To be fair, the ATF puts out stupid regulations and classifications all the time. Even as a gun owner it's hard to keep up with their bullcrap. In all practicality, that's a rifle. It's just the ATF's stupidity that labels it a "pistol." Even so, by the videoer's own admission he was just doing it to "educate" the police by causing public panic. I'm all for the second amendment but using it to intentionally cause a scene only makes people hate guns more. You'll never change the stigma about guns by using them to incite panic. Be a responsible gun owner. As far as the cops go, if someone is reportedly walking around with a gun around kids, they need to be cautious and make sure everything is okay. I'd prefer cops like these being vigilant and ensuring everything is legal rather than the uvalde cops. Yes, they should study up on gun laws, but they're not ATF officers, so they're not going to know every gun law on the spot because they usually don't deal with classifying guns or taking them unless they're involved in a crime. I know many people want reasons to hate cops but take a moment to put yourself in their shoes. If you got a call that someone was in the park with your child carrying a gun and walking around suspiciously, would you not care? Would you say "well I'm sure he's just exercising his second amendment rights" or would you make sure everything is safe and this person isn't a threat first then say it's their right? Too often we like to place blame on cops who are just people with a job that is intense and dangerous, yet we act like they're the ones that made the laws they're sworn to uphold. In this case they looked up the laws and everything was fine. They didn't shoot the guy or beat him or do anything out of line. And lastly, the ATF is an unconstitutional organization that's against the second amendment and they should be dissolved. Their regulations and classifications are made by people who have no firearm knowledge or experience whatsoever.

People like me who used to take every precaution possible to comply are realizing it's unrealistic and unconstitutional to expect citizens to maintain the level of up to date knowledge thats required to be in compliance at all times. The ATF could serve a good purpose. The problem is Democrats use it to restrict our rights through erroneous rule making. The problem is that the ATF, and other agencies, are allowed to basically make laws through "rulemaking." For any agency (supposed experts who are really just unelected and ideological administrators!) - For their rule to have the effect of law, the given set of rules should be sent back to the legislature for approval. In that way, politicians are accountable for all laws as intended rather than using an agency to circumvent the constitution. And there wouldn't be so much confusion while awaiting cases to work all the way to the Supreme Court. Very few rules would ever be granted the effect of law.

You don't know what you're talking about. They weren't looking up the law. They were looking up the gun to verify that it was indeed classified as a pistol. No matter how well the officers know the law it would be asinine to expect them to know the details of every one of the tens of thousands of different guns out there. The officers got a call about someone carrying a rifle. They had no choice but to respond and check it out. It's interesting to note that the end of this "incident" was not shared. Probably because after determining the guy was within his rights to be carrying the firearm the officers handed the gun back to him and walked away.
As a Missourian in 2021, it makes me happy to know that this action would have resulted in a $50k fine per officer, under our now-in-effect Second Amendment Protection Act. Local and state police can no longer enforce federal firearms law, only state law, of which we have very little. If the feds want to enforce their regulations, they're free to do so, they just can't force the locals to pay for it any more.

They are not trained to have any kind of negative mentality toward civilians. This case represents to me a group of uninformed officers, nothing more. That being said, stating that they're trained a certain way to be against civilians is ignorant, and objectively inaccurate.

Cops do that a LOT when trying to come up with charges. The job has an IQ cap that hovers around average. Any drift from that goes to below-average. Someone who deserves applause for grasping basic algebra is then a few weeks of training in how to apply the law in the real world with real people.
This is embarrassing for this department. As far back as 2010, all of my friends who were cops not only had AR pistols themselves, but were familiar with the actual laws in regards to firearms and what constituted what. These guys are acting like they're hearing this stuff for the first time in their life.
Most officers are not familiar with the laws they enforce. They all seem to have "masters degrees" from online universities yet they cannot understand the simplest of concepts. To be fair, a small number of officers are quite sharp but the vast majority are a dissapointment. Why? Study the recruitment process, the kinds of personalities that gravitate toward the profession, and very important, how people are promoted within the profession.

I don’t see anything wrong with short barreled weapons honestly, as long as it’s tax stamped, and not in the hands of an idiot. Distance is calibrated by rifling, and mobility is calibrated by stock or brace. If I was a cop on duty during this incident I would’ve cleared the weapon and ran the serial number in the database. Make sure it’s not stolen and manufactured as a pistol lower receiver. If it’s not manufactured as a pistol than it’s illegal. There’s a difference between a lower manufactured as a rifle and pistol. A pistol lower can be turned into a sbr legally, but a rifle lower cannot be made into a pistol. A rifle lower can only be turned into an sbr.

