I partly agree with you but the entire system is broken (the veteran, the spouse, the VSO, the RO, and the BVA). I have been a VA claim benefits volunteer for over 10 years and attend a VA weekly meeting (for over 10 years, now 40-50 veterans and spouses because of COVID) and these are a couple of things I noticed: Some veterans and spouses are doing a poor job in communicating (telephone, text, or email) with the volunteers. They don't realize the VA claim process can be a lot of work and some give up. They need to try their best to be familiar with the VA claim process. Some VSOs and VA adjudicators are a work in process. Some of the long wait time could be avoided at the RO and BVA, if we take the time and get educated. On a different subject, the Intent to file for Compensation, Pension and DIC is a great tool and I am surprised the VA has not canned this process. Just think, we have an entire year to get educated and not frustrated on the VA claim process and if the claim is granted we may get some retroactive pay. What a deal!
Been waiting for my appeal decision for 3+ years. 50000 appeals ahead of mine. I would rather do a reconsideration rather than an appeal. I'd like my money now before I die. Not too concerned about back pay. Award of back pay means nothing if you die before the appeal is approved.
How were you able to see how many appeals were in front of you? I used to have that option in the VA website but it doesn't show up for me anymore. Any ideas?

If a veteran has one year to file their appeal, then the same should apply to the Veteran's board to make a decision in one year as well. Also a veteran going through this law firm findings are ...IN THE UNITED STATES COURT OF APPEALS FOR VETERANS CLAIMS...JOINT MOTION FOR REMAND...The parties agree that vacatur and remand are warranted because the Board erred by failing to provide an adequate statement of reasons or bases for its decision. Still waiting for Board decision on appeal since 2017. I suggest you interview Veteran's on their experiences and follow the process!! Time to put the VA board to work 5 days a week 8 hrs a day and not just meet once a month.
I am a CCK client. The best decision i've ever made. Yes, it may take the VA an unreasonable time to make a decision on my appeal. But I have 110% confidence in CCK's efforts to stay on my case and succeed. Having CCK representing me has allowed me to be patient. In the end the United States goverment will be held to account and provide to what I was promised when I took the oath to serve our great country. Thank you CCK. This all makes me very glad I chose Higher Level Review. It took me from 30 to 70% for PTSD in two months, which prompted a duty-to-assist error on their part for a new claim for TDIU, which took five months to be approved. I did have a strong case, with all the evidence in my VA and in-service records, but if I were up against this against, today, I'd still recommend HLR - I mean, even if it's denied, you only would waste a couple of months, but the chance it could save you years of just waiting would seem worth it, to me.
USN Desert Storm Vet, currently 80% PTSD denied for 100% several times, now waiting for BVA video conference, have all the right medical records from private phycologist, nexus, etc. was told it could be 18 months or longer for BVA video conference. Why does it take so long for these hearings.
I've had my AMA Evidence Docket appeal at the BVA waiting to be seen by a judge since June 2021. I see it in front of a judge at least by Feb or March 2023. I hope.
This may be stupid by some, but if your a Veterean and or a wounded Veteran, I've always tought that the VA/GOV, should make you 100%, for as much taxes we pay, and how much they print, and give to other countries?, VET's , should be at the front of that line. I've been waiting on my appeals docket, I applyed Nov, 2019 coming up on 3 years now.
My claim was denied in 2020 and I find it suspicious that the contracted doctor didn't even call - just denied claim. I filed an appeal and that is approaching 2 years...sad
Im currently 685 days waiting at the BVA in the evidence lane for only 1 appeal on General Anxiety disorder that's currently at 70%. I'm at 90% and put in for TDIU December 16, 2020... All the VA website says is waiting on a BVA judge! Its a ridiculous process! 685 days is way to long!
@@bryansims9969 It just moved to "on a judges desk" April 2nd. I see alot of claims at the BVA did the same recently. Im reading on Reddit it could take 10 days or 6 months on a judges desk. Im still waiting.

Here is my opinion on this subject: the veteran should be allowed to hire an attorney before he/she files that 1st claim at the VA RO. ( This point has been mentioned 1000 times ) The Administrative Procedure Act might help veterans in this issue. If I file a claim with SSA admin, or Worker’s Compensation claim or even Immigration office, a person can have an attorney assist them…why not veterans. Closing…I filed my first claim for PTSD in 1976 ( original claim ), I have filed a total of 5 claims from 76 to 2018. I have PTSD, my case is currently at the BVA. Best advice to anyone reading this, study/ read case law and court opinions, teach yourself, be your own advocate. Then when you contact law firms like CCK for representation your chances of winning your appeal or 100% service connection are greatly enhanced.
I'm firmly convinced the VA Makes Mistakes on PURPOSE, just to deny claims another way...running out the clock hoping the Veteran dies before resolution. Congress needs to SLAM the VA into the wall and fix this crapola!

