That is a very interesting view point. But pardon me I do not agree with it. This is because a writ petition in High Court does not merely involve the question of violation of fundamental rights but may also involve the question of violation of "any other legal rights" than fundamental rights. A writ petition in Supreme Court involves only the question of violation of fundamental rights. But in spite of that considering the volume and overload of work with which all the courts function, it is not possible to quickly grasp and understand intricacies of the facts of each case and the issues involved there in without assistance of lawyers. The important function which a lawyer performs is to simplify the complicated case with his articulation before the court, so that it becomes easy for the court to understand the intercate things involved in the matter.

You may please approach the registrar of the concerned High Court for getting information about the Legal aid services that they provide to the poor and needy who cannot afford a private lawyer. They normally have Legal aid services with a panel of lawyers. If you fit into the criteria you may get a lawyer from the Legal aid panel free of cost, that means that the cost of the government. रिट पीटेशन भारतीय संविधान के आर्टिकल 226 इसमें होता है। और कानून में जो लिमिटेशन एक्ट है उसके अंदर या कहीं और भी रिट पिटिशन दाखिल करने के लिए कोई भी टाइम लिमिट नहीं दी हुई है। तो इस हिसाब से तो रिट पीटेशन दायर करने के लिए टाइम लिमिट कानून में नहीं है। मगर फिर भी कानून यानी कि बहुत सारे केस लॉ ऐसा कहते हैं कि इसका मतलब यह नहीं कि आप जब मर्जी आए तब आपके हिसाब से बहुत विलंब से रिट पिटिशन दायर करें। हाई कोर्ट और सुप्रीम कोर्ट के केस लॉ से यह निश्चित किया गया है कि रिट पीटेशन यह एक रीजनेबल समय के अंदर करनी चाहिए। और रीजनेबल टाइम लिमिट कितना होगा यह हर केस के फैक्ट्स एंड सरकमस्टेंसस पर निर्भर रहेगा। उदाहरण के तौर पर, किसी केस की फैक्ट्स एंड सरकमस्टेंसस ऐसी हो सकती है कि 1 या 2 दिन का विलंब भी बहुत ज्यादा विलंब माना जा सकता है और किसी केस की फैक्ट्स और सरकमस्टेंसस ऐसे हो सकते हैं कि 5 साल का विलंब भी बहुत ज्यादा विलंब नहीं है ऐसे भी माना जा सकता है। तो यह हर केस की परिस्थिति क्या है उस पर निर्भर रहेगा। आप के केस की परिस्थिति क्या है यह आप ही जानते हैं। अगर केस में बहुत ज्यादा विलंब है तो वह रिट पिटिशन में ही एक्सप्लेन करना पड़ेगा।

It would be best to ask a lawyer practicing in the supreme court. But in my opinion it should not be complicated. The party will either have to file a pursis or an application for withdrawal. Exactly what that I don't know. Please contact A Supreme Court lawyer for accurate idea.

Excellent information, 2nd and 3rd head will not be more than Rs.5000/, whereas in 1st head it will be differ accordingly status of lawyer. Is ot ok?

Yes there is some judgement of the supreme court which says that in marks should be rounded off. But that needs to be searched.

रिट पीटेशन भारतीय संविधान के आर्टिकल 226 इसमें होता है। और कानून में जो लिमिटेशन एक्ट है उसके अंदर या कहीं और भी रिट पिटिशन दाखिल करने के लिए कोई भी टाइम लिमिट नहीं दी हुई है। तो इस हिसाब से तो रिट पीटेशन दायर करने के लिए टाइम लिमिट कानून में नहीं है। मगर फिर भी कानून यानी कि बहुत सारे केस लॉ ऐसा कहते हैं कि इसका मतलब यह नहीं कि आप जब मर्जी आए तब आपके हिसाब से बहुत विलंब से रिट पिटिशन दायर करें। हाई कोर्ट और सुप्रीम कोर्ट के केस लॉ से यह निश्चित किया गया है कि रिट पीटेशन यह एक रीजनेबल समय के अंदर करनी चाहिए। और रीजनेबल टाइम लिमिट कितना होगा यह हर केस के फैक्ट्स एंड सरकमस्टेंसस पर निर्भर रहेगा। उदाहरण के तौर पर, किसी केस की फैक्ट्स एंड सरकमस्टेंसस ऐसी हो सकती है कि 1 या 2 दिन का विलंब भी बहुत ज्यादा विलंब माना जा सकता है और किसी केस की फैक्ट्स और सरकमस्टेंसस ऐसे हो सकते हैं कि 5 साल का विलंब भी बहुत ज्यादा विलंब नहीं है ऐसे भी माना जा सकता है। तो यह हर केस की परिस्थिति क्या है उस पर निर्भर रहेगा। आप के केस की परिस्थिति क्या है यह आप ही जानते हैं। अगर केस में बहुत ज्यादा विलंब है तो वह रिट पिटिशन में ही एक्सप्लेन करना पड़ेगा।

सर हमारा आईटीआई सर्टिफिकेट पिछले 10 सालो से नही मिला है,डायरेक्टरेट की गलती की वजह से क्या उसके खिलाफ केस कर सकते है सर्टिफिकेट के लिए। और उसमे जो भी खर्चा आएगा क्या कोर्ट से उसे वापस मांग सकते है क्या। अकेले पड़ गया हु सर 30 हजार मांग रहा है और मैं स्टूडेंट हु उतना कही से एडजस्ट करके कर भी दिया तो और प्रोब्लम में फस जाऊंगा।गलती सरकार की है अपने ही सर्टिफिकेट के लिए के लिए इतना खर्चा करना पड़ेगा ।कुछ सॉल्यूशन बताइए

अगर उच्च न्यायालय मे डबल बेंच में केस चल रहा हो, और इसके निस्तारित होने से पहले,
किसी अन्य व्यक्ति द्वारा उसी मैटर मे रिट याचिका डाली जाए।
(डबल बेंच के निर्णय से लाभ लेने के लिए)
और डबल बेंच का आदेश, रिट याचिका के निस्तारित होने से पहले ही आ जाए।
उसके 20 दिन बाद रिट याचिका भी याची के पक्ष में निस्तारित हो जाए।
प्रश्न -तो रिट याचिका दायर करने वाले व्यक्ति को डबल बेंच के आदेश का लाभ मिलेगा
अगर दोनों याचिकाएं और उनमें किए हुए प्रेयर्स आईडेंटिकल है तो समानता के तत्व पर यानी कि ऑन द प्रिंसिपल ऑफ पैरिटी, लाभ मिलना चाहिए ऐसा प्रथम दर्शनी लगता है।
पक्का करने के लिए आप एक्सपर्ट वकील की सलाह ले लीजिए।

It would be best to ask a lawyer practicing in the supreme court. But in my opinion it should not be complicated. The party will either have to file a pursis or an application for withdrawal. Exactly what that I don't know. Please contact A Supreme Court lawyer for accurate idea.

The only thing that appears on the first look of your query is that this seems somewhat impracticable...but here again attendant circumstances / things need to be examined. Sir me ek shaskiy adhikari tha, jila nyayalay me mere upar ek criminal case file huaa tha , jisme adalat dwara mujhe doshi siddh kiya hai, fesle se pehle mujhe suspend kar ke mujhe jivan nirvah bhatta diya ja raha tha. Yes p. i. l. basically arises out of article 226 of the constitution. Article 227 is about superintending jurisdiction of the high court over the lower courts and tribunals.
