Is anyone joining the dots with issues with previous cases before new legislation is written up? It seems best practice to have the solicitor involved from day one. Trust and accountability go out the window when the solicitor is only brought near the end of the process. The current system seems to have been set up to suit the system, not the client. Why do we put the cart before the horse and close the gate when the horse has bolted!
I wish people would just set them up when they are in their 40s or so, looking at all options, which could be easily enough changed should the people die or something - but at least then people would be able to be not under duress or it be "too late". It should be a "living document" that grows with you, but at least has the main baselines as to who/what is going to happen to you, especially in relation to the health and welfare side, changeable on large events, but lodged and secured in the sensible likelihood that "most people" will be of right mind and not under duress at an earlier age.
If the solicitor, having made all the prescribed enquiries, done the AML compliance etc and eventually decides not to certify, will he/she get paid nonetheless for the time and effort expended? Good luck with that…
