It’s easier to steal someone’s property than to get a drivers license. The counties and/or states need to tighten up or slow down the process. Notification should be sent to the current owner before the transaction is completed. This is like all the banking grift going on today. Why aren’t the banks forced to be proactive and ensure as much as possible that their procedures are more foolproof to protect their customers? Allowing crime to occur unabated is not acceptable.
It’s not the homeowners fault, the county is at fault for accepting fraudulent documents and the bank is at fault for giving loans to identity thieves. They need to change their policies to protect citizens or take responsibility for their own actions.
I have a freeze on my credit. I forgot to unfreeze it and when I buy a refrigerator, the company said we can’t verify your credit, sorry. Then I unfroze it and made the purchase.
They should also require a fingerprint too! In California when my parents bought a house the mortgage company required them to put their finger prints on the documents. An ID can be faked but a fingerprint cannot.
YET IT'S NOT! (See my post up there or copied here.) This scam must be international!!! The same thing has happened to us with my wife's property in Hungary, Europe owned free and clear. (Valued at about 350-400k in US Dollars.) They did it WITHIN ONE DAY(!) using two homeless people as proxies in the scam. The crazy thing is later one of them even got murdered, the other in police custody allegedly. Tens of thousands of dollars later in legal fees and costs, the property is still not back in her name after two years. After criminal investigation, court trials, litigating and lawyering it left and right and the middle. Of course, the office of the registrar of deeds is indemnified from ANY wrongdoing , or any involvement whatsoever. They can do no wrong there. (Yeah right!)

Don’t know about Texas law as notary functions vary by state, BUT in California, the notary is NOT responsible for verifying the validity of a document; their purpose in this state is to verify the identity of the signer ONLY. I know: once the LAPD showed up to my home to get a notary journal I had done for a woman who apparently had me notarize a transfer deed she used to steal her mom’s house. I got the journal back with no consequences because the police saw that the notary I did was done in accordance with state law with record of her (the thief’s) drivers license and fingerprint in my journal ‼️‼️‼️🤨
The "How" is that the state of Texas does NOT require an ID if a person shows up to the tax office to request a transfer of a deed. When you try to change it back, they DO. Our identity was stolen, and persons opened accounts in our names online and in person, no ID needed. When we made a police report and requested these accounts shut down, THEY REQUIRED US TO SHOW OUR IDENTITY and pay fees, etc. The officer who took our report was kind enough to suggest that we check to make sure no one transferred the deed to our home. When we requested a block of some kind to make sure this couldn't happen, they stated that Texas doesn't do that. So be aware people, this can happen to anyone!!! We were current on everything, great credit, etc. Thia happened after a T-Mobile hack.

@doradean3097 we've contacted every office we possibly can. Now we just tell everyone we know to check your credit. Monitor your junk mail for strange names with your address and check your deeds as often as you can. Call your loan company and set up a pin for access to your loan information. Google your name and address and remove your information when found online. Also, do not use your real name online. Contact social security and FBI websites if fraud is suspected and create a pin with social security. Freeze your credit report and check as often as you can, create a pin with them as well. Use "check systems" to look for bank accounts in your name as well.

Why cant the county insure that the transfer request is from the actual owner? How can a fraudulent Notary stamp not be recognized? Why cant the county "undo" the transfer once the actual owner presents ID and denies it? How come the county cant be sued or otherwise held responsible for failing to protect a piece of property from theft? It's laziness. One thing you can do is have the appraisal district (the guys who hold the physical property records) attach a letter to your file with instructions to contact you directly in the event of any property transfers. Type up the letter yourself and take it in.
When a purchase is made a title company overlooks property to make sure there's no other names on the title / deed or liens against it. Why can't the county's do the same procedures before making changes to home or property to Unknown individuals, so yes County's should be on the hook for this huge mistakes to the home owners.

