Back about 15 years ago I gave consent to a cop to search my vehicle. they found nothing at all because I was not doing anything illegal, but in the process of the cop doing a search of my vehicle, the cop dropped and broke a computer that was in my vehicle. I ended up taking the cop and the department to court to try and recoup the cost of the computer. the judge ruled against me, ruling that since I gave the officer permission to search my vehicle, the officer was blameless and the destruction of the computer was my loss. After that ruling against me, anytime a officer wanted to search my vehicle (3x since 2003), I refused unless the officer got a warrant, as I did not want any of my property broken again and have no recourse to get damages back.
As an officer ive got to say I think your videos are great. You seem to inform people properly on their rights but still let them know that not all cops are trying to ruin their lives. Keep up the good work.

So true. My friend who buys cars at auctions and then fixes them up and sells them had a similar thing happen. He was gutting the interior to the car to clean it out properly and found a nugget of weed. Had he been pulled over or sold the car before he cleaned it who knows what could have happened if a cop tried to search it.
Really great video, I was pulled over once for rolling through a stop and the police actually gave me an ultimatum, essentially what they were saying was we can write you a ticket or you could just let us search your car and if you have nothing to hide then you'll be on your way. I'm a Latino male it was 1o'clock in the morning and I was in a white neighborhood. Also the reason I rolled through the stop was because they creeped up behind me and got really close to my bumper, I thought they were about to tap me, my back windshield was dirty, I couldn't tell that is was a police car, I thought it was a drunk driver. I was pretty broke at the time so I let them search my car. I was cold as fuck on the side walk, the search took 20min and I was a block away from where I was headed, which was my bed. Watching this video gave me some ideas about what I could have done, thanks!!
It pisses me off when police search me & say "I'm only doing my job" as if they're trying to be nice to you. Yes, that's true but there's so many times I felt like saying "well you're the one who applied for that job just so you could be a professional asshole!"

Had an officer stop me walking in my apartment complex last week, he stated he hadn't seen me here before and asked if I lived in the complex. I stated I was, in fact, a resident in this county. He stuck out his hand and stated his name, welcoming me to the neighborhood. Next he stated "and you are?" I shook his hand, said, "pleased to meet you, have a good day." left him scratching his head

@start2liejoe No, refusing a search does not give police probable cause. Ask your professor, or any criminal defense attorney, how this works. It's a fundamental principle of 4th Amendment caselaw that police cannot cite your own assertion of constitutional rights as evidence of criminal activity.
I have pre-paid legal insurance. Now if a cop stops me I just call the emergency number and get an attorney on the phone. Then the cop gets to deal with the lawyer. I've had to do it a few times already. It's amazing how fast the cops back off once they realize you're not venerable and weak and instead you can throw a lawyer at them.
When I was 15 this happened to me and my friends who were skipping school and had cigarettes, we agreed to the search of course, they even brought a dog and made us wait for about and hour and a half while they went through our backpacks and my entire car...
Right on #5 I have two friends who consented to the police searching there cars both got in trouble for something a friend had left in their cars. One friend (age 17) dropped a girl (age 18) off. The girl forgot her pack of cigarettes in the car. A cop pulled my friend over for not using a blinker, she let him search her car, and she got a ticket for being a minor with cigarettes. My other friends story is close, but instead his friend left a stolen fire extinguisher in his car :)