I filed a Request for reconsideration On January 31st immediately after the closing of the "Legacy " period on the preceding December 31st. My request for reevaluation was based on all the errors and procedural failures VA agents had made in analyzing my disability request. The request was not re-evaluated by the examiner, it was sent back to the original source and wound up in this huge group of unresolved applications. At 1st I thought "oh no, if only I had filed one month earlier". It looks like I might as well never have filed at all because I am now nearly 80 years old -- So, like so many others have written before, I guess they are waiting for all all of us to die off! I agree with what Fred Locke (see below) has to say about being able to appoint an attorney before filing an appeal to VA RO. P.S: Before I appealed to the RO I sent my stuff to CCK. Their agent told me they "could not take my case at that time, but that I had raised some very good points in my arguments to the RO" -- Oh Well! I do appreciate all the info I have received from SSK about VA problems via email since then.
Begs the question. If the VA keeps a needy veteran with no income for treatment options due to no income in appeals for years and the veteran dies as a result of not receiving benefits to get treatment… can the remaining families SUE the VA? Seems like they would be able to.

Is it better to submit a form va form 10182 Direct review by a Veterans Law Judge while you are waiting on an appeal without new evidence in order to get your wait time reduced drastically? I have a legacy appeal. I have a docket number. On the BVA website, under "search decisions" there is no record of my case when I enter my docket number in the search bar. Is there a way to find what is currently happening with my appeal other than signing in and reviewing my claims with a 65,000 place in line? Is that an accurate number pertaining to my legacy claim? I have been regularly checking that number and recording it. The average number of cases resolved varies at approximately 150 a week. I have an appeal from early February 2019 and already had a virtual hearing. According to the math, I have another 3 years to wait for my legacy appeal decision? My claim was granted showed favorable but denied due to not having a nexus. Got the nexus. Resubmit in appeal with attention evidence. How long will it take if thats all what they need. Can I submit new evidence related to my claim while I wait?
Putting these new AMA “options” and regulations into the VA system is like putting a fresh coat of paint over a rust spot. Sure, it looks great now but, unless you cut the rust out and repair the real problem, it will just cover the REAL problem.

One of the issues that the VA is not taking action on that is really disappointing. Why doesn't the VA look at the claims in the legacy/AMA appeal process that are now presumptive conditions with the passage of the PACT act? The VA could really take lead and demonstrate their care for the veterans thru their actions and speed up the process for, I would dare to say, a majority of the denied claims are related to these Persian gulf war illness related conditions that the VA had been denying prior to the PACT acts passage. So with the PACT acts passage, there are veterans like me with appeals sitting in line with the board of appeals, that are now presumptive conditions. I have been denied for two now presumptive claims that VA actually used my first denied sarcoidosis claim in 2015 to justify denying the second asthma claim in 2017, which doesn't sit well. When claims are disapproved, notice of disagreement, appealed, remanded once, maybe twice and then be placed into the back of the docket line for the board of appeals, so five or more years is in my opinion an unnecessary amount of delay for claims anyways, but with the PACT acts passage many of these claims are now presumptive, so to continue to wait in the board of appeals line is like rubbing salt in your wounds. So, wouldn't it be great if the VA, put together a team that would review the legacy/AMA appeals and for the claims that only contain presumptive conditions, approve them on the spot. Just a thought.
Myself and my county VSO did the NOD after my initial claim got denied. We did the evidence docket route for AMA to the board for a PTSD Claim, in regards to a sexual rape that had happened to me in the service by an NCO. The overwhelming evidence and witnesses statements is clear cut as it gets. I have current diagnosis of PTSD from my private care provider & prior VA healthcare treater. My case has been at the board since July 06, 2020. Myself and My VSO have heard no new updates on the case for quite sometime. No updates on case flow management he can see. I took it upon myself to reach out to my local congressman within my district to do a “congressional inquiry.” My congressman agreed to help out and expressed remorse and wanted to help anyway possible. After doing congressional inquiry asking for status update of the case just to find out where I’m at in line. April 29, 2022 the Chairman received it. I received a copy of the response from my congressman from the (now) former Chairman of the board Cheryl Mason on May 11, 2022. It was the same response as the VA website. That it’s pending review by a VLJ. Absolutely disappointing news and overwhelming not more information was provided. Such a disservice and not having any closure. My congressional inquiry however was noted it be attached to my file with the appeal we did. As of today 9/21/2022 at 02:05am Est. I still haven’t had a VLJ looking at the case. It’s been over 2+ Years of it not being looked at. Hope no one goes through the same struggles as I did. Additionally, hope this provides some time line comparisons to others that are waiting. I will continue posting updates and my story for other veterans who look in the comments section for timelines and where other veterans or at in their possible similar process. My personal opinion recommendation if it’s been a while you been waiting, one thing that could help give more or maybe none for clarity that CCK didn’t mention is do a congressional inquiry.
@@gij0e83 Saw your comment. No new updates with the case according to the VA Disability Appeal Tracker as of Feb 01, 2023. Still says “Your appeal is waiting to be sent to a judge.” My Veteran Service Officer Director did a AOD-Advance on the Docket Request on Jan 18, 2023 for “other sufficient cause.” Awaiting on that decision but we just recently requested that. If we do not hear soon from them on either matter, we will be doing another congressional inquiry for the 2023 year.
@@famemilitary1653 I did a congressional inquiry last October. Was told by my congressman that the VA is working on appeals from September 2019. No one is able to give me any information on where I am in line. This would be good information for veterans if we knew where we were during the process. I hope your appeal gets seen soon.