Don't forget elderly people because they get targeted more often in different scams. I took care of an elderly lady (senior home) who cried every single day because she got scammed out of her house after her husband died and then kicked out of it. I mean it when i say she cried e.v.e.r.y. day how she missed her home and she doesn't want to be in a senior home. It was heart breaking. There's no words that could comfort.

Well here's part of the issue we decided everything to be digital now. All you have to do is Go online. Make it mandatory In order to change a deed you must go into a government agency in person. You must have your photo and thumb print taken. Compare your driver's license with the county records.Problem solved . Exactly - we should be able to freeze our title from transfers like we can freeze our credit reports. For many, these can be primary residence, of which our home is considered our castle and has many Constitutional protections. The government is supposed to protect those Constitutional rights and it is instead contributing to violating these rights. Completely disgraceful and negligent. It's ridiculous this is even possible. Those who commit this fraud should be locked up for a long time and be charged a hefty fine. Part of paying your property tax should be going toward watching for and protecting against this sort of fraud. It shouldn't even be possible in the first place.
This would be a very simple thing to stop. Require in-person closings/deed transfers or quitclaims, and do simple BG checks on all parties involved. Require that a funds transfer for proceeds be an American bank. This will make a funds seizure much easier should there be any fraud.
We should be able to freeze our property from title transfers like we can freeze our credit reports, we should be able to go the the recorder's office as legal property owner, present ID, and put a freeze on any title transfer that can only be overridden upon death of owner and/or appropriate legal documents with valid ID.

And in the span of one day this can cost huge legal fees and lots of time that you will never get back (and I doubt that the SOB that committed the fraud would have any assets that you can attach any claim to /sue them. My aunt tried to do this to my mom when my grandma was getting old. My mom and us two kids were living with and taking care of grandma. Luckily the lawyer of whoever she went to was just a scammer. She didn’t succeed in taking the house, and grandma left it to us

This mainly affects homeowners without a mortgage or lien on their property. I'm considering placing a lien on my own property. That way, the transfer can't happen until "I" am paid. Liens are harder to remove for scammers and easier to remove for the lien holder.
Sorry I did not see your comment and I do not live or own property in the states. However I continue to have a mortgage on my property thru a very reputable bank even though I could pay it off. Also hold a draw down clause should I require money at short notice without generating a new loan agreement.
Happened to us. Former owner died. Had an old will that said property would be given to the heir. Heir was able to file on it without notice. Then tried to have us removed after we had already paid for the house. Some people just don’t care, are out to steal when they see an opportunity.

Why add an extra $3,000 to a transfer when you can just put a lien on your own property? That way it can't be transfered out until you are paid. In any case, the only way to satisfy the lien is for you to remove it. Only you will be able to remove this lien .
What is really disturbing here is that if the real homeowner went to town hall to change it back, the real homeowner would get into trouble, but the criminal faces little or no consequences. We need changes to our laws to stop favoring criminals over victims, and to severely punish actual criminals with many years behind bars or death for their crimes. There is simply no excuse for a government entity to allow this to happen. The house was not sold, there is no actual court order to change the deed either, therefore the deed cannot change hands. In this case, it should be simple for the real owner to go to town or county hall with their obvious proof of ownership and change the deed back to themselves, and have the criminals arrested, convicted, and imprisoned for their crimes.

You know that doesn't stop the notary public right? They sometimes don't do their due diligence when it comes to verifying the true identity of the deed owner, they just care about the fingerprint and ID being there, EVEN if it's the wrong ID and fingerprint

