  • This information is for entertainment purposes only and I am not in any way, shape, or form advising you on what to carry where you live. Let me know if you agree with my findings. The main point of this is to show the absurdity of the laws and how there are contradictions in the law and more importantly, point out that our government has overstepped and found the need to suppress us with unconstitutional laws. Again, my opinion...and not backed up by any sort of law degree. My only advice to you is to not be a jerk when you are stopped by the police. Be respectful and upbeat and you will find that your life goes so much more smoothly. Remember, regardless of how you behave, they will be going home for dinner, you may be having a bologna sandwich, a slice of cheese, and warm milk in the company of a whole new group of friends for the foreseeable future. You feelin' me? Hold onto your soap.
    A recent trip to NYC got me thinking about knife laws. Things are always changing and I was surprised by some of the things I found out. It is a really good idea to know your local laws as it can save you some unnecessary headaches if you simply follow the law.

    Mr.KS, happy Friday, thanks for an interesting video. I have never been to New York and have no plans to ever go there. New York is an open sewer & needs returning to the Redskins & the beads they got paid refunded! As a lifelong SAK Aficionado it does not surprise me that carrying Swiss Army knives is possibly illegal in NYC, after all it is a well known fact the Swiss Army Toothpick is a banned weapon of war under the Geneva Convention on a par with flame throwers, poison gas, napalm & biological weapons. How did the little Toothpick become a banned weapon of war? That is simple it is made of the same non-recyclable plastic as the plastic drinking straws now outlawed in California!

      Upstate is pretty nice 🤷. The Hampton are nice 🤷, fishing is great on Long Island 🤷. When you go on vacation do you carry your Bowie knife and 9mm with a 19 rd clip ? Cause I know I don’t lol. That being said I left New York for the west coast of Florida 17 years ago and now I have a place in the NC mountains and would never go back to NEw York. Except weddings and funerals. I would be a felon just by moving my shit back lol. Didn’t realize how bad the laws were till I left for a free state. At least now you can beat up cops there and not even go to jail but you have national guard in the subways cause you have too much crime. Can someone explain how that makes sense ?

    I moved to NJ 20 years ago. First time I went to Wal Mart all the “outdoor/sporting/tactical” looking knives were in a locked display case. 3 aisles away I could just grab a 10” chefs knife and go Michael Myers’s if I wanted. It’s all about optics and emotions.

      They were secured in a case because they are more likely to be stolen (like flashlights). Walmart even secures fishing reels, boxed power tools, and car headlight bulbs. Good luck quickly finding someone to open the case for you.

      Germany is even crazier about this topic. We have "no weapon zones" in some cities which bans all knifes with blade lengths beyond 4cm. There are a dozen other laws towards knifes outside "no weapon zones" though.

      Arizona resident here. I can carry any edged weapon I want. Fixed or folder. Not an auto or balisong guy.

      But Arizona does have age restrictions. e.g. a person under the age of 21 cannot carry any knife other than a pocket knife.

    I was completely unaware how strict NY knife laws can be. The whole concept of "knife laws" is a bit strange to me being a Tennessean; where we can comfortably carry pretty much anything legally. I think those old school trench knives with the knuckle guards are an exception, but I'm not 100% sure on it.

      As an Oklahoman, I can carry pretty much anything I want here from a Sak to a Kriegsmesser (War knife). I don't do that, but you can here! You can even tuck bowies in your waistband and go about your day that way. And yet I see no knife crimes in my area. I carry a variety of knives, but my Sak is essential. Also carry a Joker Jerezana Sevillana on me at all times. Such a classic Spanish knife (Americanized though). I couldn't imagine even visiting NY or Commiefornia, as I'd have to leave those at home! Seems the southern states are just more sensible.

    Everything is legal in GA. Even ballistic knives. And knives aren't considered weapons unless the blade is 12 inches or longer.

    Chicago is stricter than NYC. 2 1/2" max blade length, single-edged only, and no autos. It was a trick to assemble, but I have a collection for travel there, now. My options are legal, almost legal, and I'm in big trouble. Always carry in the pocket--always. The classic way to measure is a straight line from the furthermost protrusion of the handle to the tip of the blade. You can squeeze in a bit more cutting edge by going choilless, serrations, recurves, karambits, and sharpened edges that undercut the front of the handle. Carry wisely.

      I'm about 45 minutes south of Peoria Illinois and I carry my 5 inch hunting knives everywhere I go and I carry a 3 inch folding knife with a clip in my front pocket.

