      virgin even. I was pulled over for
      going 20mph in a fifteen. He was
      sitting in the back of my highlander
      suffering from allergies. Was searching for a tissue and they
      pulled him out of the vehicle and
      tried to scare him by putting their hands on him, roughing him up
      trying to get him to resist. He did
      not. They had to let him go but
      it was totally illegal not to mention
      WRONG. They told me to stay in
      Car and pulled him back out of my
      vision. We didn’t get names or

    I hate it when he says "officers lie because they're just like everyone else." It's like "no they shouldn't be" they have immense power over the ordinary citizen and shouldn't be able to just freely lie and the be blindly believed. They should be held to a higher standard because they have such power and be held accountable because that power shouldn't be abused.

    "Legally, no, you don't have to do X, but if you don't, the officer is likely to get mad and unlawfully arrest you, and you don't want that, so you should just do X anyway." This is some serious victim-blaming here. Who would hire this guy to defend them

      @@omars-qz6rn yes, in Philly I always said if you want to go to jail, get a Public Defender, because they usually have many cases and don't know much about any of them. In this case I'm sure his Public Pretender will throw her all into this, it's a big case, could make her famous.

    Let me sum up: This channel’s advice…
    You have rights…
    BUT, in reality… you don’t.
    Cops gonna do what cops gonna do… just cooperate.
    Sure you have the right NOT to be illegally searched or seize…
    BUT…
    This is how your gonna get illegally searched and seized.
    You realize don’t you, that whenever you say “But” you negate whatever you just said prior?
    You have a RIGHT…. BUT….
    Means, “You don’t have that right.”
    Everything you told me about police officers in this video confirms my opinion that at least 60% of our officers require RETRAINING.
    “Your rights don’t matter. Do as I say and you won’t get hurt/arrested.”
    Yeah… Because cops are never thugs, bullies or tyrants.
    You: “No, cooperate with that, because cops ARE thugs, bullies and Tyrants.”
    At least as I understood your subtext.
    I do appreciate your “let’s be real” approach to encountering law enforcement. But the picture you paint is… “If you haven’t done anything wrong, you are not going to get hurt/arrested. Just give up your right as a private person, it’s OK. If you insist on that right… we’ll… you are going to suffer/deserve the consequences.”
    That is just so discouraging, coming from a lawyer.

    Weak. No, dont be "polite". Be direct and clear and unemotional. "Am I free to go?", "I do not consent to a search." "My lawyer advised me not to answer police questions.", "What is your name and badge number?"

    If you are not required to present ID, then the act of the officer threatening arrest is deprivation of rights under color of law by coercion. If they actually arrest you, then it the same crime but "by force". This lawyer is a danger to our constitution. Also note - whenever you give your ID to police, they will run you through several state and federal databases for warrants. Each time your ID is run for warrants, there is a record of it. Any time you apply for a job or a loan (especially at a larger corporation), one of the things they check for is how many times you have had your ID run by police. Even if it comes back with no warrants, it can still work against you when you apply for a job, a loan, etc.

      @Garry Hubbard Maybe....but it is practical, because confrontation with the police can be expensive in both time and money, even when you are in the right. There are no Constitution angels out there ready to stand over you with a flaming sword as it spirals out of your control. If you are a agent provocateur for the ACLU then have at it. No one's saying you have to allow yourself to be violated by cops.....just don't be a dick just because you don't like police and your day will go a whole lot better.

      Just because our reality isn't ideal, because there shouldn't be consequences for telling Leo to fo, doesn't make his advice incorrect.
      I think he could've saved himself a lot of negative comments by clarifying how it's supposed to be, vs. how it is in reality, and why he gives the advice he does.
      When I advise my kid not to get overly intoxicated, wearing a miniskirt at a frat party, it doesn't mean i think shes asking for anything.
      When I advise my kids that, should they ever find themselves in a situation where domestic violence seems imminent, their best option might be to placate their would be buser, rather than righteously popping off, and telling their abuser what a pos they are. It doesn't mean Im asking them to throw away their rights to make the abuser happy or accept the shitty situation permanently. It doesn't mean I don't think the situation is okay. It means they're in a dangerous situation and there's a way to minimize the risk of harm, and that most definitely would be placating the would be abuser.

