I wonder why the ATF is stepping up enforcement on pistol brace equipped firearms.

  • In this video I show a solid reason someone may have written in to the ATF asking for a guidance document on what factors are used to determine if a pistol brace equipped firearm is an SBR or not.
    Don't let Gun advocacy group and brace company sponsored UA-camrs stand in place of your own due diligence. Always verify the claims they make.
    They will tell you they tried to reclassify them. FALSE
    They will tell you that they tried to ban them. FALSE
    They will tell you that they wanted to force everyone to register. FALSE
    They will tell you they were trying to make new regulations or laws. FALSE
    They will tell you every angle that could possibly end with you feeling the need to either go out and buy a brace, or donate to their Gun Group like GoA etc.
    They might even promote their own products in their call to action videos. Fear Sells.
    Reading the documents without their power of suggestion it says
    "Objective Factors for Classifying Weapons With “Stabilizing Braces”; Withdrawal of Guidance"
    A Guidance which is defined as "advice or information aimed at resolving a problem or difficulty, especially as given by someone in authority"
    They are simply giving out clarity on how they classify pistol brace equipped firearms. This is nothing new. They have been using these factors to determine if manufacturers can market things as "ATF Approved" or not for a long time now. They are telling the public the factors they use to determine if a brace equipped firearm fits constructive intent of an SBR.

      true, these guys know what they are doing. if it was something they were harassing him over that was more obvious then that’s definitely an issue, but a guy walking in the park with something that looks identical to whatever is the law where he is is kind of bullshit and childish. unless he is trying to see if they take it from him illegally after making contact but doing this in the first place just to try and make a scene knowing how complicated this specific set up is shows what type of guy he is. not even the top government decision makers know wtf their doing and what law changes each day so how can you expect these guys who have way better shit to do and actually deal with real armed criminals that probably started out as a call just like this to know what the new rule is today. when they go home at night they don’t just beat their dick to gun laws EVERY night just so they can answer each one of your audits perfectly. they know generally what is and isn’t legal, when it gets down to specifics you should be auditing the ATF. but we both know you’ll have your ass handed to you by fine print laws that even you don’t know. so you stick to wasting everyone’s time for content like this. fucking nerd.

      Also: ran toward report of a man in a park full of kids with a rifle thinking they were going to get into a shootout with a maniac. Police handled it well. Once he was assessed as a non-threat and an idiot auditor, they have time to confirm this guy is legally circumventing the law which prohibits nearly exactly what he was doing; but loopholes it by having a piece of Velcro in the stock and a certain barrel length.

      The ATF could serve a good purpose. The problem is Democrats use it to restrict our rights through erroneous rule making. The problem is that the ATF, and other agencies, are allowed to basically make laws through "rulemaking." For any agency (supposed experts who are really just unelected and ideological administrators!) - For their rule to have the effect of law, the given set of rules should be sent back to the legislature for approval. In that way, politicians are accountable for all laws as intended rather than using an agency to circumvent the constitution. And there wouldn't be so much confusion while awaiting cases to work all the way to the Supreme Court. Very few rules would ever be granted the effect of law.

      But to clarify, since you don't seem to know, clearing a firearm means 1) dropping the mag from te well, 2) racking the slide (or bolt in this case) to release any rounds in the chamber and 3) placing the safety on (if applicable).

      You don't know what you're talking about. They weren't looking up the law. They were looking up the gun to verify that it was indeed classified as a pistol. No matter how well the officers know the law it would be asinine to expect them to know the details of every one of the tens of thousands of different guns out there. The officers got a call about someone carrying a rifle. They had no choice but to respond and check it out. It's interesting to note that the end of this "incident" was not shared. Probably because after determining the guy was within his rights to be carrying the firearm the officers handed the gun back to him and walked away.