(All of this for a Hookah in his trunk, in pieces...completely disassembled and inoperable with NO residue or smell of any kind present!! Arrested for "possession of tobacco paraphernalia"??? Never read Miranda rights...and totally & completely intimidated by the 5 SQUAD CARS WITH flashing lights that pulled him over for not using his blinker!! I swear to God, true story!! All of this happened less than 50 feet from the front door of our home yet not 1 officer could find the time to knock. I noticed the flashing lights after about half hour...they already had him on the ground and searched his vehicle!! Never even tried to locate me (50 feet away) even tho he is a minor!! Wouldn't allow me to speak to him or give me any info the entire time, telling me "he was not being arrested only investigated". We only found out he had been arrested because i ordered a copy of the police report...he didn't even know he had been arrested!! Wish me luck!! Will post update on the 13th!!"
SlimSlashie well, we had our Hearing today with the Prosecutor for what was supposed to be plea negotiations and sentencing. How did it go, U ask?? Ummm.....strange!! LOL Prosecutor wouldn't budge at first... very matter of fact saying nothing in file for us to dispute and they will not change A thing because we don't have a leg to stand on...ETC.... PERIOD!! . ummmm....I beg to differ!! I started citing Federal and State Laws That the officers violated and laws that violated our Civil Rights and BAM...Prosecutor asked for the continuance to have time to research the Laws I cited. I agreed but told her that a dismissal of the charge is really the only option i would accept. Otherwise, i invoke my right to Court Apt Councel and handed her a list of 18 peole i want subpoenaed for trial. She said, "You do know that it is only a petty offense, right? Usually the people just pay the fines, accept Diversion Programs and do their community service". I said, "well, maybe they were actually guilty as charged!? Petty, misdemeanor or felony....I will not admit to or make my son pay for something he didn't do!! Period! I fight you over this Petty Offense because he didn't commit it! If he did, I would tell him to take his licks and not waste so much time for a dumbass move...but he didn't...and i wont! So, it is principal not personal. I then told her I have more Statutes and Case Law at home that I have not included today. I had so many to choose from so I only included the most noteable. I will print up a list of the others and their relevance to my complaint and fax them over to your office if you like. She just stared for a minute then said....no, I think what you provided is sufficient. Then she asked when we want to return to complete the Hearing and my response was "you tell me how much time you need...i am good! This is all just bonus time for me to do more research. She chuckled, then asked me what i fo for a living. (I am a stay at home mom....don't they understand that us moms have more time on our hands than anyone else to research a cause important to us?? LOL ) By the close of the Hearing she was so pleasant and "soft"...I don't think she knows what just happened. LOL . I won't roll over or cave for anyone if I know they are wrong! It becomes my only mission (or obsession) to prove it. (Tired of getting shit on all the time!! I don't care who u r....wrong is wrong...and I will call u out every single time...period!) Not claiming I have won. It ain't over till the fat lady sings!! Just saying I made them "think" and "just because you can, doesn't mean you should" kind of thing!! Will post results in a week! :)

On #5, may be things in your car you would find absurd if told they were illegal. One Houston cop arrested someone for having a concealed weapon in car. He asked if driver had concealed weapons. Driver said no. Cop asked to search & driver consented. Cop found a broken off piece of a broom handle that was being used to support an electronic device not firmly bolted down. Cop claimed broomhandle could be used as a weapon, & arrested driver for illegally carrying a concealed weapon in their car.
also, case ruling is different.. Case Rulings are decisions that are carried on by the courts for future trials. Going back and looking at every single incident that a Police officer went to and then trying to show he did wrong at each one is completely different. If an Officer was in the wrong repeatedly, it would be internal affairs that handled the officer. Not the courts!

Had a cop stop me and ask me to identify myself once. I refused to identify myself initially, but after he said he would arrest me if I didn't, I gave him a fake name. Then he said my pupils were dilated and said that was grounds for a search. Obviously he found my real ID and I got $500 worth of fines for essentially nothing... The bastards.
I know it might not seem convenient for everyone but if you do decide to "carry around any pine straw", they usually don't pull you over during a severe rain storm or when it's foggy out and visibility is pretty bleak.
Talk about consenting to a search. Watch out for this police trick...glad I wasn't driving 'dirty'. I was pulled over one night by a state trooper because my license plate light had blown out, which is a ticketable offense. (OK, next time I won't pass a slow moving trooper at night.) News to me. We went around to the back of my car. Of course I couldn't see it b/c my car was all lit up from his car's bright lights and Christmas lights. The trooper got me to open my trunk so that I could see that it was, in fact, inop. Boom! I just let the trooper look dead into my trunk...just as quick as that. Whatever wasn't in plain sight before was in plain sight...up close and personal...at that point. Anything seen at that point is fair game. All because I just HAD to see that my light was inop. I got a warning ticket. Moral to the story: make sure all your lights are working and, two, get rid of the body before nightfall.
riiiiighttttttttt... They will just accept it.. Probable cause isnt hard to establish. for example, an officer could smell a presence of marijuana. Even if it isnt present, its very easy for the officer justify a search.. If a police officer is asking you for consent he probably already has cause to do it. Or can easily establish it
When I was a clueless teenager back in the day, I gave someone a ride one time who against my knowledge placed an empty beer can under my seat. I got pulled over one night for "suspicion", car searched, got fined for open alcohol container.
I can tell you from experience, I bought a used car once and found a joint in the seat mounting rail on the floor. **YOU NEVER KNOW WHAT COULD BE IN YOUR CAR!!!** This is why you must not consent to a search, rule #5.

What if you have been on some sort of probation in the past but aren't currently on it at the time they request to search. Does having that record give them the right to search?