    Are we taking the state of New York or New York City? Not that I’ll ever visit either one, but was in need of some clarity. I was wondering if you could also explain why a Swiss Army knife is illegal in New York ?

      Did you watch the whole video? Because I say why the Swiss is illegal.
      The law states that a folding knife is illegal. But switchblades are no longer illegal. Since switchblades are automatic folding knives, the Swiss should be illegal. That is the ambiguity I'm talking about in the video.
      NYC and Upstate are all one state. However, NYC likes to try and make different laws just for them. But, after the Supreme Court gave them a spanking about their special just for NYC gun laws, I think they understand that knife laws for the state, apply to them as well.

      As a knife collector here in NYS it's hilarious because they still sell folding knifes and bigger than 4 inch knives at my local Walmart and tractor supply. From what I can tell if you carry anything bigger than the maximum it has to be within reason, like hiking, hunting, fishing etc. And for any auto you have to have a hunting and fishing license and must be in the act of doing those things to carry and auto

    I live in NY. I work in a trade. Im always in a track going into a building or home. I've carried a buck on my belt for 35 years. I believe a police friend said I'm covered by a work law called in transit. Used as a tool during work hours. Let me know if you know about it. I dont carry open knife off hours tho.

      The only thing I know about a law that sounds sort of like that is if you are carrying a firearm while traveling across the country and are going through a state that illegally makes carrying a gun illegal you are still allowed to travel with it through their state. If you plan on stopping there and taking up residence for any period of time I guess that law changes but if you’re just Zip-a-Dee-Doo-Dahing right on through the state, I guess you’re covered by the “in transit“ law.

    I am planning on traveling soon, like on an airplane. I normally carry a pocketknife but I WILL NOT do so on this or any flight. The last time I traveled, at the inspection area, they confiscated my STAPLER!!! MY EFFING STAPLER!! Law enforcement can do whatever they want to do and everyone needs to know that. Rules and regulations don't apply to them. Enjoyed the video.

    😂😂😂😂😂😂😂😂😂 This is the first time I have watched your channel, and today you cracked me up. I have been carrying all types of knives since my early teens (I am 63 years young 😂). Here in Puerto Rico, the legal length is 3”. So I have a few folding knives that measure that, but to me, a knife is a tool, so I have always carried a Victorinox and a folding knife on me. My primary defense weapon is a gun 😂😂😂😂😂😂 (retired Deputy US Marshal). You earned my subscription, my friend; stay alert, stay alive, stay safe. 🙏

I do know that as a retired law-enforcement official… Especially federal… You are covered by the patriot act and basically obligated to carry a firearm. Let me know if I’m right or wrong on that.       @@knifetimestory Yes, we do. I spent 22 years as a Deputy US Marshal in the District of Puerto Rico. Under the Law Enforcement Officers Safety Act (LEOSA), I can carry a firearm, except in certain places; I do have the same credentials with the word Retired in Red on the ID. When I visited my two kids (both in the Coast Guard, one in San Diego, the other in Alaska), I checked my firearm at the counter and crossed my fingers not to lose it. The same goes when I go to Florida. Anyway, it should get better once I move to Maine and my wife retires at the end of the year. Stay alert, stay alive, stay safe. 🙏

      @@knifetimestory I know! here in CA we can carry a button activated switchblade, so long as it's under 2 inches ... but if i carry so much a spring assisted knife longer than 2 inches, it's a felony. If I carry a gun, it's a misdemeanor (actually a felony wobbler, but rarely charged as a felony). GO figure these people.

      But you can open carry fixed blades in CA. And you can conceal carry folding knives.
      Also in CA the only knives that have blade length restrictions are autos (less than 2 inches is legal)

    Just had a thought. Is there a NY law/rule on what the knife has to be made of in order to fall into the illegal category? I mean what about a solid ebony (wood) 5 inch blade........and what about an antique "ice pick"

      The whole video in and of itself should be confusing… Because it’s about a subject that was written in such a way to be completely confusing and your average citizen not be able to follow. On the one hand, a folding knife is illegal. On the other hand, a switch blade is not illegal. A switch blade is a folding knife that opens automatically. So don’t try and apply logic. Logic is not observed in NY.

      Well, long story short, and maybe I'll make a clarification video, but NY is NY is NY is NY. NYC, as hard as it wants to be its own island country with it's own laws, has to be in lock step with the rest of the state. The cops don't always think that way, so you've got that problem. But the laws are state wide.

