    Intent is a portion of fraud. But if you did not have the ability to complete the deal, even though you intended to do so, it is still fraud. This type of fraud is based out of the tort of deceit. It's elements: 1) make a factual representation, 2) know that it is false, or reckless or indefferent about its veracity, 3) intend that another relies on it, 4) the other then relies on the factual representation to their detriment. For example: Someone intends to buy a car and tells their brother they are getting a car so he should sell his, but doesn't have the money to do so, so the brother gets rid of his car and now has no transportation, that's fraud. Now obviously that scenario is annoying and maybe not worth a lawsuit. But saying you intend to give someone a job (and you do), but you have no ability to actually employ someone and you know this, and they move across country and sell their house, etc. and they show up and there is no job. That's fraud probably worth legally pursuing. The intent is actually regarding reliance. Your point of intent is true, however you can intend to do something, but not have the ability to actually do it, and still be guilty of fraud (Fraudulent Misrepresentation).
    I just am putting this here so someone doesn't get confused about what you are saying.

      Thank you for helping to clarify Christopher! Failure to mention you don't have something or are unable to complete the deal is an intent in and of itself. Even if you intend to complete the deal.

    Thank you your video is very helpful 😊. I made payment under protest UCC 1-308 and my ex's attorney refused all of my payments accept the 5th one. She than refused the bond and said I committed fraud when I filed a UCC1 finance statement naming the agreement as the collateral. Note: I am the holder of the agreement.

    My dad just passed away. i inherited a house with a tenant
    I attempted to raise her rent, and she gave me a forged lease extension to prevent me from increasing her rent. Im losing $1400/month because of this,
    Is this fraud?

      @jdelawfirm8388 The lease agreement was signed in 2017, page 8, titled rent/lease mold and ventilation addendum
      Has my dad's signature that is an exact
      Match to her lease extension of 2023, I printed them out on transparent film and overlay them, and it's a perfect match
      Even the letter "p" is missing ink at the
      4 o' clock position

      @jdelawfirm8388 I showed it to the FBI they agreed it was a forgery but will not pursue it because the dollar amount
      Is not high enough

      @jdelawfirm8388 her rent increase was to go effective today so my losses are Minimal does the dollar lose matter?
      Mostly I want her gone so I can sell
      Before capital gains tax kick in
      But because of her forged lease extension, whoever buys has to honor her extension until 7/1/25 so no one will buy it or I sell at a bid lose