PART 1 Many years ago, the police got a letter wrong in a name, of a suspect, the person they were looking for had been in serious trouble. They mistakenly came for my cousin living with me, when they banged on the door I stupidly opened the door thinking it was someone else. I had a their shot gun on my forehead. then my little puppy 3months old barked, the gun went from my head down to the pup (maltese). I grabbed him, if the cop would have shot the pup & my hands would be gone.
id like to comment to those who say "I've got nothing to hide" a couple weeks ago there was a funny picture circulating. a man cat had eaten a bird and he made a headdress for it. although not normally migratory the bird was protected by the migratory bird act. one infraction is a year in prison if the chose to charge by the bird. if they chose to charge by the feather(which the can) that's several 100s of thousands and years in prison. you do have something to hide we all do. you just don't know it.
It's really simple. If a cop is acting within the Constitution, there's no reason not to comply. If a cop is acting outside the Constitution, there's every reason not to comply. How do you know the difference? Know the Constitution. Do you know how many rights we give away because we don't what our rights are?
@sabretooth75 Probable cause is the requirement for police officials. Suspicion, based on instinct or "gut feelings", does not constitute probable cause. You are right, reasonable doubt is for the courts. Probable cause is the issue that is misunderstood by so many people.
I've said no to a Cop who wanted to search my car before. I was very scared to assert my right not to be searched, but it worked! The cop didn't end up searching my car, even though he REALLY wanted to. I had some things that I did not want him to find, lol.

You *do not* have to consent to that search, either, and the cop can't search you legally unless they have reasonable cause, like they just observed you do a deal on the corner. You want to say, I do not consent to search, am I being detained, am I free to go. If they tell you you're not free to go, ask why you are being detained, i.e. what's their probable cause.
Re: #4 Searches can waste your time and damage your property; as well as cause you bodily harm if they take the contents out of your vehicle and forget or refuse to put those contents back where they were originally found. Friend of mine had a doctors written excuse with him at the time his car was searched. And even though they didn't find anything, they didn't put the spare tire back into his trunk. Ended up throwing his back out. Poor guy.
Point to the part where I said "it's never happened." Because I didn't. I said it would be overturned in a higher court. They cannot assume guilt then treat you like you are guilty. Unless they SEE a weapon, or are searching specifically for someone with a specific weapon (something they suspect was used in a crime that was actually committed), they cannot even do a "quicky" search. Not without consent. And how do you diffrentiate between a "very quick" and "whole" search, exactly?

What can you do if you are stopped as a pedestrian? Do they need to tell you that you are being detained? Is there a legal threshold for detaining someone? Could I ask an officer "Am I being detained, or am I free to go"? If says I am being detained, what do I have to tell him and what do I not have to tell him?

I'm 21. I do not have a problem with authority. I was a model teenager and have always valued the opinions and approval of my parents and teachers. My issue is with police, and it arose from my encounters with them. I have never interacted with a kind police officer, even though I try to be polite. If you still think my generation is screwed up, well then, maybe you should have raised us better!

You can say no to searches which is well within your rights to do so. However, law enforcement does have the right to search you for weapons as a means of protection for the officer and those around. If anything is found on that search it can lead to searches happening anyway.

1) RUN from public defenders! They are free for a reason.
2) Your Miranda "warnings" are read (told) to you AFTER you're arrested. If you babble something out that GETS you arrested, you're f'd. Example, you just shot and killed someone, you run up to a cop and yell, "I murdered that guy!" Um, no Miranda warning in the WORLD will save you from going to jail.
3) The cost to the city is not what they take into account when they charge someone with a crime. If it were, well capital murder trails cost over a mil? Yeah they'd never prosecute those cases.
While I agree with everything you said previous, (ie cops aren't your friends and all that), someone gave you bad advice about whatever you have going on over there. Seriously though, good luck with it. LMK how it turns out!
To another completely off topic point: Part of the problem is when there are SO MANY LAWS that anyone who's not a lawyer doesn't even KNOW all of them, let alone understand all the intricacies of them, yet we are fully expected to follow ALL OF THEM.

OK.....here we go!!! Head to head on Feb 13th. I know you think i am making a mistake, but I can't help but stand up for what I feel is right and "just". Wish me luck! (All of this for a Hookah in his trunk, in pieces...completely disassembled and inoperable with NO residue or smell of any kind present!! Arrested for "possession of tobacco paraphernalia"??? Never read Miranda rights...and totally & completely intimidated by the 5 SQUAD CARS WITH flashing lights that pulled him over for not using his blinker!! I swear to God, true story!! All of this happened less than 50 feet from the front door of our home yet not 1 officer could find the time to knock. I noticed the flashing lights after about half hour...they already had him on the ground and searched his vehicle!! Never even tried to locate me (50 feet away) even tho he is a minor!! Wouldn't allow me to speak to him or give me any info the entire time, telling me "he was not being arrested only investigated". We only found out he had been arrested because i ordered a copy of the police report...he didn't even know he had been arrested!!

