  • Commemorate the 150th Anniversary of the 14th Amendment’s ratification with three daytime panels featuring noted scholars.
    This event is presented in partnership with the Thurgood Marshall Institute at the NAACP Legal Defense and Education Fund.
    1:00-2:00 p.m.: The Story of the 14th Amendment and America’s Second Founding
    Leading legal scholars and historians, including Allen Guelzo, Martha Jones, and Kurt Lash, discuss the story of Reconstruction, with a particular focus on the intellectual origins, drafting, ratification, and original understanding of the 14th Amendment; the “forgotten Founders” who fought for its ratification and sought to make its promise a reality; and why this key period can be thought of as America’s “Second Founding.” Sherrilyn Ifill, President and Director-Counsel of the NAACP Legal Defense and Educational Fund, Inc., moderates.

    What we need is for the Federal Government play a role in stopping the infringements on our rights by corporations. If we did, there could be an end to homelessness, unemployment, untreated illness, polluted land ND air and water, and higher education being sold to the highest bidders.

      @@adamburns2452 Possibly. Some people want to live in a pumpkin, possibly. Would society have to accept people living in random locations other than shelters and buildings if there were enough of them available. NO.
      It is very hard on the environment to have people living in certain environments which do not have adequate sanitation, have vulnerable flora and fauna and/or where it poses a threat to others such as taking up sidewalk space.
      Having people camping out in unapproved camping is correctly prohibitted.

    My uncle Ruben Jasper Dailey (24 January 1910, Asheville - 8 January 1981, Asheville was the first African American attorney to practice in Buncombe County, North Carolina, which includes Asheville. Dailey worked to press the issue of school integration not only in Buncombe County, but also across Western North Carolina in order to level the educational playing field and ensure that the mandate of Brown v. Board of Education was observed. He handled a multitude of county cases; "[i]n county after county, attorney Ruben J. Dailey confronted school boards who were trying to find ways to ignore the law and to overlook students with black skin." In addition to being Buncombe County's first black lawyer, in 1969, Ruben Dailey became the first black Asheville City Council member. He was reelected in 1971 and at some time subsequent to that reelection, he retired from politics due to health issues.

      @@larryc5688 and @NickiDee-tm1qs As a guy who saw 1969 and 1971 and thought "only yesterday", I'm guessing Nicki Dee's uncle would say, "It shows we all still have work to do." Today's temporary insanity comes from a generation that never got decent history or civic education in schools (or, sadly, from their own families). Still, it's useful to bring attention to newer generations of the ongoing obligation of all of us to keep on working to build a multi-cultural democratic America that works for everyone. I'm an 80 year old Anglo from a 'blended family' (Daddy's side Southern, Mother's side Yankees [no, actually Quakers; it makes a difference!]). I live in and love a diverse lower income suburb of Los Angeles that is about 8 percent white and feels (to me) wonderfully normal. People without an international perspective often fail to realize how unique our 250 year old national experiment is among the world's nations. I think it's the best. I like to remember Winston Churchill's comment about America (about entering the Second World War), "The Americans will always do the right thing … after they have exhausted all the alternatives."

    Seems like the Constitution Center should emphasize that the Constitution's purpose is to define powers and purpose of the U.S. Government. Citizens of the U.S. have all rights that don't interfere with that purpose. The Bill of Rights is a highlight and clarification of some of those rights that were thought to surely be in jeopardy from growth of government; a sort of impediment to government overreach.

      People do not understand that the constitution does not have anything to do with PRIVATE Citizens of the Republic. The constitution forms government and restrains government much like a Trust does with Trustees. it does not confer RIGHTS because RIGHTS existed BEFORE the advent of the constitution. You do not have constitutional rights, You have constitutionally PROTECTED RIGHTS.

      Actually, no. The U.S constitution's purpose is to limit what our government can do. To restrict government, if you will. Note the wording of the Bill of rights. "Shall not be infringed" "Congress shall make no law" "No soldier shall" "Shall not be violated" etc. Unlike other constitutions which spell out the rights of the people, ours deals more with STOPPING the government from infringing on our already inalienable rights.

