      artists??? ARTISTS WHERE??? These are commodifiers not artists. If you made your music to be sold...you are not an artist you are a commodifier. Commodifiers specifically in the hip hop community your are taking pieces of black American culture, putting it in dime bags, linking with a bank in the form of a record company...to sell those dimebags...so long as the commodifier is being paid, they could care less about how their toxified pieces of culture affect those purchasing it.
      I could care less about this cry baby. I could care less about his money. I could care less about his contract.
      Please stop calling people who make music based commodities and entertainment commodities and calling them "artists".
      They are not artists...He, the guy being discussed, is not an artist...he does not create art.

      He is a guppy. This “ content creator “ tried to accuse someone else of being a clout chaser when his whole channel is doing what everybody else is doing. Just mediocre reviews talking tripe about other people. Make it make sense.

    He didn’t read the contract, sheesh, the term says that contract will continue for a period of 3 years from the effective date he signed, plus he don’t mention none of the terms for section 1 as you mentioned plus no clause of action of agreement for section 1 if breach other than the one time flat fee & use of content. He shouldn’t have signed that contract because they rightfully own that video for 2 more years & use it how they desire on their platform because he signed the contract & gave them the approval. He shouldn’t have signed because there’s not enough information in the contract, there’s no disclosure of how much he will be paid & he didn’t even disclose if he got paid yet, he probably didn’t even get paid yet & didn’t discuss a allocated salary of payouts or payment. He can sue for not paying them royalties but it be a difficult battle because he agreed to a undercover 360 (ancillary contract) with no royalties nor flat fee based on the information we was given so far 😅
    The good thing is he still owns his masters & copyrights for the video in section 1. Best thing he can do is accept the L & somewhat of a W for free advertising his status/business.
    However, they didn’t do a proper evaluation of breaching their contract with summin summin summin terms of agreement. The most he will get is 100 dollars mentioned in the contract + all the flat fee payments mentioned was paid in the beginning of the contract till the present day he mentioned this in this video. They legit said it in the contract, neither party’s total cumulative liability arising from or related to this agreement, whether in contract or tort or otherwise, will exceed the greater of $100 and the amounts paid by output to licensor which is (summin summin summin) under this agreement. The limitation of liability set forth in this section will not apply to any indemnification obligations! (With this being said they’re saying hey dude we will not be obligated to any liabilities set forth by “summin summin summin” because this section clearly states this section does not apply to any indemnification obligations from output that you’re seeking. So basically they saying you can try your best to sue us dude but the most likely the case will get dropped or you’ll get either just $100 mention in the contract or $100 + the $300 mentioned in email with Kevin lau which was probably a upfront fee 😬, so max he will receive is $100-$400.
    Rule 1, read the contract
    Rule 2, analyze wording to see if they’re trying to play you from your master’s & royalties or any other attachments that come with your business, plus term’s & conditions required from both parties with exit clause mentioned.
    Rule 3, payout structure & duration of contract of what is being exchanged from both parties.
    Long story short if you made it this far, “Summin Summin Summin” signed a undercover ancillary 360 deal for 3 years, only thing that’s a W for him is he gets to keep his masters & copyrights while getting a little buzz from Output & he got about $100-$400 bucks & if he does decide to sue & wins the case he got about $200-$800 overall & still had to pay lawyers & attorneys, so in my opinion it’s not worth suing Output, just let them do what they desire for 2 more years & you free Mr.Summin Summin Summin.

    Wow that limitation of liability clause is a joke to me. Is it like a license to breach the contract with $100 ticket at most? . I might be old school but I signed dozens of contracts with publishing companies, artists and labels in the past and never saw that thing. Is it something new?

    Hey great video! What this all boils down to is that an attorney should’ve been involved on his end from the go. It is super unfortunate that he is going through this but to be honest This was a business deal. It is super important that as creators with a creative business we should keep an attorney on retainer to represent our creative business so that things like this don’t happen. The lesson here is to keep an attorney on hand and have them involved in the deals you do. You could even raise your fee as a creative for your services to make sure that your attorney fees are built into your price. Yes it raises your price but at the same time we have to remember that this is business. Output has an attorney on retainer at all times so why shouldn’t we as creatives do the same thing. After all this is business. Be blessed.