SlimSlashie well, we had our Hearing today with the Prosecutor for what was supposed to be plea negotiations and sentencing. How did it go, U ask?? Ummm.....strange!! LOL
Prosecutor wouldn't budge at first... very matter of fact saying nothing in file for us to dispute and they will not change A thing because we don't have a leg to stand on...ETC.... PERIOD!! . ummmm....I beg to differ!! I started citing Federal and State Laws
That the officers violated and laws that violated our Civil Rights and BAM...Prosecutor asked for the continuance to have time to research the Laws I cited. I agreed but told her that a dismissal of the charge is really the only option i would accept. Otherwise, i invoke my right to Court Apt Councel and handed her a list of 18 peole i want subpoenaed for trial. She said, "You do know that it is only a petty offense, right? Usually the people just pay the fines, accept Diversion Programs and do their community service". I said, "well, maybe they were actually guilty as charged!? Petty, misdemeanor or felony....I will not admit to or make my son pay for something he didn't do!! Period! I fight you over this Petty Offense because he didn't commit it! If he did, I would tell him to take his licks and not waste so much time for a dumbass move...but he didn't...and i wont! So, it is principal not personal. I then told her I have more Statutes and Case Law at home that I have not included today. I had so many to choose from so I only included the most noteable. I will print up a list of the others and their relevance to my complaint and fax them over to your office if you like. She just stared for a minute then said....no, I think what you provided is sufficient. Then she asked when we want to return to complete the Hearing and my response was "you tell me how much time you need...i am good! This is all just bonus time for me to do more research. She chuckled, then asked me what i fo for a living. (I am a stay at home mom....don't they understand that us moms have more time on our hands than anyone else to research a cause important to us?? LOL ) By the close of the Hearing she was so pleasant and "soft"...I don't think she knows what just happened. LOL . I won't roll over or cave for anyone if I know they are wrong! It becomes my only mission (or obsession) to prove it. (Tired of getting shit on all the time!! I don't care who u r....wrong is wrong...and I will call u out every single time...period!)

On #5, may be things in your car you would find absurd if told they were illegal. One Houston cop arrested someone for having a concealed weapon in car. He asked if driver had concealed weapons. Driver said no. Cop asked to search & driver consented. Cop found a broken off piece of a broom handle that was being used to support an electronic device not firmly bolted down. Cop claimed broomhandle could be used as a weapon, & arrested driver for illegally carrying a concealed weapon in their car.

also, case ruling is different.. Case Rulings are decisions that are carried on by the courts for future trials. Going back and looking at every single incident that a Police officer went to and then trying to show he did wrong at each one is completely different.
If an Officer was in the wrong repeatedly, it would be internal affairs that handled the officer. Not the courts!

Had a cop stop me and ask me to identify myself once. I refused to identify myself initially, but after he said he would arrest me if I didn't, I gave him a fake name. Then he said my pupils were dilated and said that was grounds for a search. Obviously he found my real ID and I got $500 worth of fines for essentially nothing... The bastards.
Well, lying to the police officer didn't really help you in that situation.
true. but he only really searched me because he was suspicious as to why I wouldn't give him ID.
I know it might not seem convenient for everyone but if you do decide to "carry around any pine straw", they usually don't pull you over during a severe rain storm or when it's foggy out and visibility is pretty bleak.

Talk about consenting to a search. Watch out for this police trick...glad I wasn't driving 'dirty'. I was pulled over one night by a state trooper because my license plate light had blown out, which is a ticketable offense. (OK, next time I won't pass a slow moving trooper at night.) News to me. We went around to the back of my car. Of course I couldn't see it b/c my car was all lit up from his car's bright lights and Christmas lights. The trooper got me to open my trunk so that I could see that it was, in fact, inop. Boom! I just let the trooper look dead into my trunk...just as quick as that. Whatever wasn't in plain sight before was in plain sight...up close and personal...at that point. Anything seen at that point is fair game. All because I just HAD to see that my light was inop. I got a warning ticket. Moral to the story: make sure all your lights are working and, two, get rid of the body before nightfall.

riiiiighttttttttt... They will just accept it.. Probable cause isnt hard to establish. for example, an officer could smell a presence of marijuana. Even if it isnt present, its very easy for the officer justify a search..
If a police officer is asking you for consent he probably already has cause to do it. Or can easily establish it

When I was a clueless teenager back in the day, I gave someone a ride one time who against my knowledge placed an empty beer can under my seat. I got pulled over one night for "suspicion", car searched, got fined for open alcohol container.

