@Ur momz a hoe kaylz The Judge was trying to get to the bottom of who was videoing people arriving and leaving his court room including possible witnesses and why? Video recording is forbidden in a court building unless special permission is granted. It could be seen as witness intimidation which is a BIG no no.
@Ur momz a hoe kaylz Well basically, filming in and oustide of a courtroom is illegal unless given permission by the juge or some authority and the man was filming people leaving the courtroom, witnessess to be more precise which is even worse. The reason this is hightly illegal is pretty obvious, you dont know why he is filming, it could be for the person who is in trial to take revenge on people testifying against him and other various reasons. @@conniedziepak6760 I think that's just on TV. It was ridiculous in real life. You can tell that last judge feels as though people are bending rules and behaving in insidious ways that might obstruct justice and he isn't having any of it. His commitment to staying calm and poised despite how obviously he was boiling just under the surface I think is a testament to his belief in the way everyone in a court house should conduct themselves. Not even holding himself above that standard. I'm sure he did everything in his power to hold those two men accountable for potentially violating the safety of witnesses and the like.

I practice in the 20th circuit and have been before judge Kyle many times. The chief judge of the circuit (not judge Kyle) entered a standing administrative order requiring the permission of the judge before video is allowed anywhere in the courthouse. Judge Kyle explains that very clearly in the video, and there are lots of signs. Since he is not the chief judge, Judge Kyle was required to enforce the order, even if he didn't like it.

Full context for people who think Judge Schroeder was being 'unfair' in the Rittenhouse trial: The video of Kyle sitting in a car talking about shoplifters was brought up in pre-trial motions, weeks before the trial started. I recall that he said 'I wish I had my AR' or something similar, while he and a friend were watching youths they thought were shoplifters. As the judge pointed out, this has nothing to do with the circumstances that occurred in Kenosha, and it would be a different story if he had said something like 'I wish I had my AR so they could attack me and I could shoot them'. Propensity evidence is evidence that shows a distinct character trait related to the crimes in question, and Rittenhouse did not have a history of shooting people or being violent, other than talking crap with a friend (which we all do), and getting involved with a fight his sister had. Other evidence that came up in pre-trial hearings was the character of those people that attacked Rittenhouse. This was also disallowed, despite all three of them having criminal records. Rosenbaum alone had a serious record, including multiple counts of child molestation, and over 40 infractions in prison. Huber threatened his own family members with a knife, among other incidents, and Grosskreutz was charged with assaulting his own grandmother. These incidents were also disallowed from being introduced as evidence, and rightfully so. Rittenhouse was not aware of their personal history when they attacked him, and none of their previous crimes were comparable to what happened in Kenosha. This was all settled, and the lawyers were instructed on this weeks before the trial. The only way any of these facts could be introduced in the trial, was if either side made a claim that contradicted those facts. This occurred at least twice during the prosecutions case. With Huber's aunt, she suggested that he was 'heroic', which possibly opened the door to his character evidence. With Rosenbaum's fiancee, the door was potentially opened about why he could not stay with her that night (he had a restraining order in place). On both occasions, the defence asked the judge to instruct the jury to leave the room, so they could discuss if the door had been opened, which is exactly how it's supposed to go. In the case portrayed in the video, Binger tried to blatantly crowbar the shoplifting video evidence in, right in front of the jury, after he had been given instructions not to weeks before, and reminded of this earlier in the day. This was after he had already questioned Kyle's 5th amendment rights, again in front of the jury and he'd been chewed out for that. Either of these incidents are more than enough to force a mistrial, which is exactly what Binger was going for because the prosecutions case was in tatters, but this judge had already decided to let the jury decide this case, no matter what happened. My point is, yes, it could look like the judge is being biased here, but there is no context. This chewing out became internet famous at the time, and of course the media and social media were all over it trying to make him look biased, but the defence did things exactly how they are meant to be done in the same situation, and there are no highlight videos of that because it's doesn't create outrage or clicks.
it’s just unfortunate that they tried him on the hardest charge to prove. Murder was a stretch but plenty of other crimes he would’ve been convicted for.
I remember the case involving Kyle when they kept pushing that he was pointing the gun at the men before they attacked him and then video evidence came out proving he didn’t and they STILL kept saying it. That was the most insane trial I have seen in a long time.
It made me sick to watch grown adults try to railroad a kid for defending his own life. The power of a false narrative is real. Thank God justice was served in Kyle’s case.

While CNN, was just creating just as much out of context clips and appealing towards the biases of their viewers (especially when he told the witness to answer the question of the DA).
@@cald1421 tbh, I never found out *because when the trial was happening, I was doing my best to stay away from propaganda from both sides so I can try to see if this case would (in my layman opinion 😂) be done fairly and so I would be able to hold an option that would be in line with the facts of the case and understand why the jurors (whether I agreed with them or not), would rule one way or the other. So to reiterate my answer, I haven't found out why exactly except on conservative pages (both on UA-cam and Facebook pages), they seemed to feel like it was an unfair trial and I would see them share clips of the judge being biased. So I'm actually in the process of rewatching the entire trial (*to an extent*). I saw some mention, which I understand is unrelated to the judge, prejudice of the jurors. Yeah when the judge went off on him concerning the miranda rights as they're called here in the U.S. it's easily the most justified anger. Can't say someone is guilty because they're silent. Everyone should stay silent too if they're placed under arrest as you have nothing to gain by talking as soon as you're in handcuffs.
YOU: 'A Prosecutor should never refer to pre trial silence....' How about the UK caution - "you do not have to say anything but you may harm your defence if you fail to mention something you later rely on in court"? The caution itself indicates that pre-trial silence may be referred to. You don't much sound like a 'UK Prosecutor', TBH.

