You guys should sue UA-cam for "adding context" by linking a Wikipedia article to The Sovereign citizen movement, which is basically considered a terrorist organization by the government. Have never seen this before but you obviously are not. This seems like the states way of cracking down on people who both know their rights and film the police while exercising them. @@TomTom-du5qv it's most certainly intended and I would expect to start seeing it more and more under any videos that are critical of police interactions with non-violent citizens standing up for themselves while video recording the interaction.

UPDATE KIND OF: Hello again everyone. I have seen all of your inquiries about an update on my case. Unfortunately there has been nothing to report on since I last updated you. We are still waiting on a rulling from the 11th circuit. Patience is key here as it could take several more years for this case to be resolved. I appreciate all the love and support you all have shown me over the years. Rest assured we are still fighting

As many of you know, a federal judge stripped the pasco county sheriffs office of qualified immunity in the case of my illegal arrest in 2018. Rather than accept they were wrong, the sheriffs office exercised a provision of the law that allows law enforcement to immediately appeal the decision on a motion even before the lawsuit has concluded. This has allowed them to delay the lawsuit for yet year. But today is the day. The United States 11th circuit Court of appeals will hear their ridiculous appeal and, if they follow the law, strike it down and let my lawsuit finally continue.
It has been 4 years since the pasco county sheriffs office illegally chained me up and threw me in a cage. The despicable way in which they have evaded taking responsibility for their misconduct is indicative of the fundamental problem with policing in America. Law enforcement is tasked with holding citizens accountable for their misdeeds. How can any citizen take law enforcement officers as anything but hypocrites when they (law enforcement) deploy every tactic possible to sidestep accountability for their own crimes.
Hopefully today, the court of appeals will send a clear message to officers nation wide. "YOU ARE NOT ABOVE THE LAW. YOU ARE RESPONSIBLE FOR YOUR MISDEED. YOU WILL BE HELD ACCOUNTABLE."

POLICE are not above the law. POLICE will be held accountable. if that could somehow become the main message from the public to the officers, it would be a beautiful thing. Because you’re right, so often, most often, they are not held accountable. The hypocrisy of the system is maddening. If a citizen makes a “mistake“, they pay for it and arrest, fines, seizure and incarceration. If an officer makes a “mistake“, their consequences aren’t nearly as dire. I have most often seen verbal warnings, extra required sensitivity training and mandatory leave of absence WITH PAY. How is this fair? This forced hero-worship ideology has got to stop.
Please give us an update, can’t find anything online and I’m hoping everything resulted in your favor! Also, hoping your dad is OK. He seemed pretty rattled about this whole thing.

Thank you for pushing back on this! Most people give up. I was arrested for “obstruction “ because I was video tapping the police and they ended up breaking my knee. No charges were ever filed against me and I now have multiple lawyers wanting to take my case. They must feel good beating up a 50 yr old grandmother. I know it’ll take years but I want justice!

UPDATE: The Judge has set a date for oral arguments in the sheriffs appeal to reinstate the qualified immunity that was stripped from them in the lower court. June 6th is the tentative date. If successful we will then return to the federal district court to set a date for trial.

When I went thru the police academy in FL they specifically asked us if a car is fleeing and they stop and 4 people bail out and run on foot who do you go after. The answer was just the driver.

They escalated a traffic stop to a drug search all because the passenger wouldn’t identify himself. Such an abuse of power.
The much bigger abuse is that the cop was denied qualified immunity. So the state is appealing that, even though it is clearly established law. It has been dragged out for years. Years more it will take, all at taxpayers expense. They will likely spend millions on this little case of fucking with a passenger to unlawfully obtain his ID. Welcome to the shit show
The father saying that he doesn’t want to go to jail says a lot more about the police corruption that he believed he could end up in jail for doing nothing wrong.
When his dad said that, the cops took that as some sort of admission that somebody was guilty of something.

@@TheSupervillain316 In the UK (where I am based) the police don't make the decision, the prosecutors do (the Crown Prosecution Service). I believe it is different in the USA?

Prosecutor was trying to do some damage control for the sake of the county and the lawsuit that would follow. A prosecution would help on the lawsuit but seeing it was dropped (i’m sure for lack of probable cause), the lawsuit will be a slam dunk for the rapper. Plethora of case law from the Supreme Court to strip them of their Qualified Immunity

A reaction like that would just leave us with no police at all. They need better training and appropriate (not determined by internal investigations) accountability and punishments but firing them outright will no solve anything.
And they should be held personally accountable in court.
I'd actually disagree. Watch enough on this channel and you'd see just how easily it is to stray into violating rights. Policing is not an easy nor a largely sought after job. Those that actually do seek it out should be encouraged to stay at the job, but only if they can continue to show progress in doing the job correctly.
That was a great one, I’m glad he articulated his concerns so well, and I’m sorry he had to get cuffed and put in a cell to prove a point. I really hope he gets a large settlement from the sheriffs Dept. He deserves one !
It's amazing to me how anyone can resist arrest when there is no lawful reason to be arrested. Ignorance of the law is no excuse is what I've been told by officers. Seems like the same should go for them.

