  • Eugene Young is about to be made a judge but his interviewers are not very pleased with his views on the Death Penalty. Scene from the TV series 'The Practice'
    I do not own this video and its main purpose is to depict a an excellent view on the death penalty.

      It's easy to be the best when you're the only actually character on the show. The rest were caricatures.

      @LordSpleach - Eugene was fun to watch. But he annoyed me as much as everyone else on the show. They were all amoral people pretending to have moral compasses. And Eugene was the worst of them all because he did the most pontificating.

      @@danieletrent5325 I swear the only episodes I've seen of the show proved Steve Harris was the only good actor on the show before the final season. The other main lawyers were caricatures.

    LOVE this clip. This show was really excellent - made me THINK about a lot of things and even changed my mind on some issues that I thought I was pretty firm on. I loved both this show and Boston Legal. This is one of the best scenes from that show as well as the one which Eugene struggles with being a defense attorney when he knows the guy is guilty of murder.
    Love that he gets the appointment anyway despite the unpopular opinion.

    I am a law student and I was thinking about this when I was writing my exam on Rule of Law. Judges really do make decisions based on their moral and politial motivations. There are cases that make sence then there are cases you're thinking to yourself how did it literally go in the opposite direction. You can call me a Naturalist.

      So the question becomes how do you stop a judge from making A decision based on moral feelings instead of the law? How do you stop them from passing a sentence because it will increase their political power or advance their career?

      @@theQuestion626 it does, in common law judgements, the judge can pass sentence based on their specific definition of the law. That isn't a possibility in the civil law system, as judges must implement the legislative act and not implement it based on their specific definition.

    Why on Earth is there only one season of this show released on DVD!?!? I would imagine that most people would want the whole series, if not AT LEAST season 8.

    That explains my dilemma over the death penalty exactly. I know I would find it extremely hard not to seek revenge on a person who committed a terrible crime on one of my family also, but I just can't totally agree to the death penalty...

    My brother was murdered decades ago at age 17 by a 19-yo thug. The killer pled guilty to 2nd-degree murder to avoid a life sentence. He got 20 years but spent only 7 years in prison, not enough. Mandatory sentences are longer now. Still, I do not favor the death penalty, as the State makes mistakes. "It is better that 10 guilty men escape, than for one innocent man to suffer." - William Blackstone. Read "An Innocent Man", a great nonfiction book by John Grisham.

    I never understood why people think the "getting revenge" by executing people ever made sense. I honestly think having them executed is the easy way out. Having them rot in jail for the rest of their lives is far harsher than that.

      Agreed to a point. However, there are always those who the death penalty was designed for. Serial murderers/rapists/molesters will never stop, and would always find a way to carry out their crimes even confined to the walls of a prison.

      It is actually cheaper to keep them alive. To even have them sentenced to the death penalty requires hundreds of thousands to millions of dollars in legal fees. Then, after the sentence, there are often years of appeals over the conviction and the sentence, costing even more. Then, if all the appeals are denied, the chemicals required for lethal injection aren’t cheap. In short, it is less a drain on the taxpayers to keep them alive for decades than to try to kill them.

      @@finris1 , it costs that much because they are allowed appeals even when there is absolutely no grounds at all. Make it where when there is no grounds theh cannot, then the cost goes down.

    His candidacy should have been over the second he uttered the first "No" to the question whether he'd impose CP if it was law.
    He's going off his own emotions, feelings, and sympathies, rather than the law. That's a no-go for a judge.

      It sadly never happened.
      One of the final episodes of the Practise ends with Alan Shore having a case in front of Eugene, but we don't see the case. Eugene then doesn't appear in Boston Legal, which is a shame.

    I gotta point out the blatant hypocrisy here.
    He says too many judges use their morality or politics when making judgements and then proceeds to say he wouldn’t sentence someone to the death penalty because of his morals and politics.