      @@MiJaHa it certainly doesn't discourage them. It can be discouraged from elsewhere and in other ways though. I wouldn't advise any individual, especially a young person w no arrest history, that it's their duty to fight that fight, and to exercise their right to be a p.i.t.a. to LE. I'm not advising that they be more than cordial, and mildly cooperative, presenting ID for example.
      I do not take my own advice. I "got the stink on me" when I was young. I'm almost always uncooperative and rude when I know a LEO has nothing on me. Due to that, I have 5-6 disorderly conducts, and plenty of arrests where the charges are dropped on Monday, or the officer doesn't show up to trial. If they get my ID and see my record, or know me, the likelihood of a bs arrest increases.
      Strongly suggest avoiding getting the stink on you.

    Isn’t it terrible that you’re not required to have an ID or present and ID to an officer in the United States but simply because you exercise that right, you can get arrested and still face huge consequences and permanently being in a system where the only thing that people see is that you have been arrested. I’m not saying I wouldn’t show my ID to avoid that, I definitely would, but definitely not because that’s the way things should be.

    If police were punished for punitive arrests they would not arrest you in retaliation for being rude! It’s a training issue train the police from the start they choose to be police they weren’t drafted against their will they volunteered and are being well paid for their service teach the police that if they arrest someone it had better be for a crime. If there not sure then detain them in the backseat of the cruiser until you get the information to determine if a crime was committed because again rudeness is not a criminal act but trying to ruin a citizens reputation in retaliation is a crime itself! FREE COUNTRY!

    I got into trouble once, some 40 yrs ago. The cop picked me up and put me in his car. No hand cuffs. I was scared shit less, I spoke not a word. On the way to the jail. We have all heard that you have the right to remain silent. So, on the way this cop asks me all types of vile questions. And tries to claim I was some kind of psycho.. We get to the jail where two other cops are waiting. The cop that brought me to the jail opened the door and told me to get out. So, I did. Then tells me to face the wall. When I did the other two cops grabbed me and slammed me head first into the wall. Then they grabbed my arms and bent them behind my back and slapped the cuffs on so tight they cut into me. After a few slams to the head they took me into a holding tank. I sat there for eight hours until I was bonded out. After wards I was told I had to come back and talk to a detective. I was told to be honest with him and everything would be OK. So I go in and this guy starts accusing me of all kinds of things that never happened. It was not until recently I learned that in order to take the fifth. You have to talk to the cops and tell them that is what you want to do. Learn from my mistake keeping quite will only get your ass kicked. I wondered why they treated me so rough for years. I never resisted or made any trouble.

    This is bad advice. Being arrested is a problem, true, but you shouldn't waive your rights to prevent an unlawful arrest. Stand your ground (verbally/legally) and if they arrest you, don't resist and hire a competent lawyer. They will tell you how to fight an unlawful arrest, how long that can be stored and how to request your arrest record to make sure it was deleted everywhere.

      that's because in reality police have their own laws ... your are guilty ( that means you can be arrested) until they/you can prove that you aren't .. .. you were proven innocent of your original crime but well u resisted arrest so that's your crime now!... interfering with investigation they call it I believe .. makes sense right .. lol.. lol

    We don't owe them any subservience. That's the problem now. They're more committed to getting responded to like dictators that employed public servants who took oaths they swore to uphold.
    Actually, the onus is on them to be polite, courteous, and respectful. For several reasons. Whether we choose to or not.
    This idea that we need to bow to cops for fear that they'll abuse their authority and violate our rights if we don't is absolutely ridiculous. You talk to them how you choose to.
    The only thing he was right about is the fact that the cowards will go rogue when you don't bow to their imaginary authority.
    THAT'S what needs to be addressed. Not this idea that encouraging tax paying citizens who employ these homegrown terrorists to cower in fear to them is the best path forward.

