OK lemme just say... small business is complicated. I wad full owner and ceo of my "brand" but the location and money generated out of that location was mostly owned by by investors. They had no rights to my name or the brand name. I managed all aspects of the business and operations but out of that location I only had 25%. When we split ways I maintained full rights to my products and brand name. Its a complicated process, her saying she's ceo and owner isn't necessarily a lie. It's just hard to understand if you haven't done it all yourself in the past.

It costs about $350 to get a trade mark application (no you don't need a lawyer to do this) for one category in the USA. An international TM in a bunch of categories would prob be $1000. If you are running a business, run a business.
Trademarking probably wouldn't have changed the outcome. All it does is give you the right (or at least make it easier) to sue. The owner could have trademarked after finding out someone was about to take her name, but she'd then have to sue Jacklyn to stop her from using the name. That would have cost her a lot of time, effort, and money that she didn't want to have to spend. If you know that a trademark owner isn't going to sue, there are basically no consequences to using that trademark yourself.

I'm a creative director, and at my last company we had a competitor using a name and logo very similar to ours, clearly not just copied but intended to scam people into thinking they were us. We sicced the lawyers on them and apparently, no dice. They were still around a few years later, same name and logo. I don't get how it's possible - and we were the ones with the money in that case.
The issue is that the people who watch these kinds of vids aren’t the same people who are buying her stuff. No if someone takes the name and you can prove that you filed first in the same category (and a bunch of other things - such as having a website etc) it makes it easier to fight. It does not mean nothing.

I'm a creative director, and at my last company we had a competitor using a name and logo very similar to ours, clearly not just copied but intended to scam people into thinking they were us. We sicced the lawyers on them and apparently, no dice. They were still around a few years later, same name and logo. I don't get how it's possible - and we were the ones with the money in that case.

The issue is that the people who watch these kinds of vids aren’t the same people who are buying her stuff. Sure they may be pushing her somewhat in the algorithms by commenting negatively on her posts but if they didn’t then her actual fan base wouldn’t ever learn of the things she has done so it’s kind of a lose-lose for us.

Influencers still buy her next product launch. They try it and discuss it on their channel. Viewers then try these said products. Wash, rinse, & repeat.
