It's called Discovery, and that Lawyer sent the cell phone records as part of discovery. The lawyer messed up and sent more than what was requested by the court. But since it was sent, regardless if it was accidental or not, it's now admissible.
@@bennetla10nope, that's not what happened. The defence lied and said these records didn't exist. Then they accidentally sent an email to the plaintiffs containing a link to ALL of their work on this case, which included this evidence that they had failed to turn over during discovery. The plaintiffs emailed them back to let them know what they had done, and at that point all Jones' lawyers had to do is reply and say "we didn't mean to send that to you, it was a mistake, and it's privileged" and that would have been the end of it. But they didn't do that, so after 12 days, the plaintiffs gained the right to use that evidence in the trial, and they used it to prove Jones had committed perjury. Again, Jones' lawyers did not do this on purpose, they lied, they f'd up, and they got caught. To call them incompetent is a massive understatement.
Evidentiary disclosures are mandated by the court. If the text messages were not considered private/privileged, then his attorneys must share it. If it was a true “accident” and was privileged, the opposing attorney knew it was an “accident” that should not be shared, then he would have to return it and not be able to use it. If he truly used “accidentally disclosed privileged evidence” he would be disbarred. What he likely means is that he subpoena’d the text messages (makes sense since he said they’ve discussed it before and are likely not privileged here), and that his attorneys gave it without a fuss, which a moral attorney should and would do but a good attorney would’ve fought it and ultimately lost that evidentiary battle anyways. Notice, he said “didn’t you say you searched your phone and did not find anything mentioning Sandy hook”, well that can be true and it can also be true that there is messages mentioning Sandy hook. He did not perjure himself, not yet at least. This attorney also did not say whether they did in fact find text messages mentioning Sandy Hook. Without more info, this attorney appears to be fishing hoping Alex messes up on the stand, but he hasn’t… fair tactic though!

And just imagine if the public could get ahold of every attorney and every judges cell phone for the last 2 years. Heads would roll
Loser
I thought evidence that was not reviewed by both sides wasn't admissible. The defense team "had no idea" this was going to happen.
I think that what the other lawyer was doing but didn’t realize that was in there I guess.
If attorney is not aware of something it's not necessarily because they didn't have access .
Entire digital copy was given to them so all legally obtained
This doofus caught lying. Or was he able to get away with playing dumb
That's not how it works, not in real life anyways. That's just how the movies show it smh. There are similar rules like they show on TV like that one, but it's not as simple as that.

Look into it. The prosecution notified defense counsel that they had turned over the entire phone, and gave them the legally-required opportunity to retract the submission from evidence. The defense counsel did not respond and so the phone became legally admissible evidence for the prosecution.

Legally the opposing attorney is entitled to any documents that his attorney has that may be relevant to the case
That's not right at all. The prosecuting attorney is not entitled to "any" documents. The prosecution is required to make their own case.

regarding perjury or anything illegal I think I would do fine. Can you remember all the illegal things you texted in the last 2 years? Most people would be able to.
@@justincase4892 That's just unreasonable. Not only is it up for debate whether he believed he was engaging in acts of defamation on his phone and therefore could remember it that way according to your point, you ask "2 years". Alex put this behind him back in 2012, believing he did nothing wrong, and was sued 6 years after that. It's been a full decade and since then he's made a LOT of content.