@@doradean3097 Agree in totality. They make you sign hundreds of papers at closing plus show your ID etc BUT some person can then go to a courthouse and two minutes later the deed is falsely changed to their name. People need to take action beforehand.
Companies that make loans to an imposter need to just lose their money. Until we put the responsibility back on them for not doing their due diligence they will keep screwing us. If they don't verify who they are making a loan to they should be the one to lose out
Every record of home ownership should be written to the blockchain (an overhaul of the current system). If the deed to her house was secured through the SOLANA, XLM, or XRP blockchain, a private key (alphanumeric code) would be required to access the document prior to making any alterations to it. In the event that someone loses their private key, they would have to prove their ownership of the house at a county office to receive a new copy of their deed on the blockchain.
The issue is the abyssal failure of the civil offices to do their job. Basic ID validation is enough to find major issues. A land or house deed should require more than just the signature. It should require the previous owner title and ID. Also, any notarized documents should be on record. Both the old and new deed should be validated with the notary. Both the cities AND the banks should call the notaries, and just make sure that the documents actually exist in their records. This is like a bank cashing checks with no signatures. Banks are supposed to validate signatures before releasing the money… they don’t.
There needs to be a system that requires numerous documents (birth certificate, employment records, etc) and for questions to be asked that only the homeowner or their rep can answer. All documents need to be presented to the court in person and under oath.
When you file your deed in Philadelphia, Pa, you have to attach a photo copy of your license, Real ID, and or passport to your deed to keep this from happening. This way staff can confirm the real owner of the property. They match the photo with the person and signature. There is no exception. Your photo must be attached. It has prevented a lot of ppl from losing their homes to scammers.
If you're going to make sure you're home is in your name, you should also make sure you own the LAND UNDER it and make sure you're listed on that deed as the OWNER, NOT just a TENANT Then, you should get a deed lock that prevents anyone from tampering with your deed
I disagree with this expert. You can file a title lock with your county clerk which legally requires the clerk to call you directly by phone and/or contact you directly in writing BEFORE your property title is transferred to ANYONE else. In which case, it will not be possible for a random person to just show up with a fake deed or notorized title and claim ownership of your property. You DO, however, need to keep your phone number and/or address updated with the clerk should either of those change. Most states and counties have title lock service. I would ne very surprised if Texas doesn't.
This is a common tactic with shady HOAs. Always keep your records and documentation. Every payment, every deed. Make sure they are certified copies. Read every document you sign from start to finish. If someone is pushing you to just sign it then tell them that you are considering a lawyer to review the documents. If a certified county clerk stamp was used by the scammer then the city needs to be held accountable and the office the stamp came from needs to be investigated.
The Florida county I live in has a program that will email you a notice when a document of any kind is filed under a name that matches yours, and the notice happens the same or next day following filing. The county doesn’t screen the documents for legitimacy, but by notifying you immediately, you can take action to correct it if necessary. Check with your county to see if they offer something like this.
True... The problem is, it is AFTER the fact "the deed is done". Correcting it? You ONLY wish it took a couple of hours or a day or two free of charge. It also happened to us. After more than two years and tens of thousads of dollars in legal fees, my wife's name is still not back on the property she own(ed) free and clear. 350-400k is up in legal smoke and mirrors for over two years now.

All the noteries are officially registered with contact information that can be looked up by anybody and the deed office can just directly ask the notery to confirm any document before filing it. So the real estate agent didn’t talk about what happened to this woman, but talked about a bunch of other things that could happen. There is no way the people doing this taking out mortgages against the property can't be traced and found. The bank they got the loan through has pictured identification of whoever sign for the loan. They need ID, they need credit reports, etc.
This isn't hard legistators! Put a simple process in place that requires verification of a valid Driver License that matches the mailing address for the property. Or in the case of a real estate company, the person working there on behalf of them. We have double verifiers to log into email, 6 digit pins on VM, but nothing for the most valuable asset folks will buy. Heck, you even need to show ID at a pawn shop to transact items. Not hard...just saying.
My mother use to always be down at the county trying to make sure no one was trying to take the property. She was obsessed about it and discovered that some of the employees at the county admitted they were investors and people they knew who were always strategizing on how to take the property. They'd make it look or appear like the taxes handn't been paid when they had been paid weeks ahead and they'd just hold it so the other investor could try to take it. Or someone tried to do something similar to what was done with this lady except it's groups of people working in the county whose working with investors or want to be part of the investor group to take the property. They were even on phones calling each other at the county whenever she came and reporting to each other how she was down there again to make sure they applied the property task immediately. I think she lived down there b/c of those crazy people.