I wonder if it would be helpful in court later if people were to carry some cards that list the 1st, 4th, and 5th amendments along with a brief interpretation, and then people could read them to the cops and then give them the card and tell them, just so you know, you have lost your qualified immunity by knowingly violating my constitutional rights under color of law. I have it on video, so when I sue you personally in court, you will not be able to claim ignorance since you have been informed verbally and in writing of the relevant rights and laws.

Exactly - imagine the son in this encounter were wrong about the identification law. Would the officers or the court accept a "he was misinformed about the law" as a compelling reason to drop charges? Somehow I doubt that...
When they pull you over for a. traffic infraction they should not be allowed to dig for other violations unless those violations are right in front of their faces. They should not be allowed to order people out of cars to search for drugs when drugs had nothing to do with the traffic stop.

@@reeferrotrandy458 where I've seen numbers, it's about a 20% drugs found in a K9 search. And that number includes planted drugs.
This incident, it was more about getting the passenger out so he could be cuffed for not waiving rights.
The dogs are actually rewarded for and and receive positive reinforcement for any "positive hit". My dog will fake cough or limp for a treat, ridiculously unreliable on the witness stand as well.

It really is astonishing how many police officers don’t even know the most basic and fundamental laws. It’s always put that ‘they either misunderstood or blatantly ignored the persons rights …’
It seems to be in a lot of cases, that both these things are true.
American police know the law, they're just privileged.
They know that a passenger isn't required to ID if they are not expected of a crime. Arresting him was retaliation for him saying no, and they are also aware they themselves will not face any consequences, which is exactly what happened.
They know the laws, They just don't care about it. This isn't ignorance, it's malicious intent. He resisted their authority so he wanted to give him a hard time.

It's unreasonable to expect them to be lawyers, but this is basic stuff that a 1 week course should be able to take care of.
It's not just the cops, a state attorney was more than eager to prosecute the case. Good that a clear headed judge threw it out.
Willing to bet it is a common practice for this prosecutor to pursue charges against nearly any and every piddly shit case brought before him. Reason being, the overwhelming majority are going to be against folks who don't want to fuck with it, impoverished, stressed with a shit ton of things on their plate from work to family/kids to whatever else. People wo have neither the time, money, or energy to fight against wrongful prosecution. Nearly all of these end with the poor citizen taking a plea just to get it behind em. The evidence of a cop lying, of the law clearly not being violated, never comes up. Id be SHOCKED if the prosectuor even reviews actual evidence like cam footage before pursuing it.

Yeah. They sound as if they're in high school -- and, frankly, don't look much older than that! Maybe they were out practicing traffic stops that night and thought they'd picked an easy target. The fact that they consulted a senior officer who was there and then threw in a narcotics search on top of a stop for a folded up paper license plate tells me they'd been sent out to get some "real experience" and were practicing on two Black men in a nice car.

yea, its only an additional charge to accompany another initial charge. would never hold up in court and his competence would be questioned in cross examination.
Arrest is the tool they use for forcing compliance with unlawful orders. Most people will hand over their ID and move on. The sad thing is, there are rarely consequences for officers that do this. They arrest people and ask questions later.
Notice how the officer phrased it, "I am going to arrest you for resisting". And not for resisting "Arrest". The resisting the officer is talking about is this "boy" having the nerve to not drop his skivvies, bend over, lube up and do as I say. That is the resisting this highly decorated heroic POS is talking about and not the LAW. Its an everyday occasion in America, especially to those police think that don't know there rights. Oh, that color thing, it always comes into play.
Resisting a superior officer is different than resisting arrest. RSO is when you stop any emergency personnel (police, fire, medical, security, etc) from doing their duties with threats and/or violence.

This officer should be charged with official oppression! That officer was asked multiple times for his name and badge number and did everything he could to avoid answering this direct question and change the subject! Dismissed charges should be punishable by law with ZERO TOLERANCE to the arresting officer(s). This insane madness must stop! Its getting worse! This is leading to civil disobedience, resulting in the police defunding themselves. A citizens arrest against those officers unlawful threats and containment should be mandatory for all citizens to uphold.
@@TaylerJDust it is, according to the Freedom of Information Act all public Information must be provided immediately, verbally or in writing. There are exceptions if the government employee believes some of the information is protected. If so they should collect contact info and pass the request on to the proper department.

