I must thank Justice V. Ramasubramanian who suggested to me to hear Justice Nariman on various issues by logging on to this Channel. A remarkable comparative analysis of the two Constitutions. Thank you Your Honour.
Seeing Justice Nariman, and listening to his wisdom.. I duly believe that the Collegium of the SC is doing an extraordinary work.. and should continue to do so.
An advice to LM who got degree to polish master shoes blindly liking too but there is small cell in brain to get advice thought in interest of country citizens benifit not benefit of his zar
Wonderful!!! 🙏🎉All MPs should listen to this lecture before taking seat in the Parliament. Only constitutional literacy can enhance the position of the Parliament and maintain the Sanctity of the August House. There is no place for rabbles. 🙏
Today after seeing justice nariman again on the podium and getting a chance to listen to him again i must say as a student in my teens ,i firmly believe the collegium system is choosing the apt and best talent. Ur profound memory and mesmerising fluency can make anyone ur admirer lordship
The speech was marvelous and we have to appreciate his thoughts on appointment and collegium recommendation. What was missed in this spectacular speech in my humble opinion was how to ensure that the judiciary is checked and balanced from its biases, as we have our Supreme Court to check the executive. I request Justice Nariman to address this aspect in his upcoming speeches.
Brilliant speech by rare genius Justice Nariman. Given the low viewership of this lecture is testimony of how poor our education system is that not even 1 lakh people are listening Justice Nariman. It is also reminder that democracy should not be reduced to tyranny of numbers and majority! Mob more often than not hangs its own wise Socrates.
but dont worry its same in all western world, thats why socrates are there like few of us. but dnt worry whole upsc training makes them understand rule of law and basic human rights vide magna carta
Thanks for uploading. Please do keep uploading all lectures of Justice Nariman. I am sure he will give many in the years to come in his Post retirement avatar. Listening to him is always a pleasure. He brings everything out with so much clarity.
Ua one of the most scholarly, wise, articulative, fiercely independent justices we ever had sir, Indians miss ua presence in SC but v are glad tht u haven't left the public space unlike ua brother & sister judges 😊
My highest regards to you Sir. For explaining our constitution in comparison to the USA constitution n its importance in a simple n brief manner. 👏👏👏👏👏👏👏👌👌👌👍👍🌹☺️💐
Justice Nariman spoke on a number of topics. He talked about checks and balances for the powers of executive and legislature. But he steered clear of commenting on checks and balances for judiciary itself. He did not touch upon or address the topics of opacity, possibility of arbitrariness etc. in the selection of judges under the collegiate system and even the lack of accountability of judiciary in the absence of any external oversight (e.g. increasing backlog of cases in courts all over the country), which is completely undermining the very pillar of justice system. Judiciary and executive are passing blame to each other, with neither showing any accountability.
I tried to e mail or something to contact him but unfortunately I can't find it on Google...he is indeed legal star... just wanted to meet him once in life
And what a blunder that would have been! Thanks that the makers didn't invoke such a thing. The executives wouldn't have to be responsible to the legislature which would be contradictory to the definition of democracy.
I am a technologist who is interested in legal studies One mechanism we use in maintaining code is to use #git. With little tweaking it should be possible to use it to maintain revisions in acts in a much better way. I am sure that US has adopted this and its available somewhere publicly. Hope someone takes initiative to create such a git repository for indian constitution as well since we are now having so many changes including those in CRPC. Pls Reach out to me if i can be of some help in getting this done
As far stains in India and the US a comparison on the actual working of equality and fraternity could have been made. Whereas, in India temple entry of Depressed classes has been achieved with no doubt still they are denied entry in various places; ...in the US even 70 yrs after Brown judgment - surveys show there are no integrated schools and churches. Therefore India's stain is removable albeit in the long run. The moot question however before us is: Weren't the western education and Christianity delivered in the colonies as something of an amazon platform to deliver "civilization" to the Indian and African barbarians? One wonders why both failed at their very backyards. Can you Sir please enlighten us on the reasons for the above disasters?
(2) Every Judge of the Supreme Court shall be appointed by the President by warrant under his hand and seal after consultation with such of the Judges of the Supreme Court and of the High Courts in the States as the President may deem necessary for the purpose and shall hold office until he attains the age of sixty-five years: Why illegal as well as Undemocratic collegium still continued in India? I think president should declare it as void....
The two Constitutions are fundamentally different models. The US Constitution is the first mdel for a political federalism. The Indian Constitution is the first ever for an administrative federal model never before attempted or reached in any country because NO country has so far reached a unity by crawling through political federalism. Power corrupts. Political power is a headier wine and none will give it up after tasting it. Here is where Sardar Patel stands taller than his statue by making an archipelago of Princely States give up political sovereignty and merge into freed India to carve out Bharat, the Union of States. Their latent Indian-ness may have contributed fundamentally to his success. Under a unitary Constitution, the Union has become a UNITY, the larger unity which is the goal of all federal models as Ivo Duchachek has discussed in his digest of nearly 200 learned pares on federalism presented at the World Conference on Federalism at Geneva in 1969.

There is no separation of executive and legislature in our constitution, why the makers did not want this
Should I answer that? But promise me you'll read in-toto?
And what a blunder that would have been! Thanks that the makers didn't invoke such a thing. The executives wouldn't have to be responsible to the legislature which would be contradictory to the definition of democracy.
@@anuran.chowdhury exactly... in india we instead have fusion of power, not separation of power, strictly speaking!