      The thing is in the american criminal justice system a judgement based on facts, morals, ethics, and popular opinion are all we have to make a verdict on. When he refers to "too many judges use their morality or politics" he's referring to using their personal sense of morality, and making judgments based on a political endgame to the detriment of the potential innocent. Yes what he says is hypocritical on the surface, but if you take a second to think about it which is worse, wrongfully sentencing a innocent to death or sentencing a murder to life in prison. As it stands the system is broken. Far to often a case is won or lost not based on the facts or law of the case, but based instead on how well the lawyers are able to manipulate the jury/judge. Transforming the court from a crucible where falsehoods are burned away leaving only truth, to a kangaroo court where the feelings and popular opinion of up to twelve idiots matter more that the truth.

      I just watched the whole season 8 and could confirm that Eugene is the stupidest hypocrite on the show. Contradicting himself within a season, episode or within a minute of the same scene. My god how did he become a main character as lawyer.

    The numbers are not in your favor when it comes to that argument. It just simply doesn't matter. Regardless of death penalty it does very little if any to be a real deterrent in the states and countries where it is still practiced. If what you are proposing is to give the death penalty to more people, and relax the requisites for it then seek some help. More killing is rarely the answer. It's all about social and economic reform and their constructs.

    His second argument was the only valid one. Who is anyone to say I as a human being, who exists in this country by chance and not choice, am not entitled to revenge when I have been wronged? Only because like his second point, I do not have infallibility, and I could be wrong in who I take vengeance on. But that is the only reason. And human life is sacred. Which is why taking it unjustly is the worst thing you can do. Why does that action not disqualify that person's life from being sacred? Entirely subjective argument and it has no place in societal procedure. But the state shouldn't be allowed to do something permanent if it is capable of being incorrect. And if it does happen, the person who falsely prosecuted an innocent person should share the same fate.

    I actually support the Death Penalty. Some sickos deserve to die. But 1:12 is a very valid point. Judgement has an almost unacceptable rate of failure that you can't risk the life of a man who might be innocent, even if it's a slim chance, with that sentence. When it can be given out, though, that's a debate for the ages.

      That's one of the problems, whose who are for war, usually are for the capital punishment too, and viceversa. Because they like to see people scream and torment for their lives before they lose it. They are sadists. The reason why is just the excuse to see that happen, they don't even care much. Just give them the excuse.

      Pro-life? How bout pro-life of the victims? An executed murderer murders no next victim. Anti-baby murder is not anti-execution of murderers. "Pro-life" is not a monolithic concept, but can be defined differently. You are not a staunch conservative on this issue.

      @temporarysanity You just made Eugene's point. You're championing a mindset that revenge is somehow something to be "celebrated as a societal good." How is revenge better than rehabilitation?
      On top of that, if the law is going to take rehabilitation off the table, does that mean *you* are not allowed to improve if you've done something bad?
      The whole point of punitive measures is to reform. Death can only be an absolution.

    @Lightner445555555555 A bit, but for me to demand blood wouldn't make me any better than the murderers themselves. The death penalty isn't even there for moral reasons. It's only there to stop the prison system from being overcrowded, while politicians can get bonus points (where it is acceptable) about being 'tough on crime'

    Personally I was pro-death penalty until I realized how a judge and jury make decisions from evidence presented. Evidence that can be controlled, manipulated, and contaminated. I do understand the last part, but I can only speak for myself. I can't speak for a parent who lost their kid to a nonrepentant rapist. There must be a middle way

    @Lightner445555555555 An eye for an eye turns the whole world blind. Two wrongs do not make a right. These are things we learn from infancy. The fact is, though, what would happen to murderers who get put on death row? They rot for the rest of their lives in prison with people who have commited similar wrongs against others. That living is not 'letting them live on'. That's their punishment, which they have to live with until their death

    premeditated murder, & you get the death penalty, then you must pay the piper. The reality of this country is that the death penalty isn't practiced enough to bring fear to premeditation. Take a look at Singapore's Criminal System and their crime rates. A jury of your peers will always avoid the death penalty leading to the overcrowding of jails, and a clear message that its possibly okay to premeditate a murder..

      Joke aside, we may not be equal from birth, but the problem is we learn to judge equally under law. Which is absurd if you think about it, as we all are not equal. Law should be relatively unequal, adapted to each individual. And that's a hard thing to do, we merely got it adapted to under aged and mature and even there just hardly.