@@maxtheroofer8004 True, but… caliber doesn’t matter when it’s manufactured. You could buy a Colt 6920 cambered in 5.56 and slap a 300 blackout barrel on it and it wouldn’t change the classification. It’s still a rifle. Even though that pistol in the video is cambered in 9mm you’d still have to run the serial number to make sure it is in fact a pistol. It could be an illegal SBR with a brace. ALWAYS run serial numbers. Caliber doesn’t matter.

it's the manufacturers lying to consumers about legality of their products that's the problem in their eyes. Pistols can be longer but shouldn't be shouldered like a rifle. They can't ban them because of the ADA so don't worry about that. If they caught you with a home build they'd more likely tell you to make it compliant or register it than charge you unless you were already getting charged with some sort of violent crime.
I don't entirely disagree, but the way they wrote the guidelines, it's subjective & up to chance as to if your complying over arbitrary thoughts. My main point was they vilified SBRs due to concealability, but concealable pistols are totally fine? Unless ofcourse you add a horseshoe pc of plastic to the rear? Also was noting they aren't plastering statistics because they don't support their argument. They're really just cracking down on manufacturers from false advertising stuff as ATF approved and trying to keep them from selling pistol brace equipped firearms as approved that wouldn't be. For the individual gun owners that bought them in good faith they wouldn't be able to jump to prosecution they would just say "make it compliant, send pictures so we can close this and move on" if they didn't just flat out waive the tax if you chose to register and throw a real stock on it.

I guess my problem is the trust part, the Kelland Wright case & also a few videos on YT of CA Leo's getting warrants to search homes of AW applicants are very concerning(plenty more). In CA they made citizens register legally owned weapons for new laws, & then tried to/did bust them for said weapon during review process they made them apply for. In my mind ATF does the same stuff, in the Wright case they tried enforcing very specific regulations that were never shared, even worse is it actually did abide by the unknown reg & they tried to measure diagonally against their own rules to make it stick. @@AllanPowell officers are not exempt from the NFA, Authorized departments can file a form with the ATF and be cleared for Machine guns and SBRs, and then issue them to the officer. But personal weapons, weapons used not in an official capacity, and retired/former officers are all subject to the NFA. It is important for officers to realize this as well, the majority are civilians when not on duty, all the more important to protect and defend the constitution and not your boss, colleague if they are opposed to it.

I think gun owners have an unwritten obligation to be responsible in their actions, and to show good judgement. Showing up to a public park where kids play with an AR pistol, with the intent to elicit a response from concerned parents and law enforcement just to prove a legal point, demonstrates a clear lack of responsibility and common sense. That, by legal definition is a pistol. If it's legal to carry and the area he is in is not restricted then they should know the laws and not harassed. They, like me, had constitutional law and if they don't know then they shouldn't be policing until they go back and learn more about people's constitutional rights. To be fair, the ATF puts out stupid regulations and classifications all the time. Even as a gun owner it's hard to keep up with their bullcrap. In all practicality, that's a rifle. It's just the ATF's stupidity that labels it a "pistol."

As far as the cops go, if someone is reportedly walking around with a gun around kids, they need to be cautious and make sure everything is okay. I'd prefer cops like these being vigilant and ensuring everything is legal rather than the uvalde cops. Yes, they should study up on gun laws, but they're not ATF officers, so they're not going to know every gun law on the spot because they usually don't deal with classifying guns or taking them unless they're involved in a crime. I know many people want reasons to hate cops but take a moment to put yourself in their shoes. If you got a call that someone was in the park with your child carrying a gun and walking around suspiciously, would you not care? Would you say "well I'm sure he's just exercising his second amendment rights" or would you make sure everything is safe and this person isn't a threat first then say it's their right? Too often we like to place blame on cops who are just people with a job that is intense and dangerous, yet we act like they're the ones that made the laws they're sworn to uphold. In this case they looked up the laws and everything was fine. They didn't shoot the guy or beat him or do anything out of line.
And lastly, the ATF is an unconstitutional organization that's against the second amendment and they should be dissolved. Their regulations and classifications are made by people who have no firearm knowledge or experience whatsoever.