I hate that there’s security measures and protections that charge to protect you from this type of theft and the right institutions that keep records of the deeds do not take these same measures. They should be held accountable by new laws. I’m wondering if these companies that charge to give you these protections are involved in the thefts? It looks too fishy for them to charge for these services and saying that there’s little they can do.
Keep a copy of everything. No one should be able to change anything without ID, calling the original homeowner before accepting any information. It's should not be the homeowner responsibility, should be the city making sure those documents are legit and contacting the original person on the deed and make the process a little longer before any exchange, making sure everything is right.
They should have both parties present bringing with them signed documents from a licensed notary, preferably a notary stationed at a courthouse, requiring photo ID’s with matching name on bank accounts.

This report has given me no comfort, and or answer as if this lady got the DEED with her name put back on it? I don’t get it. Yes, you show ID, all kinds to see doctor, you show ID to buy cigarettes and yet, we have this big problem with a house. The biggest investment in your lifetime, you poured your sweats, you sacrificed to do whatever to have that roof for you and your family. One more thing, you have a car title in your hands once you paid it off, and the house, you get nothing to show for. I don’t get it.

These crooks need to be prosecuted and people that record deeds should require proof of sale or gift to change ownership. Maybe they should take a photo of the owner and require the original owners to come down to change the ownership, and this way if the person filing false documents tries to change ownership they are denied and reported to police.
It is mind boggling that your property , not phone , not car , but land and house, can be stolen in broad daylight , and the apparent ease with which this can be done is insane . The first you may know of it is when the new owners of your home pull up with their movers . Seems easier to steal my house than my earpods .

You can go online & create an account with your tax assessors office. The parcel number will be on your tax documents then you can look up the property records...deeds etc.
If the crook can change the deed so easily, the real owner should be able to change it back that easily.

The "How" is that the state of Texas does NOT require an ID if a person shows up to the tax office to request a transfer of a deed. When you try to change it back, they DO. Our identity was stolen, and persons opened accounts in our names online and in person, no ID needed. When we made a police report and requested these accounts shut down, THEY REQUIRED US TO SHOW OUR IDENTITY and pay fees, etc. The officer who took our report was kind enough to suggest that we check to make sure no one transferred the deed to our home. When we requested a block of some kind to make sure this couldn't happen, they stated that Texas doesn't do that. So be aware people, this can happen to anyone!!! We were current on everything, great credit, etc. Thia happened after a T-Mobile hack.

@doradean3097 we've contacted every office we possibly can. Now we just tell everyone we know to check your credit. Monitor your junk mail for strange names with your address and check your deeds as often as you can. Call your loan company and set up a pin for access to your loan information. Google your name and address and remove your information when found online. Also, do not use your real name online. Contact social security and FBI websites if fraud is suspected and create a pin with social security. Freeze your credit report and check as often as you can, create a pin with them as well. Use "check systems" to look for bank accounts in your name as well.

Why cant the county insure that the transfer request is from the actual owner? How can a fraudulent Notary stamp not be recognized? Why cant the county "undo" the transfer once the actual owner presents ID and denies it? How come the county cant be sued or otherwise held responsible for failing to protect a piece of property from theft?

One thing you can do is have the appraisal district (the guys who hold the physical property records) attach a letter to your file with instructions to contact you directly in the event of any property transfers. Type up the letter yourself and take it in.
When a purchase is made a title company overlooks property to make sure there's no other names on the title / deed or liens against it. Why can't the county's do the same procedures before making changes to home or property to Unknown individuals, so yes County's should be on the hook for this huge mistakes to the home owners.

