This episode is loosely based on a real life case, Witt v United States (NO.10-885) 2003. Airman SSGT. Dean P. Witt was admitted to David Grant Medical Center for a routine appendectomy while he was on approved furlough to finalize his transfer from Hill Air Force Base, Utah to Travis Air Force Base, California. Prior to post-op, and shortly following surgery, a military nurse anesthetist re-inserted an endotracheal tube into his esophagus instead of his trachea (windpipe), forcing life saving oxygen to be pumped into his stomach, instead of his lungs, and then utilized pediatric medical device to try and save him, resulting in an anoxic brain injury to include, 100% vegetative state. Witt died 3 months later on January 09, 2004. Witt's wife filed a wrongful death claim in August 2008 under Federal Tort Claims Act in California's Eastern (9th) Circuit District, which was denied reluctantly by District Judge, John Mendez in February 2009. Judge John Mendez urged the Supreme Court to revisit the Feres Doctrine because the Feres Doctrine was “unfair” and “irrational.”
As of May 2019, the Feres Doctrine is still alive and well, having yet another decision by the SCotUS to not hear a case of military medical malpractice (only two Justices, Thomas and Ginsburg, voted to hear the case). The SCotUS in effect is deferring this matter to Congress to correct by enacting new legislation. Currently, the SFC Richard Stayskal Military Medical Accountability Act of 2019 (H.R.2422 and S.2451) has been referred to both Congressional Judiciary committees for further hearings and action. Both bills have bipartisan sponsorship and support, however, they are unlikely to ever pass. How they could put words together representing what people deep down are feeling, then give it to this brilliant, talented hard working actor to bring it to life was a once in a life time experience for all.
Just to clarify, having the endotracheal tube in the esophagus instead of in the trachea is not the malpractice part of the tube placement in this scenario. That can happen even when all the proper steps are done during the placement. Immediately after the tube is placed, the next step is to have one person ventilate the patient with BVM (bag-valve-mask) device while another person uses a stethoscope to listen for lung sounds. If the person listening hears gurgling in the abdomen instead of lung sounds, then the tube needs to be removed and placed again. After placement in the trachea, staff can achieve idea depth of placement with aid from imaging such as X-ray or ultrasound and then monitor with waveform capnography (for carbon dioxide level in exhaled air). The fact that it took staff 15 minutes to discover they incorrectly placed the tube indicates they failed to confirm placement.
Also, as I might add...it's his voice. His voice sounds different. Now, maybe it's because he lightened his voice for Stargate, but Alan Shore sounds more like Red Reddington than Daniel Jackson.
Damn, what sergeant is pulling $70K a year? A Sergeant Major sure. An E9 with 20 years gets $77K/year. A Sergeant (E5) w/ 12 years gets $42K. And that is the MAX that an E5 can earn, even if they could serve a full 20 years. Its still $42K. I do like the argument posed here. Life in the military can and does suck. But it can be the most fun you (n)ever had.
mn french I think the whole thing was over exaggerated because private contractors also don’t make 400-500k. That said, it was the n the army and if you’re deployed I could see how with hazard, bah and separation pay a sergeant could make close to 70k
@OP: I thought the same thing, lol. When I married my husband in 1999, he was an E5, making approx. $2.00 an hour! This sn aired in 2007/08. There's hazard pay for deployment, but if you're unlucky enough to be on the base-housing waiting list, you're on food stamps, and counting pennies!
The 1950 Supreme Court 'Feres v USA' decision is still current. The supreme court has refused to review it despite several submissions (RBG and Clarence Thomas dissenting). Congress has now modified FTCA somewhat and may legistlate further as debate continues to be vigorous and almost universally critical of the Feres decision.
I hate myself every time this guys speaks, because he is amazingly impassioned, a great actor, and the speech is awesome, and all I hear is John Lithgow.

Spader seemed typecast as a schlep in every 80's movie. Then he gets Blacklist, Boston Legal, and voicing Ultron. Good things come to those who wait.
Outstanding acting
I really need to watch this show again.
How they could put words together representing what people deep down are feeling, then give it to this brilliant, talented hard working actor to bring it to life was a once in a life time experience for all.
His closing arguments are priceless because you know he's gunna give it to someone
Spader is awesome.
I don’t how this clip got recommended to me. I miss BL so much now.
Man, he is SO different than Daniel Jackson 1.0 here. Such a credit. And barely 10 years apart.
Also, as I might add...it's his voice. His voice sounds different. Now, maybe it's because he lightened his voice for Stargate, but Alan Shore sounds more like Red Reddington than Daniel Jackson.
Thank god this is in disney plus! I’m glad to have witnessed this masterpiece! ❤️
Always one of my favorite shows. To this day I'm convinced that they nipped a little too close to the govts heels on some subject and got cancelled
And this is where Mr. Reddington was before turning himself in to the FBI.
Is that Dembe behind him..?
@@jeansam2426 yup
James Spader has had a fantastic career, and he absolutely nails every role.
@@mistermister8998 I know private security officers who make over 400k. It's not that far-fetched.
Nilruin what company do they work for?
We need more shows like this...
What song is that at 3:25?
Having served in Iraq over 2 years and seeing how Blackwater operated I must admit to having a twitch when he mentioned their name!
its funny how blackwater is in news again . they put a price on saving lives of afghanis and anyone trying to leave that place
If there is ever an underrated actor it surely is this guy.
What an incredible scene! What episode is this from?
I hate myself every time this guys speaks, because he is amazingly impassioned, a great actor, and the speech is awesome, and all I hear is John Lithgow.
I remember when this was on television, I heard commercials for it on the Radio pretty much every day, and the sheer excessive marketing of it made me want to watch it less because it felt desperate. Years later, a friend of mine was talking it up and showed me two episodes, and I realized just how good it was. I binged it back before binging was a thing. And now, from time to time I find myself thinking of it still and going down a Boston Legal UA-cam rabbit hole being reminded of just how amazing this show was. I wish we had something like it now.
I got the whole series because of this scene!
Does that offend you part is classic... 🤣
Holy shit. ... stumbled on this in a binge ... what is this show called?!
boston legal. Great fucking show!
Please I need a link to download this series. Someone help 🙏

Amazing scene. What episode is this from?
It has to be season 5. I've just finished a binge rewatch of "the practice" & BL sns1-4.
@@alysiamerdavid-wasser9165 It is. Episode 5 I think. It's called The Bad Seed.
i miss this show
I love this character. He is so compassionate, so smart, and so good at his job. Makes me wonder if there are real lawyers out there like this. My God, I hope so.
"Marching in crooked lines." I'm dead.
Damn, this guy makes me want to go back to law school.... If we only had more lawyers this passionate...
This guy is in another level
1:00 i think i saw Dembe behind.
Absolutely magnificent scene in a stellar televisual experience, the existential mirror to a watching populace.
Is that Dembe at 1:00?
He was also great in the movie Stargate he was also in episode of Stargate SG-1 TV series
THIS IS HOW GOOD WRITING IS DONE
This show looks good. Anyone got Sauce? Can't see it in the description...
Boston Legal! It's brilliant and you'll love it.
I agree that the Feres Doctrine wrong
Is this clip from a drama series or movie...
Where can I watch the full version...
Please help
This is from Boston Legal. It is the best show on television. A little dated, from mid 2000s. But still every bit as relevant now as it was the . It is the most intelligent show I've seen on television.
Please what's the name of the movie
