What I would like to know is, does he mean after you pay the delinquent taxes, they have 3 yearrs to stay in the home?? Im just confused by what his response means. Thanks in advance!!

Then typically 3 years later they need me to research all the interested parties and get them noticed that if taxes are not paid current within 60 days my clients will request a tax deed. Again, this year in Missoula County all of my clients’ assignments were redeemed within the 60 day period. I know of no properties which did not redeem and were deeded to the investors. Sorry that I am not more helpful with the information you are seeking. Dan

I believe he is talking about the 3-year redemption period. For example, lets say you bought a tax lien at the 2019 sale county sale. And 3 years later when its 2021 the property owner has still not paid back yet. So because its at the end of the 3-year redemption period you can begin the foreclosure process. So the attorney would go ahead and send out the notices to the property owner after the 3 years. After the attorney sends out the notices to the property owner. The property owner has 60-Days to pay you back. If they don't pay you back at the end of the 60-Days. Then you can receive the tax deed on the property. What the attorney is saying is most of his clients will get "paid back during that 60-Day period". So most liens owners will not end up owning the property and they lien will be paid back during the 60 days. From what I understand the attorney wont actually research or find tax liens for you. You will need to research the list and buy any tax liens yourself. Usually the Attorney will only help with the foreclosure process. I guess an attorney might be willing to help you with the buying process if you pay them. But paying them would cancel out any interest you made on buying the tax liens. So as far as I know you will usually need to research the list and buy the tax liens yourself. The reason the county lists the 2 attorneys at the bottom of the page is really for foreclosure and for legal reasons. The county wants to say they recommended you consult an attorney before buying - so if you buy bad liens you cant blame them. Montana is really kind of a more difficult state when it comes to buying tax liens. Some counties have several procedures that you will need to go though if you want to buy OTC tax liens. This can even include sending out notices to buy OTC liens. The advantage is there is probably only limited competition at the yearly sales. And if you can master Montana's system you will have fresh tax liens you can buy every year. If you want to see if they have any OTC lists you can contact the county treasure and ask them about it. You can also check out our Membership program and see all the lists we provide. But hopefully that will give you a better idea of what "I think" the attorney was saying and how I understand the Montana tax lien system. Thanks again, SJ Swenson
