I'm 54…9 years ago l got divorced. It devastated my finances. I had to start over and change everything about my life, it was an agonizing period. They gave her advice on how to get me out of the house. When I challenged them, they said that I could do it, too. I told them that they only said that because I called them out. When I tried to discipline my children for being disrespectful by taking their phones away from them, that I pay for, she called the cops and said I was threatening them. I no longer argue with her, and I do NOT discipline my children anymore. They aren't mine. I'll make new ones. I. Don't. Care. 11:08 the biggest most important thing. Of course. Don't do it alone. At $400 an hour for legal services, you bet your fingers and toes I'm gonna try. It took me 15 minutes to say I do and as soon as those words come out, a lawyer gets their wings. Please...the whole court system is a sham.
Believe it or not, emotions causes people to not think rationally. I remember telling one of my clients that I didn't feel comfortable continuing on his case because he had already paid $80k and I felt like he was making too many emotional decisions. He didn't care about the money. He wanted revenge. I found him another Attorney. When I catch up with him(client) every few months, we just laugh about how much he was willing to spend for revenge. He reminds me that I told him his feelings and unwillingness to move on was costing him. There's a time and place to fight. There's also a time to let go!

@@beckyrouse6115 the court really doesn't give a sh*t who cheated on who. You're not not gonna get more(or less) depending on which spouse you are. So, it comes down to dividing assets and liabilities and child support. And spousal support if it applies. And you can't get blood from a stone as they say. So, while there are 13 grounds for divorce(in Georgia), 99.99999% it's gonna be good ole 13- the marriage is irretrievably broken. That's it. Period. So, the court couldn't care less who cheated on who. So don't kid yourself that you're gonna get everything just because your husband hooked up with that cocktail waitress. It simply just doesn't work that way.

You can divorce without an Attorney. I'm not sure what the outcome would be. I always recommend having an Attorney even if it's not me. There's usually too much at stake. Also, Family Law Attorneys plan for what's needed in the future and how you're affected in the future with your decisions now. Most parties are just focused on today especially when it's a very emotional time.

Jeff, I always advise having an Attorney when going to Court. Everyone doesn't have a horror story when not represented, but the ones that do, really regret it. You may go in and be fine and that's my prayer. Assuming you are in Georgia, the following will need to be addressed whether it's via a settlement agreement incorporated into your Final Judgment and Decree or made the order of the Court by a hearing:
Child custody
Parenting time
Child Support
Division of Assets including the home (who will keep the home or will it be placed on the market? How will equity in the home be divided? How long will the Spouse keeping the home have to refinance? What if the Spouse keeping the home can't get it refinanced? etc.)contents of the home, retirement accounts, savings and other accounts.
Restoration of the Wife's last name
Vehicles
Alimony (if at issue)

However, if the mortgage is in both spouse's name and one is keeping the property, you would refinance to remove the other spouse's name from the mortgage or you may refinance to borrow enough money to give the spouse their portion of the equity or for for both reasons. The insurance company will drop you since you two are no longer married. This is regardless of an agreement. The choice is not his. However, he can continue to cover the minor children. You may want to look into Cobra coverage or shop around for your own insurance and ask for him to pay for it in the divorce if you cannot afford it.