      As an officer you should understand that in REALITY that is really NOT a pistol but the gun laws in this country are so messed up that we get to call that a pistol. I have plenty of guns and walking around a public park with a "rifle" where children play and families try to relax is definitely just acting like an asshole, especially with all the issues with guns we see in TV these days. So, I'll appreciate you as an officer try to preach more about not practicing this kind of behavior even if is still LEGAL to do it. Lets be civilize for once like a normal fking country.

      That, by legal definition is a pistol. If it's legal to carry and the area he is in is not restricted then they should know the laws and not harassed. They, like me, had constitutional law and if they don't know then they shouldn't be policing until they go back and learn more about people's constitutional rights. The 2nd amendment is not a suggestion. Those officers need retraining.

      Apparently, the city or state decided to outlaw rifles in that area, but not outlaw handguns. Probably so individuals, particularly women can protect themselves. But anyone may need protection.       Even if it wasn an sbr though, they dont have the authority to require that he show them the tax stamp. And if he showed them a tax stamp, they dont have the ability to check if its even real. They are just harrassing the guy.

      It is their job as police officers to carry a pistol. A random dude walking around with a PCC in a residential area will always look sketch. It’s just something you don’t do.       @@indoorkite651 I mean, 99% of people can't identify immediately the difference between a legal and illegal pistol brace / stock and when it becomes a rifle instead of a pistol. I wouldn't expect every cop to be able to either. I think they did a pretty good job to be honest. They didn't just roll up and shoot him or arrest him, they encountered a situation they weren't sure about and tried to figure it out calmly.

      We’re not referring to obscure and antiquated laws. We’re referring to the basics. They know those laws and often enforce them falsely and punitively.       @@AllanPowell Wrong. every officer I know is a strong 2A supporter, and believes the gun laws especially here in MA are nothing short of egregious. They are not trained to have any kind of negative mentality toward civilians. This case represents to me a group of uninformed officers, nothing more. Not all cops are gun nuts, you can't blame them for not knowing what an AR pistol is, but they did handle the situation poorly. That being said, stating that they're trained a certain way to be against civilians is ignorant, and objectively inaccurate.

    That's actually really disturbing that police officers don't know the law. I don't expect them to be able to quote penal codes but they should know whether someone is breaking the law or not without having to make contact.       they are only hired if they score under a certain level in their aptitude tests. There was a court battle over this and the prospective officer was denied a job due to scoring too highly.
      The courts upheld this and he was prevented from being a cop for being too smart.

    As a Missourian in 2021, it makes me happy to know that this action would have resulted in a $50k fine per officer, under our now-in-effect Second Amendment Protection Act. Local and state police can no longer enforce federal firearms law, only state law, of which we have very little. If the feds want to enforce their regulations, they're free to do so, they just can't force the locals to pay for it any more.

As far back as 2010, all of my friends who were cops not only had AR pistols themselves, but were familiar with the actual laws in regards to firearms and what constituted what.       Most officers are not familiar with the laws they enforce. They all seem to have "masters degrees" from online universities yet they cannot understand the simplest of concepts. To be fair, a small number of officers are quite sharp but the vast majority are a dissapointment. Why? Study the recruitment process, the kinds of personalities that gravitate toward the profession, and very important, how people are promoted within the profession.

These kids don’t have real life experience, yet they’re supposed to make adult decisions in real world scenarios. I’m a paramedic, and I can’t tell you how many times we’ve called law enforcement for them to show up and just walk around with their hands in their vest and not take charge on scenes. I literally chuckle when I see some of them show up and how young and innocent they look.
      Ive had to take charge on a lot of calls to de escalate tensions with people, even though law enforcement was there for that reason, but they stand around with their thumbs up their ass just looking clueless. It’s the reason I carry on my job, even though I’m not supposed to because little 20 year old Joey right out of high school doesn’t know how to be a man and do his job when Ems or fire request him.

