The profession that she is being appointed into whether acting or permanent requires an oath to be taking in order perform the duties required. Presidents and governors have been sworn in the country while their winnings are being contested in courts. We can say that the president and governors who find themselves in these positions are in acting until all cases have been fully decided in courts up to the supreme court. The acting CJN cannot be exempted from the code of conduct and ethics required of the CJN because the position is on acting capacity. What Donald Duke is saying is that she can act as the CJN commit all the crimes and do exactly everything contrary to the code of conduct and ethical standard for the position because she is not yet confirmed and sworn in. It will be interesting to know if that is how Donald Duke handled all Acting positions that required swearing in when he was the governor of a state in Nigeria. Sometimes open criticism of the system is good but before you criticize apply the common sense first, otherwise you will end up criticize oneself when you eventually find out that you were wrong. The CJN position is a law enforcement position and I am yet to see how anyone in that capacity is not required to be sworn in. The time frame between when the position became vacant and the time it would take to complete the confirmation process might have been responsible to all that happened in this case.