    Honestly, I wouldn't want to do business with someone who seems this angry when something goes sideways. He comes off like a hot head, and this is him holding back, I would bet. Be a man, handle your business calmly and in private. Showing this side of yourself in public makes you look weak and unlikeable. Just my opinion. If he's been wronged, there should be justice obviously, but don't be surprised when the phone stops ringing.

    28:31 IF it’s from something else. It sounded like he’s mad they are STILL using something he already made under the agreement in a “new” post. They need to define their terms: is a repost with new language like “check this out!” [then the repost of an existing video under the contract] - is that a “new post”? Because it can be argued either way.
    But yeah, if it’s not a vid he made and previously supplied to them under that contract, then OF COURSE it’s copyright infringement, possibly on a few levels, right? You have a copyright interest in the video itself, the underlying music, the theme music, the outro music, etc.

    8:29 eh….be careful here. Content NOT made under a contract may need permission. But that may not indicate that content made as PER the contract does. It really depends on the language of the agreement.

    I wonder if “make no new posts” is interpreted by Output to mean not to use his music elsewhere after the fact, but they still will treat the video itself as theirs to use surviving the term length. So it’s still the post he made (meaning the video) and thus counts as a REPOST not a NEW post, if you get my meaning?
    Also, the whole typo in re section nine (which doesn’t exist) tells me their legal is hella mid. We all cut and paste, but you HAVE to be sure not to convolute K language in the process. There was likely a section nine in the contract they copied FROM.
    I wonder if the implied work for hire in the survival language was copy/pasted from some other agreement where it DID make sense, because the whole at-will language runs counter to the right to cure language. If it’s at-will, it means you can cancel at any time with the given 30 day notice. But to then say he has 30 days to cure any breach - WHAT breach? It said any party can terminate for any reason with 30 days notice. So the other party can pull a reverse uno card and CURE??!? Tf??!?

    20:07 again: is schedule one just INDICATING the type of content or the entirety of the content? Because if you look at the term length, why would they have a term length in re performance if you (a) are talking about a single piece of existing content, that (b) they explicitly say that can use beyond the length therein, right? So I think another problem outside of not referencing the exhibit is that schedule one is vague and ambiguous af, and thus is void.

    I have watched Dude’s videos and enjoyed them. I really feel sad that I have to watch him upset whilst explaining how he has been wronged because that’s not what I watch him for. I am no expert but I just wanna say to him, “please do not let a potentially stressful situation get to you”.
    Keep putting out positive and educational contents, please.
    In my opinion, whilst respecting yours, I’ll keep any legal situation out of view of the public till I get a result and use it to educate others. Peace.

    I worked with a company years ago, it was supposed to only be for a year. Years later, I put my music on UA-cam and that same company was flagging my music saying they owned it LMAO. In the dispute I mentioned that they weren't supposed to still have the music and then they sent me and email to null the contract when it was supposed to be done a year after we signed. I don't do collabs with these companies anymore.

      This is kind of an ignorant thing to say because most artists have not been educated on nothing you just said, because they are music artists, right brain people, and this is all left brain stuff. That is why artists hire managers who usually end up robbing them as well.

      @@Byronic19134 I appreciate your sentiment; however, I would not belittle the max of the level of intelligence in any individual. Before there was the option of "getting signed with a major label", artists are known for creating their work (images, sounds, clothes lines , etc) while also managing the business side.
      There was a time that the excuse that no one wanted to do the paperwork may have flown. I do not agree with you because there are way too many entrepreneurs who run their enterprise and also handle promoting/marketing and accounting. Others also partner with people who may have the same interests and that coexistence allows for teacher/student dynamics.
      I applaud you for your thoughts. I have been an artist and writer for a long time. I also have an Associate's degree in business administration.
      According to your logic, a left handed person is excellent at sketching skyscrapers and accompanying the picture with a haiku while a right handed individual can only solve calculus. The hemispheres of the brain actually have no specified seat for logic, creativity, and practical management for finances.
      People choose to focus and learn according to their own tastes. Chefs run restaurants. Bricklayers, tile setters, and painters are also contractors.

