I'm a former racer & lifelong fan of the sport. I've watched and read about this since it happened. It seems like in the split second Tony was driving by looking at Kevin's car to check the extent of the damage, Kevin (dressed in black on a dark track) ran down towards the path of Tony's car. Tony looked back to find Kevin in his path, and in a last-second panic turned and gassed to miss him (because that's how you have to turn a sprinter), and struck him by accident. All in the blink of an eye. The rest of the stuff seems irrelevant. A little weed doesn't automatically make someone a lunatic, and having a temper doesn't make someone a murderer. A horrible accident. A horrible tragedy. Pray for peace for all those involved. 🖤

What was worse was that Ward's family blamed him and tried to sue. Ward was wearing black, got out of the car when he was supposed to stay in it until told to leave, AND stood in a spot where he was hard to see. Plus, if I remember right the autopsy showed he was high on marijuana. So Ward's death was his own fault more than it was Tony's.

Right there tells anyone with experience, that you have no experience in the cars you're talking about. You're right Tony did hit the throttle, but not for the reasoning you're thinking. These cars are really crappy to drive at slow speeds and they react very slowly at slow speeds. They're not meant to go slow. They do not drive anything like a standard car. On a street car you see something in front of you, you steer to avoid it. The car will then steer very quickly. That's not even close to how these react. If you just turn the steering wheel, the car will push and cover a decent amount of distance, before the car actually turns. To steer a sprint car, you use the throttle. If you want the car to react decently you're going to have to hit the throttle. Yes the rear end might step out/slide up some, but it's your best bet to get the car pointed down the track.

Most sprint car race organizations demand that drivers involved in a race incident, remain in the car until the safety crew is on the scene, Unless of course the car is on fire. Further, they do not accommodate the use of any and all illegal substances. Tony Stewart was not the party at fault in this incident. Tony hit the throttle to try and avoid hitting him. Sprint car are not made to turn at slow speed. They also have poor visibility when driving at slow speeds. Sprint cars slide sideways through corner and then more or less use counter steering or drifting to get throught the corner so drivers are looking out the side of the car. It is common to see the front only having one tire on the ground. I assume as Tony went into the corner he was watching the car in front of him while going through the corner he would have been looking left. My assumption is as he was approaching the wrecked car he looked right as he said and was completely surprised to see a person approaching his car. In that split second he goosed the throttle to try and turn the car to the left which kind of did if I remember correctly unfortunately he did not clear him with the rear tire. There is no way Tony was acting with malicious intent because he simply did not have enough time his actions were pure reactionary right or wrong. The overarching fact remains that Mr. Ward left the safety of his car and entered an area of danger that he should have been more than aware of. Tempers flare in racing but had he taken a moment to calm down he.would have realized Tony was not there to try and ruin anyone's night but quite the opposite and had he approached Tony in the pits after the race and aired his grievance Tony likely would have made it right. Unfortunately he had a temporary lapse in judgment that ultimately cost him his life.

I come at this with a unique perspective not many others have. #1 I've watched motorsports of ALL kinds for 30+ years. #2 I worked on dirt cars at the same tracks in Upstate NY where Kevin raced (I was not at Canandaigua when this happened) #3 I became credentialed Media for 7 years, covering those Upstate NY dirt tracks for multiple regional publications and #4 I've seen Tony race at those tracks before. I understand how a sprint car operates and most importantly, I understand the mindset of a racer. Kevin made a lot of poor decisions that night. He WAS a good KID. But Kids don't belong in full bore race cars if they can't handle the responsibility of operating a land bound missile, which is EXACTLY what a race car is.
He was under the influence of marijuana. He made the decision to approach a moving race car that DOES NOT TURN AT ALL without the throttle being applied. The wing causes compromised visibility out the right side of the car. Tony didn't see Kevin until the last second, when Kevin literally JUMPED at his moving car to try and surf his nerf bar on the right side of the car and punch Tony. When he did see Kevin, Tony hit the gas to AVOID KEVIN not run him over.
People who don't understand these cars, aren't paying attention to that movie CARS. Remember "Turn right to go left?" Remember that?! Well that's the ONLY way these cars operate. Tony had to kick the backside of his car out with the throttle to have ANY CHANCE of avoiding Kevin. Sadly, the right rear kicking out still caught Kevin. If Tony hadn't done that, Kevin would've been hit by the center of the front end of that car.
Tony only did one thing and one thing only wrong. He showed up to race with the Empire Super Sprint Series. After knowing some of the people involved with that series and other series in the area for as long as I have, I'm not shocked that someone high on weed was not only allowed to operate a race car, but was then supported by that entire racing community as if he had no fault in his own demise. Again Kevin Ward Jr. was a good KID, but he was an irresponsible racer, and so was the racing community he raced in. And I'll go to my damn grave having that opinion. And anyone from Upstate NY who wants to challenge that opinion BETTER COME WITH BIG FACTS or just keep quiet.

I was on my way to an appointment in a part of town I wasn't familiar with, and I was trying to look around corners to try to recognize which right turn was the right turn I needed to take. I looked to my right at one intersection and a police Tahoe that was blocking the road caught my attention for a split second more, and then I piled right into the back of a Mazda that ended up getting pushed forward into the bumper of the next car. This was on an incline, and I remember being disoriented and rolling backwards for a second before I realized I needed to 'lock it down,' to borrow a NASCAR term.