Can someone help me? I submitted claim for increase on service connected claims, I also submitted for secondary claims and gulf war claims. So far, i have finished the CP exams for the increase claim. I am still working on gathering evidence on for the new claims and secondary claims. Will the VA make a decision on my claims I finished the CP and adjust my rating. Or do they wait until ALL my claims are done first?
I worked at HQ's VA in Washington DC from 2014 -2020. I can tell you 100% of the staff there will tell you never to appeal. Your appeal will go into the black hole and never come out. In DC, it's easier to just send out a form letter denying your appeal with just enough technical language to make it appear like effort was put into your appeal. Re-submit your claim with new material information if you have it. If not, move on. I'm not saying the lawyers representing you are bad, but it will cost you dearly. They are in it only for the money. Sometimes it works and sometimes it doesn't. Your choice.
I'd like my money now before I die. Same here still waiting until I'm 6 feet under (NFL) Not For Long then what? That's the Board of Veterans' Appeals strategy. Next!
I learned almost nothing. Big waste of time. At least they didn’t try to get me as a client. The va has made no progress in the 2 months I have had my claim in. My 3 doctors made their evaluations in less than an hour. Step three should be done in a few minutes.
If the VA regional offices where doing a better job of determining claims. The BVA wouldn't have such a terrible backlog in cases to decide.

How do you know you have 50000 people ahead of you? Where do you find that information out.? My appeal has been at BVA since May of 2019.

They should have a timeframe of one year with an automatic approval if not reviewed at max payment. I bet they'd review them all then.

There no incentive to pay you out. You can always file another claim , secondary , etc.

I'm in the AMA evidentiary lane and it's been 27 months with little to no movement. When I submitted they claimed it was a 1 year wait time.
Got a letter in the mail today from the VA apologizing for the delay.
Really, never seen one of those in over 10 years of dealing with the VA!

I used to get those letters in early 2000s. Yes, the VA stopped sending them over 10 years ago.

What about “correcting an error” that was identified by a senior reviewer?
October of 2018, sent in an AOD in June 2022. Neither on is decided. PS: 37483 on the Docket!

If you are 93 - 94% disabled is the VA more apt to take longer with a claim that will put you over the 100%?
Huh?! Disability is rated only in increments of 10. If a vet said they had a 93% disability rating, I'd assume he wasn't really a vet.