      If I was a cop on duty during this incident I would’ve cleared the weapon and ran the serial number in the database. Make sure it’s not stolen and manufactured as a pistol lower receiver. If it’s not manufactured as a pistol than it’s illegal. There’s a difference between a lower manufactured as a rifle and pistol. A pistol lower can be turned into a sbr legally, but a rifle lower cannot be made into a pistol. A rifle lower can only be turned into an sbr.

You could buy a Colt 6920 cambered in 5.56 and slap a 300 blackout barrel on it and it wouldn’t change the classification. It’s still a rifle. Even though that pistol in the video is cambered in 9mm you’d still have to run the serial number to make sure it is in fact a pistol. It could be an illegal SBR with a brace. ALWAYS run serial numbers. Caliber doesn’t matter.

The fact that several LEOs don't know what it is scares me. They all carry an AR in their car and practice with them.. they should know who CMMG is as well. If law abiding citizens lost their right to own guns like this it would open the door up to many bad things.       @@AllanPowell officers are not exempt from the NFA, Authorized departments can file a form with the ATF and be cleared for Machine guns and SBRs, and then issue them to the officer.
      But personal weapons, weapons used not in an official capacity, and retired/former officers are all subject to the NFA.
      It is important for officers to realize this as well, the majority are civilians when not on duty, all the more important to protect and defend the constitution and not your boss, colleague if they are opposed to it.

    So let me get this straight, they are upset with effectively making a pistol longer? So legal pistol that's easily concealable is ok, but somehow becomes more dangerous by adding bulk? Yeah ok, keep pretending like any of this is for public safety. If it was then they already would have used statistics of crimes to ban them.       it's the manufacturers lying to consumers about legality of their products that's the problem in their eyes. Pistols can be longer but shouldn't be shouldered like a rifle. They can't ban them because of the ADA so don't worry about that. If they caught you with a home build they'd more likely tell you to make it compliant or register it than charge you unless you were already getting charged with some sort of violent crime.

      I don't entirely disagree, but the way they wrote the guidelines, it's subjective & up to chance as to if your complying over arbitrary thoughts. My main point was they vilified SBRs due to concealability, but concealable pistols are totally fine? Unless ofcourse you add a horseshoe pc of plastic to the rear? Also was noting they aren't plastering statistics because they don't support their argument. I dont think they should punish companies for skirting the line, its not illegal, many conversations were documented, & lets be honest the gov skirts the line 24/7. Best wishes & stay safe.

      @@pmanameless8184 All of those are valid points. The NFA is unconstitutional as a whole but as long as mass compliance exists so do their regulations and power. They're really just cracking down on manufacturers from false advertising stuff as ATF approved and trying to keep them from selling pistol brace equipped firearms as approved that wouldn't be. For the individual gun owners that bought them in good faith they wouldn't be able to jump to prosecution they would just say "make it compliant, send pictures so we can close this and move on" if they didn't just flat out waive the tax if you chose to register and throw a real stock on it.

I guess my problem is the trust part, the Kelland Wright case & also a few videos on YT of CA Leo's getting warrants to search homes of AW applicants are very concerning(plenty more). In CA they made citizens register legally owned weapons for new laws, & then tried to/did bust them for said weapon during review process they made them apply for. In my mind ATF does the same stuff, in the Wright case they tried enforcing very specific regulations that were never shared, even worse is it actually did abide by the unknown reg & they tried to measure diagonally against their own rules to make it stick. Its disgusting to me, & here it seems they have no justified reason to pursue this further, but they will. Compliancy is a killer.     it still blows my mind that cops can walk up on you, barrel pointed at your face, torso, legs, or any part of your person, and you are not allowed to shoot back in self defense. yet, if a citizen were to walk up on an officer out of suspicion that the officer is commiting a crime or felony, and has his/her barrel pointed at the officer, the officer has the right to open fire in self defense.
    it also blows my mind and pisses me off BEYOND belief that officers can so easily disarm a law abiding citizen. until that weapon is proven to be illegal, or that it is proved that the owner/carrier is not properly permitted to be carrying said weapon, law enforcement have virtually should have virtually zero right to disarm a citizen. In some cases, that weapon is a person's last line of defense against tyranny and by stripping him/her of his/her posessions, law enforcement is creating unfair grounds and asserting power they do not possess.
    i consider this unlawlful search and siezure and i would be suing the shit out of this department

