  • In this episode of 'Editorial,' HW News Managing Editor Sujit Nair delves into the new criminal laws, known as the Bharat Nyay Sanhita 2023. He raises a crucial question: will these laws benefit the politicians or the people? The Bharatiya Nyaya Sanhita (BNS), Bharatiya Nagrik Suraksha Sanhita (BNSS), and Bharatiya Sakshya Adhiniyam (BSA), which were passed in Parliament last December, are set to replace the Indian Penal Code (IPC) of 1860, the Criminal Procedure Code (CrPC) of 1973, and the Indian Evidence Act of 1872, respectively.

This is what frustrates me about my country. There are obvious disparities and even outright injustices happening and even actively being carried out, many times in the name of "politics". Why, why don't our people understand this? Why must they be blinkered and still vote unquestioningly for a particular party without actually trying to understand what is being done to our country. How different are we from states that masquerade as real functioning countries? Forget about democracies. To use your words, "My point is", why? Why?

Michael !! step 1 to not to be frustrated is to understand who the people are of this country. assuming that everyone has a similar exposure as us commenting on this video is false. there are two India , one is online the other is offline. 1.4 billion people, 80 crore people on free ration, rest just getting by, its a battle for survival, no one cares about law. the poor are used to be ill-treated, and the rest pay their way through police stations. law reforms is not what we need, we need psychic reforms.

Thank you Mr Sujit! A very good episode. Firstly, the President of India has made a big mistake by giving her assent to the laws knowing that almost 152 opposition MPs were suspended when the laws were passed. There was no discussion and debate on the laws. Secondly, why was the government very keen to introduce these? Are the laws suited to those who are in power? What is the point of extending the police remand period from 15 days to 90 days. If a person is in the police remand for 90 days , do you think that the police will keep feeding him/her and behave with them politely? I don't know why we are allowed to happen all these?

Good editorial, as a tamilian I cannot pronounce the three names that replaces the indian colonial-era Penal Code which is in effect.
Jurist and legal pundits had questioned the clarity and transparency of these laws. Also they say it is a cut and paste from original document sprinkled with few Hindi words.
An example, the present law would allow an accused to kept in police custody for 90 days where is the question of bail. This would be a nightmare. Hope the LS would revisit the entire criminal penal code with strong opposition ready to swing to action with iron fist.

unless and until, We have upright, honest people in power in Parliament both at Center and States, things won't change, nobody is bothered about common citizens of the Country, injustices, exploitation will keep happening, So it's the duty and responsibility of every citizens to send elected representative based on MERIT and NOT on the basis of religion, castes, class and gender.
We have a sick hateful, communal ideology in the country who on the name of nationalism is spreading falsehood, false fears, hateful narratives and is trying to spread poison in the society, doing divisive politics, hateful propaganda to divide fellow countrymen, which is not good for the Country nor for fellow citizens.

Such draconian measures with little or no provisions for civic rights and liberties are agonisingly and alarmingly most antagonistic so far the principles of freedom and civilised liberal outlook are concerned. Passed in a peremptory manner with a sneering disregard for the urgency of threadbare debates and deliberation by the opposition and the legal bodies these laws lake comprehensiveness. When the matters relate to the questions of life and death., the confidence and the collective wisdom and the will of the nation must not be bypassed. The inordinate secrecy , hurry and haste and the ever increasing autocratic impulses and instincts of the regime of non- biological pretence make the most slippery ground for the formulation of laws with strict adherence to the very purpose and spirit of jurisprudence. Such laws may be a tribute to autocracy but certainly not to democracy as defined by the Father of the Nation.

I wonder what exactlly were the so called colonial laws that were replaced.. The BJP and our esteemed PM are good at repackaging 'things' and this seems another case. Massive re-education of the police and judiciary mechanusm needed as BNS changes all the codes numbers

Has Amit and Modi ever done anything for the peoples benefit. Without reading further, or hearing any more , I know for sure it's not in these 2 people to do anything good.