One of the issues that the VA is not taking action on that is really disappointing. Why doesn't the VA look at the claims in the legacy/AMA appeal process that are now presumptive conditions with the passage of the PACT act? The VA could really take lead and demonstrate their care for the veterans thru their actions and speed up the process for, I would dare to say, a majority of the denied claims are related to these Persian gulf war illness related conditions that the VA had been denying prior to the PACT acts passage. So with the PACT acts passage, there are veterans like me with appeals sitting in line with the board of appeals, that are now presumptive conditions. I have been denied for two now presumptive claims that VA actually used my first denied sarcoidosis claim in 2015 to justify denying the second asthma claim in 2017, which doesn't sit well. When claims are disapproved, notice of disagreement, appealed, remanded once, maybe twice and then be placed into the back of the docket line for the board of appeals, so five or more years is in my opinion an unnecessary amount of delay for claims anyways, but with the PACT acts passage many of these claims are now presumptive, so to continue to wait in the board of appeals line is like rubbing salt in your wounds. So, wouldn't it be great if the VA, put together a team that would review the legacy/AMA appeals and for the claims that only contain presumptive conditions, approve them on the spot. Just a thought.
If the VA has to review any medical evidence it will take forever. I have had decision on claims back in 3 weeks to 6 months.
Myself and my county VSO did the NOD after my initial claim got denied. We did the evidence docket route for AMA to the board for a PTSD Claim, in regards to a sexual rape that had happened to me in the service by an NCO. The overwhelming evidence and witnesses statements is clear cut as it gets. I have current diagnosis of PTSD from my private care provider & prior VA healthcare treater.
My case has been at the board since July 06, 2020.
Myself and My VSO have heard no new updates on the case for quite sometime. No updates on case flow management he can see. I took it upon myself to reach out to my local congressman within my district to do a “congressional inquiry.” My congressman agreed to help out and expressed remorse and wanted to help anyway possible.
After doing congressional inquiry asking for status update of the case just to find out where I’m at in line. April 29, 2022 the Chairman received it. I received a copy of the response from my congressman from the (now) former Chairman of the board Cheryl Mason on May 11, 2022. It was the same response as the VA website. That it’s pending review by a VLJ. Absolutely disappointing news and overwhelming not more information was provided. Such a disservice and not having any closure. My congressional inquiry however was noted it be attached to my file with the appeal we did.
As of today 9/21/2022 at 02:05am Est. I still haven’t had a VLJ looking at the case. It’s been over 2+ Years of it not being looked at. Hope no one goes through the same struggles as I did. Additionally, hope this provides some time line comparisons to others that are waiting. I will continue posting updates and my story for other veterans who look in the comments section for timelines and where other veterans or at in their possible similar process. My personal opinion recommendation if it’s been a while you been waiting, one thing that could help give more or maybe none for clarity that CCK didn’t mention is do a congressional inquiry.
Any updates? My Evidence AMA is still waiting to be sent to a judge. Same status since Feb 2021.

Saw your comment. No new updates with the case according to the VA Disability Appeal Tracker as of Feb 01, 2023. Still says “Your appeal is waiting to be sent to a judge.”
My Veteran Service Officer Director did a AOD-Advance on the Docket Request on Jan 18, 2023 for “other sufficient cause.” Awaiting on that decision but we just recently requested that.
If we do not hear soon from them on either matter, we will be doing another congressional inquiry for the 2023 year.
@@famemilitary1653 I did a congressional inquiry last October. Was told by my congressman that the VA is working on appeals from September 2019. No one is able to give me any information on where I am in line. This would be good information for veterans if we knew where we were during the process. I hope your appeal gets seen soon.
@@gij0e83 Good to know. More let down for veterans cause they don’t provide transparency. At least they gave you an approximate what month and year of dockets they working on. Hope yours goes good as well.
Can someone help me? I submitted claim for increase on service connected claims, I also submitted for secondary claims and gulf war claims. So far, i have finished the CP exams for the increase claim. I am still working on gathering evidence on for the new claims and secondary claims. Will the VA make a decision on my claims I finished the CP and adjust my rating. Or do they wait until ALL my claims are done first?
Hi, from what I heard, they have the ability to decide an individual claim while the others are still pending.
I worked at HQ's VA in Washington DC from 2014 -2020. I can tell you 100% of the staff there will tell you never to appeal. Your appeal will go into the black hole and never come out. In DC, it's easier to just send out a form letter denying your appeal with just enough technical language to make it appear like effort was put into your appeal. Re-submit your claim with new material information if you have it. If not, move on. I'm not saying the lawyers representing you are bad, but it will cost you dearly. They are in it only for the money. Sometimes it works and sometimes it doesn't. Your choice.

I’ve been on the direct docket appeal since November 2020 with no status on a very easy presumptive condition.

Very depressing.
I learned almost nothing. Big waste of time. At least they didn’t try to get me as a client. The va has made no progress in the 2 months I have had my claim in. My 3 doctors made their evaluations in less than an hour. Step three should be done in a few minutes.
