      There is no law assigning "qualified immunity". It was assumed in a case in the '50s in which a Black Minister was arrested for being in a diner at a bus station. The immunity was included in an opinion by a Judge,not a law.

    Why wasn't the law enforcement officers charged with perjury.
    Violation of civil rights is a slam dunk in this case.

      Because perjury would require proof beyond a reasonable Doubt that the Officers lied under oath. Jame's Acquittal just means that the Jury found that there was not enough evidence to convict him on the charges for which he was arrested it does not disprove the Officers testimony even though the jurors may have believed the Officers were lying. If you Followed the video they laid out a very clear explanation of why the civil rights law suit hasn't gone forward. The Federal Civil Rights Statute 42 US Code 1983 (The law you hear Police Officers being sued under) was specifically passed to prevent STATE Governments/Officers from violating a persons Constitutional Rights. One was a Federal Officer one a local Officer but both were part of a Federal/Local task Force. They are claiming as such they can not be sued under 42 USC 1983. A corresponding Supreme Court Decision "BIVENS" said that Federal Agents could be sued for Torts against Citizens however then the Government is claiming that it was a State Action not subject to Bivens.

      In 2005 the Tennessee legislature passed a law making it legal for police to lie under oath , and it not be perjury. Shouldn't law enforcement officers be held to a higher standard than ordinary citizens. If police can't solve crimes without breaking the law, we need a new breed of cop in America

      If the prosecutor scores a plea bargain or a conviction, it is considered a victory on his record. The more victories you score, the better your record. Better records equal more job security, job offers, and promotions. The same is true for law enforcement

      Official misconduct by a prosecutor can be complained about by filing a complaint with the state bar wherever he is licensed. But it would have to be very serious for the Bar to take any action. Prosecutors have ABSOLUTE immunity from being sued in a civil action based on their official acts, such as deciding who to charge with which crimes, etc. But official misconduct can be a Bar complaint. Criminal actions can be both a Bar complaint and a criminal charge against the prosecutor, but I wouldn’t hold my breath.

      Sue the police, FBI office, and prosecutor personally. The fact that all charges were dropped says it wasn't anything you did wrong. SUE THEM FOR FALSE ARREST, EXCESSIVE USE OF FORCE, ILLEGAL DETAINMENT, and anything else the attorneys can think of. I think if they were acting outside the law, there is no immunity.

      These charges should have been dropped. The judicial system is very corrupt. The innocent cannot assume that the truth will come out because DA’s and police along with judges are generally corrupt and really HATE THE PUBLIC.

    You know you live in a horrible society when the people in power would rather ruin someone’s life instead of being accountable, enduring possible public embarrassment, and giving an apology to an innocent man.
    Now imagine all the people that were too afraid or couldn’t fight back and took plea deals. Their lives are now ruined.

    This happens to hundreds of innocent people every day, James was a very lucky man to get his story out, a lot people either die or are imprisoned on false or trumped up charges.

    The thing is this case is the extreme exception. Most who suffer this kind of unjustified indignity and abuse of authority are still convicted and punished for the misdeeds of law enforcement.

      @Michael Brennan that's what James King was doing when they approached him and accosted him for no reason other than he matched an excessively broad description of the suspect and never identified themselves. Further they said they wore lanyards but James said he couldn't see the badges, besides from the photo I've seen of the two thug cops the badges on the lanyards they were wearing looked fake. So he probably thought they were street thugs who could project an air of authority because that's exactly what they looked like: street thugs

      I went through the same situation where my lawyer wanted me to plead I fired his azz and took over my own case it happened in 2012 and I won in 2014 I came to be my own counsel and investigator

    They will never apologize, as that is a legal admission of guilt. They violated your civil liberties, they assaulted you, and they filed fraudulent charges against you.

    I feel so bad for this young man, he was deprived not only of his Civil Rights but also of basic humanity ! I've always thought that police were a necessary Evil in a civilized society, not so much anymore ! I watch hundreds of videos and follow countless accounts of police committing criminal acts and using excessive force . It's really scary to think that "We the People" have quietly allowed the Police to run rampant over all our desires to be protected . No person should ever need to go to a police station to get an Officer Complaint form due to 'intimidation', all body cams should transmit to a cloud recorder so they can't be erased, all dash cams should be reviewed by Council Members weekly and all complaints should be acted on immediately ! Giving an Officer time off with pay is not punishment, it's a fishing trip !

    I hate the idea of plea deals. "This crime is so bad it's worth 75 years in prison, but if you just go along with it, 5 years will be fine." If it's worth 5 then you should be able to get your day in court and only risk 5.

      I asked, "When will I be Mirandized"?, the officer told me, You have NO rights!! When I told this to my supposed defense attorney. He said, "Oh, I doubt that"! I then pointed out that signs all around the area of the desk where I was standing, stated, the AREA WAS UNDER CAMERA SURVELLIANCE 24/7, I told the attorney to check the facility's TAPES!! I DOUBT he EVER did!!

    Its up to the citizens to enforce laws against Law Enforcement Officers. Also, it is up to the citizens to enforce penalties and punishment onto Law Enforcement Officers. Same for Judges.

      No, there is not a series of "steps" leading to a police state. Police states are designed as such. All states are police states, what matters is the severity of the oppression.

