The issue isn’t with the items themselves returning (I’m all for it). The problem lies in how they were originally marketed. Fortnite sold its battle pass content as exclusive and the community understood it that way. Even if there’s a TOS loophole, bringing back those older items would essentially go against that promise, making Epic Games seem dishonest and likely create distrust and outrage in the community. Anything from Chapter 5 Season 4 onward is fair game, as Epic Games clearly stated that battle pass items from this point forward will return. Not really about the skins, its about massive companies keeping promises.

Exactly, that’s the TOS loophole I meant! Most of us didn’t read the fine print, but years of BP items not returning made them feel exclusive. Regardless of the technicalities, the community believed they were dispite having a gray zone of sorts. To me, it’s about holding companies accountable to the expectations and marketing strategies they set at a given time (eg. Fear of missing out). It feels like misleading marketing if they bring them back. I’d love to get Season 4’s BP, but it wouldn’t be fair to the original owners even if they don’t care about exclusivity.

I totally get where you're coming from and it’s 100% true newer players didn’t have a chance to get iconic items. It really is a tough balance between fairness for them and honoring the expectations set for the original playerbase. Once again for me, it’s less about skins returning or whether OGs care (like you said, you wouldn’t lose sleep) and more about trust. When something is marketed as exclusive (even if just implied) it sets an expectation. Changing that later breaks trust with an already money hungry and profit-centered game. I think that if they were to bring back old skins, a middle ground could work - like slightly altered versions of older skins for new players, or vice versa like something similar to the purple skull trooper/reflex situation for original owners. That way, BP owners keep exclusivity while others still get access. I don't think this is perfect, but it would be an acceptable compromise.

It's a direct downgrade in a lot of ways to the original. Comic book Spider-Man is another example, though we have many variants of the webslinger they aren't the same character across each skin, Miles Morales, far from home spidey, and Spider man Noir are all entirely different characters. Offering a compromise or an alternative is a band-aid solution to fans of these characters. I'd say this for only BP owners who have incomplete sets of skins/items that they were trying to get right before their specific season ended. It's probably because IRL they have important matters to deal with and not enough time to stick to playing a game all day. It would be better to give the BP owners what they're missing and not leave their skin sets incomplete. But it depends, like let's just say if they only played the season right before it ends, but they manage to get all the BP base items but not the special awards & secret (secret then but bonus nowadays) awards, then I'd say have them grant it to them because that player did participate in the season. And if a player jumps in the new season right before it ends BUT have like 25% of the base BP earned, then no don't give them all the items but only grant the remaining items they were currently grinding for on the current page they were on. Since we can't sue them alone, I suppose a large audience bands together or a massive corporation (Disney since they own Marvel, Star Wars and Fox; along with Sony) would have its attention on Epic so that this issue can be addressed because people only play just for the character they want to play as, and not wait decades until a rehash of a past skin gets released in the shop. We'll be dead by then if Epic takes too long. Idk I'm probably too stupid to think about this, this may be a dumb idea. I don't even know if petitioning works anymore. They have made the recent battle passes non-exclusive and have stated that they will be available for purchase two years later. How does this video not include this? There is nothing preventing them from bringing these skins back, and you wouldn't be able to sue Epic on any legal ground whatsoever since you would need to prove that you incurred damages. the FTC wouldn't care either and the only reason they put epic in hot water was because they violated coppa regulations and made their item shop predatory and anti-consumer friendly with not allowing people to confirm their purchases or allowing proper refunds to parents who's children may have used their money without their knowledge. An issue ENTIRELY seperate from battle pass exclusivity and "false advertising"
