  • Rera Section 18, Return of amount with interest and compensation:
    Sulaiman Bhimani
    (1) If the promoter fails to complete or is unable to give possession of an apartment, plot or building,--
    (a) in accordance with the terms of the agreement for sale or, as the case may be, duly completed by the date specified therein; or
    (b) due to discontinuance of his business as a developer on account of suspension or revocation of the registration under this Act or for any other reason,
    he shall be liable on demand to the allottees, in case the allottee wishes to withdraw from the project, without prejudice to any other remedy available, to return the amount received by him in respect of that apartment, plot, building, as the case may be, with interest at such rate as may be prescribed in this behalf including compensation in the manner as provided under this Act:
    Provided that where an allottee does not intend to withdraw from the project, he shall be paid, by the promoter, interest for every month of delay, till the handing over of the possession, at such rate as may be prescribed.
    (2) The promoter shall compensate the allottees in case of any loss caused to him due to defective title of the land, on which the project is being developed or has been developed, in the manner as provided under this Act, and the claim for compensation under this subsection shall not be barred by limitation provided under any law for the time being in force.

    Hello sir.. I booked flat under construction and as per agreement possession should be April 2019 and including Ammuninties April 2020 for grace period but still not completed construction. In agreement mentioned 2500rs per month compensation delay and delay payment asking for 18 percent monthly cumulative interest by builder . It's not RERA project. Please advise me I can get any justice

    I purchased a plot from builder and land registry has been done,
    Now builder is violating the agreement and not developing project as per T&C approved layout.
    Should i demand return and by what process.
    Please help.

    What if the builder has madhe the agreement in 2011 and 80% amount is paid by buyer in 2012 and in 2015 builder has given the physically possesion but now not making the sell deed. What to do?/pls help..sir

    1. I have purchased a plot from builder, builder shows me the T&C approved layout, in that layout 25 feet wide road is sanctions in front of my plot, but now builder doesn't provide me the 25 feet wide road.
    2. In the right side of my plot there is another plot which is last plot of that row,25 feet wide road is sanctioned in front of that also.but as it is the last plot builder silently allows the owner to encroach the road. & the owner constructed porch of his house on the road .
    Registry has been executed.
    So can I demand refund of my whole invested money??
    Which act is applied in that matter?
    Please help.

    Hello sir,
    I had filled a rera case against builder regarding the delay, and the rera court has advised them to pay the compensation and interest, I have recieved the information through email, could you let me know what would be the next step that needs to be taken?
    Builder lawyer has also recieved the same through email.

    Dear Sulaiman sir, very much informative and practical solutions briefed by you. I have the case in which I have given around 30% (cheque payment) of flat cost as a booking amount in March 2016 thereafter insisted builder for an agreement but they had some legal issues. At time of booking they told verbally the possession will be by end 2019. In between management has been revised or changed somewhere at end of 2017. When I checked project details in MAHARERA, possession mentioned by year 2023 which is too long and not worth to stay with this. In Sept 2018, I requested to cancel booking and refund of my principal amount, till date they have refunded me only 40% of booking principal amount that too with heavy one sided follow up. Now I am thinking to register complaint against builder in MAHARERA to get back my booking amount with interest.
    Request you to pls guide and update me on said subject.

    Sir Maine ek plot book karake cancel v kara liya tha.
    Company wale ne refund amount ka 3 month ka instalment paper v diya written me.
    But 1 sal se upar ho gya paisa refund nhi kar rha hai

    Hi Sir,
    I have booked a flat on June 2019 , At that time when my agreement was executed(June 2019),project was registered under RERA and had a completion date of 09, Oct 2019.In Rera official website also same has been updated. They have failed to deliver the flats till now (Nov 2019) with a lot of construction still to be done. Now the Builder got a extension from RERA for 1 year till Oct 2020. I bought a home loan and already i am paying interest around 6 months. Builders are not ready pay the interest too. Due to this extension, I have planned to cancel my booking. But the builder is saying you are layable for 20% cancellation charge from so far paid amount. In agreement one date is mentioned, but RERA given another deadline, then who is responsible for loss of buyers. Kindly suggest

    Hello how will I be able to take intrest on my clp plan. Deposited money as per builder demand since 2018 Dec. Some times 2.2 lac then 11lacs then 4.4 then 4.4.lacs total 21.5 lacs till date .from Tim to time deposited how will I get interest ?

    सर मुझे compensation का इंटरेस्ट की receipt देने के वक्त बिल्डर 10% TDS कट करणे की बात कर रहा है ! क्या हे सही है या गलत ! चार साल delay हुवा है ( डिसेंबर16 ) और भी आगे तीन साल पुरा नही हो गा ऐसा बिल्डर के स्टाफ से मालूम पडा है ! तो मेरा 3लाख हर साल का इंटरेस्ट बिल्डर के तरफ हो रहा है !
    मै प्रोजेक्ट मे बने रहना चाहता हु !

    Sulaiman ji shama chahta hoon par main aapki baat se sehmat nahi hoon. I have received judgement from rera that builder was supposed to hand over the property by 30.7.2020 but builder is not responding. Can you help me to get the recovery certificate and also help in execution of recovery certificate to get my money back .tks

      he will not convert it . he will dupe you . take an enginer with you and measure the exact area for confirmation. builder will say they increase area and convert 2 to 3 bhk but in reality they will give small rooms and not increse area and will charge saying that play this amount because they increase the area

    SIR, IN MY CASE RERA CHIEF GAUTAM CHATTERJEE FAVORED THE BUILDER. I HAD PAID FULL FLAT AMOUNT AND THEIR WAS DELAY FOR 36 MONTHS. GAUTAM CHATTERJEE OFFERED COMPENSATION OF 5 PERCENT OF 100 PERCENT AMOUNT.

    मैं राजस्थान से हूँ मेने RERA रजिस्टर्ड प्रोजेक्ट में विला खरीदने हेंतु (एक लाख) 100,000 रूपये बिल्डर को बुकिंग हेंतु दिए, विला की कीमत 16,00,000 रूपये हैं, बिल्डर के साथ एग्रीमेंट करने से पहले मैंने फाइनेंसियल रीज़न से बुकिंग कैंसिल करवाई है, बिल्डर रिफंड देने से मना कर रहा है, इसके बिल्डर तीन कारण बता रहा है ___१. बुकिंग कैंसिल एक महीने के पहले नहीं करवाई, २. बुकिंग का GST जमा करवा दिया है , ३.हमारी कंपनी नॉर्म्स के हिसाब से बुकिंग कैंसिल करने पर रिफंड नहीं करते.
    मुझे कहा शिकायत करनी चाहिए ..?? RERA नॉर्म्स के अनुसार मुझे रिफंड मिल सकता है क्या.. .?? कृपया मुझे इस सम्बन्ध में जानकारी देने की कृपा करे. .....!!!!
