Thanks David for another great presentation and tutorial. I have been wanting to learn about the appeal process just in case I got a summary eviction even though I have actively pursued rental assistance.

@@sierramills8991it was rejected, and i got home and was evicted and locked out by the constable while I was at work, now I'm homeless.
@@shakaama Did the appeal push the eviction back a little ? Or was it rejected immediately?
@@AshRiggs-iw2ed it was all very suspect. I was told by lawyers the appeal would send it back because I had offered a payment plan. but no, the female appeals judge literally said NOPE. there was no trial, no minutes read into the court log or anything. even the clerk was confused.
I was served a 7-day pay or quit notice 2 wks AFTER the landlord said he was advised NOT to charge me rent until habitability repairs could be made. On day 2 of this notice, I tried to inquire about a weekly rental and it was already on my background check. Is this legal? I can't live there because of habitability issues and I can't go 'cause I've been blackballed. Can you help, please? I'm a 65yr of age disabled veteran.
my Landlord has posted 3x 7 day notices to pay or quit in the last 2 weeks.
on the last 2 She had her lawyer ad a 3 page document titled:
"supplementary notice to the summary eviction: 7 day notice to pay rent or quit"
"Please take notice the landlord hereby States she is willing to participate in the application process for rental assistance that she will accept rental assistance on behalf of the tenant..."
next line says:
" landlord hereby provides written notice to tenants that landlord is seeking exemption from a stay of eviction proceedings and intends to follow motion to robutt any affirmative defense asserted by the tenant"
Assembly bill number 486 notice to tenant of the provisions of AB486 sections 2, 3 and 4...
What is this and is she trying to get around the law thank you...?
Landlord may seek exemption based on imminent risk of foreclosure. This is illogical given that rent assistance will prevent the foreclosure.
David, please allow me to come in to speak with you. My issue is involved, complex, and convoluted, and my landlord has purposely made it that way. After reporting to APS that I'm inhaling hydrogen sulfide because of sewer gases in the house, he served me with ANOTHER eviction notice requiring me to leave 60 days BEFORE the hearing on the 7day pay-or-quit that I answered. Please help. Thank you.

Do I have to leave the property the same day the constable comes ? Or does the constable come and post a 24 hour notice first ?
NRS 40.253 requires the constable or sheriff to wait 24 hours and evict between 24 and 36 hours after posting notice.

Post within 24 hours of order being signed and evict within 36 hours
@@jeannicole233If they grant an eviction, you can file what's called a "Stay of Eviction," which is granted would allow a judge to give you up to ten extra days to move.
Yeah but they won't give it to you.
