ICJ rules against halting German arms exports to Israel

- The World Court has ruled against issuing emergency measures over German arms sales to Israel.
“The circumstances are not such as to require the exercise of its power under Article 41 of the statute to indicate provisional measures,” presiding Judge Nawaf Salam said.
The International Court of Justice (ICJ) in The Hague made its ruling on Nicaragua’s request that emergency measures be imposed on Germany over its support for Israel’s war on Gaza.
Nicaragua argued during two days of hearings earlier this month that Germany violated the 1948 Genocide Convention and international law by supplying Israel with arms, accusing Berlin of being well aware there was a risk of genocide.
Germany denied the accusations, and its lawyer argued that Nicaragua’s case was rushed, based on flimsy evidence and should be thrown out for lack of jurisdiction.
Germany is one of Israel’s biggest military suppliers, sending it $353.7m in equipment and weapons in 2023.
Moataz El Fegiery, head of the human rights programme at Doha Institute for Graduate Studies, says the International Court of Justice (ICJ) reminded the international community of its obligation under the Geneva Convention.
“It’s not the end of the story. There is a legal battle that will continue and many other issues that the court will deal with, with regards to jurisdiction to examine the case or the merit,” El Fegiery told Al Jazeera.
“There is also South Africa versus Israel, and actually Nicaragua intervened in this case as well … of course we hoped that today there would be some measures because this would be an important legal message to many other countries that are right now supporting Israel with weapons and arms.
“But I think even if the court today dismissed the measures, there is also some kind of political message in the whole process.”

But since you WANT it so desperately, you shame and blame even the ICJ ... in the end, you only accept rulings that are in your favor - there we have it.
This is the most backwards logic. You cannot rule in one instance that Israel is plausibly committing a genocide, so much so that you issue provisional measures that tell Israel to stop committing a genocide and protect all life, then simultaneously say that you have no standing to prohibit another country from sending arms to the country plausibly committing a genocide which they could then use in the commission of said genocide. This makes absolutely no sense.

@seb3209 you make no sense. If the court hadn't found that Israel were plausibly committing a genocide, it wouldn't have issued provisional measures...it wouldn't have later reinforced those measures a month later when Israel had increased its attacks on Palestinians after the initial ruling.

Nicaragua might not have legal standing, but Germany has no moral standing in the world as evidenced by the Ministry's response.
The ICJ should have already pronounced a guilty verdict against Itsracial and then proceeded to do the same to Germany. Instead the ICJ decided to be complicit with genocide.

If the ICJ had ruled on South Africa’s charges by now, and they defined as a plausible genocide, then the case probably would have more teeth. I don’t think the judges had much to work with, and the case isn’t over. Nicaragua can call it back again if more arms find their way from Germany to Israel. It’s still a big deal.

Shameful ruling
International law just repeatedly devaluing the Genocide Convention where it clearly states:
Article I
The Contracting Parties confirm that genocide, whether committed in time of peace or in
time of war, is a crime under international law which they undertake to *prevent* and to
punish.
Article VIII
Any Contracting Party may call upon the competent organs of the United Nations to take
such action under the Charter of the United Nations as they consider appropriate for the
*prevention* and suppression of acts of genocide or any of the other acts enumerated in
article III.
Given that the ICJ has already issued provisional measures stating that it is *plausible that Israel is committing genocide* there is no reason that the duty to prevent should not fall under the ICJ's purview as well. This decision reeks of US compulsion.

I am baffled, too! The genocide convention is very clear on this. In the spirit of prevention, they should have called for a cease of arms sales. Now all the other countries providing for Israhell will think they can go on providing bombs.

Effectively the ICJ have said that this decision could change should Israel be found to be committing genocide when that case is heard. Meaning that Germany and other nations have to change their actions or they could still be found to be in violation of the Genocide Convention.

ICJ fails to provide provision measures against Israel when most needed and to expect them providing anything against Germany it's completely unacceptable.

@aljazeera: there is already a local case ongoing and a provisional ruling has been issued that warns the German government to further issue weapon export and orders for every export licence to be previewed by the court, which has slowed down the weapons export campaign considerably.