      I thought the lack of "preemption" makes this not the case? For instance, in Alabama there are no state knife laws remaining that I am aware of, but there are areas (I want to say Montgomery?) that still have local laws prohibiting switchblades. I've always heard that NYC knife laws are more strict than NY state but both are pretty stringent. @@knifetimestory

      What do you mean this is a great question? Read the law! It clearly says there are exceptions for people that use knives as customary tools for their profession. Law enforcement, electricians, chefs, etc.

    2:13 The 91mm Swiss Army Knife is not illegal in New York. Please elaborate if you think otherwise. There’s even a Victorinox flagship store near 5th Ave, from which I’ve bought a couple of knives on two different trips. I’ve carried them in NY many times, have even used the Victorinox Compact ballpoint pen to jot down notes in the open and have never had a problem.

      I think you are confusing my stating the fact that the Swiss Army knife is illegal over the fact that it appears to be illegal according to the New York law that I was reading at the time of making the video. The absurdity of the whole thing is that while the law states folding knives are illegal, it also states that switchblades are legal. and we all know switch blades are automatic folding knives. So there in lies the contradiction. That’s making it confusing for you, me, and any other law abiding citizen and guaranteeing that any ne’er-do-well police officer could give you a hard time.
      And, I know I will have to go to NYC again this year, where is this store? I would love to visit it and grab myself a true souvenir.

      ​@@knifetimestory The Victorinox Rockefeller Center store was at 620 5th Ave #7. It opened in 2016 but I just realized it's now permanently closed, which breaks my heart!! I shopped there last in 2018. On the issue of legality, I'm confident they're absolutely legal to purchase and carry in NY, despite the apparently confusing wording of the laws. Perhaps we'd have to resort to legal precedents to know for sure, but I wouldn't go that far. I'll continue to carry my Swiss Army Knives every time I go to NY. Oh, before I leave, I once needed to enter the NYFD HQ in Brooklyn and had a Victorinox knife on me... The X-ray machine alarm went off and the guards only asked me to either leave the knife in my car or with someone outside the building. No biggie at all bro.

      And...I'm totally with you on continuing to carry my Swiss. My video was simply to point out the absurdity of the law and the fact that it is a law to begin with is the biggest absurdity.

      620 Fifth Ave. New York, NY. Open 11am to 7pm tomorrow (and most days). Don’t know what the original poster is reading, but NYS Penal law does not include a blade length promulgation nor mention “folding” or “folder”. But NYC, Albany, Buffalo and Syracuse certainly do have their own local ordinances that are more restrictive. I posted a link but UA-cam doesn’t like folks to do that, apparently.

    I’d love to see you do a video on updated knife laws in Washington DC. I believe there are certain restrictions around federal property (huge portion of the city) compared to the rest of the city.

    Great informative video, but I'm confused about something. You said a folding knife is illegal, so you showed a Swiss army knife as an example, but then toward the end of the video, you have video footage of you putting a pocket knife into your pocket and saying that if the knife can't be seen, then that's legal! What am I missing? Please explain!

      Do you have a very valid question. It is all very confusing. However… Assuming that the part about a folding knife is actually in error being still a part of the law because quite simply a switch blade is an automatic folding knife and those are legal. My main point was the fact that many of us have been walking around with knives clipped to our pocket or a buck 110 in a sheath totally out in plain view and now it seems that that is illegal, and it should be concealed rather than visible.
      The whole point of the video is just to show the absurdity of it. So if my video confuses you, imagine how a law enforcement officer feels or citizens feel in trying to tow the line and do everything by the book. The book is screwed up!

      I believe you, but I don’t think there is a police officer breathing air that would go for that. The obvious measuring point is end of handle to blade tip. And like I said in the video, I’m not going to argue that point in the street. I will let it go to court and then I will sue the municipality.

    Born and raised in New Jersey, Dad and Uncle are from Manhattan Uncle is a federal lawyer, all those knife laws you just cited are on the books but have been found to be unconstitutional and un-enforceable by the US Supreme Court in the Kaitano and Bruin cases and carrying any knife is protected the same with pepper spray, stun guns, tasers even swords, and half their gun laws most of the rest of their firearms laws will fall in the next five years but during the founding Era 1773 to 1833 there is not a historical prohibition on knife length or carry restrictions making any law contrary to that fail Constitutional muster and is in itself therfore unlawfull. In fact my father faced this six months ago was arrested was immediately released and is now suing the NYPD was offered 1 settlement that has been rejected there is no qualified immunity because Kaitano is well established law. Bruin is new 1 year.

      That is where you are wrong. Because a clip is exposed. I used to be under the same assumption you were. So rather than take a chance, that is why the very beginning of my video shows me unclipping my Benchmade 940 and sliding it into my pocket. Problem solved.