      He addressed 'when the individual is caught in the same situation'.
      Eugene openly stated that if a heinous crime was committed to someone he loved, he could NOT guarantee that he wouldn't murder that person on sight.
      He continues to believe that his actions (even though completely understandable) would still be wrong.
      So in his case the 'result of that answer' is not different.

    @MAnnaconduit1 maybe I feel okey about the state killing the person because because i'm an atheist and if the state doesn't have the right who does? not God because I don't believe he exists....people with mental illness should get treatment and help not prison or death but people who act on emotion should get the chair we all have powerful emotions but the vast majority of us are able to resist our primal urges because of our ability of our brains to reason and look beyond primal urges.

    besides the contrived nature that is always going on in shows like this. And ignoring the one sided argument to the death penalty given.
    The NAIL here on the head is the first part.. BUT also the problem with his entire end argument. Judge's moral point of view,,, such as his on the death penalty..
    So the fact here is it was right on about judges being politically driven on judgements. FACT..
    On the scene it was,, very contrived and pretend.. I'm only commenting on the scene because this was a very good show. Other series made this show look almost factual

    But what is your reason why the Death Penalty or any other punishment is right or wrong? Do you accept the Word of God, or just dream it up for yourself? BTW, the alternatives are not live forever vs never live any more. "It is appointed to man once to die, but after that the judgment." If many persons are wrongly convicted, then the standard of proof needs to be raised. Bible requires 2-3 witnesses. And why do you assume that a man is less punished by long years in prison than by execution?

    That's why I loved the THE PRACTICE over BOSTON LEGAL.
    BL was majorly about sex, Alan shore & Denny crane.
    In The Practice there was hardly any central character and focus was much more on cases than office sex. Every lawyer in the firm was equally good & important.
    In BL all the lawyers were already rich and use to get a sudden burst of consciousness sometimes.
    In The Practice all of them were low to middle class lawyers fighting tooth & nail to keep themselves afloat & fight a lot of pro Bono cases

    @SonOfCallaugh while your statement makes some sense, it is mostly not true. You do not need to instil the fear into people by showing them the execution itself; but rather move along the thousands of pending executions. The problem with the system is, that it waits too long to uphold its dictated sentences, creating a long line of murderers waiting to be executed. So instead we house them, feed them, provide a gym, reading materials, television (commodities they don't deserve!)

    I can say I'm torn when it comes to the death penalty, it is obvious that defense attorneys disfavor the death penalty, and for some of us to disagree with the particular states who practice it. Eugine made sense when it comes to wrongful convictions, and wrongful executions. Although his argument is flawed, of course you cannot take matters into your own hands by going after the killer yourself & killing him/her. We have a justice system, and if that system deeds you guilty of

    i'm for the death penalty even with those points he raised in mind i just believe with the crimes some commit they don't deserve to walk the same earth and breath the same air as us....that is what i believe i dont always feel good about it i wish sometimes i had the same capacity for forgiveness and mercy as he clearly does but i just don't

    Such a good statement. Yes, revenge is semi-encouraged today. How many movies or shows are about revenge, some of them clearly disproportionate revenge? Killing is also often touted as the best possible solution, often to a black-and-white degree. You just have to be around a few comment sections on UA-cam to see people expressing disturbingly bloodthirsty opinions.

    In capital cases, where multiple credible witnesses or incorruptible video evidence is present, the death penalty should be administered immediately after the trial. Getting criminals off on technicalities, should not be allowed.

    As a law student myself, i dont really agree with death penalty but agree to taking things into my own hands. I remember how people even cheered or celebrated the moment ted bundy died on the chair. Its like the french revolution where people were excited on the death of others. I would rather take the punishment into my own hands quietly than let the state come in and then subject myself to rules of procedure that allow it a fair game to my enemy and may even beat my by a technicality and the doctrine of pro reo. It wasnt fair that i lost or was prejudiced and that the rapist or killer would now have a chance. At least when its my own hands.. It doesnt miss when rapist would be choking at night under a tub or with a garote wire. No state money wasted on trials and postponements. The only verdict is vengeance.. To deny this natural instinct of humanity just to be raised to be "tamed" while others break the law is unfair to the sheep. We must govern ourselves first.. Especially against crime.

