    The original sellers should be charged with a variety of frauds--real estate, loan fraud, etc....and I am sure they didn't declare the payments as income with the IRS.

      Of course we all feel that they should, but legally they probably aren’t responsible for it, because of whatever contract they had going on. But, this is the risk you assume when you try to buy and sell on your own without real estate agents

    This makes me furious! She should sue that seller that took out a mortgage on her home AFTER she’s signed a promissory note.

      @@williamwilson6499 LOL The seller never showed up for multiple court hearings, so even with a default judgement, this lady is not ever going to see that money. At best, this can be turned into a criminal rather than a civil case. At least the seller might do jail time with an order of restitution, that is if they own anything.

    My parents purchased both homes they've owned via owner financing in the 60s and 70s. This used to be an incredibly common way to purchase a home. The seller just committed fraud and should be charged accordingly.

    I'm confused why the company isn't going after the people who defrauded them instead of another innocent victim of that same fraud

      The bank is owed money from owner of property and they are taking back the house. They have nothing to do with the victim, who is a tenant.

      They are. By foreclosing the home. Unfortunately, as far as the letter of the law is concerned, the scammers never officially sold the house to the woman and the company that bought the defaulted mortgage from the bank doesn't care about their reputation or public opinion, only about making a quick buck.

      @@jormugand5578 the issue here is they took the mortgage *fraudulently*, they didn't scam anyone. Scams are usually legal, morally wrong, but they typically involve someone voluntarily handing over their money. Fraud is literally breaking the law, scam is convincing someone to give you money, which isn't against the law. There are very specific circumstances where lying to someone to get money from them is illegal. For example, catfishing, that's completely legal. However, if you're a company and misrepresent a product in order to get people to buy it, that's illegal. At least in the US, that is where I'm basing all this, cuz it did take place here.
      The former owners may not have recorded the mortgage, but that does not negate the sale. The fact is they lied to the bank that they still had ownership of the property knowing full well they did not. It's like trying to take out a mortgage on your neighbor's home, that's illegal. But let's say the bank believed you and gave you money with their house as collateral.. and the bank tries to foreclose your neighbor's house instead of going after you/ your house/assets. That's.. not legal and the bank can start to get into legal trouble as well. Unfortunately, it IS easier to try to foreclose the home, especially since it sounds like the former owners are MIA and this poor lady is an immigrant and a PoC, the law is not on her side, even though laws have clearly been broken. I predict she will be able to get the bank off her back, and they will not get their money back because the fraudsters are long gone, they will have to write it off. Boo hoo :)

      @@preston74 No she was not a tenant and she is not paying rent, she is making payments for something she bought. She and the seller signed a real estate contract which clearly says she is buying the house from them and they agreed to finance it. The cops should go after those sellers for what is clearly fraud.

They created a illegitimate contract that was never officially recorded by the county, title company, etc. The owner never intended to give her the house after that final payment was sent. In reality, the woman was just paying rent.

    Never, ever buy a house from a seller who wants to carry the contract without going through a title company and getting everything in writing. This was Real Estate fraud and the Finance Company that gave the loan to the fraudsters is going to have to eat it. The fraudsters should be rotting in prison for doing this to this poor lady.

      Not certain that the finance company would have any culpability here; they likely weren't even informed by the fraudsters of the unrecorded/untitled transaction that existed with Mrs. Zaragoza.
      In a private sale such as this one, engage a real estate attorney to look things over.

      @@promotelove I agree except did the bank actually not know someone else was living there? When you take out a mortgage there is an appraisal. You sign documents saying you live there. Did they note this as an investment property? The mail typically goes to the property address in which the mortgage was taken, did she never get a statement? Why is that? Did the sellers use another address, did the bank not inquiry why if they noted it as their primary residence? If she has any shot in hell it’s going to come down to notice

    This woman owns that house. The banks should not be allowed to foreclose on it because the banks do not properly have interest in the house. The interest the banks have is with the original seller which is for mortgage fraud. This is 100% mortgage fraud by the seller of the house. This is a criminal matter which should not concern the current owner.