    Im very proud that you made a stand and fought for your rights! I was assaulted also after leaving church on 6/17/2016 they knocked my teeth out after throwing me from the passenger side of my daughter's car. They handcuffed me then tackled me ! It was t the worst night I'f my life. I still suffer from the situation, that the video was altered and it was corrupt from the beginning!!! I wish i could go to the supreme court with this but ive been to afraid! Bless you James

    I experienced a similar incident and as a victim can relate to his state of mind. This is not an isolated phenomenon, but a chronic problem in law enforcement. The laws need to be clear and uniform across the country.

    If the prosecutor scores a plea bargain or a conviction, it is considered a victory on his record. The more victories they score, they better their record. Better records equal more job security, more job offers, and more promotions. The same is true for law enforcement.

      @@Uberragen21 Qualified Immunity really doesn't apply in this situation. The Government is using two Different legal principles against each other concerning a Federal Law and a Court decision and a jurisdictional issue concerning whether they acted as Federal or Local law enforcement.

    Had to rewind it as soon as I realized that at around the 1:40 mark, when he's about to state how he realized that they weren't Muggers! If you pay careful attention to his facial expressions, his breathing, him raising his eyebrow, etc. You can clearly tell that even just by his eyebrow raise alone he's looking for a visual cue from those filming him as to rather or not he's staying within the guidelines by not saying anything in a way that jeopardizes his case or him possibly being sued for stating the obvious fact - Basically he struggles wanting to say that - " he ultimately realized that they were Tyrant's!" It just pains me knowing this guy (victim) literally is uncomfortable with having to struggle with saying anything but the obvious about the criminals responsible. SMDH

    I don't ever let one, let alone two questionable men approach me and I certainly don't let them get behind me. This guy was a kid at the time, well young adult (same thing), so he may not have been the best trained or been able to defend himself adequately. He may have also been too naive to see these criminals approaching and analyze the situation properly.
    I was _that young guy_ once and it ended badly for me. I learned and grew from the experience and now identify threats before they get too close. It has saved me a few times from robbery and assault. Sadly I got off easy compared to this kid, so yes, he would have been better off getting mugged by a dozen kids.
    Stay in shape boys. Remember the rules of Zombieland.
    Rule #1: Cardio
    Also rule of life, trust your instincts and pay attention to your surroundings. The police are not your friends. They are not necessarily your enemy, but they are _definitely_ not your friends.

    The most disappointing part of the whole story to me is the officers who went around to witnesses and ordered them to erase their footage, they are as guilty as the guys who did this. You clearly cannot trust law enforcement. Protect and serve themselves. They are not your friend and they are not here to help you.

    WoW. Such open corruption . I would have lost my touch with reality when released. Went to my foot locker break out all my old combat fatigues, camouflaged my mug and super cleaned my 2 AR15s , two klocks and went on a manhunt. Everyone involved would be taken out then turn myself claiming PTSD which cause me to have flashback of being in iraq for 14 months. Sad.

    The experience of being mistreated by the government leaves you with a long lasting PTSD. You devolve from being angry to being mistrustful and downright anti government/cop. They do as they will and you have little to no recourse. It's a hard smack in the face when you've lived your whole life indoctrinated in the fallacy of american freedom, rule of law, equality and justice for all.

    I lived in NYC for about 5 years in the 80s. I was a frequent visitor to the Times Square area at all hours of the day and night. Every time I saw a uniformed cop standing around, I felt a sense of safety.

      Charlie Belle the “clearly established” part of Graham analysis is construed in different ways. More often than not, it’s always tilted in favor for the cops. Hence, the majority of civil rights violators get away from being held accountable despite the obvious.

      @@vovin8132 No he didn't cross state lines and I agree the feds never should be involved with anything that's not strictly interstate or an offence against the Federal Government. The joint task force is only supposed to deal with violent fugitive felons. The fugitive never went further than 50 miles from Grand Rapids and the fugitive did not commit a violent crime. The home invasion was strictly an ordinary burglary.

      Hard to do when the DOJ protects their own. Contrast with Bryce Masters who was tased for 23 seconds into cardiac arrest while he was under arrest then dropped on the kerb face first. The DOJ went after the suburban cop who did this because the kid's dad was a narc who was owed favors from the FBI

You should put a little not under your category giving several different ways to make a donation for this cause. i.e. direct snail mail with check made out to institute. 2. patreon or PayPal, repetitive donation where a person could make a small donation monthly, etc. Don't you think that would be a good idea?

    When you’re accustomed to privilege, equality feels like oppression. I have a similar case. I was given 4 public defenders who ALL ended up withdrawing. None of them were willing to stand against the local government who included all of the top officials. The Mayor, Chief of Police, Assistant Chief of Police, Sheriff, Chief Deputy Sheriff, State's Attorney, 1 Police Lt, 2 Sargents, 2 judges, plus many more. I was given a bench trial is how I was beat. I was not given the opportunity of a jury trial. I had to defend myself because the public defenders felt like prosecutors. My defense was rock solid, yet the judge couldn't wait to find me guilty. My appeal runs out in 2 weeks. I have no idea how to file an appeal and I have no money, not that any attorney in this town would be willing to help me anyways. I feel very defeated. This was covered up. None of you know my name or my story yet I have published it on my channel. The government refuses to admit their wrongs and are willing to criminalize innocent citizens in order to avoid accountability. I have lost ALL faith in the government. I have no option left but to take matters into my own hands. Give me liberty or give me death! If a law is unjust, a man is not only right to disobey it, he is obligated to do so. Police need to be set straight. They are out of control and not held accountable. THIS NEEDS TO CHANGE!!!!