      @@EBR1 Have you read the U.S. Constitution? Seriously, it only takes about 20 minutes. Its original purpose was to establish a form of government and define the role of each branch of government. The Bill of Rights was added 2 years later and it created limits on the government's power over private citizens. "Inalienable rights" was a phrase from the Dec. of Ind. which was written 23 years before the Bill of Rights. It is not mentioned in the Constitution or the Bill of Rights - if it was it would have needed to be defined - what is an inalienable right? Infringing means violating or negating, not impinging, which it is frequently confused with.

    When will these intellectual elites stop talking about the racism of the past and concentrate on preaching individual accountability and social responsibility?     James Wilson, a distant relative, realized that slaves were being counted representation in congress. I would have said that any voting age person to include women. He made the Three-Fifths Compromise. This might have accelerated voting right.

      I mean when you read section 3 of the single page amendment it bans people who who "civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof." but that's not banning lawyers, it's mostly banning people from the CSA from holding office

    No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

    Most challenges to the 14th amendment are brought by corporations and not individual citizens. Since the government treats corporations as individual persons (that is to say that they can own property, sue others, enter into contracts, etc,, ) they have rights that need to protected. Of course the amendment was originally designed to guarantee the rights of former slaves...and we know how that turned out. In fact, amendment 13, 14 and 15 were crafted with the intention of doing one thing: protecting the rights of newly emancipated Americans, but somehow each amendment failed to do that for many people. Amendment 13 for example didn't eliminate slavery but merely redefined the parameters of who could be held as a slave and who couldn't be. This opened the door for convict leasing of mostly African Americans. The 15th amendment granted the right to vote to African Americans who did vote for a very short time in the 19th century until they were effectively shut out of the their right to vote and still in many ways are disenfranchised in this regard.

      Hint: VOLUME 8 FOREIGN AFFAIRS MANUAL (8 FAM) SECTION 505.2 ENDORSEMENTS (scroll down to #8 and #9)

      08 (ALL) THE BEARER IS ALSO KNOWN AS (K-A GIVEN NAMES) (K-A SURNAME).
      Bearer uses an assumed name in addition to their legal name.
      09 (ALL) "THE BEARER IS A UNITED STATES NATIONAL AND NOT A UNITED STATES CITIZEN."
      Placed in a passport book issued to a U.S. national who is not a citizen. “U.S. National” will be printed instead of “USA” on the front of the passport card.
      Prior to the creation of this endorsement in 1992, the bearer's status as a non-citizen U.S. national was indicated by circling the word "National" or crossing out the word "Citizen" in the Secretary's message on the signature page of the U.S. passport.

      At the time this decision was being drafted, what constituted the term "any citizen" is ambiguous, many people, challenged who is a citizen. The 3/5 persons were jailed because they did not work or own property, thus any citizen has a narrow meaning to the Federal government, US Supreme courts, and state courts laws, the idea of who is a citizen, and enforcing this new ideal is still being debated in the states.

    Not sure I'm a fan of the idea of originalism vs traditionalism, cause I'm just not a fan of the idea that we need a verses. My approach is very simple. Scientifically speaking, we are all the same species... men, women, black, white etc, and no law can be in harmony with reality that doesn't respect reality, so our law should reflect reality, which is that there is no fundamental difference.

      I'm not arguing against your constitutional point except that there are fundamental differences namely in digestion of food and alcohol, leading to vastly different personality motivations and aggressive behaviors in all the races. Asians experience worse metabolic health outcomes than everyone.
      Blacks, have digestion that operates in putrification whereas whites operate in fermentation. Specialized digestion cells are controlled by a system of endocrine cells and neurons. Aka: the brain. Furthermore, gut biomes are varying greatly depending on location of study. This explains why certain diseases like stomach cancer are more common in specific populations (i.e.: EA's)
      I couldn't find the resource, but I expect the great popularity of Kimchi and other fermented foods by Asians suggest they are seeking digestion aids their whole lives.     The 14th Amendment was entirely ignored during COVID.
    A Governor issuing an order which designates any person as nonessential and says that person may not use public transit is absolutely, 100% a blatant violation of the 14th Amendment.
    Every Governor who did such a thing (e.g. literally every Governor in the nation) as well as all other State actors who enforced such a thing (from State police to State Judges to State legislators) should be put in prison for violating the 14th Amendment. They should receive one felony for each person affected. That means Governor Polis of Colorado is eligible for 5.8 million felonies, and thereby is eligible to serve the remainder of his life in Federal prison, without any potential of parole.