    I seem to remember when I had to travel to New York tonight. Flaws said something about folding knives had to have a blade that was under 3 in, required. Two hands to open and were considered a "gentleman's knife," meaning it had either brass or nickel on the handle. I was assuming they meant like a traditional Buck or Case knife.

    In Indiana, the only restriction is a ban on ballistic knives and throwing stars because those are considered weapons. All other knives are tools. You can have any type and size of knife and carry it openly if you want. Nobody cares and they probably won't bother noticing.

    I don't know about the whole country but knife laws also vary inside a state. Some states like California and Nevada allow pockets knives with a 3 inch + blade but inside large cities like Los Angeles and Las Vegas don't blades of 3 + inches.

      There lies the issue. State law supersedes stupid municipal and local laws. Why have a state constitution? And, the Constitution of the USA reigns over state law. NY got a talking to about having different gun laws for Upstate and NYC. So, any of those laws you reference, are truly unlawful and could be challenged in court should you find yourself suddenly a guest of the state (jail)

      Because the way the law read, it is a folding knife. And the law did not specifically say what size folding knife it just said, a folding knife. And that is the point of my video as to how absurd this is, because a stiletto is a folding knife that is automatic. Are no longer Illegal.

    As a tradesman and native of NYC it ultimately really comes down to intended use. As a teen a knife was more trouble, usually the cops just took it away and let me go with a warning. Since I work in a corporate theatrical setting a knife and a flashlight are my EDC. Once several years the police stopped my in the train to inquire about my foldable pocket knife, they'd seen the clip. Camly I explained as a professional rigger such a knife could save someone's life on site. Also I offered to show them 250 photos of me working with power tools, which they declined. They explained main issue involving open carry is they're more concerned someone else might see and grab your knife for criminal use. Since I had a Bosch tool bag they asked me to put it with the rest of my tools. It's incredible how knives are feared and mainly viewed as weapons vs. tools in our society. For much of my daily life I reach for my knife to cut and english muffin, a sandwich, a chop, or to share an sandwich or dessert. As for a Swiss Army Knife no cop is going to give you a hard time over having one, or even a Leatherman.

      Believe their logic is if there is some type of altercation, someone could view/grab your knife and use it against you. For me this is unlikely, I wear/yield a big studded belt that's been useful against people that pull knives for intimidation. NYC is my natural habitat and I went to public school in the 70's when this town was a warzone. @@knifetimestory

    Here in Canada we can carry any kind of knife even exposed. As long as you are not carrying it for self-defense and have a reasonable excuse for carrying it. You would think that a country that doesn't allow people to carry guns would would have laws against carrying large knives. It's kind of mixed up in this country so who knows what is going on. I just got a Esee 4 clip point yesterday, pretty cool looking knife.

    Swiss Army Knives are not illegal in New York State. I’ve lived here 64 years and carried one about 50 of those. Have a Camper that fits nicely beside my wallet. Though some places forbid any knife (court houses, schools, Federal buildings, etc.) Corporations and local ordinances may forbid them as well. And I carry EDC type folding knives (with thumb studs) with pocket clips exposed.

      I don't care if you lived here 100 years. For the entire time you were carrying a folding knife, it was illegal, as the law is written now. That was my whole point. It is very ambiguous. If a switch blade is no longer illegal, ( and they are simply automatic folding knives) then obviously a SAK is not illegal, but, the law says it is. So, they GET Ya either way.

    Suburban New York laws dictate folding knives that lock open , blades with any type of thumb assist or hole , blades that can be flipped open , any neck knives , are illegal. I'm not mentioning the usual auto,bali,dagger,belt buckle, etc. those are well defined .

    Always measure up to the handle and you can't go wrong. The knife length is not about how much you can slice with a cutting edge. It is about how much you can stab into a person which means all the way up to the handle. So i guess in NY, you need to stab twice to equal an 8" bladed knife? Ballistic knives were first marketed as re-productions of a KGB knife. The same company later came out with a version that could fire a "baton" and a grappling hook, but would not fit the blade.

    UK law: folding, non locking, blade less than 3", can carry without explanation. Anything else - locking, more than three inches or fixed blade, requires good reason.
    However, if stopped by the police, they will ask you why you have a 'street legal' knife.
    If you say, for example, self-defence, you will be charged with carrying a bladed article with intent.
    Police have been known to interpret blade length from where it exits handle, and I've heard they have also measured it by following the blade's contour.
    Scotland and NI might be different.

