Hear ya, but if a cop says you are known to have drugs and run from the police. And you, in fact, prove these statements correct; then I bet you’ve been found guilty of a felony at some point in your life. You don’t earn that reputation accidentally. Are they allowed to just go on your property like that and check ya for drugs? Jesus! All the Deputy did was see him... From what I can tell that was dude's crime. Being seen. Why he had to pull out his gun on a guy known to use drugs is beyond me.
To be fair though I hadn't interacted with dude before, the Deputy did, so maybe he knows something I don't. .. Just seemed excessive to take away someone's freedom and rights for walking in their own neighborhood....
Its the same as if you're randomly on the street, and when you see a cop you randomly start running or trying to hide. Sure running and hiding is not illegal without context, but if you do it after spotting a cop, cop is allowed to pursue you because thats suspicious activity, you lock eyes with the cop then start ducking away.
Even if the guy ran away I doubt they had enough reasonable suspicion to detain him. If the homeowner simple said get off my property then they couldnt use the K9 on his property. He also couldve just walked in the house then they wouldve needed a warrant to go in and to be on the property. They couldve just left while he was detained and finished the investigation on public property. All he said was, “I seen a guy standing there that’s known to have drugs on him”... that’s not probable cause to stop and detain him just because of past interactions.. I’m HOPING there’s more to the story than only what he said.
Jacob Smith the guy running away makes it suspicious behavior. Known addict, plus quickly dippin away after seein cops, equals guilty behavior.
When I was a user back in the day, and I had friends with me that used as well, as soon as a cop was seen, they’d yell “dip! 5-0!!!” And I’d say NO. We are gonna sit here calmly. Don’t you dare move frantically either.... and in my 15 years in that terrible lifestyle, my record is clean. I only have a few parking tickets (not drug related of course).
My cousin is a cop. Running at the site of cops means you’re guilty of something illegal, and gives them suspicion which is in fact probable cause
@@almadeluz501 Thank You for clearing that up for him.
More than likely that guy is subject to search at any time. Probably a court stipulation agreed to by the defendant.
@@almadeluz501 Are you delusional? "Suspicious equals probable cause" Is being suspicious a misdemeanor or a felony? Being suspicious absolutely does not give them probable cause. This clip shows cops just straight up trampling over this guy's rights. When the cop saw this guy he decided he was going to search regardless if he found anything or not, that's not cool at all. If he just fights this I bet he would win. No way are all 12 jurors going to convict a man of drugs that where found on the ground of what appears to be a trailer park. If it even made it that far because the cop definitely violated this guy's rights. Cops are supposed to treat everyone equally and this cop did not.
@@steven71288 I really agree with most of your reply except, if he happens to be on probation, which I would guess he is, and the officer knows he is on probation, then that alone makes him or anybody else on probation subject to being stopped by the police and randomly searched at any given time. I know it sucks that it's like that but if someone is on parole or probation then they have pretty much lost all rights that someone who is not on paper has.

This whole situation is crazy. He shouldn't have gone to jail! The cops just can't roll up on a guy and say "well this guy is known to have drugs." The officer here had no reason to stop, he needs to see a crime being committed, or be out there for a specific call. There was no justifiable cause to cuff and arrest the man.

mike long Sigh, wrong. Illinois vs. Wardlow The police had reasonable suspicion to justify the stop because nervous, evasive behavior, like fleeing a high crime area upon noticing police officers, is a pertinent factor in determining reasonable suspicion to justify a stop. When that guy saw the cop and ducked behind the building, the cop now had probable cause to search and detain him.