    I have not been pulled over for years the last time it was harvest and the combine broke down. I was running 15 mph over the limit and had my usual .44 on my hip. The officer was not able to turn around brcause of traffic. Our highway has no shoulder and is dangerous. I saw his lights go on so found what I thought was a safe place pulled over to wait for him. When he pulled in behind me I asked right away if he was safe were I pulled over. It turned out I knew him very well and in fact often talked guns with him. When I informed him I had my gun he reminded me he knew just what I carry. No trouble I got a really strict warning and then he asked if he could use my gun range of course I said yes. If I was not polite and honest I told him we had a harvest breakdowm anf I had panicked worrying about the crops.

    I respected your father. He was a great sheriff. When I was a little boy my dad was a police officer and when your father was running for sheriff we would go down to his campaign headquarters and put signs together. A lot of officers were there helping. It was fun and I learned a lot about your father and the good he did for our community. And his son is doing the same. Thank you.👍

    I was stalked by a man for almost two yr. I was going to a soup kitchen that allowed this man to terrorized women and I was stalked by this man and harrassed by his daughter. 8 times l had to get protection order for him to leave me alone( I told him that I didnt want a boyfriend, l was married for 24 yr). the last time I was in court - he tried to get the protection order admended/ stopped( again)- and his daughter kept calling the police and had me arrested. I was already leaving and the 2 police officers grabbed me (I use forearm crutches to walk because of a broken back). I calmly said that l had not committed a crime and that l have a back and neck injury. When they pulled my purse off my right shoulder and body- they dislocated my neck. I was booked and fingerprinted while in excruciating pain. I promptly went to my neck doctor to get my neck realigned and filed a complaint against the two officers. The state lawyers agreed that l had done everything possible to protect myself from this stalker.I was found innocent of the incident. Noticed the officers lied on their report to cover their inappropriate actions. I cringe to think that now l have a record of being arrested. I have no criminal history

    If I'm minding my own business then there no reason for an officer even speaking to anyone. But, they get bored and the go ' fishing' but, no one seams to tell the cops what to do. Why can't they honor the oath, do there real job to protect and serve instead of making arrest out of nothing!! ALWAYS RECORD THE POLICE NO MATTER WHAT. Lawyers take oaths to the government 1st not the people.. Every single police officer does lie and lie to make arrest!!

    Rule #1. OBEY! COMPLY! or Die! when confronted by a "King's man". When (IF) you get to court then *maybe* you can present your doubts, If the court has time to listen. Seizure and searching computers and mobile phones are violations. RARE is it that a Kop can get a search warrant for specific information to seize, they get a warrant to FISH for anything they can charge.

    If you're arrested for standing up for your rights, the arrest will not stand up in court and wouldn't be used agaisnt you when looking for a job or could it cost you a job. Any lawyer thart would tell you to speak with police officers or i.d. without being placed under arrest, or voluntarily allow them to search yourself, your car, or home is an idiot and not a good lawyer.

    "Swallow your pride u say" more like "swallow your human rights held up by the Constitution. Swallow your rights, liberty, and justice." That's why police violate the Constitutional rights of the public and commit unlawfulness. You can refuse to show ID or show them yrs if they agree to show u their legal ID as well. If they're not comfortable with that then y should u b. or to speak to them. And uphold hr rights that are enfored by the Constitution, that they won't and still be calm and respectful and show integrity at the same time. Don't be bullied. We need to start holding the government accountable for violating the Constitution that they are 1st and for most suppose to protect and inforce. And if any laws violate those rights they are void. If we don't start making them be accountable and start inforcing law constitutionally and stop allowing them to treat us like they're masters were slaves to and not the servants to the public then we're shortly going to be a police state. If the people who gave them the authority don't hold them accountable for tyranny then who will? Its our fault its gotten this bad for complying to whatever they say and rolling over and not up holding our rights to be met and letting them bully us to complyence because they do what a bully does and make things harder when 1st standing up for yourself. But till we stop n in force our rights every 1 to b upheld and stop complying and submitting and start making it not worth the burden for them to try to violate those rights so its no longer worth it to them to try to bully. It will not stop and will and is getting worse. It won't be a short game and it may be a longer in counter than it would b if u just did what ever the fuck they want but making law constitutional again and protecting against violation of our rights isn't that worth it. Its principal.