      Nope. I lived under that assumption for a long time. You may not display the knife. So if I have my ESEE3 on my belt hidden under my coat with nothing exposed, that is legal. If I was to take my coat off and walk around and people could see it, then that knife is illegal. Makes no sense… But that is the law.

    I dont know where you're getting this from. The biggest issue in NYC was always the gravity knife law, which was a state law, and it was amended in 2019. Folders were NEVER illegal. Which is why the safest way to carry there was always something like a slipjoint. The way that NY prosecutors interpreted "gravity knife" was by flicking them out as hard as they can, making all the usual locking knives effectively "gravity knives". I had to fight different felonies over this many years ago.

    New York City and New York State are two completely different things. Cops in the city can choose to interpret a drawing of a knife as a weapon. Just don’t go to the city. I live on Long Island and under no circumstances would I ever intentionally go into the city. They could be giving away $500 in cash and I would shrug and say no thanks. Seriously. Don’t reward any municipality that treats you this way.

      Nope. NY is NY. I looked it up. Just like the gun law is for all of NY. The gun law is the 2nd Amendment. The Supreme Court gave NY a spanking about just that issue. Municipalities and such can not add different layers of bureaucracy to existing laws to hinder the lawful ownership of a gun. Sure, NYC cops are going to bust your chops about a perfectly legal knife...STATEWIDE...but you won't win that argument in the street. You'll have to win that one in the courthouse.

    I studied national principles of self-protection law. For one thing, don’t argue your case with the police when they first approach you on the street. They have the authority there. Wait until you go to court. You can argue your case there.

    A pocket knives with a blade length of 4” or less is legal in NY State, as long as you do not have criminal intentions.

      That my friend is the sort of interpretation that will land you in jail. The law is 4" inches or greater. Just like I emphasized in the video. There is a big distinction between 4" or less or 4" or greater. Don't push the envelope. I'll stick with blades 3 7/8" so as to leave no possible error on interpretation.

    My mother would call me an a****** too so I know where you're coming from I live in North Carolina I can carry a switchblade provided that it isn't completely concealed. So if you have a sheath on your belt or I was also told by the police that the pocket clip with it's sticking up out of your pocket is legal. However I keep a completely concealed in my pocket I believe it's nobody's business what I'm carrying

      You see, I thought I was doing the right thing with the pocket clip and even at times an orange-handled knife to PROVE I was not carrying it concealed. Turns out I was just pointing a big red finger at my pocket for any cop to harass me.

    That's one good thing about living in Indiana, the ONLY knife laws are, no ballistic knives and no throwing stars. That's it. Not sure about throwing knives. Even if those were illegal, that's it. Switchblade, spring assist all good. You wanna walk around with a machete on your hip, all good. Very few gun laws too. As of a few years ago, you don't even need a permit anymore to open or conceal carry. I still have my lifetime permit anyways, but I had it for years before they made this new law. Love it!

      What part of “folding knife” was unclear? That is the conundrum. The law states a folding knife, but then again switch blades are OK. And they are in automatic folding knife. So none of it makes sense. But to the letter of the law, a folding knife is illegal. And last I checked a Swiss Army Knife is a folding knife.

    I live in a free state, we can carry automatic knives (switch blade) must be 21 years old, large hunting knives can be open carried, got to love freedom.

    All weapons (arms)are legal to possess and carry everywhere in the united states of America. It doesn't matter how long the blade is or if they fold or not.

    As a N.Y.C. resident this is the advice I give my son and follow myself about E.D.C. in The People's Republic of New York City : 1- keep it small ( less then 3 "😊 ) 2 - single edged ( no swedge ) 3- nothing tactical or that screams " weapon " 4 - no pocket clip 5 - A " Grand pa " knife is best ( I presently carry a Barlow ) 6 - most importantly never say you carry it for self - defense , you only carry it for utility purposes ( " officer I like to whittle " ) You wont get locked up , but there will be some fines and court costs involved for carry of a prohibited " weapon " ( $ 150. +/- ) .
    And so it goes .

    I was never stopped for a pocket check in NY or the city and ive walked with knives in public everytime. Right past cops many a times. Now Philadelphia on the other hand...... Lmao

    Knife laws vary wildly from state to state. In Delaware, one cannot carry a folding knife with greater than a 3” blade in one’s pocket. In some parts of the state openly carrying a bowie knife is OK. In at least some of the county and municipal parks carrying any knife with a blade of 3” or greater is illegal. Stupid, because if you have a picnic in one of these parks and you bring a paring knife with a 3” blade or greater to cut your cheese with, well you are an outlaw.
