      Obama & other Presidents took Classified Documents with them to their homes. Notice WSJ stated Bush & Obama to Classified Documents & the amount. The President has the Right to Declassify the Documents. The Archives were aware President Trump had the documents in a safe locked @ his home.

    The National Archives should have a team of archivists and records managers who sole job is to pack up the WH inventorying each box as it is filled.

    A very helpful video. What I can’t comprehend however is why there is not a traceable classified document custody chain, particularly for Secret and Top Secret (especially SCI and SAC documents). My local public library does a better job tracking books than the National Archives, the DoD, CIA, NSA, National Intelligence Agency, and other US government intelligence agencies. Why is there no law and protocol mandating that Top Secret documents can only be viewed in a SCIF then immediately retrieved and stored by special custodial agents? Documents of such high classification should only be viewed that way and NEVER be allowed to be taken by a President, Vice President, or high government official to their personal residence or elsewhere. How is it that this is not standard opera procedure? Absurd.

      Bc it's not the document that is classified it's the INFORMATION. Even hand written notes of classified info from a classified source or meeting then becomes deemed classified. You're technically supposed to DESTROY classified documents bc it's the INFORMATION that is classified.

      What I do not understand is; the National Archive knew which docs Fmr. Pres. Trump had in his posession. How did they not know Biden (or Obama administration) had docs that needed returning for 7 years. Especially since they were top secret & above top secret? This is confusing to me. Anyone know how this works?

      The probable answer: Because it developed over a long time and the president and his aides effectively make the rules they have to follow - and then people are way more likely to make convenient rules

      Obama took Classified Documents. The President has the right to Declassify the Documents. The Archives were aware the documents were @ President Trump’s home. They were in a safe locked. Biden’s were in his garage by his Corvette & in his Penn Office by Chinatown.

    I would like to know how many other Presidents and Vice Presidents have taken materials with them. Surely the NARA has a record of the letters that they have sent over the years requesting missing papers. It didn't sound like it was a new problem in either administration. Anyone even curious if it happened with Nixon or Truman?

      Speaking for myself only....the curiosity (normally piqued for The unknown & incomprehensible) that Should be raised from concerns of Presidential protocols & the maintaining of National Security......has been regrettably overridden. Dully overshadowed by 24/7 talking head, regurgitated news coverage. My normal process of raising query, pondering scenarios of plausibility, and creatively entertaining the mental gymnastics of wonder that all bloom from the urging itch to somehow comprehend, unknown knowledge has been stymied. The fulfillment and comfort, compiled through process of deduced & equatable outcome in This particular Kerfluffel.....has been eluded! And relegated to the Trash bin of assumptions!!!
      Curiosity, has killed This Cat!
      And Yes!.....It would seem to Me, that a different process is needed and the placement of new methods is not only paramount, but are also sorely overdue!

    No the Vice Pesident does not have the authority to decalss documents so you may want to do better research on this, also they are not allowed to move SCI out of an area until they have been cleared and declassified by the originator of those documents.

      WRONG.
      First of all, Biden has never said, as of January 20th, that he did declassify them.
      Secondly, the vice president absolutely has the right and power to declassify documents as expressed in Executive Order 13526 signed in 2009 which clearly states: “the authority to classify information originally may be exercised only by the President and Vice President,” as well as “agency heads and officials designated by the president". Maybe YOU should do some research.

Both President and Vice President have the authority to classify the information; however, only President has the authority to declassify the information unless Vice President has written delegation authority from the President. Executive Order 13526, signed in 2009, Sec. 3.1. Authority for Declassification, has no mention that the Vice President has the authority to declassify information.

      Realistically, yeah. Since X4 classification are usually just leader-interpreter communication logs
      NARA actually issued the warrant on Maralago looking for X4 documents on Trump (communication between KimJongUn and Trumps Translator/Interpreter), but also found 280 other documents, some requiring the highest security clearance to even be near (X2, X1, and XX1 seals)

      They will not because the floor display was more for photography purposes on the part of the FBI. Furthermore republicans were saying they wantedvto ACTUALLY SEE THEM. Bidens documents were too few to be displayed on the floor so I would assume photographers were avle to maybe use a table. Furthermore no democrat has demanded to ACTUALLY SEE THEM because they believe they are there anyway.

      Well there’s no need to in Biden’s case. Since the documents were volunteered by Biden’s legal team (and later the DOJ), there were no photos taken for evidence files
      There were for Trump, because a subpoena was issued and the FBI entered with a warrant and followed procedure (hence, the photos)

      The two situations are simply not comparable. Biden accidentally got 0.01% of the classified docs he handled as VP mixed in with his personal papers. Trump intentionally took dozens of boxes of documents and refused to give them back. Of course they're investigating what he took and why.

      2. Intent is not written into the law. If you fail to disclose that you took classified documents with you as vice president it's against the law regardless of how good intentioned you are.

    Still confusing - the process seems to vary depending on the legal expert and which news station is providing the information:
    * Is sending confidential or top secret documents specifically to the National Archives part of the actual law or is this a best-practices protocol?
    * What does the law say, if anything, about the process a President is supposed to go through to declassify documents?
    * Can a President have a nonwritten legally satisfactory standing order (or use the jedi-mind trick), as Trump claims, to declassify any confidential or top secret documents that are removed from the White House?
    * Does any law make it a crime to remove classified documents from the White House or National Archives without permission? If so, is there an intent requirement for criminality?
    * If it's legally permissible for a President to use the jedi-mind trick to declassify documents, then couldn't Biden just do the same to declassify anything that was found at his home or office now that he is the POTUS?
    * If the law is clear, as some pundits claim, then why have so many Presidents had issues with the removal of classified documents?

      Biden wasn't showing them to visitors to impress them or get them into his bed.

      It was on a diplomatic visit with Obama shorty before the transition of power. It is commonplace for outgoing leaders to pay last visits to other world leaders before their departure (Clinton and Bush did the same)
      Trump was one of the few that didn’t (probably because following that tradition would be alluding to his defeat in 2020)

    John Dillon and Brian Teeter couldn't have said it better! Personal I like how you made this video so formal but still had Biden back. Like John Dillon said, " Vice President does not have the authority to declassified documents". Also ever President has taken documents from the white house, but only after they declassified them and bring it through the proper channels.