People like me who used to take every precaution possible to comply are realizing it's unrealistic and unconstitutional to expect citizens to maintain the level of up to date knowledge thats required to be in compliance at all times. The ATF shouldn’t even exist.
The ATF could serve a good purpose. The problem is Democrats use it to restrict our rights through erroneous rule making. The problem is that the ATF, and other agencies, are allowed to basically make laws through "rulemaking." For any agency (supposed experts who are really just unelected and ideological administrators!) - For their rule to have the effect of law, the given set of rules should be sent back to the legislature for approval. In that way, politicians are accountable for all laws as intended rather than using an agency to circumvent the constitution. And there wouldn't be so much confusion while awaiting cases to work all the way to the Supreme Court. Very few rules would ever be granted the effect of law.

The officers got a call about someone carrying a rifle. They had no choice but to respond and check it out. It's interesting to note that the end of this "incident" was not shared. Probably because after determining the guy was within his rights to be carrying the firearm the officers handed the gun back to him and walked away.

As a Missourian in 2021, it makes me happy to know that this action would have resulted in a $50k fine per officer, under our now-in-effect Second Amendment Protection Act. Local and state police can no longer enforce federal firearms law, only state law, of which we have very little. If the feds want to enforce their regulations, they're free to do so, they just can't force the locals to pay for it any more.

The inherent risks that come with doing these audits far outweigh any potential benefits. Cops do that a LOT when trying to come up with charges. The job has an IQ cap that hovers around average. Any drift from that goes to below-average. Someone who deserves applause for grasping basic algebra is then a few weeks of training in how to apply the law in the real world with real people.

As far back as 2010, all of my friends who were cops not only had AR pistols themselves, but were familiar with the actual laws in regards to firearms and what constituted what. These guys are acting like they're hearing this stuff for the first time in their life.

Most officers are not familiar with the laws they enforce. They all seem to have "masters degrees" from online universities yet they cannot understand the simplest of concepts. To be fair, a small number of officers are quite sharp but the vast majority are a dissapointment. Why? Study the recruitment process, the kinds of personalities that gravitate toward the profession, and very important, how people are promoted within the profession.

If I was a cop on duty during this incident I would’ve cleared the weapon and ran the serial number in the database. Make sure it’s not stolen and manufactured as a pistol lower receiver. If it’s not manufactured as a pistol than it’s illegal. There’s a difference between a lower manufactured as a rifle and pistol. A pistol lower can be turned into a sbr legally, but a rifle lower cannot be made into a pistol. A rifle lower can only be turned into an sbr.

@@maxtheroofer8004 True, but… caliber doesn’t matter when it’s manufactured. You could buy a Colt 6920 cambered in 5.56 and slap a 300 blackout barrel on it and it wouldn’t change the classification. It’s still a rifle. Even though that pistol in the video is cambered in 9mm you’d still have to run the serial number to make sure it is in fact a pistol. It could be an illegal SBR with a brace. ALWAYS run serial numbers. Caliber doesn’t matter.
So let me get this straight, they are upset with effectively making a pistol longer? So legal pistol that's easily concealable is ok, but somehow becomes more dangerous by adding bulk? Yeah ok, keep pretending like any of this is for public safety. If it was then they already would have used statistics of crimes to ban them. it's the manufacturers lying to consumers about legality of their products that's the problem in their eyes. Pistols can be longer but shouldn't be shouldered like a rifle. They can't ban them because of the ADA so don't worry about that. If they caught you with a home build they'd more likely tell you to make it compliant or register it than charge you unless you were already getting charged with some sort of violent crime.
I don't entirely disagree, but the way they wrote the guidelines, it's subjective & up to chance as to if your complying over arbitrary thoughts. My main point was they vilified SBRs due to concealability, but concealable pistols are totally fine? Unless ofcourse you add a horseshoe pc of plastic to the rear? Also was noting they aren't plastering statistics because they don't support their argument. They're really just cracking down on manufacturers from false advertising stuff as ATF approved and trying to keep them from selling pistol brace equipped firearms as approved that wouldn't be. For the individual gun owners that bought them in good faith they wouldn't be able to jump to prosecution they would just say "make it compliant, send pictures so we can close this and move on" if they didn't just flat out waive the tax if you chose to register and throw a real stock on it.

@@AllanPowell officers are not exempt from the NFA, Authorized departments can file a form with the ATF and be cleared for Machine guns and SBRs, and then issue them to the officer.
But personal weapons, weapons used not in an official capacity, and retired/former officers are all subject to the NFA.
It is important for officers to realize this as well, the majority are civilians when not on duty, all the more important to protect and defend the constitution and not your boss, colleague if they are opposed to it.