Everyone here in these comments is dismissing a lot of facts from that night. First of all it's disgusting that nearly every commenter says that Kevin Ward getting out of the car is why he got killed, as if he deserved to get hit. Tony Stewart had a reputation in Nascar for getting out of his car and throwing objects at other drivers...so you all have a blatant double standard. Back to Kevin Ward, every other car managed to see him on the track and pass by on the apron...the only car that didn't manage to get down on the apron to pass him was the guy that was fighting with him...Tony Stewart...what a coincidence. Kevin Ward did what Tony Stewart had done dozens of times and that was get out of his car and run to point at the guy that wrecked him. Only Tony Stewart was driving directly at Kevin Ward instead of going down to the apron like everyone else. Kevin Ward realized Tony Stewart was aiming for him and 2 seconds before being hit Kevin Ward begins to run back up the track. Watch the video of the incident and confirm this before spouting off nonsense. The last, most disturbing, fact is that it is clear on the video and audio of the incident that as Tony Stewart gets to within feet of Kevin Ward he floors the accelerator, which causes the car to slide on the dirt right into Kevin Ward. Why did Tony Stewart gas it as he approached Ward? Had he not done that he would not have wiggled the car into Ward. It seems that Stewart intended to scare Kevin Ward by getting close to him and gassing it, but Stewart apparently didn't think enough before gassing it and sliding the car. The fan boys on here are why the justice system in America is so corrupt nowadays. Had any of you done this you'd have been charged with some form of manslaughter and would've been convicted and sentenced to 6-10 years in prison...but because a rich race car driver did it he got off scott free...and all you fan boys are okay with that 2-tiered justice system because Stewart's your guy...disgusting. Tony Stewart ran into Kevin Ward...Kevin Ward did not run into Tony Stewart...he wasn't suicidal. The attendees of the race all said on the video "Tony Stewart hit him [Ward]"...no one said Kevin Ward ran into his car. Kevin Ward would be alive if he hadn't got out of his car, but getting out doesn't mean he deserves to be ran over and killed by a maniac.

Ward and Stewart got in their tangle, Ward got out to scold Stewart, Stewart wanted to give the kid a little scare by punching the gas as he drove by, back end steps out and catches the kid. At that speed, taking the setup of the car (stagger, camber, etc), slightly turning left, slight banking, etc., an experienced driver would NOT hit the gas to turn left. At that speed you turn the wheel to steer the car. At racing speed you throttle it to get the back end around but not at low speed so everybody can drop that argument. Show me one example of a driver steering the car with the throttle at pace car speed. That's not how it works. Mr Grumpypants didn't mean to hit the kid but he did mean to scare him.

Smoke did settle the lawsuit out of court and he also did pay for Kevin Ward's funeral without telling the family about it.

Smoke is not a bad guy, but he has bull tempers that have played wrong against him due to his explosiveness. That's why he is happy drag racing with his wife. It is a more peaceful environment were no manhandling is done like in oval and dirt racing. I'm glad he aknowledges his guilt on taking a life and that he made the right choices to keep himself free. But he never should've used the 3CHI as a scapegoat. That's why Karma charged him on him not being able to hire Larson and eventually loosing his team.

While I'm aware that a criminal court decided in Tony's favor on the charges of 2nd degree homicide and criminally negligent homicide, and while I am not a judge or attorney, I will always disagree with those rulings. And yes...Kevin Ward contributed to his own death by first making the decision to get out of his car before first responders told him to do so and then further contributed to his own death by advancing down the track into the line used by cars under caution. I understand how sprint cars are driven. Their angle of attack and direction is controlled with the accelerator and brake as much as the steering wheel. When you watch the video of the incident. All of the cars in front of Tony came through the area where Ward had crashed and then once the first car saw Ward himself on the track, they dropped down to the lower part of the track (left side) and you can then watch as each car after that also dipped down lower to give Ward plenty of room. When you're in a line like that under caution and you see the guy in front of you move left or right, you follow because there is likely a very good reason to do so. Usually, they are avoiding debris or fluid. But when Tony comes through he does not dip down. And not only does he not dip down to the left, he inexplicably hits the gas, causing his rear end to move to the right and his right rear tire strikes Ward and kills him. Did he intend to strike him? I don't think so, but no one can know someone else's intent unless that person announces their intent prior to doing so. These kinds of post-crash incidents are common in many forms of motorsports. My speculation was that Tony stepped his rear end out like that to scare Ward and misjudged it and struck him. Again, there is just no reason to step on the gas so forcefully there under caution when you admit you saw someone close to you on the track. So, innocent of criminal charges and Tony settled out of court on the wrongful death lawsuit. On the one hand, I would say that he is very, very lucky. Lucky that he can afford the lawyers he can, lucky that the jury found him not guilty and lucky that he could stroke a check to the Ward family and end this. I have no doubt given the person Tony is, he lives with this everyday and he has been forever changed by this. I would also say that while motorsports have rich and specialized traditions all over the world and when it comes to sprint cars, the local amateurs enjoy competing against professionals in the Saturday night feature. But, I just think when you have a sport where death can be the ultimate penalty, amateurs should not be racing against professionals.

All the others drivers passed Kevin with no problem, its a race track WITH lights not a dirt country rd at 3am , and the one who hits and kills him is the same one who ran him in the fence a lap earlier , hmmm.
You don’t steer a dirt car with the gas under caution at slow speed that’s ridiculous . Only at race speed would you steer in reverse like that. It’s similar to a motorcycle in that way
Tony didn’t mean to kill him obviously, but he did see him and I believe meant to throw dirt on him or just scare him by hitting the gas when he went by him. My opinion Tony in anger misjudged getting close to him to scare him as he went by and accidentally hit him. It’s under caution for god sakes you don’t smash the gas like that!!!
No Kevin shouldn’t have been on the track but I’ve seen tony get mad and walk across a live track also even in the cup series.
Tony is not completely innocent in this as he claims to be, there was no need to hit the gas as he passed Kevin . TONY SAW HIM, and reacted with a throttle input to get close and scare him, misjudged and killed him , end of story