I believe Binger wanted a mistrial because he knew he was losing. If he got the mistrial, there was a chance he could retry prosecuting Kyle. The fact that Binger brought up Kyle's remaining silent during police interrogation was a blatant attempt to force a mistrial. I think that's just on TV. It was ridiculous in real life. My defense attorney literally read the statute that would have proven that even if the story the detectives made up was true, I couldn't be charged with the crime. The victim in the case came in and described his actual assailant who was there, but said his name was my name. He even said under oath that the detectives told him to pick a guy he'd never seen (me) out of a photo lineup. None of that stuff mattered to the court. They told me I did not qualify for a public defender and my constitutionally guaranteed "reasonable bail" was $80,000. It's hard to argue malicious intent and guilt when there's a clear video showing the opposite. Binger charged Rittenhouse strictly for political reasons. There's no reason he should still be allowed his position as a prosecutor, as he's clearly proven he has a bias.
Binger is evil and malicious. It was nothing but a political show trial and he should be permanently disbarred and sitting in a prison for life.

@N A Dude, they're talking about Judge Kyle, not the Kyle Rittenhouse case.
Full context for people who think Judge Schroeder was being 'unfair' in the Rittenhouse trial:
The video of Kyle sitting in a car talking about shoplifters was brought up in pre-trial motions, weeks before the trial started.
Great response.

