police constable that is involved in actions that are wrong , whether known or not shall upon conviction receive up to 14 years imprisonment or a fine or both " let the bastards pick the bones out of that and we can all do it.
    No need to go through police complaints, hit them with a private writ and bring them to court.
    Never trust a Copper as they are the first to get you in court
    without prejudice vexation or frivolity.

    section 5 - states that "It is a defence for the accused to prove- (c)that his conduct was reasonable." is filming people in public a reasonable act? YES. rather than argue just point out how the action is reasonable calmly.

      @@jamesfinbow4071 So why not arrest under suspicion of a section 5 offence, 'suspicion' a lower bar than 'belief'?
      I think you would have to demonstrate to the court that the officer did not really 'believe' and therefore the arrest was unlawful, or at least disproportionate.
      The police are twisting ASB legislation to coerce you into giving your name.

      No, You can only use section 24a ( citizens arrest ) for indictable offences and section 50 is not recordable.

    Officer, ! Google’s cars are filming me, it’s an, anti social offence, stop them now, also I hate these people filming in parks, it’s anti social, can I call 999, and demand a officer to attend for section 50. I have a neighbour who I feel is using their security cameras, for covert reasons, please use section 50 and visit them and put them in handcuffs.
    I accept I must go to court and proof these allegations, likewise a policemen, must take details of all parties complaining, regardless of those people wanting or not wanting to take these issues to court.
    I would like to thank this officer for giving me the freedom to use the 999 service, for people filming me in public, which he states it is now a new anti social crime, which according to this officer, we should all contact any nearest police officer. I feel, I should write to my Chief Constable ( likewise everyone should write to their own area’s Chiefs Constable), thanking them, that no one can film a person in public, because of section 50, which this officer, now states is a anti social, section 50 crime

    Two things:
    1 - The young female that he's spoken to numerous times AND who had been doing exactly the same thing Vis a vie filming is I can guarantee an ATTRACTIVE YOUNGER WOMAN...(ask an older lady, young woman privilege defo exists🤔) .
    2 - Why did no one request a sergeant ? (All those young white woman and NOBODY requested the MANAGER..??! 😅😂😁😎)
    The offer wasn't even that younger...what an idiot 😲 either ignorance of the Act or willful misuse in an attempt to intimate...

    Wow I don't think I've actually seen this gem on the streets yet I'm about her she's a tough female auditor and I don't think she gives a crap about what the police have to say about anything especially if she knows she's in the right well she's cool if you ask me People say there's no female auditors because they are scared but she doesn't show fear I think she mainly goes out with other female auditors as well she's got her own little gang bet the police want to stop her, they are trying to get a community behaviour order on me I'm at court I have denied that but they would like to get me on one for 5 years to stop me from taking photos and making videos in public they would like to stop me from taking photos and making videos of police buildings emergency workers members of public and I must walk up to every single person on a high street and ask them if I can video I am not to video any government or emergency buildings within five hundred yards

    i would not give my name in the po lice station i abused them on the intercom for about 11 hours they taken me to the finger print room i would not give my fingers print they taken me to the floor forced my finger print then tolde my name i already new my name.🇬🇧.
