  • In today's video, I analyze the new updates in Sam Bankman-Fried's case, highlighting his missed chances for mitigation that could influence his ultimate federal prison sentence.
    Our team at White Collar Advice assists others involved with FTX, though Bankman-Fried isn't one of our clients.
    Bankman-Fried seems to be repeating history, relying heavily on his legal team instead of mitigating. This approach could lead to a harsher sentence, much like others before him.
    Understanding federal sentencing is complex. Bankman-Fried's lawyers suggest a 63 to 78-month term. In reality, I'll explain what this could mean, factoring in the First Step Act and good behavior.
    His defense strategy leans on his attorneys' arguments and experts' reports, sidelining proactive efforts that could show his character and remorse-potentially crucial for leniency.
    I urge Bankman-Fried and anyone in a similar situation to mitigate. True change and resilience come from within, not through your defense team's efforts.

    I love it when you get all riled up and start shouting -- well, not shouting, but speaking emphatically. Even more so since it stems from a very deep truth not just of how the system works but how we should all live: taking responsibility for our actions and, if we can, making this world a better place.     The Holmes sentence was an absolute mockery of the system. The magnitude of the crime and dollar amount was enormous. SBF's is Madoff-like.

      She pulled her brown skinned "foreign" boyfriend into her crimes. The jury looked at this pretty, white, brand new mother and excused her on 7 of the 11 counts. Of course the brown skinned foreign boyfriend was found guilty of all 11 of the charges by his jury, he didn't have her pretty face, blond hair, and brand new baby to help the jury see him as a more sympathetic person.

    He shows no remorse and continually disrespects the system. The judge owes it to the people to punish him and his family. It’s sad that SBF doesn’t understand how to help himself.

      He has to pay 100% of the trial tax. I'd be a lot more sympathetic if it was a plea deal prior to trial.

      @@WhiteCollarAdviceOfficial 100% agree. It just doesn’t seem like he gets it. He ruined peoples lives and bankrupted innocent investor, many of whom were convinced to invest after seeing his ads and placements with “trustworthy” celebrities and politicians. It’s one thing to misappropriate funds, it’s another to do everything he did… The punishment needs to incentivize others not to make the same mistakes.

      Yep, many of his victim investors (as stupid as they were) will have lost years to decades in savings, anything less than 15 years no parole would seem very off to me.

    I'm not bloodthirsty enough to demand a life for a billion or so dollars. I think you're a good man and you opened my eyes to some of these perspectives about sentencing and how pointless it is to warehouse people until they die. I would be open to see SBF authentically redeem himself and contribute more than the damage he caused. Impact isn't just measured monetarily, and while he probably won't be the next JP Morgan, I bet he could prevent 100 FTX's by learning from his experience and acting as a positive influence to society like you do.

    63-78 Months is what Gary Wang and Caroline should get. SBF should get 5x to 10x that.

    I do not care one bit about restitution to investors and customers. That is not a priority at all. I also don't care about giving him a chance to redeem himself outside the walls of prison. I have zero in FTX as a customer or investor. I don't care about his psychiatric problems, especially since he is very high functioning. I am part of the plaintiffs (the people of the US). I care about sending a message to future SBFs to not do it unless you want a 110 year sentence. So I hope Kaplan sentences him to the max, especially since he needs to pay the trial tax.

    He will be lucky to get 20 years!!!!! Prosecutors are asking for 50 yrs sentence. Thry have to make an example out of him because there are too many other similar companies which could do the same.

    It’s easy to armchair quarterback, this, I do it too. But the truth is SBF steadfastly maintains. His innocence and autism is a neurocognitive disability that complicates everything. I definitely see more the lawyers can, and should’ve done in their sentencing memo. It remains to be seen what else they present, but in terms of remorse and acceptance of responsibility, and all the things you so rightly speak of, that is impossible to achieve in this case.

    As you said; 150 years for Bernard Madoff.
    SBF has committed premeditated large-scale fraud! (lots of victims) I can't see him getting out! Or, at least 30 plus years! (IMO - which means nothing). Appreciate the great content. Thanks

    I really hope Judge Kaplan is merrciful to Sam, he has not killed anyone,and it seems his investors will get all their money back. I don't think he had the legal advice he deserves. I am going to pray for him, Sam doesn't believe in God, but I do,. My sister and I are on his side. Get over it, it is only money that will be paid back.

      ​@WhiteCollarAdviceOfficial it's all so out of hand, a severe message has to be sent! 100 years, no possibility if parole, and if he wants any privileges in prison, he has to work to prevent others in doing the same.

    Bankman-Fried is on the autism spectrum. His abilities to understand the minutiae of human communications are very limited. You can give him all of the correct advice, but due to his inability to "read" emotions will make it impossible for him to do what you ask. So far, his lawyers have tried to do that for him. So-called "high functioning" spectrum disorders sometimes leave their very high IQ participants in a wilderness of confusion about people. Often you can't tell the difference. But gradually, their human-communication disability comes into view.
    In the meantime, the judge EXPECTS remorse and a "skilled" emotion-filled Mea-culpa from Bankman-Fried. Unless the judge has people in his family who are on the spectrum, he will not understand Bankman-Fried. And Bankman-Fried WILL be punished for his inability to communicate. Maybe Bankman-Fried should have a longer sentence because of this, maybe not.
    It's up to the judge.