    @4:06: There's quite a bit of excuse-making for unjustified bullying and invented pretexts for searches or uses of force. You seem to excuse all searches as reasonable as long as an officer can invent a suspicion--e.g., bulges in clothing, "furtive movements" (real or imagined), hands near a waistband (you know, where hands usually are), etc.
    This is the strange inconsistency of conservatives who are both "anti-government" and obsequiously deferential to authority. I just don't follow the legal theory of a defense attorney who pre-emptively excuses violations of civil rights... unless he's just a cynic/ pragmatist who thinks civil rights are better thought of as mercies from our betters if we cower and snivel appropriately.
    You're seriously talking about cops as if their power resides in veiled or implied threats, not in legitimacy, and it's not clear what conduct from them you wouldn't excuse. Should I ever need one, that's not the sort of defense strategy I'd want.

      This guy clearly says to never talk to the cops under any circumstances. From his perspective as an attorney, if he was defending someone, he cannot say that the cop is outright lying, rather, he is informing us that cops will say things such as that "real or imagined"; eg the bulge in one's pocket.

    My standing policy to dealing with cops - I give them my full legal name and social security no. & then go mute. I respectfully decline to answer any questions, not even innocuous ones like, "Where ya comin' from?", etc.

      You don't even have to give them SSN, they've no right to that as a non-federal agent (I don't know if you're required to show someone like the FBI the SSN, but definitely not some lower tier copper), just only that identifying information legally required. The law does say that you have to verbally claim your right to silence. "I claim my right to silence, I decline to answer any questions" or "I invoke the 5th Amendment" ought to be enough.

      You're an idiot. Under Section 7 of the Privacy Act of 1974, neither federal, state, nor local government agencies, including police, have any legal authority to demand your SSN, and they may be sued under 42 U.S.C. Sec. 1983 for monetary damages, injunctive relief, attorneys fees and costs of suit. Giving up your SSN is giving up your valuable right to not disclose it to police. Don't ever give your SSN to a cop before consulting with a lawyer to determine your rights.

    If approached, or stopped I always start out friendly with, "Hi officer, how can I help you?"
    That suggests I'm friendly and intend to assist. That puts the office at ease. If driving I have my license and hand it without being asked. We ARE required to show it if driving.
    If asked to show proof of insurance, I say, "The papers are in the glove box, my neighbor, the sheriff, told me not to be digging in there when you were walking up. With your permission, I'll get them out".
    That sends the message I am friendly to law enforcement and my neighbor is the county sheriff.
    A skeptical officer might decide I'm making all that up so I have his name and address which shows he lives close by.
    I don't speed, I use my cruise control so it's always some other reason if I get stopped. I have not had an encounter in many years except for a burned out headlight. That only merits a warning which is nothing so long as you fix it.

    Police are allowed to lie, but if you lie to them it's a crime so your best bet is to keep the conversation to a bear minimum and if they start asking a bunch of questions, remain silent --5th amendment-- and if asked don't agree to anything especially if you are innocent

    You are only expected to identify yourself to Florida law enforcement officers (police officers and Sheriff's deputies, not immigration or FBI agents) when you are stopped on suspicion of a crime or a traffic violation. If you don't have identification documents, you may choose to remain silent.

    keep your cellphone locked. it's your life. whether cop, girlfriend, mother, etc., anyone will find something in it to complain or bust you about no matter how innocent you think you are. as a tech guy, let me remind you to only use a PIN code unlock. that's best along with an automatic wipe after like 10 wrong tries. a PIN depends on your memory and consent for access. if you use face or fingerprint unlock, these can be taken from you by force. a PIN requires your conscious decision for access. you're welcome 😎

    The personality traits of the individual officers come into play, as well. If officer candidates do not undergo sufficient psychiatric screening, specifically for traits consistent with Cluster B personality disorders before the badges are passed out, then the local community is in for a world of hurt.

