From Todd Kelly's interview with Rafe Foreman here in Texas, I learned a fascinating strategy: use pieces of paper (or Word for remote depositions) to jot down a question and have the deponent admit to the question, circle their YES, and then tender that to reporter as an exhibit. It is a powerful visual chart of key issues that matter to you, and can be used as a nasty impeachment tool at trial.@@AlderTalk

For a lot of depos. Especially to mix things up. I’ve done them standing the whole time. Walking around.
