  • In this episode of Caregiver Corner, caregiver attorney and host Daniel R. Chaleff, Esq. addresses the question: "What is the minimum pay for a twenty-four hour caregiver providing one-on-one care to a patient inside a residential home?"
Are you a 24-hour caregiver in California who works for a day rate (e.g., $160 - $240 a day), without overtime compensation, for someone who can afford to pay a fair wage? If so Chaleff Rehwald Peterson would like to help you recover your unpaid overtime. Unfortunately, many caregivers do not understand their rights, including the right to overtime. If you or someone you know is a caregiver receiving a daily salary without overtime, we can help.
For years, "The Caregiver Attorneys" at Chaleff Rehwald Peterson have helped caregivers claim their rightfully owed wages. We ask you to share this message with friends who are caregivers so that they can receive information about possible claims for unpaid wages.
We offer free consultations and are available to speak any time; just contact us.

Facilities are paying $20 to $28 an hour now. California the minimum wage is $25 for healthcare workers. Good luck finding someone to work 24 hours shift without overtime at $14.

I’m in California my uncles wife is my grandma caregiver but she has never taken care of her she has neglected her it’s an ugly situation when I started seeing the real picture I started doing 100% of the work except the cooking but bathing getting her up putting her to sleep cleaning her room getting her back up and putting her back to bed I’m doing it all and I’m not even getting paid and I’m tired mentally and physically and don’t want to report them for fraud but it’s getting to that point and I don’t know what to do anymore she’s 101 yrs old . I might have to take her to my house and take care of her would IHHS send someone to help out what would happen anyone that has gone through this situation can you please reach out or anyone knows a similar case what happens ???? I’m thinking about taking her but don’t know if I would make it known a home and have bills . Would I get back pay for all the work I have done ????? And maybe with that little money I get I can hire or get help to at least survive and pay my bills and take care of my grandma would I have to completely quit my job ????

I feel like if you know you can't handle the situation why even start something that you can't even finish. You even say it yourself that you be overwhelmed and it's too much for you so why would you take on the stress. I don't know about the back pay but I'm pretty sure it's a BIG NO since there no actually proof that you claim you did any DAL (daily activities living) tasks. This is a serious job and should be taken accountable not just for you to get a check if your heart and emotional not attached obviously this is not your answer