The dressing down can be relevant sometimes, yes?
They did excuse the jury
@@xino_z I see your point.
Nah, if the lawyer is trying to clown the jury, the jurors need to know
That last judge looks like he's perpetually surprised by his own quiet intensity.
🤣🤣🤣
That's a beautifully constructed thought.
What makes alll this funnier is that attorneys will go for the NECK in court but will go out for drinks later .
@@Work782 EXACTLY!
It's disgusting.
@@USERTM7 idk how they do it, you disrespect me in front of a judge I’m throwing a drink in ya face (jk don’t do that unless it’s water bc people may be allergic to the ingredients)
It's actually one of my favorite things about the job. It's not personal most of the time and when it is, you're not goin for drinks after...
@@klaire1058 We don't usually disrespect each other in court. Things may get heated, but it's usually professional. The ones who do get personal don't go get drinks with each other.
I wouldn’t call the second one angry at all. He was merely instructing the witness to act in her own best interests and the best interests of the defendant. No yelling or even raising his voice.
i started to get goosebumps while judge kyle was asking his questions lol
I could see the gears in his head turning as he starting making progress. You can see that he is fuming but doesn't allow it to boil over.
That guy was actually scary. He was not f’ing around.
He is really great though. And has a fantastic sense of humor. GREAT with victims.
Something about judge kyle's demeanor screams he has absolutely zero tolerance for bs.
i enjoyed the judge bruce kyle he seems very composed and knowledgeable while being stern and authoritive
That prosecutor in the Rittenhouse trial was out of line and I'm glad that judge held him in line.
Oh he was even worse afterward. He said straight up he was being malicious in that trial, and that if Kyle had been killed by one of the rioters he would not have gone after charges.
The Prosscuter in rittenhouse trial countied to lie and think he was right for his questions and then he thinks he has a right to ask to be not interrupted and then asking to them to let him finish his lies I would have asked for a new Prosecutor
That second judge was just PRAYING they'd object. Dude let LOOSE.
And that last judge was seething under the surface, but stayed cool as a cucumber throughout. Absolutely the pinnacle of what a judge should be and he seems like a credit to the profession.
Yeah he sure was haha, that second judge was awesome
Judge Peter Cahill was a fantastic judge. The fact that he was hated by both extremists on both sides showed how fair and balanced he was in the trial.
I didn't think about that. That's a nice observation
Was he hated by the extreme right?
I know the left suddenly hated him even though in any other situation they love strong protections for a defendant
@Cal D (I can't find your comment anymore (I think my UA-cam app is acting up)) but I was on several conservative pages and they were all going off on the judge during the trial and including some of those misc random UA-cam pages that will appeal to right-wing conservatives and/or anti-liberals.
While CNN, was just creating just as much out of context clips and appealing towards the biases of their viewers (especially when he told the witness to answer the question of the DA).
@@BerserkerSloth I guess I meant more why were the conservatives angry? I get why the liberals were angry at the Judge. But why the conservatives?
So I'm currently watching the juror selection of the jurors who were selected.
After I'm done with that and the rest of the trial, I'm gonna try to find some of the conservative videos against Judge Peter Cahill and see what they were saying.
I'm sure the majority were mainly trying to poke holes in the prosecutors arguments and argue why he died of asphyxiation.
^but if it helps, unlike the Kyle Rittenhouse trial, I saw NOTHING positive about Judge Peter Cahill (on conservative pages/platforms) but ONLY negative.
"Who you pointing at? I'm a grown man," he said...yet proceeded to act immaturely. Funny.
A grown man? Yes. A mature man? Definitely not.
He said it to remind himself; he did, surprisingly. XD
That last judge has the LONGEST fuse I've EVER seen on a human being... Seemed like he was ready to explode at any moment.
that judge was VERY patient with Binger. Other judges might even had held Binger in contempt.
@Sal Spencer Still so salty, delicious 😊
@Sal Spencer its not the judges fault the prosecution tried to bring evidence before the jury that was not admitted by the court and comment on the defendants use of the 5th amendment.
Its the DA that was the disgrace.
@Sal Spencer get over it
Yes! I thought he was going to hold him in contempt and was so surprised he didn't!
@Sal Spencer Of course, being objective, going by the law book, not looking for political points and not bowing down to the establishment should be a crime....
Binger's a POS, during the whole trial he tried this nonsense. So love that judge for putting him in his place.
don't you mean FlufferBoy2004?
@Sal Spencer lol we all saw the trial, he was rightfully cleared and most people even a lot of liberals agree the defenses case was stronger than the prosecutions.
@Sal Spencer
🤣🤣🤣🤣🤣🤣 Sure! 😂😂😂😂
@Sal Spencer
I see your brainwashing and indoctrination have been very successful.
@Sal Spencer You need to be medicated
That last incident was exceptionally concerning. I wouldn't be surprised if the person responsible were cast out of the legal profession.
The legal system is sooo subjective when I thing about it. The mood and personality of a judge determine the destiny of people
Those things apply to a jury even more.
I love Judge Bruce Kyle. He was not happy!
Attorney Binger is the most irritating little man i've seen in the courts.
probally intentional makes it a face of the problem rather than the law lol
@@Mikefishing0 I’m not sure I’m interpreting your comment right, but I feel like that guy intentionally strays off the path to try and manipulate or try to make things go his way that otherwise wouldn’t, he’s not new to the game, he knows what he’s doing, he just intentionally goes too far in his profession. I understand why, but it’s not a nice idea in the court of *law* (not emotion)
I’d swear he might be a homosexual
He watched too many Game of Thrones and he thinks he is Littlefinger ...
@@markhamilton8728 huh
The last judge was down right scary. You could see how angry he was but it came off as icy. I was expecting him to start throwing charges out
I like the judge that despite he is clearly angry and the attorney had been inappropriately behaved, he still tries to be patient and explain why 13:00
Binger did not respect the 5th. Why was he even made a prosecutor?
The last one was a quiet anger, I like that judge.
I am a UK Prosecutor, this Prosecutor is dreadful. Previous bad character should never be raised before the jury without a ruling as to admissibility. Criminal Law 101. A Prosecutor should never refer to pre trial silence.
Oh ya, same in America
Not just any law though a right, through the bill of rights, with added case law
Hi Steph Boyd
YOU: 'A Prosecutor should never refer to pre trial silence....' How about the UK caution - "you do not have to say anything but you may harm your defence if you fail to mention something you later rely on in court"? The caution itself indicates that pre-trial silence may be referred to. You don't much sound like a 'UK Prosecutor', TBH.
That last judge was absolutely boiling with rage, that's a man holding back an explosion
who is here because they are following the johnny and amber trial so now they are getting videos from this channel?
"Why didn't you first fight the guy pointing a gun at your head?"
Binger is a chump.
I wouldn’t want to cross Judge Kyle. That bottom lip frightened me and I didn’t record anyone. I was yelling at my phone “no your honor, I didn’t record anyone outside your courthouse, I swear!”
6:57 did he just put the judge in his place?? 😯😯 Whoa, that was a bold move, I'm surprised the judge didn't reprimand him. He just popped off and got smart and snappy at the judge and the judge didn't say anything at all.
No, the judge was disgusted by this lowlife piece of shit’s audacity.
My favorite trial judge told me that a good judge has three things: Patience, patience and patience.
If anything I think a judge should be patient and not raise his voice. Judges get a bad reputation already so if I was a judge I’d be patient.
Yes, and none of these men have that.
Imagine that angry bold Judge doing JD and AH's case.
I believe Binger wanted a mistrial because he knew he was losing. If he got the mistrial, there was a chance he could retry prosecuting Kyle. The fact that Binger brought up Kyle's remaining silent during police interrogation was a blatant attempt to force a mistrial. Thankfully, Kyle's attorneys didn't bite shows how well the trial was going for the defense.
That’s what I was thinking too
And Kyle's attorneys didn't bite when Binger pointed Kyle's gun at the jury and pulled the trigger. Steel nerves.
um I am by no means an expert, but the defence asked for "with prejudice" doesn't that mean the prosecutor can't retry it? Or is it the other way around?
@@bigdog3628 Idk the answer but I recommend googling the answer vs trusting someone here.
@@bigdog3628 Binger was hoping the judge wouldn't grant the with prejudice. coin flip basically.