    This is just heart breaking! How does that couple sleep at night knowing what they have done. They should have to sell everything they own to pay for not only the second mortgage but to compensate this precious lady. I'm glad her boys have her back and making sure she will have a place to stay if things don't go the way they should. ❤️

    My brother lost his house while it was being built. He had his loan with Wells Fargo and they let the contractor take out all his money. Nothing was ever done to the employee that kept releasing the money. Poor lady in this story. I pray she gets to keep her home.

      I am sorry this happened to your brother and hope he reported to authorities and filed a civil suit. Wells Fargo and Bank of America are the shadiest when it comes to residential loans practices, credit insurance practices, and holding employees accountable.
      Edit: credit insurnace is taken out to protect the both entities. But when Clinton deregulated banking, the law changed allowing disability insurance payments to be applied to the interest instead of the principle. The home buyer would receive notification from the insurance company the claim was being paid monthly and the bank would notify receipt of the payment. The bank then waits until the period of disability is over OR until 6 months to 1 year goes by to notify the mortgage principle has not been paid and foreclosure proceeding have begun. All legal. The bank will not allow an equity loan or extend credit citing the mortgage debt defaulted on makes the home buyer a poor credit risk. Bank of America was the worst at this. You may remember all the foreclosures going on following 9/11? This completely legal banking practice was one major reason.

    There should be absolutely no reason the sellers of this home shouldn’t go to prison! Absolutely a felony to steal from this poor lady.
    BUYERS BEWARE OF OWNER CARRIED CONTRACTS, THEY SHOULD ALWAYS INCLUDE TITLE INSURANCE AND CLOSE WITH A TITLE OR ESCROW COMPANY SO THEY ARE RECORDED WITH THE COUNTY!
    Thank goodness this attorney stepped forward to assist her, praying for a positive resolve.

    She is absolutely screwed. It's not IF but WHEN she will be kicked out. ALWAYS use a title company or an attorney to close real estate.
    The seller should be criminally prosecuted for fraud, but the local DA likely has other priorities.

      Yup. She isn't recorded as the legal owner of the property. So, by law, it isn't hers. Imagine you have a title but there's a lienholder on that title. Your hands are tied legally on what you can do unless that lienholder is removed.

      We were forced into bankruptcy and a very quick move in a house we were renting when I was young after the owners of the house decided to suddenly stop making payments. It's really not fair because nothing came of the home owners.

    The scumbags that did this should be held criminally responsible. When you're dealing with that much money how can it not be illegal to do what they did! I don't know this woman or her family and I can honestly say I am mad as hell! I hate when people are taken advantage of and there's nothing worse than a criminal and that's what these people are. I don't understand how the district attorney's office has not been involved in this case.
    I hope this News Network update this story on what the outcome of this is. I could not imagine living day by day thinking I would have to leave my home.

    Fight, Fight for this lady who worked all of her life to afford a home legally, as to her understanding and sale agreement signed by all parties at the beginning of sale. While in the legal sector of foreclosures worked years past in So CA, this unfortunate situation was something that happened more often then not. May the DA office step in and work on behalf of this lady, so that she may keep her home; And, file criminal charges if any, that defrauded the Sale Agreement.

    Well, my mother-in-law did that to my husband and me. They verbally agreed when he was 19 years old to buy one of his mom's property and just make the payments to her. Twenty-five years later, when the house supposes to be paid off, we found out that she was taking loans after loans on our house. Crazy how we can't even trust our own family our own blood. From now on, we learn to have everything on paper with our lawyer's help. Back in the day, the house was 100,000 thousand dollars, and recently we still had to pay about 90,000 to put the house in our name...on top of that, she didn't want to do it. We put the house on our name, sold it, bought a new one, and to this day, she swears that we have our new big home because of her. My husband made the payments on the house from day one. All she did was use our house like her piggy bank and dare to go around saying that she got our new home. There are mean people out there, so yeah, always hire a lawyer to ensure people don't screw you over. We may be traumatized by this but look what happened to this poor lady.