    Imagine being stopped by the law in any other time in history for carrying a firearm. I used to have rifles in the gun rack of my trucks back while parked at my high school.     Unfortunately google is not a reliable source. These officers need to call the county Attourny, and they will call to verify the information. The simple fact is that the 2nd amendment is very clear. It does not say there will be a tax stamp, special license, or anything else that will hinder a US citizen from obtaining a firearm. This should be clear, but these corrupt officials want to go after innocent citizens rather than the criminals. People need firearms to protect themselves, and their families.

    This is one of those, just because I can do it doesn't mean it's a good plan to do it. I'll open carry all day long in the back country or in my own house but out in the public it's just way less headache to carry concealed. This is a solution looking for a problem, as near as I can tell.

      I think gun owners have an unwritten obligation to be responsible in their actions, and to show good judgement.
      Showing up to a public park where kids play with an AR pistol, with the intent to elicit a response from concerned parents and law enforcement just to prove a legal point, demonstrates a clear lack of responsibility and common sense.
      Frankly I wouldn’t trust this man with a firearm.

    This is an easily avoidable situation. Dispatcher: Thank you for calling concerned citizen, however, unless the person was pointing the weapon at people or causing some kind of disturbance, it is perfectly legal for them to have a weapon. It's like you're calling the police because someone is flying a kite in the park, and you just don't like kites. THEN, dispatch officer to get eyes on the person, not interfere or ID them, and if they are not doing anything illegal, LEAVE THEM ALONE.

      Problem is the way the news is sensationalizing these mass shootings when a person who doesn't know better sees a guy with what looks like a scary "assault rifle" they call it in and these guys have to show up
      Cops are some of the most ignorant gun people I've ever known, I heard one call a hi point 380 a Glock 40 on cops the other day lol.... So they are just as clueless and that is a problem that we need to solve asap

      EXACTLY! When the pistol brace issue first came around and ATH=F issued their memo/"ruling" about them being legal, gun owners should have just said cool, and gone about their business enjoying the win. But then people like this push the issue drawing unneeded attention. Then ATF issues a memo saying the inadvertently shouldering a brace is okay. Again, gun owners should have just said "cool" and gon about their business. BUT, every swinging dick with a brace jumps on youtube posting videos of them intentionally shouldering the braces and thumbing their noses at "the man". WTF did they think would happen?
      Now look at the situation, it is a direct result and the fault of those who like to "poke the bear" for no good reason.
      Don't get me wrong, I believe in fighting the good fight, but it pays to pick your battles and to not start a fight when it is not needed and serves no real purpose.
      ALSO, even if it were just standard pistol (Glock, Sig, etc) walking around with it in your hand or displayed in the open other than carried legally in a holster (per whatever state's laws), in a park where families and kids are present could be a cause for alarm.

      The guy in the video is a good friend of mine named Tim Harper. He's done more to advance gun rights in the state of Oklahoma than many others could ever hope to do. This incident happened at Hafer Park in Edmond, Oklahoma. The agency in the video is the Edmond PD.

    Safety lesson kids:
    First cop W/rifle: BAD- Finger on the trigger pointed at the "Suspect".
    Third cop W/drawn pistol: CORRECT- Pistol held at ready without muzzling anyone and finger off the trigger, Ready to go if the "Suspect" goes homicidal, but not ready to commit manslaughter.
    Not saying I absolutely condone "Displaying your rights" by the "In your face " method, but as shown in the video, it definitely serves as a great awareness tool.
