    Excellent excellent excellent I enjoyed it. I happen to be on Social Security disability and I have a workers comp case. I had a bad accident on a job or
    A wall unit slammed on my head and had a mild conclusion. The lawyers are not good. They said I need to do work search I said I’m on Social Security disability they try to trick me. I’m just waiting for my appeal for my settlement.

    Does payment get made on bilateral lower extremity or just for on side if both sides are impaired

      If both sides are impaired you should be able to receive compensation for both. It will depend on what your OWCP accepted claim has stated.

    OPM did not count the last 16 or so years I was on OWCP. I was only credited 4 yrs.2 months going back to sept 2004. MY OPM pay is Dog food money. Since OWCP and OPM don't pay into ss my ss is also horrible. Why did OPM not use all my years on OWCP toward retirement? I never got a straight answer from a Lawyer or from OPM. maybe you can help. Thank you

    I hurt my back in a car accident while deployed on active duty 18 months ago. I was diagnosed with lumbar radiculopathy, 2 bulging disks and degenerative disc disease. I’m a distribution associate with the postal service and since coming back from my deployment has been very difficult to perform my duties. My job requires a lot of twisting, lifting, bending and walking on average 10 miles a day. It requires for me to take pain medication to perform my duties. Is it possible to apply for OWCP or Federal Medical Retirement even if my injuries occurred while activated on active duty? Thanks

      Great question! Your high 3 average will include overtime if it's labeled as mandatory overtime on your SF 50. If you have any questions regarding your high 3 average you can contact your HR department or the OPM.

    When I reach MM hi will I have an appeal in court? How does that go and how long does that take?

      Your physician will determine when you are at maximum medical improvement. This will typically happen after you and your doctor have exhausted all treatment options and you are not likely to improve further. This process varies between cases significantly since it depends on the amount of treatment options you must go through. Once you reach MMI you can apply for a schedule award.

    Can one apply for federal disability retirement if the company dismissed you but you are still receiving worker's compensation?

      Great question! You cannot receive workers' compensation wage loss payments at the same time as Federal Disability Retirement. You can apply for Federal Disability Retirement and put your annuity payments on hold until your workers' comp runs out. Being separated from your agency due to your inability to perform the essential functions of your job can help support your Federal Disability Retirement case! Remember that you must apply for Federal Disability Retirement within one year of separation from your agency.

      There are a lot of steps that go into filing! You'll have to request accommodations, gather medical documents, and fill out the SF 3107 and SF 3112. For help through this process, give our office a call at 877-226-2723!

    How come when you file for federal disability retirement they want you to file for SSDI ????

      Hi - this is a really interesting question... Basically what it comes down to is, SSDI is a benefit available to any US citizen who has paid into it and like most things in the federal government, they want to figure out creative ways to pay for things. So, when you are applying for Federal Disability Retirement, you must apply for SSDI too, because essentially the OPM wants to see if they can split the bill for your disability annuity with the social security office. However, it's important to know that while you do have to apply for SSDI, you do not have to be approved for it to be approved for Federal Disability Retirement. We hope this answers your question!

    What is the weeks of compensation for PTSD?

      This depends on the severity/length of disability. Workers comp claims typically last the length of the injury so if you are expected to recover from your disability, your OWCP may end. If your OWCP runs out and you are still struggling to perform your job, you may qualify for FERS Disability Retirement. You can give our office a call at 877-226-2723 for more information.

      @@DisabilityRetirement i have not received a rating as of yet...we have been waiting for the defense IME report...i worked overseas in iraq and afghan as a civilian for 9 years...i have been uable to work since june 2022...i was not able to complete 1st quarter of school for rehabilitation so I dropped out...i am not the person i used to be...i have years of treatment for PTSD that I was first exposed to during my military service but i never spoke to a Psych until after my govt contracting jobs...i also worked a civilain job for about 5 yrs but i could no longer do so because of my diagnosed conditions by several doctors...apologies for my long post

    Is a workers compensation injury of the cervical spine under the Impairment Rating?

      Great question, Judy! A spinal injury is not directly eligible for a schedule award unless it directly affects an extremity (i.e. an arm or leg). It must be proven that the extremity is affected by using a Nerve Conduction Velocity test (EMG). We wish you the beat of luck!