Exactly - we should be able to freeze our title from transfers like we can freeze our credit reports. For many, these can be primary residence, of which our home is considered our castle and has many Constitutional protections. The government is supposed to protect those Constitutional rights and it is instead contributing to violating these rights. Completely disgraceful and negligent. This would be a very simple thing to stop. Require in-person closings/deed transfers or quitclaims, and do simple BG checks on all parties involved. Require that a funds transfer for proceeds be an American bank. This will make a funds seizure much easier should there be any fraud.
We should be able to freeze our property from title transfers like we can freeze our credit reports, we should be able to go the the recorder's office as legal property owner, present ID, and put a freeze on any title transfer that can only be overridden upon death of owner and/or appropriate legal documents with valid ID.
And ADD fingerprint requirement with ID driver license, birth certificate or passport.

There may be a lag period of months before you receive notice that the change occurred after you paid your last tax bill.
This mainly affects homeowners without a mortgage or lien on their property. I'm considering placing a lien on my own property. That way, the transfer can't happen until "I" am paid. Liens are harder to remove for scammers and easier to remove for the lien holder.

Sorry I did not see your comment and I do not live or own property in the states. However I continue to have a mortgage on my property thru a very reputable bank even though I could pay it off. Also hold a draw down clause should I require money at short notice without generating a new loan agreement.

Happened to us. Former owner died. Had an old will that said property would be given to the heir. Heir was able to file on it without notice. Then tried to have us removed after we had already paid for the house. Some people just don’t care, are out to steal when they see an opportunity.

Why add an extra $3,000 to a transfer when you can just put a lien on your own property? That way it can't be transfered out until you are paid. In any case, the only way to satisfy the lien is for you to remove it. Only you will be able to remove this lien .

What is really disturbing here is that if the real homeowner went to town hall to change it back, the real homeowner would get into trouble, but the criminal faces little or no consequences. We need changes to our laws to stop favoring criminals over victims, and to severely punish actual criminals with many years behind bars or death for their crimes. There is simply no excuse for a government entity to allow this to happen. The house was not sold, there is no actual court order to change the deed either, therefore the deed cannot change hands. In this case, it should be simple for the real owner to go to town or county hall with their obvious proof of ownership and change the deed back to themselves, and have the criminals arrested, convicted, and imprisoned for their crimes.

@@doradean3097 Agree in totality. They make you sign hundreds of papers at closing plus show your ID etc BUT some person can then go to a courthouse and two minutes later the deed is falsely changed to their name. People need to take action beforehand.

Many counties in Texas run what they call property fraud alert systems to prevent exactly this from occurring. Registering is recommended.

Every record of home ownership should be written to the blockchain (an overhaul of the current system). If the deed to her house was secured through the SOLANA, XLM, or XRP blockchain, a private key (alphanumeric code) would be required to access the document prior to making any alterations to it. In the event that someone loses their private key, they would have to prove their ownership of the house at a county office to receive a new copy of their deed on the blockchain.
The issue is the abyssal failure of the civil offices to do their job. Basic ID validation is enough to find major issues. A land or house deed should require more than just the signature. It should require the previous owner title and ID. Also, any notarized documents should be on record. Both the old and new deed should be validated with the notary.
Both the cities AND the banks should call the notaries, and just make sure that the documents actually exist in their records.
This is like a bank cashing checks with no signatures. Banks are supposed to validate signatures before releasing the money… they don’t.
There needs to be a system that requires numerous documents (birth certificate, employment records, etc) and for questions to be asked that only the homeowner or their rep can answer. All documents need to be presented to the court in person and under oath.
When you file your deed in Philadelphia, Pa, you have to attach a photo copy of your license, Real ID, and or passport to your deed to keep this from happening. This way staff can confirm the real owner of the property. They match the photo with the person and signature. There is no exception. Your photo must be attached. It has prevented a lot of ppl from losing their homes to scammers.