    I have a question, so in 2013 I created a song called not the same and let a collaborator from Miami do a remix. A guy by the name of Memphis Bleek would end up hearing this song and a studio and liked the song so much that he put his own versus over my friends Remix. This part of the story takes place in 2015. That same year a producer by the name of ballistic beats gets in touch with me because we needed to do splits for the song. I remember just asking for about 300 -$500 and I didn’t care about, the royalty splits. He insisted on buying me a plane ticket to Miami so that we could discuss things and speak to his lawyer. While I was out there, the living conditions were not what I expected, I was sleeping in a three room storage warehouse that was converted into a studio. Had to shower at Planet Fitness and dry clean my clothes every few days. By the time we spoke to the lawyer, that’s when I found out that ballistic didn’t even have enough money to properly push the record that Memphis Bleek did. Ballistic was in charge of the song was going to be released and promoted, I believe the figure was around $30,000 just to get the song and rotation for radio. I remember not signing anything because ballistic wanted me to sign to his record label and after multiple discussions reiterated that I didn’t want to sign because it didn’t offer me anything. There was no advance. No royalty splits. Nothing that could’ve helped me as an artist or producer besides having my name legally bound to a contract. After I returned home, ballistic said he would fly me out to Miami again in a couple of weeks after he took a trip to Atlanta where he was at the home of Akon and I believe Serena Williams at some point. After losing contact with him and at this point, this was during July 2015, I became extremely depressed about this situation and ended up shooting myself which resulted in me going completely blind. Also, during the month of May ballistic and Memphis Bleek released this record and tried a small blog campaign to get it going, there’s still numerous posts on Twitter about it and even a complex magazine, web article where Memphis Bleek sits down and talks about. I wasn’t even credited as a producer During this point and it took me arguing with ballistic about having my name properly represented for him to update the cover art, at least the version that’s on UA-cam to have my name even though he also takes production credit. My voice tag was also removed from the final product. The thing about my situation is that because I went completely blind. I lost the phone that I was using during this time. And my phone number expired because I had a pay as you go plan. I couldn’t maintain these things because I was blind. I lost access to my email and pretty much all I have left is a video of me showing that I sent an email to my friend in 2013. This video clip also shows me playing the a cappella audio of the original not the same song. I have screenshots of Memphis Bleek telling me to attempt to go shoot myself again and him jokingly admitting that he did steal my music. This is from 2023. Ballistic beats blocks my social media accounts when I try to contact him about this. People know what happened to me was wrong, but during the time. After I went blind, I didn’t have the money resources or information to pursue a lawyer and being in Kansas it’s actually very difficult to find an entertainment lawyer. I know these events took place in 2015 and it’s almost been 10 years but both of these gentlemen have in someway shape or form acknowledged that something happened and that there was wrongdoing and even potentially admitted to it so is there anything I can do in modern day? I lost my eyesight and had to rebuild myself from the ground. I lost thousands if not millions of dollars. I used to be a UA-cam partner and get paid for my video views, I used to make money as a producer, and I was also an artist. If you manage to read all of this and give a response, thank you in advance.

      1. That's a helluva story, brother! I hope you're doing well/better.
      2. Memphis Bleek has been cold as ice for over 2 decades. That song has PROBABLY made all the money it's ever gonna make. Is 25%-50% of that song worth.. anything? Surely it's not worth enough to hire a lawyer... is it?
      3. The song is sitting at 360k on Spotify (about $1200) and about 18k on UA-cam. Unless it's been licensed (for sync), somewhere, this song hasn't made any money to speak of.
      4. Having absolutely ZERO legal knowledge, it seems +to me+ ... that you can check to see if it's been licensed somewhere but otherwise, your best case scenario is for it to be licensed at some point +in the future+ (which seems unlikely) and THEN to lawyer up... once there's enough money to claim a slice of.
      BUT... I have ZERO legal knowledge and I'm not the person you asked for advice so... feel absolutely free to ignore me, brethren. Best of luck.