I can tell you from experience, I bought a used car once and found a joint in the seat mounting rail on the floor. **YOU NEVER KNOW WHAT COULD BE IN YOUR CAR!!!** This is why you must not consent to a search, rule #5.
It's interesting that you leave out the most obvious answer to this question... That they can plant something in your car. We'd all like to think this doesn't happen, but it absolutely can and does.

What if you have been on some sort of probation in the past but aren't currently on it at the time they request to search. Does having that record give them the right to search?

PART 1 Many years ago, the police got a letter wrong in a name, of a suspect, the person they were looking for had been in serious trouble. They mistakenly came for my cousin living with me, when they banged on the door I stupidly opened the door thinking it was someone else. I had a their shot gun on my forehead. then my little puppy 3months old barked, the gun went from my head down to the pup (maltese). I grabbed him, if the cop would have shot the pup & my hands would be gone.

id like to comment to those who say "I've got nothing to hide" a couple weeks ago there was a funny picture circulating. a man cat had eaten a bird and he made a headdress for it. although not normally migratory the bird was protected by the migratory bird act. one infraction is a year in prison if the chose to charge by the bird. if they chose to charge by the feather(which the can) that's several 100s of thousands and years in prison. you do have something to hide we all do. you just don't know it.

Probable cause is the requirement for police officials. Suspicion, based on instinct or "gut feelings", does not constitute probable cause. You are right, reasonable doubt is for the courts. Probable cause is the issue that is misunderstood by so many people.
I've said no to a Cop who wanted to search my car before. I was very scared to assert my right not to be searched, but it worked! The cop didn't end up searching my car, even though he REALLY wanted to. I had some things that I did not want him to find, lol.

You *do not* have to consent to that search, either, and the cop can't search you legally unless they have reasonable cause, like they just observed you do a deal on the corner. You want to say, I do not consent to search, am I being detained, am I free to go. If they tell you you're not free to go, ask why you are being detained, i.e. what's their probable cause.
Re: #4 Searches can waste your time and damage your property; as well as cause you bodily harm if they take the contents out of your vehicle and forget or refuse to put those contents back where they were originally found. Friend of mine had a doctors written excuse with him at the time his car was searched. And even though they didn't find anything, they didn't put the spare tire back into his trunk. Ended up throwing his back out. Poor guy.

They cannot assume guilt then treat you like you are guilty. Unless they SEE a weapon, or are searching specifically for someone with a specific weapon (something they suspect was used in a crime that was actually committed), they cannot even do a "quicky" search. Not without consent.
And how do you diffrentiate between a "very quick" and "whole" search, exactly?

Question: if you are a Felon, what are your rights as far as searching goes? When you're a felon and on probation I know you have to let them search your car, but is this true for the rest of your life? Or just while you're on probation?
@95EOB Laws in other countries only apply in those countries. You have to look up laws and due process relevant to where you live.

Please answer: What about the k9 units? I have said no and the cop says hes bringing a k9 unit - then what are my rights? Do they depend on how the dog reacts? I drop food and some dog freaks out they could tear my car to bits or worse, just arrest me based on the dogs reaction right?
What can you do if you are stopped as a pedestrian? Do they need to tell you that you are being detained? Is there a legal threshold for detaining someone? Could I ask an officer "Am I being detained, or am I free to go"? If says I am being detained, what do I have to tell him and what do I not have to tell him?

I'm 21. I do not have a problem with authority. I was a model teenager and have always valued the opinions and approval of my parents and teachers. My issue is with police, and it arose from my encounters with them. I have never interacted with a kind police officer, even though I try to be polite.

You can say no to searches which is well within your rights to do so. However, law enforcement does have the right to search you for weapons as a means of protection for the officer and those around. If anything is found on that search it can lead to searches happening anyway.

Years ago, my dad was a former police chief, years later, as much as I hate to admit it, had an interest in joining a sheriffs dept, went for the try-out, but just about every single one of my constitutional rights were violated, the cops broke just about every law in the book...and there was no help from no one! Bottom line...my hell was all because of mistaken ID!
Friend of mine had the number 13 and a half(1/2) tattooed on his hand in between his thumb and first finger. I asked him what it meant and he said,"12 jurors, 1 judge, and 1/2 a chance.
Don't know in the States but most places, Police have recording devices and must provide the audio in legal cases.
People don't realize that most German Shepard K-9's are trained in Germany. So at the very least you could (in theory) just continually yell out."Nine!" which in the German language translates to meaning, "No". Or if you spoke in German fluently would be even better.