      I've used by owner twice, both buying and selling with never any issues whatsoever. The mistake here was not having it recorded by the county. If you do it all correctly, there is no issue and Owner Carry is the best real estate transaction of all, saving thousands of dollars in bank and realtor fees.

    Stay away from seller financed homes as well as lease option to buy homes. These are avenues for scammers.

    I lived in NM for quite awhile. The Latino population is very pleasant and respectful. However, their non-confrontational personality can cause problems!! They truly are a lovely people!!

      I agree 100%. I retired here 9 years ago from Chicago, landlords get away with so much. Their attitude is what are you going to do about it? I do alot of maintenance and minor repairs on my own uncompensated

    I've been bamboozled like this, well no where near the extent that this poor woman was scammed but I've been in a situation where my ex and I were looking for a place to rent in a VERY small town off the highway in Indiana BC we both got placed at a job there. We weren't familiar with the area but we found a ad in the classifieds section of the local newspaper. We met the owner of the property and checked it out, he was wanting to rent it 2 us. So a few days later we gave him the security deposit & 1st month's rent & started moving in. The 2nd day we noticed an issue with the plumbing in the house. No running water, so we contacted him & he said he hadn't gotten the water turned back on yet since the place has been empty for a few years. So that we would have to wait no longer then a week that he would go to the water company & get it turned on. (Since utilities were supposed to be included in our rent payments). So a week goes by & we were sooooo READY for the water to get turned on since that meant we had to buy alot of gallons of water to use the toliet, do dishes or cook...ect.
    After a week we called him a few times with no answer, so my ex started texting him asking about the water & if we can just get it turned on in our names BC it's HARD to not have water for that long. Can't shower, flush the toliet ect. And he finally texts us back & says he paid the water bill & they're due to be there anytime to turn it on & that he wasn't sure why it took sooo long. A few more weeks go by & NOTHING no water no response from the landlord. It wasn't until a neighbor stopped us outside and asked if we were really living there. We said yes? He said how's the plumbing? We said we don't know and explained what was going on with the landlord. And that's when the neighbors told us that a few years ago there was a discrepancy about the water lines and whose property they were on and i guess there was flooding in the neighbors yards and that the owner of the house got sued and the neighbors ended up digging out the water lines & plumbing out of THEIR property bc they were tired of the flooding & that the plumbing shouldn't of been under their property. So, the owner who moved us in KNEW THIS OBVIOUSLY since the neighbors told us that our "landlord" used to live in the house until the plumbing was dug up & taken out. So basically he just stiffed us & knew there would be no plumbing BC it wasn't even possible unless he wanted to put in a whole new plumbing system... So Ig he just wanted a easy payday (our Security deposit, 1st month's rent, & by the time we were told the truth from our neighbors, we had paid 2nd months rent. ) and after all that time confronted the landlord (via text since we didn't know where he lived & he wouldn't answer the phone) & he said nothing. And he even had the audacity to text & ask for RENT for the 3rd month... thankfully a different landlord that lived in this very small town heard what had happend & what the dude did to us she, had a rental a few blocks away which was ALOT nicer then the place we were scammed into. She approached us, and offered to move us in and she didn't want any security deposit and gave us a deal on 1st month's rent. (Though we got scammed pretty bad, there's still some good people in the world like the lady that was kind to us BC she had heard from others in the town that the landlord had scammed us)

    What a nightmare! The original sellers should be held accountable! They fraudulently sold to her, knowing they were going to take out a new mortgage on the house. They are the ones who should be in default!! I truly wish Ms. Zaragosa all the best. It’s a further shame that the courts keep jerking this lady around, when they know she’s not responsible😡.