If you're going to make sure you're home is in your name, you should also make sure you own the LAND UNDER it and make sure you're listed on that deed as the OWNER, NOT just a TENANT

I disagree with this expert. You can file a title lock with your county clerk which legally requires the clerk to call you directly by phone and/or contact you directly in writing BEFORE your property title is transferred to ANYONE else. In which case, it will not be possible for a random person to just show up with a fake deed or notorized title and claim ownership of your property. You DO, however, need to keep your phone number and/or address updated with the clerk should either of those change. Most states and counties have title lock service. I would ne very surprised if Texas doesn't.
This is a common tactic with shady HOAs. Always keep your records and documentation. Every payment, every deed. Make sure they are certified copies. Read every document you sign from start to finish. If someone is pushing you to just sign it then tell them that you are considering a lawyer to review the documents. If a certified county clerk stamp was used by the scammer then the city needs to be held accountable and the office the stamp came from needs to be investigated.
The Florida county I live in has a program that will email you a notice when a document of any kind is filed under a name that matches yours, and the notice happens the same or next day following filing. The county doesn’t screen the documents for legitimacy, but by notifying you immediately, you can take action to correct it if necessary. Check with your county to see if they offer something like this.
True... The problem is, it is AFTER the fact "the deed is done". Correcting it? You ONLY wish it took a couple of hours or a day or two free of charge. It also happened to us. After more than two years and tens of thousads of dollars in legal fees, my wife's name is still not back on the property she own(ed) free and clear. 350-400k is up in legal smoke and mirrors for over two years now.

There is no way the people doing this taking out mortgages against the property can't be traced and found. The bank they got the loan through has pictured identification of whoever sign for the loan. They need ID, they need credit reports, etc.

This isn't hard legistators! Put a simple process in place that requires verification of a valid Driver License that matches the mailing address for the property. Or in the case of a real estate company, the person working there on behalf of them.
We have double verifiers to log into email, 6 digit pins on VM, but nothing for the most valuable asset folks will buy.
Heck, you even need to show ID at a pawn shop to transact items.

My mother use to always be down at the county trying to make sure no one was trying to take the property. She was obsessed about it and discovered that some of the employees at the county admitted they were investors and people they knew who were always strategizing on how to take the property. They'd make it look or appear like the taxes handn't been paid when they had been paid weeks ahead and they'd just hold it so the other investor could try to take it. Or someone tried to do something similar to what was done with this lady except it's groups of people working in the county whose working with investors or want to be part of the investor group to take the property. They were even on phones calling each other at the county whenever she came and reporting to each other how she was down there again to make sure they applied the property task immediately. I think she lived down there b/c of those crazy people.

I hate that there’s security measures and protections that charge to protect you from this type of theft and the right institutions that keep records of the deeds do not take these same measures. They should be held accountable by new laws. I’m wondering if these companies that charge to give you these protections are involved in the thefts? It looks too fishy for them to charge for these services and saying that there’s little they can do.
Keep a copy of everything. No one should be able to change anything without ID, calling the original homeowner before accepting any information. It's should not be the homeowner responsibility, should be the city making sure those documents are legit and contacting the original person on the deed and make the process a little longer before any exchange, making sure everything is right.
They should have both parties present bringing with them signed documents from a licensed notary, preferably a notary stationed at a courthouse, requiring photo ID’s with matching name on bank accounts.

Maybe they should take a photo of the owner and require the original owners to come down to change the ownership, and this way if the person filing false documents tries to change ownership they are denied and reported to police.
In my CA county, that change would require a notification from the county. Maybe your county can adopt this practice.
It is mind boggling that your property , not phone , not car , but land and house, can be stolen in broad daylight , and the apparent ease with which this can be done is insane . The first you may know of it is when the new owners of your home pull up with their movers .

Dont you need ID to transfer property to a new name? And if the transfer was fraudulent shouldnt it be reversed?
You can go online & create an account with your tax assessors office. The parcel number will be on your tax documents then you can look up the property records...deeds etc.
Put the house in a Trust or Corp. Keep you personal info off of the web.