The officer might not get qualified immunity if it clear case of infringement of constitutional rights. Then it comes out of his pocket.. most times the city pays but always nice when cop has to pay. "We Fight As One" is Pasco County Sheriff's motto, that tells you something right there, they don't SERVE as one, they see citizens as adversaries and anyone who exercises their rights is "escalating" in their eyes.

Literally in this case - they are facing another lawsuit for the sheriff's "Intelligence Department" which identifies people they believe are likely to commit future crimes based on their police record, and actively harass them _and their relatives,_ admitting their goal is to make their lives miserable.

They were looking to write citations for anything (grass too high, etc.), surrounding their home and questioning in the middle of the night for any crimes, etc. 4 people are filing suit, but if they're successful, I would expect everyone on the list to follow up with their own suits.

I never get in a car with someone who’s not on my level with constitutionally protected rights. I’ve seen too many wives and parents throw someone under the bus answering questions that they shouldn’t.

That passenger could easily have an outstanding warrant. The officer can ask a passenger to identify themselves. The driver also can be held responsible for aiding and abetting a fugitive if that person is wanted for any crime. The passenger screwed up not the police.

The issue is having humans behind the badge. It can’t be helped but humans have flaws to varying degrees. It does need an overhaul but it should start by evaluating their emotional state. I’ve said it before and I’ll say it again… why can’t the average citizen use ignorance of the law as an excuse, but when it comes to LEO’s ignorance of the law, they get qualified immunity?
The argument I believe is that their job exposes them to legal situations constantly and that it's not unreasonable for someone to occasionally make mistakes in their job. So given an honest mistake it is reasonable that the officer doesn't face personal liability.
I don't really agree with it personally. Otherwise honest mistakes should be allowed for citizens as well.
The problem is that it's also not just used for honest mistakes, but as a blanket protection for pretty much everything they do.

I see that a lot on these videos: cops narrating, for the video, something is not happening. It's a form of gaslighting. People who have that happening during a police interaction need to be aware of it, challenge it, and call it out for what it is -- so that *their* challenge to the lie is also recorded on the police video. Otherwise, when the video is shown to a jury or a judge or even a D.A., the cop's narration will be planted in the viewer's mind, even though what's happening on-screen may be completely different -- or, worse, undetermined because of low-quality video, making the cop's narration more believable.

It was sad for me to hear his father’s instinct to submit to the officers demands while his son was standing up for their rights. Clear demonstration of the difference in their ages and past experiences. His father has grown up with the police’s abuse and having to submit to it where his son has grown up in an era in which we are becoming more knowledgeable about our rights and that we can challenge authority.
I too commend his ability to remain calm but assertive and Hope he desecrates that department in his civil suit. This is what needs to be done if we’re ever going to clean up American law enforcement.
It is very sad. The father obviously knew police are likely to abuse power. People should definitely fight for their rights. Police need better education. And better systems for identifying individuals who are in violation of a crime. Honestly asking and demanding ID are 2 different things and asking may be ok for some and not ok for others. Police shouldn't be fishing for violations and people should have privacy. Personally, for me, I think everyone should just say who they are, let the police just document I feel that 5 minute interactions are not always adequate time in some situations to see if other crimes are involved. Who knows if someone in the car was carjacking and planning to murder the driver or vice versa. But, again, not at the risk of violating anyone's ability to maintain privacy.

Just being able to arrest someone on the basis of false assertions, or plausibly deniable misconduct (where a cop just wants to arrest a person and therefore pieces together reasons that are weak but pieced together “in good faith”), seems like too much power and too little consequences for wrongdoing. I hate that it has taken me 36 years of ignorance about this stuff, until it happened to me, in order for me to dedicate the rest of my life gathering ammunition against similar cops.