    Someone should set up a go fund me so she can pay off the vultures who bought the foreclosure in bulk, and the thieves who took a loan against the house after selling it should be in jail for life.
    But it's also a warning to never buy a rent to own or from a private seller unless you also go thru their bank and an attorney.

    I learned more Spanish in 1 year as an exchange student than this woman has learned English in 4 decades in the USA? Contracts in each country are written and enforced in the language of the land. Trying to think of a reason to pity her.

    This happened to my step father. He was paying on a land contract and sending in all his payments when they came knocking on his door. Turns out the owner was a drunk-wino and never made a single payment. They the owner and my stepfather did a short sale to a real estate company to try and recover some money. He ended up loosing the house.

    This is so sad! I hope the mortgage company and courts' work with this women. If there is anyone to blame it's the people who sold her the house.     Wells Fargo and those who are stealing families' homes will face God. This happened to me. Also, I never used my equity from the home. I lived in my home for 11 years and received less than what I should have.
    Although I forgave all those who stole my home, I know in my heart everyone had to pay for what they do. God, Bless, and may it all work out for you.

    This is fraud . The original sellers , should do jail time . This is happening to a friend of mine in NJ . The County is pressing " felony fraud " . Now the sellers want to " negotiate " . When he gets his home and accepts a settlement . The fraudsters will still have to deal with the courts . 😎

    This happened to me in Ca. I purchased a home ( first time home buyer) from a couple. We agreed on a price and I gave them $25,000 down with the balance due within 36 months by either obtaining a loan or cash. A month in And I knew I was dealing with fraudulent people. Only 4 months later, and I got financing and bought them out. In that short time, they took out a HELOC for 30,000.00. They broke into the property during a weekend I was away and barricaded the property with chain’s and dogs so I was unable to enter. I had no idea who these people were that took over my home and later found out it was the sellers family members. Of course I called the cops and the trespassers were producing false rental contracts etc. after hours and hours of my kids and I literally locked outside of our home and the cops finally sending a competent officer to review my notarized contract, my cashiers check (down payment), monthly payments directly to the mortgage company, text & emails, it was determined I was the rightful owner. They were forced to leave and once inside, I see the extensive damage they caused. When I bought them out for the balance I owed I also had to pay the additional 30,000 loan they took out because they refused to pay it and so now I had to qualify for a bigger loan But I was already in 25k hard cash (all my savings) so I couldn’t walk away. As of right now, I’m still hoping to sue them.

    If you want to help this woman, call the District Attorney (Prosecutor) in the county where happened and demand that the prosecute the "seller" of this home for financial fraud against an elder. (Assuming NM has an enhancement statute for fraud against an elder person.

      Arguably, this seller also committed mortgage fraud against the lender by not disclosing the sales agreement and significant funds received from the buyer, which was a liability on the seller's financial statement and a potential future lien against the property.

    Sellers committed fraud by taking out a mortgage on a home they already sold to someone else. They should not take the home of a 3rd party who owns the home by all intents and purposes.

      I agree that she should keep the home but because the sale wasn’t done through a lawyer or real estate agent, and the sale was never recorded, legally she does not own the home. It’s like buying a car and never registering it, never transferring the title, having it towed because the seller lied and said it was paid off and then getting mad at the financing company for repossessing the car. Unfortunately this woman didn’t seek any sort of professional guidance when making the purchase and she will have to take the sellers to court to try to recoup the money she’s paid for the home. I’m hoping that the sellers have other property that can be liquidated so this woman can get her money back. I do feel very bad for her and if I had any money to share I’d love to help her.

    The notary who signed off on the transfer. is also legally responsible for not filing the notary.or the missing documents.

      This may be true for some states, but where I live, a notary just notarizes the signatures, they aren't responsible for filing anything. Are you a attorney, or just an internet lawyer?