    @BOECNation Your argument of socioeconomic injustice in the United States also has no validity. This country helps millions of lower class Americans through government run programs, versus Singapore, where lower class citizens get the end of the stick, yet their criminal system is superb, and crime is lower than any other country.

      the sianpore system as far as i understand works strongly through charities, and they do subsidize housing due to its very high costs in the market price

    Some of these practice scenes are great but not really watching this show when it was aired I’ve now come to the conclusion it really showed a liberal/progressive bias. Hey, how about Immigration law, let’m all in?!

    A very compelling argument, but I believe the death penalty is essential in the legal system. It just needs reform.

      Sounds compelling, but if you notice its all about "some" being innocent. And, 10,000 wrongly convicted on ALL crimes in the US. A perfect system with every convicted person being truly guilty is a fairy tale. There will always be mistakes, and I'm fairly certain the "some" who were innocent is less than 1% of the total on death row. Does that make our system flawed? I think no. But also, far from perfect.

      I agree with you on that concept, but the legal system has advanced today far from the days of the early medieval English system of common law. I know of the mistakes and prejudice in our system, but the death penalty is brought up when we as citizens are affected by school shootouts and victims are asking for it after so many was to repeal it. If life is so precious, why not support a punishment on a vicious act done properly, than kill an innocent person.

      @@starbury64 when is the last time you heard of a school shooting ending with the the conviction of the perpetrator to life or death row. never. Because most school shooters think that by the time you murder half a dozen kids your life is effectively over and your destined for the chair so why stop now. The death penalty isn't cost effective, doesn't deter crime, and has the tendency to kill an innocent man every once an awhile. The only logical argument of the death penalty is that "I" want to watch that person die because it will make me feel better. That may be moral even legal, for a person, but for the government, the organized society, They cannot, should not have the power to decide what results in death. Their have been many documented cases in which a parent will attempt or actually kill the murder of their child and not be charged with the crime (best example Gary Plauche). In my humble opinion, that is how a death sentence should be used only after the fact as a means of legal protection to victims who due to the nature of the crime attempt to impose the death penalty. In those situation we have a Trial of the dead man, present the evidence and if it is found that the dead man would have been convicted of the death penalty who ever did it gets a pass. IF that sounds ridiculous then let me remind you that we already do that but then wait 20 years before actually killing anybody.

      The state has been involved in the execution of innocent men by use of the death penalty, and it is not cheap, but these are not suitable answers, Always when it comes to this subject, the criminal that committed these egregious and violent acts against humanity gets life in jail over what they truly deserve coming to them only because a few people say no. The family of the victim should decide whether to choose life imprisonment or capital punishment, but it is the state through the courts that will dispense the punishment. One taking the act into their own hands looks heroic, but dangerous. We must move according to the rule of law which all must abide by.

    The way I feel about the death penalty is a simple one, it should be a method of punishment. If someone is on trial for killing someone, then that victim's family should be the judge/jury. The punishment should always reflect the crime. If you murder someone, then you should be put to death. If you rape someone, then you should be raped, if you shoot or stab someone, then the same should happen to you. We should not have judges or juries but rather the victim or the victim's family should be the sole person determining your guilt and what punishment you should get.

      How easy it is to create evidence, versus the difficulty of disproving said evidence.

    The problem with the death penalty is not how often it is enforced, but how it is enforced. If a criminal were to be executed it's in a private setting with only a few people present. More than likely none of those people are going planning on committing crimes that will warrant a death penalty. If the executions were public and those executed made an example, then maybe there would be an effect on the crime rate.

    I just watched the whole season 8 and could confirm that Eugene is the stupidest hypocrite on the show. Contradicting himself within a season, episode or within a minute of the same scene. My god ... how did he become a main character as lawyer.

    How can you call yourself conservative & reject the Bible as you moral guide? The death penalty is a Biblical requirement for murderers, as also 2-3 witnesses. There should be a high standard of evidence. It is not as if a murderer would live forever if not executed. All men must die anyway. Having a death sentence reliably & quick enough enforced encourages repentance. Also, once a murderer is executed, he does not repeat murder.