    I fish while open carrying a pistol here in Florida because I am allowed to do so. Florida Statutes Title XLVI crimes 790.25 (3) (h). The local police don't like it and become confrontational because they don't know the law, and some idiot calls them and says there's a man down at the river with a gun. So I have to correct them and show them a copy of the law which I bring when I'm fishing. I don't have to ID either unless I'm being detained or arrested. They tell me I have to ID and I tell them no I do not. If I am arrested, qualified immunity is not going to help after I've given them a copy of the law, and they've called into their local station.

      What he is saying is that some cops lie sometimes, not all cops lie at all times. There are 1000x more honest cops than dishonest, it is just that today, with everyone surveiling cops, the dishonest ones make the news more; you almost never hear about the honest ones because they don't bring in viewers or readers.

    i do things a different way.
    when i am told to do something by a man acting as police officer, i simply ask him if what he wants me to do is his wish and order.
    9 out of 10 times the reply is "yes".
    i then fulfill the man's wish and order.
    and here's where the problem comes in for the man acting as police officer.
    The man is acting under oath to the Constitution of the United States of America, and as such is bound by its stipulations including the 13th amendment, which reads as follows:
    Section I: Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.
    as the man acting as police officers diminished his capacity to that of a public servant of the people, and he is ordering a man or woman of the people to do something, the one giving the orders is required to pay fair and just compensation.
    i am not your slave, you are not my master.
    So when asked to produce a license, car insurance, etc. not a problem, i would be more than happy to fulfill your wish and order.
    if i am given a ticket or a fine of some type, that serves as the basis of the charges that will be on the itemized bill that will be sent to the man or woman acting as police officer at the police station, a copy sent to the chief of police, and a copy sent along with the ticket.
    one order to produce drivers license: $150.
    one order to produce car insurance: $150.
    one order to place hands behind back: $5000.
    one order to get in police car: $10,000
    etc.
    Of course i don't tell the man or woman about the fee schedule or anything. i'm polite, and not rude, i don't get into arguments.
    If you go to a fancy restaurant and there are no prices on the menu and you order the most expensive bottle of wine, and are handed a $5000 bill, you best believe you're liable for said bill.
    caveat: all of this is done under the presumption that no harm injury or loss has been caused to any man or woman or their property.

    Times we live in is changing for the worst. We have democrat liberal officials, whole police forces that not only hate this country as founded ,have no respect for the constitution they swore to uphold. They despise civil rights. It may have proper to cooperate with authorities and over information to assist these authorities in the distant past. Not this day and age. As raised , I will always treat an officer with respect. But that is all. No voluntary information. I will not agree to searches. And invoke my right to remain silent

      thats how the law reads ,as it is today in almost every court RAS is 100% subjective to the officer ,even though the SCOTUS has ruled numerous times that exercising ones rights (4th A) cannot be deemed suspicious they will do it anyways and get away with it

    Apparently he thinks you must allow police to violate your 1st, 4th, and 5th Ammend rights..but do it politely. Cops are loathed by many because they are in reality, poorly educated, angry people. The videos we see daily of these thugs should be enough to convince anyone.

      I think that he's saying many people become confrontational when they don't need to. You're dressed in black, out for a walk at 3 AM and cop says, "Watchu upto?" and you say, "Buzz off copper," expect some pushback.
      The other day, a cop pulled up as I was walking to my door. "Do you live here?" I could have said, "Buzz off copper!" but I said that I did and he asked me if I had seen a U-Haul at a neighbor's house.

      Gold Winger you do not even need to reply..but being arrested for being assertive is nonsense. An arrest is expunged when cops know that a court case is impending.. My daughter has made a great living litigating cops...her stories regarding them are shocking. We are not dealing with the upper crust of America..they are devious beyond comprehension

Sure you may get it expunged eventually(if that's even really possible) but it still costs. And there in lies your contradiction.     I'm still wondering why there were no repercussions from the Boston PD forcing people out of their homes at gunpoint and conducting warrantless searches for the "Boston Maraton Bombers". The cops "claim" that they asked permission to search, they asked while pointing evil black rifles at the residents. Would they have walked away if someone had the balls to say, "Get a warrant." Probably not because to the police, refusal to allow a search is probably cause for a search.