At any rate, the legal system will always tend to back them up, not us. The State doesn't like to be wrong...that is bad policy in their minds. Agree, and that generation didn't have cell phone cameras growing up. I've overheard it said several times by LEOs. The one thing they fear more than a guy with a gun, is a guy with a video camera.
My feeling is that to become a cop, you should have at very least an Associate Degree in Criminal Justice. There could be ways around it, like having a certificate in criminal justice and requiring insurance, etc. But if our police had a basic understanding of the laws, we may see less of this crap.
Pea Bee, I hear you. I am a cop and admittedly a relatively new cop. To be certified in Florida as a law enforcement officer, you need to have 770 hours of classroom training. At my agency, we have to have another 520 hours of field training - that is a total of 1290 hours, just to be on the road by yourself operating as a full-time active deputy. In my humble opinion that trumps a mere 60 semester hours of an associate's degree.
Truth be told, the deputies were well within their authority to identify the passenger as established in the legal guidelines of the 2020-2021 edition of Florida Criminal Law and Motor Vehicle Manual (see section “Automobiles” and subsection “Treatment of Passengers”. Identifying passengers in the State of Florida is also well established by case law (Bratcher vs State, 1999). The case could have been dismissed based on ANY technicality, not necessarily procedure. I understand that many people who watch this channel are cop-haters, but ATA sometimes do not appear to be objective and cite only portions of a statute - that too is also misleading if not wholly disingenuous. For what it’s worth, as a cop I probably wouldn’t have arrested the passenger as a matter of discretion, as I likely would not have asked the passenger for his ID unless he decided to interject himself into my investigation.

Facts of the case were totally different. In that case, the cop knew an unoccupied vehicle’s owner had a warrant from running the tags. When he came back around, the vehicle was then occupied and driving away. He proceeded to pull it over and on the basis that the owner had a warrant, that’s his RAS to ID the passengers.
Totally different case. These piggies had no RAS for the passenger, nothing even resembling RAS. The statutes are clear.
I would say in your case, that those 1290 hours of training (which teach you how to see the people as enemies, how to deceive the public and how to lie, how to shine shit and call it gold) weren’t nearly enough. Back to the academy with you!

But like many, you seem not to be concerned with truth…simply agenda. I’m trying to be the change I want to see. You do the same…sign up…go to academy and serve your local community. @@lc3507 I am by no means a cop hater. My dad was a police officer and a sheriff's deputy for many years. He would often talk about how he felt policies have changed the way police can do their jobs and that today's police officers don't have the ability to make the same types of judgment calls as he did back in the day. I am glad you are able to use your discretion when it comes to these types of situations.
My opinion is that we have a twofold problem. 1. Currently, all we hear about is police brutality, not the actual people behind the badge. Maybe if the public was more aware of the training you go through? More news about the good you do for our communities would certainly be nice.
2. You have a highly litigious population who may believe they know their rights, right or wrong, who are looking for an easy payout or clout. They are often aggressive and use their videos as a weapon, trying to antagonize the police which pushes the narrative that all police are uneducated and/or corrupt. You get yet another video pushing the narrative, and which puts police under even more scrutiny. Heaven forbid they come across an officer who pushes back, then you may end up with a video worthy of UA-cam or worse, the 6 o’clock news.
Maybe that narrative is working, because it appears that some people are very defensive when confronted by police. Perhaps they feel as though the cops are looking for any reason to arrest them.
My position of requiring police to have a degree is just looking for a possible solution to perhaps having people become less afraid when they are pulled over. It is no way to besmirch good police officers who are just trying to enforce the laws. We are in a vicious circle, people vs police. I come here to try and make sense of both sides.

or at least be able to get an idea of where any given law would be. (im not entirely sure if this is how it works, but arent most laws ordered by type?) as well as be forced to have a computer in their vehicles with every law that they can search up and be trained in how to search it. (since its human nature to forget some things, especially more obscure ones.)

Laws constantly change, and there's a lot of them, so they always need to stay on top of laws and changes to laws. I agree they should know a whole lot more about how to conduct a legal traffic stop.
Rights of citizens are not their priorities, they are just money collectors for the government. You are guilty until proven innocent. Period.

Many older generations bow more easily to cops. The newer gens are learning not to do so.
The arrest was vindictive. The deputies were butt-hurt that someone calmly yet firmly asserted his rights. Early on you can can hear the deputy say something like, "You really want to play that game?" From that point in the interaction, it was "game on" for the deputies. And they were going to win the game no matter what. Hopefully, the lawsuit will show it to be a costly victory for them.
It's just to bad that the cost paid, comes out of the pockets of the tax paying citizens! The police should have to pay for their mistakes and blatant ignorance of the law, by having to carry their own liability insurance. When we make a mistake, we pay for it out of our own pockets, when the police make a mistake, we pay for it again, out of our own pockets, it's exceedingly lopsided against the citizens, being done not by the police but by the legislators. Qualified immunity has got to go!

A passenger is not required to give identification in response to that request. However, refusal to provide identification may allow the officer to expand the stop in order to determine whether that passenger or passengers poses a danger to their safety during the traffic stop.
How does he interfere by not violating his own rights? These cops are so above themselves, they are a joke. They don't have a clue of what they suppose to do or apply the law.