Imagine not being able to open carry a rifle and having to have a permit to carry a pistol
It being lawful does not mean it’s a good idea. For what purpose do you bring an AR 15 pistol to a park where families gather other than to make a point? You expecting a gun fight? This brings more heat to the 2A community and invites more ignorant laws to be passed because someone has a bright idea to alarm the community with an audit stunt. Your goal is commendable but the approach is stupid.

So he had a pistol, potentially strapped to his arm, at a park where kids were playing. Is it reasonable to expect the reasonable person to conclude that an individual with a weapon of that nature is merely exercising their second amendment rights? If that is the precedent, then what stops any individual with malicious intent from leveraging that precedent to situate their selves in a public space, unharassed, to carry out malicious intent? More guns? Does every law abiding citizen need to bring a similar weapon with them to a baseball field? I am a firm second amendment supporter, but the premise of auditing the police on the second amendment in a place where children are playing is selfish and asinine. Be a decent human being and run your audit in a place less conspicuous preferably with no children next time. All this scenario would've needed to potentially cause a lot of harm is another lawfully bearing citizen spooked into shooting first and asking questions later.

they are only hired if they score under a certain level in their aptitude tests. There was a court battle over this and the prospective officer was denied a job due to scoring too highly.
The courts upheld this and he was prevented from being a cop for being too smart.

I've been a law abiding gun owner my whole life and and I'm at a loss to understand what this accomplishes? Idk why it Bugs me when people call themselves auditors . Weather it’s the ones who just go and record buildings to make people uncomfortable and call the police or the ones who legally open carry AR style pistols . This is one of those, just because I can do it doesn't mean it's a good plan to do it. I'll open carry all day long in the back country or in my own house but out in the public it's just way less headache to carry concealed. This is a solution looking for a problem, as near as I can tell.

I think gun owners have an unwritten obligation to be responsible in their actions, and to show good judgement.
Showing up to a public park where kids play with an AR pistol, with the intent to elicit a response from concerned parents and law enforcement just to prove a legal point, demonstrates a clear lack of responsibility and common sense.

When the pistol brace issue first came around and ATH=F issued their memo/"ruling" about them being legal, gun owners should have just said cool, and gone about their business enjoying the win. But then people like this push the issue drawing unneeded attention. Then ATF issues a memo saying the inadvertently shouldering a brace is okay. Again, gun owners should have just said "cool" and gon about their business. BUT, every swinging dick with a brace jumps on youtube posting videos of them intentionally shouldering the braces and thumbing their noses at "the man". WTF did they think would happen?
Now look at the situation, it is a direct result and the fault of those who like to "poke the bear" for no good reason.
Don't get me wrong, I believe in fighting the good fight, but it pays to pick your battles and to not start a fight when it is not needed and serves no real purpose.
ALSO, even if it were just standard pistol (Glock, Sig, etc) walking around with it in your hand or displayed in the open other than carried legally in a holster (per whatever state's laws), in a park where families and kids are present could be a cause for alarm.

You have a right to do something But the police also have a obligation to investigate suspicious stuff. And if you wander around the park wiith an ar pistol out in the open its slightly abnormal. Just because you have the right to do something. Doesn't mean people won't be concerned and call the police. And don't be surprised when called sometimes the police show up. Not a fan of how either party conducted themselves.. the first officer made some pretty snide remarks and was very "us vs them". That said they're just doing there duty I mean it's weird for a citizen to patrol a park with a braced pistol. As a father of 3 kids and a total 2a supporter/gun fanatic I'd be quite cautious if I saw someone walking around with that pistol at a park... idk. Is what it is.

I’m all about the removal of the NFA- but there is no need to go out with an AR pistol and stand around needlessly drawing attention to yourself and wasting police resources. Yes, the cops should know the law. Yes, we do have the right to do it and that right needs to be protected. But just because we have the right to do this doesn’t mean we need to do it blatantly on camera for UA-cam 🙄

When you think about the recent ATF ban of pistol braces picture this video. “I’m just exercising my rights and trying to make a scene while I do” may be legal, but it isn’t ever going to be beneficial in the long run.
And yet here we are.
If we do not Actively Challenge these Infringements, then they will not get attention.
If they do not get attention, they do not get brought to Court.
If they do not get brought to court, the Infringements Stay ‘law”.
If ten million American Gun Owners stopped complying with the ATF, the NFA and all other Infringements, the Government would be Unable to Enforce the’laws”, and they would be Forced to look at the viability and Constitutionality of their Infringements.
Sometimes rocking the boat is the only way to make people realize that there are Holes in it.
