Sir कृपया स्पष्ट करे की हाई कोर्ट के नोटिस का जवाब विपक्षी पार्टी सरकार द्वारा छह माह से नही दिया गया है और न ही कोर्टके स्टे आदेश पर ही अमल किया गया कोर्ट के आदेश को किसी प्रकार मान्यता नहीं दिया है कोर्ट ने भी सरकारी अधिकारी के आचरण को कंटेप्ट ऑफ कोर्ट मानकर आदेश जारी किया है फिर भी विपक्षी पार्टी सरकारी अधिकारी पर आज तक कोई भी कार्यवाही नही की गई है जबकि उक्त अधिकारी ने कोर्ट के नोटिस का जबाव भी आज तक नही दिया है और याचिकाकर्ता को आज तक कोई भी न्याय नही मिला है प्रकरण माह अक्टूबर वर्ष 2020 से स्टे होने के उपरांत भी उस पर कोई भी सुनवाई नहीं हुई है अब याचिकाकर्ता को कब तक न्याय मिल सकेगा?(याचिका कर्ता द्वारा हाई कोर्ट जबलपुर में दायर याचिका क्रमांक WP -14086 -2020 एवं CONC 96-2021 हैं)

Hello Sir, your videos are very helpful. I have few question if you would be able to answer them in your videos it will be very helpful of you.
1- In Criminal Trespass/ Only Trespass- Can noise be considered as interference? Generally it may not be valid but in case it's in odd time or very loud without any festival like usually neighbours are noisy, so if that happens multiple times atleast in such cases Crminal Trespass should become valid !! It was interference, also now even Mental Health has been recognised by law as well as Courts so it should amount to Hurt too in exceptional circumstances. Just a few days ago Delhi Court again brought this into Justice by making mandatory for Insurance companies to cover Mental Costs too as it can't be discriminated just because this organ's damage in not identifiable as Physical Injury.

It's procedure etc. In one of the service matters the opposite party has submitted a sur sur rejoinder, is ir necessary for the other party to file a reeply for that. Sir, I was charged u/s 19/54 of Rajasthan Excise Act 1954, for transporting of liquor. I file a FIR against the excise police, on that state police made FR. The liquor shows near by 15 liter mix of country and English liquor. In trial I acquited. The government appealed to session court, there it accepted by rejecting all the trial with nonsense reason and adding that this accused file FIR and police found it absolute wrong. I, as petitioner self, appeal in revision to HC Raj. The appeal in waiting to admission hearing. What shall say in admission hearing, such as, the appellate authority have been fixed by police so this judgement is or shall I say that, sir please call the record and decide the case. Guide me sir.

Actually I thought this to be a very good topic for making a short video so that I would answer this question in a video separately.
But anyways! Now that you are eager to know the answer, let me answer it here for you.
When the high court orders notice returnable on a particular date it means two things. First is that the High Court has, by way of an order directed / called upon, the respondent side to respond to the petition of the petitioner. Second is that the notice of the high court should be served upon the other side within a particular time as specified in the order, and the report to that effect should be submitted to the High Court by the registry of the court. The matter is again listed on the date specified as returnable date. If by that date the respondent is served with the notice of the High Court the matter proceeds further. But if by that returnable date notice of the high court still remains to be served on the opposite side, then the High Court passes some order with regard to service of notices.

Advocate is not pressing his petition simply means that he is not interested in continuing with the petition. This may be for few certain reasons. It could be because his grievance is satisfied by the respondents, or that with the passage of time, the reliefs claimed in the petition are no longer significant or meaningful.

Yes! I think you can withdraw the case even when it is before the registrar.
I don't think there is any specific term for this stage. The case is only in a presented state.
For refund of court fee you will have to apply under the relevant laws such as the court fees act applicable to your area, to the appropriate authority. To know how to do that you will have to consult a lawyer properly.

सर इलाहाबाद हाईकोर्ट में मेरी अप्रैल माह में एक डेट को एडिशनल कॉज लिस्ट में लिस्ट हुआ था
लेकिन उस दिन उस कोर्ट का कोई भी एडिशनल कॉज लिस्ट जारी नहीं हुई।
तो क्या अब सुनवाई नहीं होगी।
केस लिस्ट नहीं होना, केस में जल्दी सुनवाई ना होना, केस में बहुत देरी होना, केस लिस्ट होने के बाद भी तारीखे पड़ना वगैरा-वगैरा इन सब बातों से हम वकील भी परेशान हैं।
लगता है यह स्थिति सारे देश में है। आज की तारीख में ना मेरे पास इसका सोल्यूशन है और लगता है ना किसी और के पास।
जैसी भी है स्थिति को स्वीकार करके उसके अंदर जो जो कर सकते वह करते रहिए और आशा करते रहिए कि आपकी केस जल्दी हो जाएगी।