And the naturalization act of 1790 limited many people from naturalization including white people that were not of good character, there were reasons for this, in order to understand one must go back to Scotland and Ireland and at least 700 years of history, they had been massacred by kings pretty much every where they went. They were eventually sold into slavery by the British into the colonies, they sold what the British called undesirable and riff raff, people under religions and political persecution, street children, one of the main reasons is they always believed we are in endowed with certain unalienable rights from our creator and not from a king or any man, this never went over well with kings. So as much as people would like to blame every single white person, those white people died for blacks and blacks died for whites, as many blacks and whites fought side by side in the revolution and ran off as slaves together before the revolution. Government violates peoples rights it was not the people in the revolution doing that, they also violated women's right to vote, women always had the right to vote, people will say government gave women the right to vote, since when does the government give us rights in the country, again we are endowed with unalienable rights from our creator. Government derives their just power from the consent of the governed, women and blacks were also the governed, they were violating their rights, as they still violate our rights today. Something we will always be fighting for. A person that recognizes we are endowed with unalienable rights from our creator could not possibly believe in owning another person as those that fought in the revolution did not want to be owned, one of the reasons they went against the British.

      Understand what you see on UA-cam is a microscpopic slice of what occurs each day in America. With a population of 333,000,000 there are likely, at least a billion and a half, person on person interactions, some of which include police. Justice Department statistics show at least 62 million law enforcement contacts per day. That data does not include those person 16 years and younger.....see where I am going with this?

    Very easy simple concept basic logic if life is not free why the hell would death be any cheaper it's not. So the question one may wonder is the spiritual cost to one's own soul and spirit for having lived and died only using the smallest percentage of A fraction of the true potential they were first born with equally as reckless neglectful at the same time to the lowest standards of quality for so many years now global pollution has diminished the quality of life to the point where today's people are living, dying and yielding the worst spiritual kickback that has ever been manifested since the beginning of life only getting worse. The polar opposite extreme to that is today's people should be living and dying to the highest standards of quality which would make each and every moment physically, mentally, financially and spiritually beneficial rewarding constantly consistently S.R.F.

    14th amendment was written to give DC it's own citizens after the civil war, meaning, freed slaves now belong to the federal government citizens of DC to be exact. 14th does not apply to state citizens. Bill of rights does not apply to US citizens. State citizens were given the option to join us citizens on form SS5 line 5. When you get your SSN, you can chose state citizen or us citizen. Us citizenship means you lose the bill of rights. You now pay income tax to IRS, you become a resident of your state. You lose state citizenship. You lose all your rights. 14th amendment created privileges not rights

      Firstly, the tribal peoples, or Indians lived (& most still do) under their own form of government. If they choose to live away from tribal lands they are subject to US laws. There are no “native Americans”, their ancestors migrated across the Bering Strait from what is now called Siberia

      The 14th Amendment did not associate any other peoples as citizens, the question was about the 3/5 persons claiming rights in the newly conceded colonies. Andrew Jackson decided that natives were to move to reservations or die using the trails of tears idea, for the homestead act to be enforced after the Louisana Purchase from Napolean. The immigrant Europeans decided this land was theirs for the taking, so the natives who lived here for thousands of years would not be included in a 14th Amendment discussion based on expansion at that time.

I find it hard to believe that there were no people in North and South America until the unproven so-called migration along the Bering Strait. Native Americans from Alaska to Chile have no history of this migration. They say they were ALWAYS there.

      Under the constitution US citizens aren’t property but the owners of the government, the term public servants refer to elected officials who are supposed to serve the public, unlike the slaves to communist and socialist governments or subjects of monarchies
