They know society will take their "emotions" into account even when they're lying or being unreasonable. She has to ensure that her words are correct and are within the boundaries of the law and are more difficult to be overturned by an application for an appeal. The fact that she appears to be unsure about whether a Supreme Court will counteract her decision is rather dubious. She knows that she is dealing with lawyers. The judge doesn’t appear to be very knowledgeable about certain issues.
      Her comments about Miss Merchant are potentially diluted as compared to the reality.
      We know that the trumpy sycophants and his cohorts are quite involved in making a mountain out of a molehill, whilst building a molehill sized lump pretending that it is a molehill.
      Also, given the type of information she requested does seem to imply a ‘fishing’ exercise. Non disclosure agreements are usually confidential to the party’s, how an office spends their money when dealing with a case that is not about financial spending etc. Some records that she requested may have been necessary but others I’m not sure about but obviously I haven’t paid a lot of attention to this case overall because there has been so many other issues to deal with.
      I’m alleging that it’s possible that the Merchant firm are seeking legal costs because the trump cohorts haven’t paid. I’d be interested to know if they have been paid. The fact that they also want fees prior to the litigation implies not. I may be wrong however so it is a mere speculation.😅

    • @joshua43214
      @joshua43214 24 дні тому

      @@amayastrata4629 The Judge would not be saying this publicly unless she was pretty confident that the Supreme Court would rule as she expected. She is giving the State the chance to be prepared, and subtly warning them that they better be prepared. She is also giving the Merchants a chance to prepare the Order, this is also standard procedure for a plaintiff to write the Order for the Judge.
      In court, an NDA is meaningless if it blocks testimony. When a person is under subpoena, they are compelled to testify, period. The judge can decide if the line of inquiry is not relevant or could harm 3rd parties, but a simple NDA is insufficient grounds.
      Given how often DA's have been caught withholding information, especially in this particular jurisdiction, fishing is a very good idea - ALL Americans have the Right to a fair and impartial jury, and the executive branch should *never* be able to decide what is fair, impartial, or relevant. Open records are open records, period. If there is nothing there, then there is nothing there, and there is no reason not to comply. The "wasted resources" argument is meaningless. The law says the records are open, period.
      Lastly, the Merchants are getting paid. This money they are asking for is meant to be punitive, and a small fraction of the the total legal bill. They want the fees first because Lawyers always get paid up front. If they where not being paid, they would not be in court at all.

    I believe that the Judge’s characterization of Ms. Merchant as “difficult” was inappropriate. Judge’s should refrain from passing personal judgments particularly when giving extemporaneous comments from the bench, and rather, issue a more detailed and thoughtful written order and opinion wherein the Judge could better reflect on her choice of verbiage.

      Women do this all the time. They'll be solidly in the wrong and then claim it was because they felt intimidated by the aggressive behavior of their victims. They learn how to do it as children, using tears and false claims of fear to manipulate the audience into believing their anger is fear. It's also why many women never grow up, acting like a toddler and turning all their indiscretions against works quite well. You can also see this behavior in many young men who were raised by single mothers, nothing is ever their fault, some person or circumstance made them do what they did. It leads to many of them dieing because men have different rules and behaving like girls won't save them from their fellow man.

When people finally wake up, these judges are not for Democrats or Republicans, they are creating decisions for the elitists and their inner circles as a way to try to stave off the attacks from average people being treated unfairly. In turn, it makes these judges and inner circle do things that are being exposed by a younger generation (using social media) who wants to destroy this type of authority. The Supreme court, better do the right thing, and Not allow Fani Willis and her corrupt team, get away with their corruption of withholding public records. If so, there are no upstanding laws in all of Georgia involving Fani Willis and her side sidekicks. Bond was the extremely rude to Merchant. I don't know what the judge means, by labeling Merchant as difficult and aggressive, just doing her job. The judge told Bond, you can say what you want to Merchant. Rather he wanted to work with her or not, it's his job to do what is requested.

    What is this judge going on about? Merchant has a right to public information under the public records act. Her motive for requesting the information is completely irrelevant. If the DA’s office had given her the information, then there wouldn’t be an issue at all. But it’s clear that the DA’s office deliberately withheld this information because they don’t like her. So Merchant had to be a difficult (rhymes with witch) and drag them to court to get them to do their job. This runs up unnecessary expenses for the defense and the DA’s office should pay for every dime of it. Plus, the individual public employees who violated the law based on their petty dislike for Merchant should be fined.

    She was surprising deferrential to the argument that the Merchant's had ulterior motives. Access to public records should be the same regardless of the motive of the requestor except for very specific cases, and "public embarrassment" is not one of them.
    And the DA knows this because they tried to half assed respond because they knew they couldn't legitimately deny the request. It's not just incompetence, it's malicious. And they hoped to excuse themselves because of all the media hoopla.
    It's a conscious attempt to subvert the law.
